Pursuant to the Law on Information Technology dated June 29, 2006;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

Pursuant to Decision No. 239/2006/QĐ-TTg dated October 24, 2006 of the Prime Minister approving the Assistance Program for Persons with Disabilities for the period 2006-2010;

Pursuant to the proposal of the Director of the Science and Technology Department,

c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B

Article 1. Scope of Regulation

This Circular stipulates the application of standards and technologies to assist persons with disabilities in accessing and using information technology and telecommunications.

Article 2. Applicability

This Circular applies to:

1. Telecommunication service providers, Internet service providers, Internet agents; enterprises producing, importing, distributing, retailing telecommunication systems and information technology equipment, including both hardware and software;

2. State agencies, including Ministries, ministerial-level agencies, government agencies, People's Committees at all levels, and state budget-funded public institutions that design and build electronic information websites;

3. Television stations licensed to operate in Vietnam;

4. Organizations providing public services and administrative public services.

Article 3. List of Standards

1. The accompanying this Circular is the "List of Standards Supporting Persons with Disabilities in Accessing and Using Information Technology and Telecommunications";

2. Standards supporting persons with disabilities in accessing and using information technology and telecommunications are prescribed to be applied in two forms: mandatory application and recommended application. The form of application for each standard is specified in detail in the List of Standards issued together with this Circular;

3. This List of Standards shall be periodically reviewed, updated, amended, and supplemented in accordance with the practical conditions of Vietnam and the level of technological development worldwide.

Article 4. Provisions for television stations

1. Within twelve months from the date this Circular takes effect, central television stations licensed for nationwide broadcasting shall have the responsibility to apply technology to support persons with hearing impairments in accessing daily comprehensive political news programs broadcast at least on one channel;

2. It is encouraged for television stations in provinces and centrally-administered cities, and regional coverage television stations to apply technology to support persons with hearing impairments.

Article 5. Provisions for electronic information websites

1. In cases where existing electronic information websites of agencies and organizations as stipulated in Clause 2 and Clause 4, Article 2 do not comply with the "List of Standards Supporting Persons with Disabilities in Accessing and Using Information Technology and Telecommunications" issued by this Circular, such agencies and organizations shall have the responsibility to upgrade and improve their websites so that within twelve months from the date this Circular takes effect, their electronic information websites must comply with the provisions of this Circular;

2. It is encouraged for other organizations and individuals to apply the provisions of this Circular to their electronic information websites.

Article 6. Effectiveness of the Circular

This Circular takes effect from November 2, 2009.

Article 7. Implementation Organization

The Director of the Office, the Head of the Science and Technology Department, the Director of the Quality Management Department of Information Technology and Telecommunications, Heads of agencies and units under the Ministry of Information and Communications, Directors of Provincial Departments of Information and Communications, and relevant organizations and individuals are responsible for implementing this Circular./.
