CIRCULAR
AMENDMENTS AND SUPPLEMENTS TO AND REPEAL OF CERTAIN ARTICLES OF CIRCULAR NO. 41/2018/TT-BYT OF THE MINISTER OF HEALTH ON NATIONAL TECHNICAL REGULATIONS AND QUALITY CONTROL REQUIREMENTS FOR WATER USED FOR DOMESTIC PURPOSES
Pursuant to Decree No. 117/2007/NĐ-CP dated July 11, 2007 of the Government on production, supply, and consumption of clean water; and Decree No. 124/2011/NĐ-CP dated December 28, 2011 of the Government amending and supplementing certain articles of Decree No. 117/2007/NĐ-CP dated July 11, 2007 of the Government on production, supply, and consumption of clean water;
Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Health Environment Management Department;
The Minister of Health issues this Circular to amend, supplement, and repeal certain articles of Circular No. 41/2018/TT-BYT dated December 14, 2018 of the Minister of Health on the issuance of National Technical Regulations and quality control requirements for clean water used for domestic purposes (Circular No. 41/2018/TT-BYT).
Article 1. Amendments and supplements to and repeal of certain articles of Circular No. 41/2018/TT-BYT
1. Repeal Clause 3, Article 3 and Article 4 of Circular No. 41/2018/TT-BYT.
2. Amend Point b, Clause 2, Article 5 as follows:
"b) Issuing local technical regulations on the quality of clean water used for domestic purposes."
3. Amend and supplement Clause 1, Article 5 of the National Technical Regulation on the quality of clean water used for domestic purposes (QCVN 01-1:2018/BYT) issued together with Circular No. 41/2018/TT-BYT as follows:
"1. Testing of water quality parameters must be conducted in laboratories or organizations certified in accordance with TCVN ISO/IEC 17025."
4. Amend and supplement Clause 3, Article 5 of the National Technical Regulation on the quality of clean water used for domestic purposes (QCVN 01-1:2018/BYT) issued together with Circular No. 41/2018/TT-BYT as follows:
"3. Water quality parameters group B: The testing of these parameters shall be carried out according to local technical regulations on the quality of clean water used for domestic purposes issued by provincial People's Committees based on selecting specific parameters suitable to the actual conditions of the locality. In cases where provincial People's Committees have not issued local technical regulations, all water quality parameters group B listed in the regulation must be tested in accordance with Article 4 of this regulation."
Article 2. Effective Date
1. This Circular takes effect from February 1, 2022.
2. Repeal the entire Circular No. 04/2009/TT-BYT dated June 17, 2009 of the Minister of Health on the issuance of National Technical Regulations on the quality of drinking water and Circular No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health on the issuance of National Technical Regulations on the quality of domestic water from the date this Circular takes effect.
Article 3. Responsibility for Implementation
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Director of the Science and Training Department, the Director of the Health Environment Management Department, the Director of the Legal Affairs Department, relevant Departments and Units under the Ministry of Health, Chairpersons of Provincial People's Committees, Directors of Provincial Health Services, and related organizations and individuals are responsible for implementing this Circular. Any difficulties encountered during implementation should be reported to the Ministry of Health (Health Environment Management Department) for resolution.
