PRESIDENTIAL DECREE-LAW NO. 261/SL
HANOI, MARCH 28, 1956
THE PRESIDENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
Pursuant to Decree-Law No. 138B-SL dated December 18, 1949 establishing the Inspection Board of the Government;
Pursuant to a resolution of the Council of Ministers after consultation with the Standing Committee of the National Assembly,
ISSUES THE FOLLOWING DECREE-LAW:
Article 1
To ensure strict compliance with the policies, directives, and laws of the Government, to uphold the law, and to protect state property, the Central Inspection Board of the Government of the Democratic Republic of Vietnam is hereby established.
Article 2
The tasks of the Central Inspection Board of the Government:
a) To inspect the work of ministries, administrative agencies at all levels, and specialized agencies; to inspect state enterprises.
b) To inspect the implementation of national plans, the use and preservation of state property, and to combat sabotage, embezzlement, and waste.
Article 3
The powers of the Central Inspection Board of the Government:
a) The Central Inspection Board has the right to require officials, employees, and workers to report and provide necessary documents and records for inspection purposes; it may attend meetings of ministries, agencies, and state enterprises when necessary for inspection purposes or request that such meetings be convened.
b) In special cases and emergencies, the Central Inspection Board has the authority to temporarily suspend activities causing or likely to cause significant damage to state property and public interests; to temporarily suspend the duties of officials and employees who commit serious offenses in specialized agencies at provincial level and below, while immediately reporting to higher authorities for decision.
Article 4
The Central Inspection Board of the Government consists of:
- One Chief Inspector
- Two Deputy Chief Inspectors
- And a number of members appointed by decree of the President of the Democratic Republic of Vietnam.
Article 5
The Chief Inspector shall enjoy all benefits accorded to ministers. Deputy Chief Inspectors shall enjoy all benefits accorded to deputy ministers.
Article 6
The Central Inspection Board will require a number of assistants. Such assistants shall be appointed by decree of the Prime Minister.
Article 7
The establishment of inspection boards in ministries and districts, cities, provinces shall be regulated by a decree of the Prime Minister.
Article 8
Decree-Law No. 138-B/Sl dated December 18, 1946 is hereby repealed.
Article 9
The Prime Minister is responsible for implementing this decree-law.
