ISSUING PLAN TO IMPLEMENT THE LAW ON CITIZEN IDENTIFICATION CARDS

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

The Minister of National Defense hereby issues this Circular amending and supplementing certain articles of normative legal documents within the competence to issue of the Minister of National Defense related to the declaration of personal information when performing administrative procedures.

Considering the proposal of the Minister of Public Security,

DECISION:

Article 1. The Plan to Implement the Law on Citizen Identification Cards is hereby promulgated together with this Decision.

Article 2. This Decision takes effect from the date of issuance.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and Chairpersons of municipal People's Committees directly under the central government shall be responsible for implementing this Decision.

PLAN

IMPLEMENTATION OF THE LAW ON CITIZEN IDENTIFICATION CARDS
(Issued together with Decision No. 267/QĐ-TTg dated March 2, 2015 of the Prime Minister)

I. OBJECTIVES AND REQUIREMENTS

1. Objective

a) Determine responsibilities and assign specific tasks to ministries, sectors, and localities in implementing the Law on Citizen Identification Cards, ensuring timeliness, consistency, and effectiveness, meeting practical requirements.

b) Organize well the dissemination of the Law on Citizen Identification Cards to various strata of the population, civil servants, public officials, and armed forces; effectively conduct training and capacity building for personnel involved in citizen identification card management, the National Population Database, and the Citizen Identification Card Database.

c) Establish mechanisms for coordination among ministries, sectors, and localities regarding the exchange and provision of information about citizens for population management, economic and social policy planning, and citizen transactions; improve organizational structure and staffing to ensure consistent and effective implementation of laws related to citizen identification cards nationwide.

2. Requirements

a) Specify the content of work, deadlines for completion, and responsibilities of relevant agencies in implementing the Law on Citizen Identification Cards.

b) During the implementation process, ensure close cooperation between relevant agencies, promptly urge, guide, and resolve difficulties and obstacles in organizing implementation to ensure the effective progress of the Law on Citizen Identification Cards.

II. CONTENT

1. Dissemination of laws on citizen identification cards

a) Organize the dissemination of the Law on Citizen Identification Cards and guiding documents with appropriate content and forms suitable for specific target groups, contributing to enhancing awareness and understanding of the people, heads of agencies and organizations, especially those directly involved in citizen identification card management, the National Population Database, and the Citizen Identification Card Database.

b) Compile materials to support the dissemination of the Law on Citizen Identification Cards and guiding documents.

c) Assignment of implementation

- The Ministry of Public Security shall take the lead and coordinate with the Ministry of Justice to compile materials for disseminating laws on citizen identification cards to civil servants, public officials, armed forces, and the general public, ensuring clarity and ease of understanding, to ensure uniform implementation of the Law.

- The Ministry of Information and Communications shall direct and guide news agencies, radio, and television at both central and local levels to allocate appropriate time slots for disseminating the Law on Citizen Identification Cards and guiding documents through mass media.

- The Ministry of Justice, ministries, sectors, and all levels of People's Committees shall organize the dissemination of the Law on Citizen Identification Cards and guiding documents; guide and direct newspapers, magazines, and units responsible for legal education and dissemination within their ministries, sectors, and localities to develop plans for concentrated and regular dissemination of laws on citizen identification cards.

d) Timeframe for implementation: 2015 and subsequent years.

2. Training and capacity building for citizen identification card management, the National Population Database, and the Citizen Identification Card Database

a) Compile training and capacity-building materials for citizen identification card management, the National Population Database, and the Citizen Identification Card Database with content suitable for the trainees.

b) Organize the implementation, training, and advanced training of management staff and those directly involved in citizen identification card management, the National Population Database, and the Citizen Identification Card Database.

c) Assignment of implementation

- The Ministry of Public Security shall compile training and capacity-building materials for citizen identification card management, the National Population Database, and the Citizen Identification Card Database; organize training and advanced training on laws on citizen identification cards, enhance legal awareness, serve the people conscientiously, administrative reform requirements, anti-bureaucracy, and reduce harassment in citizen identification card management, the National Population Database, and the Citizen Identification Card Database for police officers, those managing the National Population Database, the Citizen Identification Card Database, and issuing, replacing, and reissuing Citizen Identification Cards.

- All levels of People's Committees shall organize training and capacity building for citizen identification card management and the National Population Database for leadership staff and those directly involved in citizen identification card management and the National Population Database at the local level.

d) Timeframe for implementation: 2015 and subsequent years.

3. Review and draft regulatory documents to implement the Law on Citizen Identification Cards

a) The Ministry of Public Security

- Take the lead and coordinate with relevant ministries and sectors to draft the Decree detailing certain provisions and measures to implement the Law on Citizen Identification Cards, to be submitted to the Government by October 2015.

- Issue Circulars detailing the implementation of the Law on Citizen Identification Cards and the Government's Decree detailing certain provisions and measures to implement the Law on Citizen Identification Cards by the fourth quarter of 2015.

- Issue Circulars specifying the format, language, appearance, size, material of the Citizen Identification Card, and forms used in citizen identification card management by the fourth quarter of 2015.

- Issue Circulars detailing procedures for issuing, replacing, and reissuing Citizen Identification Cards by the fourth quarter of 2015.

- Issue Circulars detailing the management of citizen identification card archives by the fourth quarter of 2015.

b) The Ministry of Finance

- Take the lead and coordinate with the Ministry of Public Security to issue Joint Circulars specifying the subjects, rates, and management and use of fees for exploiting and using information in the National Population Database by the fourth quarter of 2015.

- Issue Circulars specifying the rates, exemptions, reductions, and collection, payment, management, and use of fees for replacing and reissuing Citizen Identification Cards by the fourth quarter of 2015.

c) The ministries, ministerial-level agencies, government agencies, people's committees at all levels within their scope of responsibility and authority shall conduct inspections and reviews of normative legal documents and other relevant documents related to citizen identification management, the national population database, and the citizen identification database to amend, abolish, or propose amendments or abolitions of provisions that contravene the provisions of the Citizen Identification Law and guiding documents for its implementation.

4. Ensuring material conditions and human resources for citizen identification management activities.

a) The Ministry of Public Security

- Strengthening organizational structures, enhancing competent and professionally qualified staff with good moral character to engage in citizen identification management, the national population database, and the citizen identification database; rectifying work styles, public reception, and strictly punishing officials who exhibit disrespectful attitudes, words, or actions, or who harass or cause inconvenience to organizations or individuals; improving work methods to ensure simplicity, timeliness, accuracy, transparency, compliance with procedures, and prompt resolution of citizens' complaints and reports related to citizen identification and the national population database.

- Taking the lead and coordinating with relevant ministries and sectors to complete the construction project of the national population database by the first quarter of 2015.

- Summarizing the implementation of the project for the production, issuance, and management of identity cards using new technology by the third quarter of 2015; taking the lead and coordinating with relevant ministries, sectors, and localities to develop and submit to the Prime Minister for approval the project for the production, issuance, and management of citizen identification cards by the fourth quarter of 2015.

b) The Ministry of Finance, leading and coordinating with the Ministry of Public Security to allocate regular funding for the operation of the national population database and the citizen identification database; ensuring funding for the issuance, replacement, and reissuance of citizen identification cards according to current state budget classification.

c) The Ministry of Planning and Investment and the Ministry of Finance, based on their assigned functions and tasks, coordinate with the Ministry of Public Security to allocate funds from the state budget to implement the national population database project and the project for the production, issuance, and management of citizen identification cards.

d) The Ministry of Justice directs registration offices to provide and update information on household registration for the national population database.

đ) The provincial and municipal people's committees under the central government direct relevant departments and sectors in their locality to provide information and materials for the national population database; allocate funding for citizen identification management activities, the national population database, and the citizen identification database according to their assigned responsibilities and classifications; promptly resolve citizens' complaints and reports related to citizen identification and the national population database in accordance with the law; strictly punish officials engaged in citizen identification management, the national population database, and the citizen identification database under their jurisdiction who exhibit disrespectful attitudes, words, or actions, or who harass or cause inconvenience to organizations or individuals.

5. Funding for the implementation of the Citizen Identification Law.

Funding for the implementation of the Citizen Identification Law is guaranteed by the state budget according to the state budget management classification and other sources (if any) as prescribed by law. For the year 2015, ministries, sectors, and provincial and municipal people's committees under the central government shall proactively allocate within their allocated state budget for the year to implement this plan. In cases where additional funding is needed to ensure the implementation of this Plan, the Ministry of Finance will coordinate with the Ministry of Public Security and relevant agencies to report to the Prime Minister for consideration and decision.

III. IMPLEMENTATION

1. The Minister of Public Security is responsible for assisting the Prime Minister in overseeing, inspecting, urging, and guiding ministries, sectors, and localities in implementing this Plan and reporting to the Prime Minister on the implementation of this Plan.

2. The Ministry of Finance and local financial agencies are responsible for compiling and submitting to the competent authority for approval the budget estimates, ensuring funding sources for the implementation of this Plan based on the budget estimates of ministries, sectors, and localities.

3. The ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial and municipal people's committees under the central government are responsible for directing and organizing the implementation of assigned tasks according to schedule, ensuring quality and effectiveness; developing plans to implement the Citizen Identification Law within their ministries, sectors, and localities./.
