Article 1. Amending and supplementing certain provisions of Decision No. 246/1998/QĐ-TTg dated December 22, 1998 of the Government on certain special regimes for military pilots, crew members, and individuals directly serving flights at military airports under the Ministry of National Defense as follows:
1. Amend Point a Clause 2 Article 1 as follows:
2- Flight allowance:
a) Pilots and flight training instructors:
- Allowance ranging from 0.2 times the minimum wage/month/hour to 1.0 times the minimum wage/month/hour when flying over land, depending on weather conditions, day or night, type of aircraft.
- Allowance ranging from 0.5 times the minimum wage/month/hour to 1.2 times the minimum wage/month/hour when flying over sea, depending on weather conditions, day or night, type of aircraft.
- Allowance of 0.5 times the minimum wage/month/hour when flying a dedicated aircraft A.
- Allowance of 0.3 times the minimum wage/month/hour when flying a dedicated aircraft B".
2. Amend Clause 3 of Article 1 as follows:
3- Test flight allowance: Ranging from 1.0 times the minimum wage/month/trip/person to 1.4 times the minimum wage/month/trip/person depending on the level of repair and type of aircraft for pilots and crew members of military flights''.
3. Amend and supplement Article 4 as follows:
Article 4.
1. Pilots and crew members of military flights who fall ill shall be subject to the disability benefits regime as stipulated in Clause 2 Article 42 of Decree No. 28/CP dated April 29, 1995 of the Government.
2. When pilots and crew members of military flights cease flying, they shall be assigned appropriate work and shall be granted a one-time allowance as follows:
a) For fighter pilots, bomber pilots, and flight training instructors, each year of service in flying duties shall be calculated as two months of the minimum wage as prescribed by the Government.
b) For propeller transport aircraft pilots and other crew members of helicopter flights, each year of service in flying duties shall be calculated as one month of the minimum wage as prescribed by the Government''.
Article 2. This Decision takes effect from January 1, 2004.
Article 3. The Minister of National Defense, after reaching consensus with the Minister of Public Security, the Minister of Labor, Invalids and Social Affairs, and the Minister of Finance, shall guide the implementation of this Decision.
Article 4. Ministers, Heads of ministerial-level agencies, and Heads of agencies under the Government are responsible for implementing this Decision.3. The name of Clause 3 of Article 22 is amended and supplemented as follows:
