Pursuant to Decree No. 01/1998/NĐ-CP dated January 3, 1998 of the Government on the system of local health organizations;
Pursuant to Circular Joint No. 02/1998/TTLT-BYT-BTCCBCP dated June 27, 1998 of the Ministry of Health and the former Civil Service Affairs Council under the Government (now the Ministry of Home Affairs) guiding the implementation of Decree No. 01/1998/NĐ-CP;

Article 1. Now hereby promulgates with this Decision the "Regulations on Functions, Tasks and Organizational Structure of the Occupational Health and Environment Center under the Province and City Department of Health Directly Subordinate to the Central Government."
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The following officials are responsible for implementing this Decision: Head of the Office, Director of the Personnel Department, Director of the Preventive Health and HIV/AIDS Control Department - Ministry of Health, Directors of the Provincial and Municipal Departments of Health directly subordinate to the Central Government and Heads of related units.

REGULATIONS
FUNCTIONS, TASKS AND ORGANIZATIONAL STRUCTURE OF THE OCCUPATIONAL HEALTH AND ENVIRONMENT CENTER UNDER THE PROVINCE AND CITY DEPARTMENT OF HEALTH DIRECTLY SUBORDINATE TO THE CENTRAL GOVERNMENT
(Adopted by Decision No.: 2689/2004/QĐ-BYT dated August 10, 2004 of the Minister of Health)
I. Position and Function.
The Occupational Health and Environment Center of the province and city directly subordinate to the central government (hereinafter referred to as the province) is a public service unit under the Department of Health, having the function of advising and organizing the implementation of management of occupational hygiene, management of workers' health, and management of occupational diseases in industrial zones, export processing zones, production and business establishments, and services belonging to various economic sectors within the province.
The Occupational Health and Environment Center is a legal entity with its own office, seal, and bank account at the state treasury.
II. Tasks.
1. Based on the provincial health development plan, directives from the Ministry of Health, and actual conditions at the locality, develop plans for managing occupational hygiene, managing workers' health, and managing occupational diseases, submit these plans to the Director of the Department of Health for approval, and organize their implementation after approval.
2. Organize and conduct inspections of occupational hygiene work, regular health check-ups, and occupational disease examinations; recommend measures to ensure occupational hygiene.
3. Implement programs in the field of occupational hygiene, management of workers' health, and management of occupational diseases, evaluate the effectiveness of each program, and integrate programs to achieve efficiency during implementation.
4. Coordinate with the Health Education Communication Center and local mass media agencies to develop plans and contents for health communication and education regarding occupational hygiene and prevention of occupational diseases.
5. Participate in training and retraining in specialized fields and vocational skills according to local and central plans for medical specialists and other staff.
6. Conduct research and participate in scientific research on occupational hygiene, prevention, and management of occupational diseases; apply scientific and technological advancements to meet practical needs of the locality.
7. Manage and utilize resources effectively in accordance with the law.
8. Implement statistical and reporting systems as prescribed by law.
9. Perform other tasks and powers assigned by the Director of the Department of Health.
III. Organizational Structure.
1. Organization.
1. 1. Center Leadership: Director and one to two Deputy Directors assisting with work at the bachelor's degree level or higher.
1. 2. Functional Departments: - Planning and Finance Department, - Organization and Administration Department.
1. 3. Specialized Departments: - Occupational Hygiene Department, - Occupational Diseases Department, - Laboratory Department,
2. Labor Quota.
Implemented in accordance with the law on labor quotas.
3. Tasks of Departments.
3. 1. Planning and Finance Department.
- Develop annual, quarterly, and monthly comprehensive plans for the Center. Organize mid-term and final reviews, evaluations, and lessons learned from plan implementation.
- Collect information, compile data, and implement reporting systems as prescribed by law.
- Manage and allocate funds and materials according to approved plans, and be responsible for settlement in accordance with legal regulations.
- Forecast plans for purchasing materials, equipment, medicines, and chemicals.
- Develop and implement training and retraining plans for professional and vocational skills according to specialized fields.
3. 2. Organization and Administration Department.
- Responsible for all administrative affairs of the Center, purchase materials and equipment according to approved plans to serve Center activities.
- Manage materials, assets, and mobilize means of transportation according to the Director's plan.
- Manage and advise the Director on personnel organization and administration, and implement policies and regulations as prescribed by law.
- Organize seminars and training sessions according to annual plans.
3. 3. Occupational Hygiene Department.
- Implement environmental monitoring and control of harmful factors (dust, fumes, toxic gases, noise, vibration, radiation, light, microclimate...) in the workplace.
- Guide the implementation of occupational hygiene; inspect and assess the hazards of chemicals listed in the specified directory and other harmful agents; monitor the use of chemicals with strict occupational hygiene requirements and provide initial guidance when poisoning occurs.
- Maintain records and store results in accordance with the Ministry of Health's regulations.
- Coordinate and participate in organizing and implementing training and seminars on professional and vocational skills; health communication and education on occupational health for medical specialists and other groups.
- Participate in handling emergency situations caused by harmful factors and occupational accidents.
3. 4. Occupational Diseases Department.
- Implement regular health check-ups, occupational disease detection examinations, and participate in occupational disease appraisal examinations.
- Establish and manage workers' health records; classify workers' health status; compile statistics on occupational diseases, illness rates, and workplace accidents.
- Organize and maintain the operation of the Occupational Disease Clinic at the Center.
- Provide initial response to emergencies caused by harmful factors and occupational accidents.
- Participate in research on occupational disease incidence rates and supplement the list of occupational diseases.
- Collaborate to implement training programs on professional skills; disseminate health education on preventing occupational diseases for specialists and other relevant personnel.
3. 5. Department of Laboratory Testing.
- Conduct laboratory tests related to occupational hygiene and occupational diseases.
- Participate in laboratory testing for inspection, supervision, or requests from higher authorities and during incidents of poisoning in the area.
- Provide laboratory testing services within the assigned field in accordance with the law.
- Collaborate to implement training programs on professional skills for specialists and other relevant personnel.
- Research and adopt new laboratory techniques to support diagnostic work.
- Be responsible for laboratory test results before higher authorities and the law.
- Carry out statistical reporting as required by law.
IV. Operating Budget.

4. From grants and other funding sources.
V. Work Relationships.
1. The Occupational Health and Environment Center is directly managed and directed by the Director of the Department of Health.
2. The Occupational Health and Environment Center is professionally managed and directed by the Ministry of Health (Preventive Medicine Bureau and AIDS Prevention and Control, Institute of Occupational Health and Environmental Hygiene, Public Health Institute).
3. The Occupational Health and Environment Center collaborates with units under the Department of Health.
4. The Occupational Health and Environment Center cooperates with functional agencies in the province and healthcare units of various Ministries and sectors.
5. The Occupational Health and Environment Center is responsible for managing and directing professional activities related to occupational hygiene and occupational disease prevention for district health centers, healthcare facilities in industrial zones, export processing zones, enterprises, and primary healthcare facilities in the province.
