REGARDING THE ESTABLISHMENT OF THE BANK PROJECT MANAGEMENT BOARD
GOVERNOR OF THE STATE BANK OF VIETNAM
Pursuant to the Ordinance on the State Bank dated May 23, 1990;
Pursuant to Decree 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities of state management by ministries and ministerial-level agencies;
Considering the work requirements;
At the request of the Director of the Organization, Cadres, and Training Department of the State Bank;
DECISION:
Article 1: The Bank Project Management Board, which manages investment projects utilizing loans from international development organizations with the State Bank as the implementing agency (referred to as the Bank Project Management Board), is hereby established under the Central State Bank. The Bank Project Management Board assists the Governor in managing and implementing investment projects utilizing loans from international development organizations where the State Bank acts as the implementing agency.
Article 2: Tasks of the Bank Project Management Board
1. Managing the implementation of investment projects utilizing loans from international development organizations where the State Bank acts as the implementing agency.
2. Initially, managing the implementation of the project to modernize the payment system using World Bank (WB) loans in accordance with Decree No. 177/CP dated October 20, 1994 on the Regulations for Investment and Construction Management, relevant international legal provisions, including the following stages:
- Serving as the point of contact with the World Bank (WB) to resolve all issues related to borrowing and utilizing WB loans.
- Serving as the point of contact to work with all relevant domestic agencies to resolve issues related to the project.
- Preparing preliminary and feasibility studies of the Payment System Modernization Project for government approval.
- Preparing documentation and organizing bidding, hiring consulting experts; negotiating and signing tender contracts; purchasing equipment for the project in accordance with the content stipulated in the Development Credit Agreement, WB procedures, and current domestic regulations.
- Organizing the implementation of the Project, monitoring and evaluating the work of contractors and consulting experts; organizing partial and final acceptance according to the project schedule.
- Organizing training, preparing all human and material resources, technical facilities to meet the needs of the project.
- Organizing the preparation and submission of periodic and ad hoc reports to relevant parties in accordance with regulations.
- Organizing and managing the use of loan funds and other sources of funding for the project in accordance with the responsibilities of the project owner.
- Coordinating the activities of the Commercial Bank Sub-project Boards.
- Serving as the point of contact to coordinate with departments and bureaus of the State Bank, commercial banks, in proposing regulations and legal documents serving the payment systems to be built under the Project for functional departments of the State Bank to study, draft, and submit to the Governor and higher authorities for issuance.
Article 3: Organizational Structure and Operation
1. The Bank Project Management Board has the following departments:
1. Investment and Development Projects Department.
2. Computer Telecommunications Department.
3. Contractor Management and Technical Services Department.
4. Accounting - Planning - Consolidation Department.
The tasks and powers of the departments shall be decided by the Board Director.
2. Operation of the Board.
The operation of the Board shall be headed by a Chairperson, with several Deputy Chairpersons assisting the Chairperson.
Article 4: Relations between the Project Management Board and the Commercial Bank Sub-project Management Boards within the framework of the modernization project for the payment system.
To assist the Project Management Board during the implementation of the Modernization of Payment System Project, each participating commercial bank will establish its own Commercial Bank Sub-project Management Board. These Commercial Bank Sub-project Management Boards are subordinate units under the commercial banks, but within the scope of the project, they are subject to the overall coordination of the Project Management Board.
Article 5: The Commercial Bank Project Management Board is an organization with full legal capacity, having its own seal, and is entitled to open domestic currency and foreign currency accounts for the project at serving banks in accordance with its role as the principal investor.
1. Revenue Sources: The main revenue sources include loans from development organizations, domestic counterpart funds, contributions for project management work from project participants, and other revenues in accordance with state regulations.
2. Expenditures: Major expenditure items include expenditures on project components, project management work, and other expenditures in accordance with regulations.
Article 6: This Decision takes effect from the date of signature.
Article 7:The Director of the Governor's Office, the Head of the Organization and Training Department, the Chairman of the Commercial Bank Project Management Board, and the Heads of relevant units under the State Bank, as well as the General Directors (Directors) of commercial banks are responsible for implementing this Decision.
