Regarding the issuance of the Regulation on Recognizing Secondary Schools Meeting National Standards

(Period from 2001 to 2010)

 

Pursuant to the Government Decree No. 15/CP dated March 2, 1993 on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;

Pursuant to the Government Decree No. 29/CP dated March 30, 1994 on the tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decision No. 23/2000/QĐ-BGD&ĐT dated July 11, 2000 promulgating the Charter of Secondary Schools;

At the proposal of the Director of the General Department of Secondary Education;

 

DECISION:

Article 1The attached Decision includes the "Regulation on Recognizing Secondary Schools Meeting National Standards (period from 2001 to 2010)."

Article 2. This Decision takes effect 15 days after the date of signature. The General Department of Secondary Education is responsible for guiding and monitoring the implementation of this Regulation.

Article 3The Chairpersons of Provincial People's Committees, the Heads of the Office of the Ministry, the Directors of the General Department of Secondary Education, and the Heads of relevant units under the Ministry, and the Principals of Departments of Education and Training shall be responsible for implementing this Decision.

REGULATIONS

RECOGNITION OF SECONDARY SCHOOLS MEETING NATIONAL STANDARDS

(Period from 2001 to 2010)

(Issued together with Decision No. 27/2001/QĐ-BGDĐT dated July 5, 2001 of the Minister of Education and Training)

This Regulation stipulates standards, procedures for organizing the examination and recognition of secondary schools meeting national standards during the period from 2001 to 2010.

PART I

GENERAL PROVISIONS

 

Article 1. Scope of regulation.

Upon examination and recognition.

Article 2. 1. Based on the prescribed standards, public, semi-public, private, and private secondary schools that have been awarded the title of advanced for five consecutive years prior to the year they apply for recognition as meeting national standards may self-assess and request competent authorities to recognize them as meeting national standards.

2. The Minister of Education and Training decides on recognizing secondary general schools as meeting national standards. The Chairperson of the People's Committee of provinces and centrally-administered cities decides on recognizing secondary schools as meeting national standards.

Duration of Recognition

Article 3. The duration of recognition for secondary schools meeting national standards is five years from the date of signing the decision on recognition..

Within the five-year period, if a school recognized as meeting national standards violates the standards, it will be reviewed based on the nature and severity of the violation to determine whether to continue recognizing it as meeting national standards or not.

Responsibilities of the Educational and Training Departments at District Level and Departments of Education and Training

Article 4. The Educational and Training Departments at district level and Departments of Education and Training within their assigned functions and tasks are responsible for selecting and concentrating investment to build national standard schools based on existing schools, while simultaneously advising localities on investing in building new schools according to the prescribed standards and in line with local educational development plans.

STANDARDS FOR SECONDARY SCHOOLS

Chapter II

Article 5. Standard 1 - School Organization

MEETING NATIONAL STANDARDS

1. Classrooms.

a. Having all grade levels of the educational stage.

b. Not exceeding 45 classes.

c. Each class having no more than 45 students.

2. Subject Departments:

a. Annually addressing at least one subject matter issue aimed at improving teaching and learning quality and effectiveness.

b. Having a plan to enhance teachers' professional qualifications and achieving the set targets for short-term, medium-term, and long-term training.

3. Administrative and Management Department:

a. The administrative and management department has sufficient staff to handle administrative, management, clerical, archival, accounting, treasury, health, security, service, and warehouse duties in accordance with current regulations of the Secondary School Charter.

b. Having all types of records and files for management purposes and using them correctly as stipulated in the Secondary School Charter and specific usage guidelines.

c. Completing tasks well without any staff being disciplined at or above the warning level.

4. Councils and Parent-Teacher Associations:

The activities of councils and parent-teacher associations in the school are planned, regular, and effective in enhancing educational quality and establishing school discipline.

5. Party Organizations and Mass Organizations:

In secondary schools where there are Party cells or branches, they must meet the criteria of integrity and strength. Schools without Party organizations must develop plans and achieve specific targets for Party membership development each academic year and organizational construction.

1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows: b. The Teachers' Union, the Communist Youth Union, and the Young Pioneer Corps of the school must be recognized as strong in organization and advanced in activity by the county level or higher.

6. Standard 2 - Management Staff, Teachers, and Other Personnel

Article 1. The Principal and Deputy Principals must meet the prescribed standards according to the Secondary School Charter; implement democratic regulations effectively in school operations; and be rated as good or better by direct education management authorities regarding managerial capacity and effectiveness.

2. Having sufficient subject teachers who meet the required qualification standards, including at least 20% teachers rated as excellent at the county level or higher; possessing good moral qualities; and having no teachers rated as weak in either subject expertise or morality.

3. Having sufficient librarians, laboratory technicians, and subject-specific practical room instructors who are trained or have received vocational training. These personnel always perform their tasks well.

Article 7. Standard 3 - Quality of Education.

In the school year preceding the year of recognition application and during the five years following recognition, at least the following indicators must be met:

1. The annual dropout rate shall not exceed 1%, and the rate of students repeating a grade shall not exceed 5%.

2. Educational quality:

a. Academic performance:

The excellent category shall reach at least 3%.

The good category shall reach at least 30%.

The weak and poor categories shall not exceed 5%.

b. Conduct:

The good and excellent categories shall reach at least 80%.

The weak category shall not exceed 2%.

3. Educational activities:

Implement the regulations of the Ministry of Education and Training regarding the time for organizing and the content of educational activities both within and outside class hours. Each school year, organize at least one collective activity on a whole-school scale.

4. Complete the tasks assigned in the local comprehensive secondary education popularization plan.

Article 8. Standard 4 Ministry of Science and Technology: The Minister and Deputy Ministers, agencies and units under the Ministry;Infrastructure and equipment.

1. Schools established before this Regulation takes effect:

a. The school campus is a separate area with fences, gates, school signs, all areas within the school are reasonably arranged, always clean and beautiful.

b. The structure of facilities within the school includes:

b.1. Classroom and laboratory blocks:

- Sufficient classrooms for each class; classrooms are well-ventilated and well-lit; student desks and chairs, teacher desks and chairs, and blackboards meet current standards.                      

- Laboratory rooms and subject-specific practical rooms for Physics, Biology, Chemistry, and Computer Science, equipped according to the Equipment Regulations for kindergartens and primary schools issued by the Ministry of Education and Training.

- Language learning rooms and audio-visual rooms.

b.2. Service and study support blocks:

A library meeting current standards for school libraries, a traditional room, sports training areas, offices for the Teachers' Union, and activity rooms for the Communist Youth League and the Ho Chi Minh Pioneer Organization.

b.3. Administrative and management blocks:

Offices for the Principal, Deputy Principals, school office, teachers' meeting room, storage, and permanent office.

b.4. Clean playgrounds with shade trees ensuring hygiene.

b.5. Separate sanitary facilities for teachers, male students, and female students, preventing environmental pollution inside and outside the school.

b.6. Separate parking areas for teachers and each class within the school premises, ensuring order and safety.

b.7. Sufficient clean water for teaching and learning activities, educational activities, and for teachers and students; a proper drainage system.

2. Schools established after this Regulation takes effect:

They must have infrastructure according to the provisions of Chapter VI of the School Charter and accompanying guidance documents issued by the Ministry of Education and Training.

Article 9. Standard 5 - Socialization of Education.

Actively advise the Party Committee and local authorities on educational matters. There should be many forms of mobilizing social forces to build a healthy educational environment, contributing to improving the overall quality of education; ensure close relationships between schools, parents, and the community in accordance with Chapter VII of the School Charter; mobilize social forces to participate in funding the construction of school infrastructure.

 

Chapter III

ORGANIZATION FOR ASSESSMENT AND RECOGNITION

NATIONAL STANDARDS SCHOOL

 Article 10. Files.

Schools applying for assessment and recognition as national standard schools must submit the following documents:

1. An application for assessment and recognition as a national standard school.

2. A report on the implementation of the standards specified in Chapter II of the Regulation, accompanied by a diagram of the school's facility structure.

3. Inspection records and recognition recommendation documents for national standard secondary schools from the county-level and provincial-level inspection teams.

Article 11. The Assessment Recommendation Council and Inspection Team.

County-level and provincial-level Assessment Recommendation Councils and the Ministry's Inspection Team are established annually; their operational period is defined in the establishment decision to carry out the assessment and recommendation for national standard secondary schools.

Composition and duties of the county-level and provincial-level Assessment Recommendation Councils and the Ministry's Inspection Team are as follows:

1. County-level Assessment Recommendation Council.

a. Composition.

Chair: Deputy Chairman of the People's Committee of the county.

2 Vice-Chairmen:

Director of the Education and Training Department serves as the Permanent Vice-Chairman.

Chairman of the Education and Training Trade Union of the county.

Members and Secretary of the Council: representatives of relevant agencies appointed by the Chairman of the People's Committee of the county.

b. Authority to establish.

The Chairman of the People's Committee of the county decides to establish the county-level Assessment Recommendation Council.

c. Duties.

Organize inspections of secondary schools proposed for national standard status based on the documents submitted by the Education and Training Department.

Assess and prepare recommendations for the provincial-level Assessment Recommendation Council to consider and recognize secondary schools as national standard schools.

2. Provincial-level Assessment Recommendation Council.

a. Composition.

Chair: Deputy Chairman of the People's Committee of the province.

2 Vice-Chairmen:

Director of the Department of Education and Training serves as the Permanent Vice-Chairman.

Chairman of the Education and Training Trade Union of the province.

Members and Secretary of the Council: representatives of relevant agencies appointed by the Chairman of the People's Committee of the province.

b. Authority to establish.

The Chairman of the People's Committee of the province decides to establish the provincial-level Assessment Recommendation Council.

c. Duties.

Inspect, assess, and prepare documents for the Chairman of the People's Committee of the province to decide on recognizing secondary schools as national standard schools.

Inspect, assess, and prepare documents for the Ministry of Education and Training to recognize general secondary schools as national standard schools, after obtaining agreement from the Chairman of the People's Committee of the province.

3. Ministry of Education and Training Inspection Team.

a. Composition.

Composed of representatives from the General Secondary Education Division, the Education Inspectorate, the Education and Training Trade Union, and related units within the Ministry appointed by the Minister of Education and Training.

b. Authority to establish.

The Minister of Education and Training decides to establish the Ministry of Education and Training Inspection Team.

c. Duties.

Inspect general secondary schools proposed for national standard status based on the documents submitted by the provincial-level Assessment Recommendation Council.

Assess and prepare documents for the Minister of Education and Training to consider and decide on recognizing general secondary schools as national standard schools.

4. Permanent Office.

a. During the period beforethe establishment of the Councils for Proposal Review and Inspection Teams of theMinistry of Education and Training at the district, provincial, and centrallevels, there shall be one permanent office at each level.

At the district level:The Department of Education and Training.

At the provincial level:The Department of Education and Training.

At the central level:The Secondary Education Department of the Ministry of Education andTraining.

b. The permanent officesshall have the following responsibilities:

Guide secondary schoolsmeeting the conditions to prepare application files for recognition as nationalstandardized schools, organize the recognition ceremony for those schools thatare recognized as meeting the national standards.

Receive application filesto recognize secondary schools under their management.

Propose the list ofProposal Review Councils and Inspection Teams to be decided upon by thecompetent authorities at each level.

Monitor activities, detectand propose measures to address any violations (if any) by schools that havealready met the national standards.

Article 12. Implementation steps.

1. For secondary schoolsat the basic education level.

a. The Department ofEducation and Training is responsible for receiving and reviewing the applicationfiles for recognition as national standardized schools from secondary schoolsat the basic education level and transferring them to the Proposal ReviewCouncil at the district level.

b. The Proposal ReviewCouncil at the district level shall organize inspections, reviews, and preparedocuments to submit to the Proposal Review Council at the provincial levelalong with the inspection report and the file specified in Article 10 of thisRegulation.

c. The Proposal ReviewCouncil at the provincial level shall inspect, review, and submit to the Chairmanof the Provincial People's Committee for consideration and decision onrecognition.

2. For secondary schoolsat the general education level:         

a. The Department ofEducation and Training shall be responsible for receiving and reviewing theapplication files for recognition as national standardized schools, reaching anagreement in writing with the District People's Committee, and transferring themto the Proposal Review Council at the provincial level.

b. The Proposal ReviewCouncil at the provincial level shall organize inspections, reviews, andprepare documents to request the Ministry of Education and Training to recognizesecondary schools at the general education level as meeting the nationalstandards along with the inspection report and the file specified in Article 10of this Regulation.

c. The Inspection Team ofthe Ministry of Education and Training shall directly inspect secondary schoolsat the general education level based on the proposal of the Proposal ReviewCouncil at the provincial level, review, and prepare documents to submit to theMinister of Education and Training for consideration and decision onrecognition.

3. After each round ofrecognition, the competent authorities shall be responsible for providingwritten responses to secondary schools that have not been recognized as meetingthe national standards regarding specific criteria for the schools to strivefor in the next academic year./.
