THE MINISTER OF EDUCATION AND TRAINING
Pursuant to Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Amending and supplementing certain articles of the Interim Regulation on Quality Assessment of Universities issued together with Decision No. 38/2004/QĐ-BGD&ĐT dated December 2, 2004 of the Minister of Education and Training as follows:
a) Article 18 shall be amended to read "University Self-Assessment Council".
The Minister of Education and Training promulgates this Circular amending and supplementing certain provisions of the Regulations on the procedures for recognizing diplomas issued to Vietnamese citizens by foreign educational institutions accompanying Decision No. 77/2007/QĐ-BGDĐT dated December 20, 2007 of the Minister of Education and Training.

Article 1. b) Clause 2 of Article 18 shall be amended and supplemented as follows:
a) The National Compensation Agency advises and assists the Minister of Justice in summarizing and generally monitoring the resolution of compensation in administrative management activities nationwide;
"2. The Chairman of the University Self-Assessment Council is the Rector or Deputy Rector authorized by the Rector, and one Vice-Chairman is the Deputy Rector in charge of training at the university. Other members of the Council include representatives from the University Council or Board of Directors, the Scientific and Training Council, Heads of Departments, Faculties, and Research Institutes related to the assessment, reputable lecturers, representatives of organizations within the university, and some representatives outside the university."
c) Clause 3 of Article 18 shall be amended and supplemented as follows:
"3. The University Self-Assessment Council and its members have the following functions and responsibilities:
a) The University Self-Assessment Council has the function of assisting the Rector in developing and implementing self-assessment plans; advising the Rector on measures to improve the quality of education.
b) The Chairman of the University Self-Assessment Council has the responsibility of assigning specific tasks to each member of the Council; convening and chairing meetings of the Council; approving self-assessment plans; directing the process of collecting information, evidence, processing, analyzing, and writing self-assessment reports; resolving issues arising during the implementation of self-assessment activities.
c) The Vice-Chairman of the University Self-Assessment Council has the responsibility of chairing the Council when authorized by the Chairman and being accountable to the Chairman for assigned tasks.
d) Members of the University Self-Assessment Council have the responsibility of carrying out tasks assigned by the Chairman."
a) Article 20 shall be renamed "External Evaluation Expert Team".
b) Clause 1 of Article 20 shall be amended and supplemented as follows:
2. Article 20 shall be amended and supplemented as follows:
"1. The External Evaluation Expert Team is established by the Minister of Education and Training, consisting of seven to nine members to evaluate universities applying for quality assessment.
a) The Head of the Team is the Rector or Deputy Rector of a university with experience in conducting evaluation activities. The Head is responsible for managing the activities of the team;
b) The Secretary of the External Evaluation Expert Team is an officer from a university in the same field as the evaluated university, knowledgeable about quality assessment. The Secretary assists the Head in implementing activities and preparing reports for the team;
c) The remaining members consist of five to seven experts, including one expert in quality assessment consulting, one expert from the Testing and Quality Assurance Department of Education, and three to five experts from universities, state management agencies, professional associations, or employers corresponding to the fields of training at the evaluated university. These members are responsible for carrying out tasks assigned by the Head. The quality assessment consulting expert also advises other team members on quality assessment matters."
c) Clause 3 and Clause 4 shall be added after Clause 2 of Article 20 as follows:
"3. The Ministry of Education and Training is the agency responsible for selecting external evaluation experts. The selection of external evaluation experts is conducted publicly based on individual applications and with the consent of the head of the direct supervising agency.
4. Members of the External Evaluation Expert Team are responsible for keeping confidential all information related to their work and the results of the team's assessment before the team announces the results to the university."
3. Clause 3 of Article 21 shall be amended and supplemented as follows:
"3. Based on the results of studying the self-assessment report and survey results at the university, the External Evaluation Expert Team writes an evaluation report. The draft external evaluation report must be approved by more than two-thirds of the team members before it is sent to the university for comments. The External Evaluation Expert Team completes the report and sends it to the Testing and Quality Assurance Department of Education."
4. Article 21a shall be added after Article 21 as follows:
"3. Based on the results of the research, self-assessment reports, and survey results at the university, the external evaluation expert team writes the evaluation report. The draft external evaluation report must be approved by more than two-thirds of the members of the team before the team submits it to the university for comments. The external evaluation expert team finalizes the report and submits it to the Testing and Quality Assurance Agency."
4. Add Article 21a after Article 21 as follows:
"Article 21a. Re-evaluation of the external expert evaluation team's assessment results
1. The external expert evaluation team's assessment results shall be re-evaluated when the following issues occur simultaneously:
a) The external assessment results lead to the university not being recognized as meeting the quality assurance standards or being recognized at a lower level than the expected level of the university;
b) The university disagrees with the external assessment report of the expert team and submits a written document to the Ministry of Education and Training.
2. The re-evaluation result has final conclusive value. The university and the expert team have the responsibility to comply with the re-evaluation result.
5. Supplement Article 21b after Article 21a as follows:
"Article 21b. Working Group for Re-evaluating the External Expert Evaluation Team's Assessment Results
1. The working group for re-evaluating the external expert evaluation team's assessment results, established by the Minister of Education and Training, includes representatives from the Testing and Quality Assurance Agency, the Inspectorate, relevant Departments, experts from universities, and representatives from the management authority of the university under assessment.
2. The working group is responsible for studying the files and working materials of the external expert evaluation team, discussing with some members of the expert team, surveying the university, discussing with the university leadership and the Self-Assessment Council, and writing a re-evaluation report on the external expert evaluation team's assessment results.
6. Supplement Article 21c after Article 21b as follows:
"Article 21c. Responsibilities and Authorities of Universities Registering for Quality Assurance
1. Creating favorable conditions and preparing necessary files and data related to the activities of the university to serve the external assessment.
2. Cooperating, exchanging, and publicly discussing with the external expert evaluation team about the research report on self-assessment and the survey results of the team at the university.
3. Having the right to submit a written document to the Ministry of Education and Training and the external expert evaluation team expressing agreement or disagreement with the draft external assessment report within 15 days from the date of receipt of the document.
4. Having the right to appeal against issues related to external assessment activities, having the right to request compensation for damages according to the law caused by incorrect conclusions or illegal actions of the external expert evaluation team.
7. Supplement Article 21d after Article 21c as follows:
"Article 21d. Responsibilities of the Testing and Quality Assurance Agency
1. Organizing training for external assessment experts.
2. Receiving and reviewing the self-assessment reports of universities. Within 15 days from the date of receipt of the report, it is responsible for notifying the university in writing whether the report is accepted or requires further completion.
3. Taking the lead and coordinating with relevant units to develop plans and organize the selection of members of the external expert evaluation team; submitting to the Minister of Education and Training for the establishment of the external expert evaluation team and the re-evaluation working group.
4. Supervising the external assessment process according to current regulations of the Ministry of Education and Training.
5. Ensuring conditions for the activities of the external expert evaluation team.
Article 2. Amending and supplementing terminology in certain provisions of the Interim Regulations on University Quality Assurance issued together with Decision No. 38/2004/QĐ-BGD&ĐT dated December 2, 2004 of the Minister of Education and Training as follows:
1. Replace the phrase "external evaluation" with "external assessment" throughout the text.
2. Delete the paragraph "The university's self-assessment process will be guided by a separate document by the Ministry of Education and Training" in Clause 4 of Article 19; delete the paragraph "The external evaluation process will be guided by a separate document by the Ministry of Education and Training" in Clause 3 of Article 21.
Article 3. This Decision takes effect 15 days after its publication in the Official Gazette. All previous provisions contrary to this Decision are abolished.
Article 4. The Permanent Secretaries, Directors of the Testing and Quality Assurance Agency, Heads of the Higher Education Department, the Cadre Organization Department, heads of relevant units under the Ministry of Education and Training, Chairmen of Provincial People's Committees, rectors of universities and academies, and principals of universities are responsible for implementing this Decision.
