CIRCULAR
GUIDELINES ON THE PROCEDURE FOR IDENTIFYING ELIGIBLE BORROWERS UNDER DECISION No. 157/2007/QD-TTg dated September 27, 2007 of the Prime Minister on STUDENT LOANSREGARDING STUDENT CREDIT
Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Labour, Invalids and Social Affairs;
Pursuant to Decision No. 157/2007/QD-TTg dated September 27, 2007 of the Prime Minister on student loans.
The Ministry of Labour, Invalids and Social Affairs issues guidelines on the procedure for identifying eligible borrowers under Decision No. 157/2007/QD-TTg on student loans as follows:
I. GENERAL PROVISIONS
1. These Guidelines provide procedures for identifying eligible individuals from the grassroots level (village/hill tribe; commune/district) to accurately determine those eligible for borrowing under Decision No. 157/2007/QD-TTg dated September 27, 2007 of the Prime Minister on student loans.
2. Principles of identification: ensuring accuracy; democracy, fairness, transparency, and participation in evaluation by the people.
3. Authority and responsibility for identifying eligible individuals.
The People's Committee at the commune level shall organize surveys based on criteria and guidance from the Ministry of Labour, Invalids and Social Affairs to establish lists and confirm eligible households for borrowing under Decision No. 157/2007/QD-TTg on student loans.
The process of identifying eligible borrowers under Decision No. 157/2007/QD-TTg of the Prime Minister may be conducted in multiple phases but must ensure that it does not affect the resolution of borrowing needs for students from financially disadvantaged families.
II. SPECIFIC PROVISIONS
1. Responsibilities of the People's Committee at the commune level:
The People's Committee of communes, wards, and towns (collectively referred to as the commune level) shall notify all households with children or siblings currently studying at universities (or equivalent), colleges, vocational secondary schools, and training institutions eligible for borrowing under Decision No. 157/2007/QD-TTg dated September 27, 2007 of the Prime Minister on student loans, who have borrowing needs, to submit loan application forms to the People's Committee at the commune level for consideration and confirmation.
2. Procedures for confirming eligible individuals:
a. For students who are orphans of both parents or only one parent and the remaining parent is unable to work, the People's Committee at the commune level shall base their confirmation on the list of social welfare beneficiaries managed according to Decree No. 67/2007/NĐ-CP dated April 13, 2007 of the Government on policies for assisting social welfare beneficiaries to confirm on the loan application form of the household.
b. For students who are members of poor households according to legal standards, the People's Committee at the commune level shall base their confirmation on the list of poor households managed by the commune to confirm on the loan application form of the household.
c. For students whose families face financial difficulties due to accidents, illness, natural disasters, fires, or epidemics during their studies, the People's Committee at the commune level shall confirm based on the actual extent of damage on the loan application form of the household.
d. For households with average per capita income above the poverty line up to 150% of the poverty line (for rural areas: above 784,900 VND to 300,000 VND/person/month; for urban areas: above 260,000 VND to 390,000 VND/person/month), the People's Committee at the commune level shall direct the following actions:
- Conducting a survey of household income using the household income survey form (Form No. 1) to determine household income; households with average per capita income above the poverty line up to 150% of the poverty line will be compiled into a list for evaluation.
- Organizing an evaluation meeting at the village level and basing the results of the evaluation to compile a list of households with average per capita income above the poverty line up to 150% of the poverty line (Form No. 2) and propose the Chairman of the People's Committee at the commune level to confirm on the loan application form of the household (implementation method according to the guidelines in Circular No. 04/2007/TT-BLDTBXH dated January 29, 2007 of the Ministry of Labour, Invalids and Social Affairs on the annual review procedure for poor households).
III. IMPLEMENTATION
1. These Guidelines shall take effect 15 days from the date of publication in the Official Gazette.
2. During implementation, if there are any arising issues or difficulties, please report to the Ministry of Labour, Invalids and Social Affairs for prompt resolution.
