THE MINISTER OF EDUCATION AND TRAINING

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decision No. 08/2008/QĐ-BGDĐT dated March 6, 2008 of the Minister of Education and Training promulgating the High School Graduation Examination Regulations;

At the proposal of the Director of the Department of Testing and Quality Assurance,

DECISION:

Article 1. Amending and supplementing certain articles of the High School Graduation Examination Regulations issued together with Decision No. 08/2008/QĐ-BGDĐT dated March 6, 2008 of the Minister of Education and Training as follows:

1. Supplementing Point d of Clause 2, Article 4 as follows:

"d) Conditions for participating in the second examination period (if there is a second examination period):

- Candidates who meet the conditions for participation as prescribed in Points a and b of Clause 2 of this Article but have not participated in the first examination period;

- Candidates who have participated in the first examination period but have not graduated and have not been disciplined with suspension from the examination or higher."

2. Deleting Paragraph 4: "- Certificate of admission to grade 10 of high school (original);" at Point a, Clause 1, Article 11.

3. Amending Point b of Clause 6, Article 18 as follows:

"b) In each examination room, there must be two invigilators; the number of invigilators outside the examination room shall be arranged according to the specific requirements of each Examination Board but must ensure that there is one invigilator for every two to three examination rooms."

4. Amending Point c of Clause 2, Article 31 as follows:

"c) The Kinh people and foreigners residing in Vietnam with permanent residence registration for three years or more (counted from the date of organizing the examination) in mountainous areas, remote areas, islands, new economic zones, particularly difficult communes, border communes, safe zones under the investment scope of the Program 135 Phase II as currently prescribed;"

5. Amending Clause 2 and Clause 3 of Article 34 as follows:

"2. Students in the category of conduct assessment who have a vocational certificate issued by the Department of Education and Training or educational and training institutions managed by the education and training sector shall be granted bonus points based on their conduct assessment grades as follows:

- Excellent grade: plus 2.0 points;

- Good grade: plus 1.5 points;

- Average grade: plus 1.0 point.

3. Students holding foreign language or information technology certificates at level A or above, issued in accordance with regulations of the Ministry of Education and Training: plus 1.0 point."

6. Amending Paragraph 3 of Point b of Clause 2, Article 35 as follows:

"- The Kinh people and foreigners residing in Vietnam with permanent residence registration for three years or more (counted from the date of organizing the examination) in mountainous areas, remote areas, islands, new economic zones, particularly difficult communes, border communes, safe zones under the investment scope of the Program 135 Phase II as currently prescribed;"

7. Amending Clause 2 of Article 41 as follows:

"2. The Minister of Education and Training shall issue a decision to establish inspection teams of the Ministry, consisting of experienced managers and organizers of examinations from universities, academies, colleges, and specialized secondary schools to all provinces to supervise and urge the implementation of the regulations in all stages of the examination."

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. All previous provisions contrary to this Decision are hereby abolished.

Article 3. The Head of the Office, the Director of the Testing and Quality Assurance Agency, Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of provincial Departments of Education and Training; Directors of universities and academies; Principals of colleges and specialized secondary schools; Principals of boarding schools for ethnic minorities directly under the Ministry of Education and Training are responsible for implementing this Decision.
