JOINT CIRCULAR

Guidance on training for direct advancement from intermediate vocational level to higher vocational level,

 and from higher vocational level to college and university levels

Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

The Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs provide guidance on training for direct advancement from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular guides training for direct advancement from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels, including: the subjects, conditions for direct advancement training, and the authority to assign tasks for direct advancement training from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels; the tasks and powers of schools in direct advancement training from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels; the tasks and rights of students.

2. This Circular applies to universities, academies, colleges, higher vocational schools, intermediate vocational schools (hereinafter referred to collectively as schools).

Chapter II

SUBJECTS, CONDITIONS FOR DIRECT ADVANCEMENT TRAINING AND AUTHORITY TO ASSIGN TASKS FOR DIRECT ADVANCEMENT TRAINING FROM INTERMEDIATE VOCATIONAL LEVEL, HIGHER VOCATIONAL LEVEL TO COLLEGE AND UNIVERSITY LEVELS

 FROM INTERMEDIATE VOCATIONAL LEVEL, HIGHER VOCATIONAL LEVEL TO COLLEGE AND UNIVERSITY LEVELS

Article 2. Subjects for admission to direct advancement training

Those who have graduated with a certificate from an intermediate vocational school or a higher vocational school in the same field of study may take the entrance examination for direct advancement training to college and university levels according to the regulations on direct advancement training of the Ministry of Education and Training.

Those who have graduated with a certificate from an intermediate vocational school must complete the required amount of general knowledge courses and pass the graduation examination for secondary school subjects as stipulated by the Ministry of Education and Training if they only completed junior high school.

Article 3. Admission to direct advancement training

The work of admitting students for direct advancement training from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels shall be carried out according to the current regulations on direct advancement training of the Ministry of Education and Training.

Article 4. Conditions for direct advancement training

Colleges and universities assigned the task of direct advancement training from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels must ensure the following conditions:

1. There is a decision assigning the task of opening programs at the college and university levels for the fields registered for direct advancement training from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels by the Ministry of Education and Training.

2. There is a notification of enrollment quotas for direct advancement training issued by the competent state management agency.

3. They have completed the development of the direct advancement training program from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels according to the current regulations on direct advancement training of the Ministry of Education and Training.

4. There is a decision allowing direct advancement training from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels by the authority specified in Article 7 of this Circular.

Article 5. Application for direct advancement training registration

The application for direct advancement training registration includes:

1. A request for registration for direct advancement training. The content of the request must clearly state the field and level of direct advancement training being applied for; the training needs; the organization of the training process; criteria, forms, and conditions for admission; estimated training quotas; quality assurance conditions and commitments to ensure training quality.

2. A certified copy of the decisions assigning the task of opening regular college and university programs for the fields registered for direct advancement training.

3. A comparison table of the training programs of the trades at the intermediate vocational level and higher vocational level with the training programs of the corresponding fields at the college and university levels as the basis for developing the direct advancement training program.

4. The direct advancement training program from intermediate vocational level to higher vocational level and from higher vocational level to college and university levels for the training field.

5. An explanation of the conditions for ensuring quality regarding the teaching staff, technical staff, and laboratory personnel; the number and area of lecture halls, laboratories, workshops, libraries, textbooks, reference books; types of equipment serving training activities.

Article 6. Program and Duration of Concurrent Education

1. Program of Concurrent Education

a) The concurrent education program must be developed based on the framework program of the Ministry of Education and Training;

b) The development of the concurrent education program from intermediate vocational level to college level and university level shall be carried out according to the principle of supplementing the necessary knowledge and skills, avoiding overlap to ensure that the final standards for college and university levels are met.

2. Duration of Concurrent Education

a) The duration of concurrent education from intermediate vocational level to college level and from advanced vocational level to university level shall be implemented from one and a half to two academic years;

b) The duration of concurrent education from intermediate vocational level to university level shall be implemented from three to four academic years.

Article 7. Authority to Assign Concurrent Education Tasks

The authority to assign concurrent education tasks from intermediate vocational level and advanced vocational level to college and university levels is approved by the Minister of Education and Training.

Chapter III

TASKS AND LIMITATIONS OF SCHOOLS IN CONCURRENT EDUCATION FROM INTERMEDIATE VOCATIONAL LEVEL TO COLLEGE AND UNIVERSITY LEVEL

FROM INTERMEDIATE VOCATIONAL LEVEL, ADVANCED VOCATIONAL LEVEL TO COLLEGE AND UNIVERSITY LEVEL

Article 8. Tasks and Authorities of Universities and Colleges

1. Universities and colleges have the responsibility to compare and verify the training objectives, final standards of the trade being trained, the content of the training program, the volume of knowledge, the ratio of theoretical to practical time, the duration of training, the examination and evaluation methods of the intermediate vocational and advanced vocational programs with those of the college and university programs in the same field to develop the concurrent education program from intermediate vocational and advanced vocational levels to college and university levels.

2. Publish on the school's website information about concurrent education admissions (requirements for admission candidates, cultural subject levels suitable for college and university training levels, time, location, examination format, and other related information), final standards of the college and university training fields, concurrent education programs, concurrent education organization, quality assurance conditions, and graduation certificates to be issued to students upon completion of the program.

3. Organize concurrent education from intermediate vocational and advanced vocational levels to college and university levels in accordance with current regulations on concurrent education of the Ministry of Education and Training.

4. Issuance of graduation certificates to students after completing the concurrent education program from intermediate vocational and advanced vocational levels to college and university levels shall be carried out in accordance with current regulations of the Ministry of Education and Training.

Article 9. Tasks and Authorities of Advanced Vocational and Intermediate Vocational Schools

Advanced vocational and intermediate vocational schools have the responsibility to provide full information to universities and colleges regarding: training objectives, final standards of the trade being trained, training programs, quality assurance conditions of the school, educational quality assessment results confirmed by authorized management agencies, as a basis for recognizing learning outcomes, exempting completed courses for students, admissions, developing concurrent education programs, and organizing training to ensure training quality.

Chapter IV

STUDENT TASKS AND RIGHTS

Article 10. Duties of Students

1. Students who wish to take the entrance examination to be admitted into programs for continuous education from intermediate vocational level to higher vocational level, and from higher vocational level to college and university levels must submit complete application files and fees as prescribed. When required, students must present original certificates or diplomas that have been issued.

2. Implement regulations on education, student affairs, and other relevant laws concerning students; comply with school rules, internal regulations, and provisions.

3. Respect teachers, staff, and employees of the school; unite and help each other in study and training.

4. Participate in labor and social activities, protect the environment, prevent social evils; maintain and protect the property of the school.

5. Contribute to building, protecting, and promoting the traditions of the school.

Article 11. Rights of Students

1. The school shall provide students with full information about the course: admission conditions, examination format, inspection methods, and other requirements for selection, educational regulations, student regulations in training institutions, graduation diplomas, tuition fees.

2. Enjoy benefits as prescribed by law for students; the school shall create favorable conditions for learning and ensure the conditions for continuous education at the quality announced.

3. Be awarded diplomas, grade sheets, and certificates upon graduation or completion of the course.

4. Participate in activities of associations and social organizations within the school and other educational facilities as prescribed by law.

5. Use equipment and means serving learning, cultural, sports activities of the school.

Chapter V

IMPLEMENTING PROVISIONS

Article 12. Implementation Provisions

1. Intermediate vocational schools and higher vocational schools are responsible for coordinating with colleges and universities to develop continuous education programs from intermediate vocational level to higher vocational level, and from higher vocational level to college and university levels.

2. Each year in December, universities and colleges report to the Ministry of Education and Training on the implementation of continuous education from intermediate vocational level to higher vocational level, and from higher vocational level to college and university levels.

3. This Circular takes effect from December 12, 2010./.
