CIRCULAR

for use implementing certain contents for building and applying a quality management system

in accordance with the national standard TCVN ISO 9001:2008 for administrative state agencies

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decision No. 144/2006/QD-TTg dated June 20, 2006 of the Government on the application of a quality management system according to the TCVN ISO 9001:2000 standard in the operations of administrative state agencies and Decision No. 118/2009/QD-TTg dated September 30, 2009 of the Government amending and supplementing certain provisions of Decision No. 144/2006/QD-TTg;

Considering the proposal of the Director General of the Standardization, Measurement, and Quality Control Department,

The Minister of Science and Technology guides certain contents for implementing building and applying a quality management system according to the national standard TCVN ISO 9001:2008 (hereinafter referred to as the quality management system) for administrative state agencies as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular guides certain contents for implementing building and applying a quality management system according to the national standard TCVN ISO 9001:2008 (hereinafter referred to as the quality management system) for the implementation of administrative procedures at administrative state agencies.

Article 2. This Circular applies to administrative state agencies that implement the construction and application of a quality management system as prescribed in Clause 2, Article 1 of Decision No. 118/2009/QD-TTg dated September 30, 2009 of the Government and related organizations and individuals.

Article 3. Administrative procedures implemented by administrative state agencies that construct and apply a quality management system include: all administrative procedures published based on the results of the Simplification of Administrative Procedures Project in State Management Fields for the period 2007-2010 issued together with Decision No. 30/QD-TTg dated January 10, 2007 of the Government (hereinafter referred to as Project 30) and Decree No. 63/2010/NĐ-CP dated June 8, 2010 of the Government on administrative procedure control.

Chapter II

SPECIFIC PROVISIONS

Article 4. Responsibilities for identifying administrative procedures subject to the construction and application of a quality management system

Point 1. Ministries, ministerial-level agencies, and government agencies shall identify, classify through postal services as stipulated in Clause 3, Article 1 of this Circular and implement at each subordinate agency or unit according to Model I attached to this Circular and publish on the electronic information website of the Ministry, ministerial-level agency, or government agency.

Point 2. Provincial People's Committees (hereinafter referred to as Provincial People's Committee) shall identify, classify through postal services as stipulated in Clause 3, Article 1 of this Circular and implement at each administrative state agency within their jurisdiction (excluding representative offices in localities and vertical agencies under ministries, ministerial-level agencies, and government agencies located in localities) according to Model II attached to this Circular and publish on the electronic information website of the Provincial People's Committee.

Point 3. When new administrative procedures are promulgated, amended, supplemented, replaced, abolished, or repealed, ministries, ministerial-level agencies, government agencies, and Provincial People's Committees must update electronic media in Vietnam the electronic information website of the Ministry, ministerial-level agency, government agency, or Provincial People's Committee no later than fifteen working days from the date of signing the Decision announcing the administrative procedure.

Point 4. Ministries, ministerial-level agencies, government agencies, and Provincial People's Committees are responsible for the accuracy of the contents published onthe electronic information website of the Ministry, ministerial-level agency, government agency, or Provincial People's Committee as stipulated in Clauses 1, 2, and 3 of this Article. as provided for in Clauses 1, 2, and 3 of this Article.

Article 3. Construction and application of quality management systems at Ministries, agencies equivalent to Ministries, and government agencies

Based on the provisions through postal services to be constructed and applied quality management system stipulated in Clause 3, Article 1 and Article 2 of this Circular, construction and application quality management system shall be implemented as follows:

1. For of the administrative units of Ministries, agencies equivalent to Ministries, and government agencies:

Construct and apply a quality management system including Leaders, units (Office, Departments, and equivalents) and individuals participating in the process of implementing administrative procedures from receiving files to delivering results.

2. For agencies at the General Department, Department, and equivalent levels under Ministries, agencies equivalent to Ministries, and government agencies:

a) Construct and apply a quality management system including Leaders, units (Office, Departments, Divisions, Bureaus, and equivalents, excluding Departments directly under the General Department) and individuals participating in the process a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters. through postal services from receiving files to delivering results.

b) Departments directly under The Minister of Agriculture and Rural Development issues the National Technical Regulations on Wood Adhesive construct and apply a quality management system including Leaders, units (Office, Divisions, and equivalents) and individuals participating in the process a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters. through postal services from receiving files to delivering results.

3. Based on actual circumstances, Ministries, agencies equivalent to Ministries, and government agencies may consider and decide on the construction and application of a common quality management system for the objects specified in Clause 1 and Clause 2 of this Article.

4. For local representative agencies and overseas representative agencies of Ministries, agencies equivalent to Ministries, and government agencies:

Construct and apply a quality management system bincluding Leaders, units, and individuals participating in the process a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters. through postal services from receiving files to delivering results.

5. For vertical sectoral agencies located in localities under Ministries, agencies equivalent to Ministries, and government agencies:

Construct and apply a quality management system according to the model framework of the quality management system established and announced by Ministries, agencies equivalent to Ministries, and government agencies.

Article 4. Construction and application quality management system at People's Committees at all levels, specialized agencies under provincial People's Committees, specialized agencies under district, county, town, and provincial city People's Committees

Based on the provisions through postal services to be constructed and applied quality management system stipulated in Clause 3, Article 1 and Article 2 of this Circular and the model framework of the quality management system announced by the Ministry of Science and Technology, the construction and application of the quality management system shall be carried out as follows:

1. For provincial People's Committees and Provincial People's Committee Offices:

Construct and apply a common quality management system including Leaders, units (Divisions, Bureaus, and equivalents) and individuals participating in the process of implementing administrative procedures from receiving files to delivering results.

2. For specialized agencies under provincial People's Committees (excluding Provincial People's Committee Office):

a) Specialized agencies under provincial People's Committees construct and apply a quality management system including Leaders, units (Divisions, Bureaus, and equivalents, excluding Sub-Councils) and individuals participating in the process of implementing administrative procedures from receiving files to delivering results.

b) Sub-Councils specialized agency under the People's Committee of the province/city.under specialized agencies under provincial People's Committees construct and apply a quality management system including Leaders, units (Divisions, Bureaus, and equivalents) and individuals participating in the process a) Report to the Ministry of Natural Resources and Environment on the results of training and upgrading, including listing the teaching staff participating in teaching, evaluating the participation of trainees in the training process, the results of organizing examinations for completing the training and upgrading program on land valuation business, the issuance of Certificates and the use of Certificate codes, summarizing the feedback from trainees on the quality of the training and upgrading program on land valuation business, and other relevant matters. through postal services from receiving files to delivering results.

3. For district, county, town, and provincial city People's Committees (hereinafter referred to as District People's Committees) and specialized agencies under District People's Committees:

The Department of Science and Technology is responsible for taking the lead, coordinating with the Department of Home Affairs and relevant agencies to advise the provincial People's Committee on the form of construction and application of the quality management system for District People's Committees and specialized agencies under District People's Committees within their jurisdiction, ensuring economy, avoiding wastage of state budget funds, and being suitable to the actual conditions of the locality according to one of the following forms:

a) Construct and apply a common quality management system for District People's Committees and all specialized agencies under District People's Committees.

b) Construct and apply an independent quality management system for a maximum of three (03) specialized agencies under District People's Committees that have separate offices, seals, and accounts and implement many delegated administrative procedures. The remaining specialized agencies under District People's Committees shall construct and apply a common quality management system with District People's Committees.

4. Encourage People's Committees at commune, ward, and town levels to construct and apply quality management systems. In cases where People's Committees at commune, ward, and town levels construct and apply quality management systems, they must do so for all administrative procedures stipulated in Clause 3, Article 1 and Article 2 of this Circular.

Article 5. Content of consultancy work to be hired and content of work to be independently carried out by administrative state agencies during the process of establishing and applying a quality management system Administrative state agencies shall carry out the establishment and application

or hire consultancy services according to the contents prescribed in Point 3.1 of Appendix XI issued together with Circular No. 01/2010/TT-BKHCN dated February 25, 2010 of the Minister of Science and Technology on consultancy, evaluation, and certification activities quality management system for administrative state agencies, and costs according to Circular No. 159/2010/TT-BTC dated October 15, 2010 of the Minister of Finance on financial management for the establishment, application, and maintenance quality management system of the operation of administrative state agencies, specifically as follows: quality management system 1. The head of an administrative state agency shall consider and decide on hiring organizations or independent consultant experts to perform the following tasks partially or entirely:

a) Assessing the current situation of quality management at the agency;

b) Preparing a plan for establishing and applying a quality management system, including time frame, number of working days, and workload;

c) Training knowledge, including: training on quality management systems; methods for building documentation, operational procedures, and work resolution processes; training internal auditors and internal audits;

d) Guiding the establishment of the Steering Committee for Quality Management System Construction (referred to as the ISO Steering Committee);

đ) Providing practical guidance on building documentation, operational procedures, and work resolution processes; guiding the expansion of the quality management system to meet the requirements of Project 30 and Decree No. 63/2010/NĐ-CP;

e) Guiding the agency to disseminate and guide the application of the quality management system to all officials and civil servants within the scope of construction and application of the quality management system;

g) Guiding the implementation of internal audits, corrective actions, and improvements

for non-conformities identified during internal audits; quality management system h) Guiding the completion

before and after certification assessment. quality management system 2. Administrative state agencies shall independently carry out the following tasks:

a) Approving the implementation plan for establishing and applying a quality management system;

b) Establishing the ISO Steering Committee;

c) Building, issuing, and controlling documentation, operational procedures, and work resolution processes;

d) Organizing the dissemination and guidance on the application of the quality management system to all officials and civil servants within the scope of construction and application of the quality management system;

đ) Implementing internal audits, taking corrective actions, and improving the quality management system for non-conformities identified during internal audits;

e) Taking corrective actions and improving the quality management system for non-conformities identified during certification body assessments; completing the application dossier for the General Department of Standardization, Metrology, and Quality Control to issue a Certificate

of conformity to the national standard TCVN ISO 9001:2008 (hereinafter referred to as the Certificate); g) Maintaining and improving the quality management system during its application.;

g) Maintain and improve the quality management system during the implementation process.

Article 6. Tasks of administrative state agencies

1. Implement the establishment and application of a quality management system for all administrative procedures specified in Clause 3, Article 1 and Article 2 of this Circular.

2. In cases where there are administrative procedures that are similar in content and implementation steps, the administrative state agency shall study and develop a common process for handling such administrative procedures (by work item). similar in content and implementation steps, administrative agencies shall study and develop a general procedure for handling tasks for administrative procedures (according to the list of tasks).

3. When there are changes, additions, replacements, cancellations, or abolitions of administrative procedures, the administrative state agency to be constructed and applied quality management systemupdates the changed contents of its own unit to implement and apply them. CHIEF update the contents of changes to through postal services into quality management system of their own unit for implementation.

4. The head of the administrative state agency determines internal activities and other activities of the agency that need to establish and apply a quality management system to support and serve the implementation of administrative procedures and the internal management process of the agency.

Chapter III

IMPLEMENTATION

Article 7. Implementation Provisions

1. This Circular takes effect 45 days from the date of issuance.

2. As of January 1, 2012, administrative state agencies are only allowed to issue (issue new, reissue, adjust, expand, narrow the scope of application) Certificates after establishing and applying quality management system the provisions set out in Clause 3, Article 1 and Article 2 of this Circular. through postal services as stipulated in Clause 3 of Article 1 and Article 2 of this Circular.

Article 8. Implementation organization

1. The Minister, the Heads of Ministries equivalent to Ministries, the Heads of Government Agencies, and the Chairmen of Provincial People's Committees are responsible for organizing the implementation of this Circular.

2. The Heads of administrative state agencies, relevant organizations, and individuals are responsible for implementing this Circular.

3. The Director of the General Administration of Standardization, Metrology, and Quality Control is responsible for organizing guidance and supervision of the implementation of this Circular.

4. During the implementation process, if there are emerging issues or difficulties, organizations and individuals shall promptly report in writing to the Ministry of Science and Technology for research and amendment. /
