JOINT CIRCULAR

Regulations on the content and expenditure levels for building a list of vocational training equipment

for初级级职业，中级职业和高等职业

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;

Pursuant to Decree No. 70/2009/NĐ-CP dated August 21, 2009 of the Government detailing and guiding the implementation of the Law on Vocational Training regarding state management responsibilities for vocational training;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

The Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs hereby prescribe the content and expenditure levels for building a list of vocational training equipment for primary vocational skills, intermediate vocational skills, and higher vocational skills as follows:

Article 1. Scope and Applicability

This Circular applies to agencies, units, and organizations that use state budget funds to implement the construction of a list of vocational training equipment for primary vocational skills, intermediate vocational skills, and higher vocational skills pursuant to Decision No. 241/QĐ-LĐTBXH dated February 12, 2010 of the Minister of Labor, Invalids and Social Affairs on issuing the procedures for constructing, reviewing, and promulgating lists of vocational training equipment for each profession according to three training levels.

Article 2. Source of funds currently

Funds for activities related to the construction of a list of vocational training equipment for primary vocational skills, intermediate vocational skills, and higher vocational skills are allocated from the annual state budget of the Ministry of Labor, Invalids and Social Affairs and other lawful sources as prescribed by law.

Article 3. Content and expenditure levels for the construction of a list of vocational training equipment

1. For the list of vocational training equipment for primary vocational skills: implemented in accordance with Clause 5.3 Article 6. Circular Joint No. 112/2010/TTLT-BTC-BLDTBXH dated July 30, 2010 of the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs on guiding the management and use of funds to implement the Program "Vocational Training for Rural Laborers until 2020" issued pursuant to Decision No. 1956/QĐ-TTg dated November 27, 2009 of the Prime Minister. In addition, this circular supplements some additional funding items as follows:

- Soliciting opinions (from experts) on the list of vocational training equipment for primary vocational skills: VND 100,000 per module per expert.

- Review and evaluation by the Review Board for the list of vocational training equipment for primary vocational skills: VND 800,000 per module per board.

2. For the list of vocational training equipment for intermediate vocational skills and higher vocational skills:

a) Expenditure for seminar, training, survey, and documentation preparation activities for the construction of the list of vocational training equipment shall be carried out in accordance with current regulations.

b) Special content and expenditure levels for the construction of the list of vocational training equipment for intermediate vocational skills and higher vocational skills are prescribed in the attached appendix to this Circular.

c) Expenditure for the review of the list of vocational training equipment by the Review Board established by the Minister of Labor, - Invalids and Social Affairs.

- Soliciting opinions (from experts) on the list of vocational training equipment for intermediate vocational skills: VND 100,000 per module per expert.

- Soliciting opinions (from experts) on the list of vocational training equipment for higher vocational skills: VND 120,000 per module per expert;

- Review and evaluation by the Review Board for intermediate vocational skills: VND 1,000,000 per module per board;

- Review and evaluation by the Review Board for higher vocational skills: VND 1,500,000 per module per board.

Article 4. Establishment, allocation, management, utilization, and settlement of funds

The establishment, allocation, management, utilization, and settlement of funds for building the list of vocational training equipment according to three levels of vocational training shall be carried out in accordance with the provisions of the State Budget Law and guiding documents of the Law. In addition, this Circular guides specific contents as follows:

a) Based on the annual plan for the construction of the list of vocational training equipment for various trades, the General Department of Vocational Training establishes steering committees for the construction of vocational training equipment lists in accordance with Decision No. 241/QĐ-LĐTBXH dated February 12, 2010, issued by the Minister of Labor, Invalids, and Social Affairs on the procedures for constructing, reviewing, and issuing vocational training equipment lists for each trade, at three levels of training.

b) Based on requirements regarding the content and volume of work related to the construction of the list of vocational training equipment, economic-technical norms issued by relevant ministries and sectors (in cases where there are no economic-technical norms, detailed explanations are required) and the content and expenditure levels specified in this Circular, steering committees for the construction of vocational training equipment lists prepare budgets and submit them to the General Department of Vocational Training.

c) The General Department of Vocational Training is responsible for checking and consolidating the budget for the construction of vocational training equipment lists and submitting it to the Ministry of Labor, Invalids, and Social Affairs for inclusion in the annual consolidated budget in accordance with the State Budget Law and guiding documents of the Law.

d) The construction of the list of vocational training equipment is implemented through contracts signed between the General Department of Vocational Training and the steering committees. Payment vouchers and settlement documents are kept at the General Department of Vocational Training, including: Contracts for the construction of vocational training equipment lists signed between the General Department of Vocational Training and the steering committees (accompanied by detailed budgets approved by the General Department of Vocational Training); acceptance certificates for work; liquidation certificates for contracts; payment authorization forms or payment vouchers and related documents (if any); specific invoices and expenditure vouchers in accordance with current regulations.

đ) Steering committees for the construction of vocational training equipment lists are responsible for the content and quality of the vocational training equipment lists assigned to them and are legally accountable for implementing financial expenditure regimes as prescribed.

Article 5. Implementation Provisions

1. This Circular takes effect from April 20, 2011.

2. Units that have spent funds on the construction of vocational training equipment lists in 2010 shall apply the contents and expenditure levels stipulated in this Circular and settle accounts in accordance with the State Budget Law within the scope of the 2010 budget allocated by competent authorities.

3. During implementation, if there are any difficulties, units are requested to report to the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs for guidance on implementation.
