of the Standardization, Measurement and Quality Control Department
under the Ministry of Science and Technology

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Law on Measurement dated November 11, 2011;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Minister of Science and Technology,

The Prime Minister issues this Decision to stipulate the functions, tasks, powers, and organizational structure of the Standardization, Measurement and Quality Control Department under the Ministry of Science and Technology.

Article 1. Position and Functions

1. The Standardization, Measurement and Quality Control Department is an organization under the Ministry of Science and Technology, performing the function of advising and assisting the Minister of Science and Technology in state management and enforcement of laws on standardization, measurement, and quality control throughout the country, including technical standards and regulations, measurement, product and commodity quality, and organizing public service activities related to standardization, measurement, and quality control in accordance with the law.

2. The General Department of Standardization, Metrology, and Quality Control has legal personality, its own seal with the National Emblem, a separate account at the State Treasury, and its headquarters located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Standardization, Measurement and Quality Control Department shall perform the following tasks and powers:

1. Submit to the Minister of Science and Technology for submission to the Government and the Prime Minister:

a) Drafting laws, ordinances, draft resolutions of the National Assembly and its Standing Committee; drafting decrees of the Government, draft decisions and directives of the Prime Minister regarding standards and technical regulations, measurement, productivity, and product and commodity quality; product labels; barcode numbers; quality awards;

b) Strategic plans, programs, projects, and proposals for national importance concerning standards, technical regulations, measurement, productivity, and product and commodity quality.

2. Submit to the Minister of Science and Technology for approval or decision:

a) Planning, programs, projects, and proposals on standards, technical regulations, measurement, productivity, and product and commodity quality in accordance with the law;

b) Drafting circulars and other documents on standards and technical regulations, measurement, product and commodity quality; product labels; barcode numbers; management of conformity assessment activities; designation of conformity assessment organizations; quality awards;

c) Publishing national standards;

d) Issuing national technical regulations, lists of products and commodities that may cause safety risks within the scope of responsibility of the Ministry of Science and Technology;

đ) Specifying criteria, conditions, procedures, and formalities for awarding national quality awards; conditions and formalities for awarding product and commodity quality awards proposed by organizations and individuals.

3. Organizing publicity, dissemination, education on laws, and guidance on professional matters related to standards, technical regulations, measurement, productivity, and product and commodity quality.

4. Implementing legal regulatory documents, strategic plans, programs, projects, and proposals on standards and technical regulations, measurement, productivity, and product and commodity quality after approval or issuance.

5. Issuing professional guidance documents on standards and technical regulations, measurement, product and commodity quality, and other individual documents as prescribed by law.

6. Regarding standards and technical regulations:

a) Organizing the drafting of national standard drafts and national technical regulation drafts in the assigned fields;

b) Participating in the drafting of national standard drafts led by ministries, ministerial-level agencies, and government agencies;

c) Reviewing national standard drafts and national technical regulation drafts led by ministries, ministerial-level agencies, and government agencies; providing opinions on the establishment and issuance of local technical regulations according to the assignment of the Minister of Science and Technology;

d) Providing guidance on the construction of standards and technical regulations;

đ) Organizing the dissemination and application guidance of national standards, international standards, regional standards, and foreign standards in Vietnam; implementing national technical regulations in the assigned management field;

e) Organize participation in the development of international standards and regional standards as prescribed by law;

g) Organizing reviews, proposing the Minister of Science and Technology to amend, supplement, replace, or revoke national standards and national technical regulations issued or promulgated by the Minister of Science and Technology;

h) Implementing the registration and publication of technical regulation lists; publishing national standards and national standard lists;

i) Establishing and managing the activities of National Technical Standards Committees.

7. Regarding metrology:

a) Managing, organizing, and implementing the establishment, maintenance, preservation, and use of national measurement standards in the assigned fields;

b) Managing, organizing, and implementing inspection, calibration, and testing activities of measuring instruments and measurement standards;

c) Providing guidance on the construction of measurement standards systems of ministries, sectors, and localities;

d) Certifying working standards, reference materials; designating organizations for inspection, calibration, and testing of measuring instruments and measurement standards; certifying and issuing metrology inspector cards;

đ) Approving samples of domestically produced or imported measuring instruments;

e) Certifying the registration of activities providing inspection, calibration, and testing services of measuring instruments and measurement standards;

g) Managing, organizing, and implementing the certification of compliance with labeling requirements for prepackaged goods;

8. On product quality and goods:

a) Implementing national programs and projects on productivity and product and commodity quality;

b) Leading inspections of product and commodity quality produced domestically, circulating on the market, exported, imported, and in use within the scope of responsibility of the Ministry of Science and Technology;

c) Cooperating with relevant quality management agencies in supervision and inspection activities on product and commodity quality under the responsibility of sectoral ministries;

d) Organizing activities for awarding national quality awards; managing activities for awarding product and commodity quality awards by organizations and individuals as prescribed by law;

đ) Managing product labels and barcode numbers.

9. On conformity assessment with standards and technical regulations:

a) Implementing registration of the fields of operation of conformity assessment organizations in the assigned management fields;

b) Designating conformity assessment organizations to conduct testing, certification, appraisal, and inspection activities in accordance with national technical regulations issued by the Ministry of Science and Technology; guiding the designation of conformity assessment organizations by ministries, sectors, and localities;

c) Chair and organize the implementation or coordinate with relevant ministries and sectors to implement international treaties and mutual recognition agreements on conformity assessment results in the field of standards, measurement, and product quality according to the division of labor by the Minister of Science and Technology;

d) Guide the implementation of conformity assessment methods based on national technical regulations issued by the Ministry of Science and Technology;

đ) Manage the activities of recognizing testing organizations, calibration organizations, conformity assessment bodies, and inspection organizations;

e) Manage and guide the registration of consulting activities, quality management system assessment, issuance, suspension, or revocation of the validity of registration certificates for conformity assessment activities according to the provisions of the law;

g) Coordinate with relevant agencies to implement standard compliance and regulation compliance announcements;

10. Coordinate with relevant agencies to organize the implementation of inspections, checks, controls, and handling of violations of laws in production and sale of fake, prohibited goods, substandard products, and other fraudulent trade practices related to the fields of standards, measurement, and product quality according to the provisions of the law;

11. Organize and manage the operation of the national network of notification and inquiry agencies regarding technical barriers in trade;

12. Implement international cooperation on standards, technical regulations, measurement, productivity, and product quality according to the provisions of the law; represent Vietnam at international and regional organizations concerning standards, measurement, productivity, and product quality according to the decision of competent state authorities;

13. Organize training and professional development for agencies and organizations operating in the fields of standards, technical regulations, measurement, productivity, and product quality;

14. Guide and create conditions for associations, organizations, and individuals to participate in activities related to standards, technical regulations, measurement, productivity, and product quality;

15. Manage and organize the implementation of investment projects under the National Standard Measurement Quality Administration according to the provisions of the law;

16. Organize scientific research, application of scientific and technological progress; information dissemination, promotion, and consultation on standards, technical regulations, measurement, productivity, and product quality;

17. Conduct specialized inspections, handle violations of laws on standards and technical regulations, measurement, and product quality; resolve complaints and accusations and implement anti-corruption measures according to the provisions of the law;

18. Carry out service activities in the fields of standards and technical regulations, measurement, productivity, and product quality according to the provisions of the law;

19. Implement administrative reform in the fields of standards and technical regulations, measurement, and product quality according to the goals and contents of the approved administrative reform program and plan;

20. Manage, guide, and organize the implementation of advanced quality management systems in the operations of administrative state agencies;

21. Manage organizational structure, civil servant quota, and number of employees, officials, and workers; implement salary systems, appointments, reappointments, transfers, rotations, dismissals, resignations, secondments, retirements, terminations, rewards, and disciplinary actions for civil servants, officials, and workers under the jurisdiction of the National Standard Measurement Quality Administration according to the provisions of the law and the delegation of the Minister of Science and Technology; establish job positions and the structure of civil servants and officials of the National Standard Measurement Quality Administration to be submitted to the Minister according to the provisions;

22. Manage finance and assets assigned, organize the implementation of budget management allocated according to the provisions of the law and the delegation of the Ministry of Science and Technology;

23. Perform other tasks and powers delegated by the Minister of Science and Technology and according to the provisions of the law;

17. Conformity Assessment Certification Center;

18. Training Center for Standards, Metrology, and Quality;

22. Vietnam-Germany Training and Technology Transfer Center;

24. National Notification and Inquiry Office for Standards, Metrology, and Quality;

Organizations specified from Clause 1 to Clause 9 of this Article are administrative organizations assisting the Director General in performing state management functions; organizations specified from Clause 10 to Clause 24 of this Article are public service organizations directly under the National Standard Measurement Quality Administration;

The Minister of Science and Technology decides the establishment, dissolution, and restructuring of the Central Quality Management Agency for Central Region Products and Goods in Da Nang City and the Southern Region Products and Goods Quality Management Agency in Ho Chi Minh City under the Products and Goods Quality Management Department;

The Director General of the National Standard Measurement Quality Administration stipulates the functions, tasks, powers, and organizational structures of the organizations under his/her administration; appoints, dismisses, and removes leaders and managers of units under their own management according to the provisions of the law.

Article 4. Leadership of the General Department of Standardization, Measurement and Quality Control

1. The General Department of Standardization, Measurement and Quality Control shall have a Director and not more than three Deputy Directors.

2. The Director and Deputy Directors shall be appointed, relieved of duty, or dismissed by the Minister of Science and Technology in accordance with the provisions of the law.

3. The Director of the General Department of Standardization, Measurement and Quality Control shall be responsible to the Minister of Science and Technology and to the law for all activities of the Department. The Deputy Directors shall be responsible to the Director and to the law for the areas of work assigned to them.

Article 5. Effective Date

1. This Decision shall take effect from June 1, 2014.

2. This Decision replaces Decision No. 104/2009/QĐ-TTg dated August 12, 2009 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Standardization, Measurement and Quality Control, and Decision No. 46/2011/QĐ-TTg dated August 22, 2011 of the Prime Minister amending and supplementing Decision No. 104/2009/QĐ-TTg; and abolishes previous regulations that are contrary to this Decision.

Article 6. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, and the Director of the General Department of Standardization, Measurement and Quality Control shall be responsible for implementing this Decision.
