issued by the National Academy of Public Administration under the Ministry of Home Affairs

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

||| Based on the proposal of the Minister of Home Affairs;

The Prime Minister issues this Decision to stipulate the functions, tasks, powers, and organizational structure of the National Academy of Public Administration under the Ministry of Home Affairs.

Article 1. Position and Functions

1. The National Academy of Public Administration is a public service unit directly under the Ministry of Home Affairs.

2. The National Academy of Public Administration is a special-class public service unit, serving as the national center for implementing training and capacity-building functions in administrative knowledge, leadership, and management skills for civil servants and officials; human resource development; administrative science research; advising and consulting the Ministry of Home Affairs in the field of administration and state management.

3. The National Academy of Public Administration has legal personality, its own seal, and a separate account at the State Treasury, with its main office located in Hanoi, and its international name in English is National Academy of Public Administration, abbreviated as NAPA.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The National Academy of Public Administration (hereinafter referred to as the Academy) shall have the following tasks and powers:

1. Regarding the training and capacity-building of civil servants and officials:

a) Assist the Minister of Home Affairs in organizing and implementing training programs and contents for civil servants and officials on administration and state management throughout the country as prescribed by law;

b) Train and enhance administrative management knowledge and skills according to civil servant rank standards and official occupational title standards as prescribed by law;

c) Train and enhance knowledge and skills according to job position requirements for leadership and management positions and specialized technical positions as prescribed by law;

d) Enhance professional expertise and teaching methods for state management lecturers within the training, capacity-building, and research system;

đ) Train administrative knowledge, skills, and management practices for leaders, managers, civil servants, and officials within the political system and state-owned enterprises;

e) Participate in researching, surveying, evaluating the needs and quality of civil servant and official training; propose directions for innovation and improvement in training quality to meet state management and public service requirements;

g) Organize training sessions on management techniques for training and capacity-building for civil servants and officials responsible for training and capacity-building work in ministries, agencies equivalent to ministries, government agencies, central-level political-social organizations, and provincial-level cities, and other tasks as directed by the Minister of Home Affairs.

2. Provide undergraduate, master's, and doctoral education in accordance with the Higher Education Law and current laws.

3. Regarding scientific research:

a) Conduct administrative and state management scientific research and policy science research to serve the Academy’s teaching activities;

b) Research and provide scientific evidence for administrative reform, civil service reform, public policy, strategies, and measures to enhance the capabilities and quality of civil servants and officials and administrative state machinery suitable for each stage of development;

c) Participate in developing programs and projects in the field of administration and state management when assigned by competent authorities.

4. International cooperation in training, capacity-building, academic exchange, administrative and state management scientific research, and related fields.

5. Organize the compilation of training programs and materials for civil servants and officials based on assigned tasks and responsibilities and the division of labor by the Minister of Home Affairs; develop and issue textbooks and materials for higher education and postgraduate education in accordance with the law.

6. Manage and issue certificates and diplomas in the field of training and capacity-building of the Academy in accordance with the law.

7. Implement examination work and ensure the quality of training and capacity-building of the Academy as assigned by the Minister of Home Affairs and in accordance with the law.

8. Publish and distribute journals, newsletters, scientific publications, textbooks, and materials to support training, capacity-building, and administrative and state management scientific research in accordance with the law.

9. Decide and direct the implementation of the Administrative Reform Program for subordinate organizations and units of the Academy.

10. Carry out internal inspection work, handle complaints and denunciations, and prevent corruption, wastefulness, and malpractice in the Academy’s activities in accordance with the law.

11. Manage the organizational structure, staffing, and number of employees; implement regulations and policies; train and enhance staff; conduct commendation and reward and disciplinary actions for Academy staff and workers in accordance with the law and the delegation of the Minister of Home Affairs.

12. Manage financial resources and assets allocated in accordance with the law.

13. Coordinate with units of the Ministry of Home Affairs to develop strategies, programs, plans, regulations, and normative legal documents when assigned by competent authorities.

14. Perform other tasks and powers as delegated by competent authorities and in accordance with the law.

20. Central Region Branch of the National Academy of Public Administration.

21. Western Highlands Branch of the National Academy of Public Administration.

Article 4. Leadership

1. The Academy’s Board of Directors consists of the Director and not more than four Deputy Directors.

2. The Academy’s Director is appointed and relieved from duty by the Minister of Home Affairs after obtaining the Prime Minister’s opinion. The Academy’s Deputy Directors are appointed and relieved from duty by the Minister of Home Affairs upon the recommendation of the Director.

3. The Director of the Academy shall be responsible to the Minister of Public Security and to the law for all activities of the Academy. The Deputy Directors of the Academy shall be responsible to the Director of the Academy and to the law for the areas of work assigned to them.

4. The Director of the Academy shall issue the Rules of Operation of the Academy; specify in detail the functions, tasks, authorities, organizational structure of units under and affiliated with the Academy and of units constituting units under and affiliated with the Academy; decide on the establishment, merger, division, dissolution of departments, majors, and equivalent units; appoint and relieve officials holding leadership and management positions at units under and affiliated with the Academy.

Article 5. Transitional Provisions

1. Merge the Hanoi University of Public Administration into the National Academy of Administration.

2. The Hanoi University of Public Administration shall be responsible for transferring all current personnel, finances, and assets of the University to the Academy.

3. The Academy shall be responsible for receiving, arranging, organizing, managing, and utilizing the personnel, finances, and assets of the Hanoi University of Public Administration in accordance with regulations; developing self-financing plans, management and financial asset handling plans in accordance with legal provisions to submit to competent authorities for approval.

4. The Academy shall receive and organize the implementation of training and development tasks of the Hanoi University of Public Administration, ensuring the rights of students; issuing diplomas and certificates to students in accordance with legal provisions; inheriting all rights and obligations of the Hanoi University of Public Administration that have been and are being implemented.

Article 6. Effectiveness and Responsibility for Implementation

1. This Decision shall take effect from January 1, 2023.

2. This Decision replaces Decision No. 05/2018/QĐ-TTg dated January 23, 2018 of the Prime Minister stipulating the functions, tasks, authorities, and organizational structure of the National Academy of Administration; abolishes Decision No. 2016/QĐ-TTg dated November 14, 2011 of the Prime Minister regarding the establishment of the Hanoi University of Public Administration; Decision No. 468/QĐ-BNV dated April 3, 2018 of the Minister of Public Security stipulating the functions, tasks, authorities, and organizational structure of the Hanoi University of Public Administration; Decision No. 5989/QĐ-BGDĐT dated December 21, 2016 of the Ministry of Education and Training regarding the establishment of a branch of the Hanoi University of Public Administration in Quang Nam Province; Decision No. 5600/QĐ-BGDĐT dated December 27, 2018 of the Ministry of Education and Training regarding the establishment of a branch of the Hanoi University of Public Administration in Ho Chi Minh City.

3. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government, and the Director of the National Academy of Administration shall be responsible for implementing this Decision.
