MINISTRY OF FINANCE-MINISTRY NUMBER: 27-TTLB |
SOCIALIST REPUBLIC OF VIET NAM HA NOI, JUNE 11, 1958 |
CIRCULAR
REGARDING THE COLLECTION OF FEES AND ISSUANCE OF DOCUMENTS AT PEOPLE'S COURTS
JOINT MINISTRY OF JUSTICE AND FINANCE
|
Respectfully submitted to: |
- The Administrative Committees of Provinces, Cities, and Prefectures |
Decree No. 113-SL dated June 28, 1946 on the collection of judicial fees at courts stipulates in Article 3 as follows: "Any individual wishing to obtain a full copy or extract of a criminal case record or civil case file, or a judicial dossier must pay two đong for each sheet of paper printed on both sides." However, during the resistance war, this decree was only implemented for a short period before being suspended. After peace was restored, People's Courts in Ha Noi and Hai Phong City collected 300 đong per sheet, while other People's Courts did not collect any fees. The collection of fees for issuing various types of documents such as full copies or extracts of criminal case records or files, mediation statements, and judicial dossiers needs to be uniformly implemented at all People's Courts, so now the Joint Ministry specifies that the fee for issuing a typed sheet of paper will be 300 đong for all People's Courts from district level upwards.
The collection of fees for issuing documents at People's Courts shall commence from July 1, 1958.
Each time a document is issued, the responsible staff member will collect the fee and record it in the document as follows:
Copy issued to Mr./Mrs...
Fee collected is...
Recorded in the book on...day...month...year 195...number...
Signature and seal of the court
Due to the note recorded in the document as above, there is no need to issue a receipt for the payment; however, each time there is a collection, it must be recorded in a special book for collecting fees for issuing documents (model attached).
Monthly, People's Courts at the county level shall remit the amount collected in the previous month to the People's Court at the provincial or city level, which will then remit the total amount collected from local courts to the provincial treasury. When remitting the money, the county court must report the total amount collected and break down the collection by type of document (criminal cases, household matters).
The revenue collected from People's Courts within a province will be deposited into the "Revenue from Fees" account of the local budget, whereas the revenue collected from Appellate Courts at the regional level will be deposited into the "Other Revenues" account of the central budget.
Regional and provincial People's Courts shall report the total amount collected to the Ministry of Justice every three months, six months, and annually.
Financial Departments at the regional and provincial levels shall assist the accounting units of People's Courts in the collection and remittance of fees according to the current budgeting and accounting regulations.
Daily collections shall be deposited into the office fund (recorded under a temporary holding account). At the end of the month, the temporary holding account will be adjusted to "Revenue for Total Budget" and the funds will be transferred to the treasury.
People's Courts in Ha Noi and Hai Phong Cities, which have been collecting fees for issuing documents and case fees, may continue to collect case fees and deposit them into the treasury and maintain their records as usual, but they should apply the provisions set forth in this circular for the collection of fees for issuing documents.
The Joint Ministry has attached a model for the book of fees collected for issuing documents here, to ensure uniformity among courts. Since the book is simple and the number of collections is not large, each court can print its own book without incurring unnecessary costs.
The joint ministries hereby attach a model receipt book for issuing certificates, to ensure uniformity among courts. Given that the book is simple and the amount of collection is not significant, each court shall print its own book without incurring printing costs.
