DECISION OF THE PRIME MINISTER
Regulations on occupational allowances
for cadres, civil servants at state healthcare facilities
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, public officials, and armed forces;
At the proposal of the Minister of Health, the Minister of Home Affairs, and the Minister of Finance,
DECISION:
Article 1. Scope and Applicability
1. This Decision stipulates the occupational allowance system for cadres and civil servants directly engaged in medical specialties, and those involved in management and support services not directly engaged in medical specialties at HIV/AIDS, leprosy, tuberculosis, mental health, pathology, and forensic medicine departments in state healthcare facilities.
2. State healthcare facilities include:
a) Medical examination and treatment facilities;
b) Institutes and Centers: research, testing, inspection, appraisal, and health communication education;
c) Centers under the preventive healthcare system;
d) Regional multi-specialty clinics, midwifery houses, commune health stations, urban district health stations, and school health centers.
3. The occupational allowance system prescribed in this Decision shall not apply to individuals working in healthcare facilities under the Ministry of National Defense, the Ministry of Public Security, and confidential agencies.
Article 2. Rate of Allowance and Calculation Method:
1. The rate of occupational allowance is specified as follows:
a) A 50% allowance applies to cadres and civil servants performing the following tasks:
- Directly examining, treating, and caring for patients in HIV/AIDS specialty departments, institutes, and hospitals;
- Specializing in HIV/AIDS testing.
b) A 45% allowance applies to cadres and civil servants directly engaged in medical specialties at HIV/AIDS prevention and control centers in mountainous, island, remote, and far-flung areas;
c) A 40% allowance applies to cadres and civil servants directly engaged in medical specialties at HIV/AIDS prevention and control centers in plains, cities, and towns;
d) A 35% allowance applies to cadres and civil servants performing the following tasks:
- Directly engaged in medical specialties at provincial and district preventive healthcare centers, malaria, leprosy, tuberculosis, and mental health prevention and control centers, and commune health stations in mountainous, island, remote, and far-flung areas;
- Directly examining, treating, and caring for patients in specialty departments, institutes, and hospitals specializing in leprosy, tuberculosis, mental health, emergency care, intensive care, neonatal care, detoxification, radiotherapy;
- Directly engaged in pathological and forensic work.
đ) A 30% allowance applies to cadres and civil servants performing the following tasks:
- Directly engaged in medical specialties at provincial and district preventive healthcare centers, malaria, leprosy, tuberculosis, and mental health prevention and control centers in plains, cities, and towns;
- Directly examining, treating, and caring for patients in specialty departments, institutes, and hospitals specializing in pediatrics, burns, infectious diseases, and malaria;
- Directly engaged in medical specialties at district-level healthcare facilities in mountainous, island, remote, and far-flung areas.
e) A 25% allowance applies to cadres and civil servants performing the following tasks:
- Directly engaged in medical specialties at district and commune-level healthcare facilities in plains;
- Engaged in medical specialties in departments and offices responsible for protecting and maintaining the health of senior officials of the Party and State at central hospitals under the Ministry of Health and provinces and centrally-administered municipalities.
g) A 20% allowance applies to cadres and civil servants directly engaged in medical specialties at central, sectoral, provincial-level healthcare facilities in plains, cities, and towns, and urban district and town health stations and school health centers;
h) A 15% allowance applies to cadres and civil servants engaged in management and support services not directly engaged in medical specialties at HIV/AIDS, leprosy, tuberculosis, mental health, pathological, and forensic departments.
2. The occupational allowance rate is calculated based on the current grade salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).
Article 3. Source of Funds
The source of funds for paying occupational allowances for cadres and civil servants in the healthcare sector is allocated annually from the state budget according to the provisions of the State Budget Law assigned to the healthcare sector, and income from healthcare facilities operating under the financial regulations applicable to public service units.
Article 4. Effectiveness
l. This Decision takes effect 15 days after its publication in the Official Gazette.
2. Individuals who have been receiving special occupational allowances as specified in Decision No. 924/TTg dated December 13, 1996 of the Prime Minister on supplementing special occupational allowances for special professions for civil servants in the healthcare sector and as stipulated in Article 2 of Decision No. 97/QĐ-TTg dated June 26, 2001 of the Prime Minister on supplementing allowances for civil servants in the healthcare sector shall be entitled to such allowances from October 1, 2004.
3. This Decision replaces Decision No. 924/TTg dated December 13, 1996 of the Prime Minister on supplementing special occupational allowances for special professions for civil servants in the healthcare sector and Decision No. 97/2001/QĐ-TTg dated June 26, 2001 of the Prime Minister on supplementing allowances for civil servants in the healthcare sector.
Article 5. Guidance and Responsibility for Implementation
1. The Ministry of Health shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to guide the implementation of this Decision.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
