DECISION OF THE MINISTER OF TRANSPORT
Regarding specialized management of inland waterway transport on the Tien Yen River in Quang Ninh Province

THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;
Pursuant to Decision No. 1731/QD-PCVT dated July 10, 1997 of the Minister of Transport on announcing the list of rivers and canals under central management;
To be consistent with the economic development of Quang Ninh Province;
Considering the proposal of the Director of the Legal Affairs Department - Transport, the Director General of the Vietnam Maritime Administration; the Director General of the Vietnam Inland Waterways Administration;
DECISION:
Article 1.
Removing the Tien Yen River from the list of rivers and canals under central management issued together with Decision No. 1731/QD-PCVT dated July 10, 1997 of the Minister of Transport.
Article 2.
1. The section of the Tien Yen River from Mo Mouth to Mui Chua Port falls within the waters of Mui Chua Port and shall be managed by the Vietnam Maritime Administration according to the legal regime stipulated by the Vietnam Maritime Code.
2. The section of the Tien Yen River from 200 meters upstream of the Mui Chua Port wharf bridge to the town of Tien Yen shall be managed by the Quang Ninh Department of Transport according to the legal regime for inland waterways.
Article 3.
1. Transfer the entire section of the Tien Yen River from Mo Mouth to Mui Chua Port (including channels, navigation aids, assets, and personnel) from the Vietnam Inland Waterways Administration to the Vietnam Maritime Administration for management.
2. Transfer the entire section of the river from Mui Chua Port to the town of Tien Yen (including channels and navigation aids) from the Vietnam Inland Waterways Administration to the Quang Ninh Department of Transport for management.
Article 4.
1. This Decision shall take effect 15 days from the date of signature. Abolish Decision No. 3028/1999/QD/BGTVT dated November 1, 1999 of the Minister of Transport regarding the responsibility for managing the channel leading to Mui Chua Port in Quang Ninh.
2. The Heads of the Ministry's Office, Directors of relevant Departments under the Ministry of Transport, the Director General of the Vietnam Maritime Administration, the Director General of the Vietnam Inland Waterways Administration, the Director of the Quang Ninh Department of Transport, Heads of relevant agencies, units, and individuals shall be responsible for implementing this Decision./.
