DECREE
Regulations on functions, tasks, powers
and organizational structure of the Ministry of Education and Training
Pursuant to the Law on Government Organization No. 63/2025/QH15;
At the proposal of the Minister of Education and Training;
The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training.
Article 1. Position and Functions
The Ministry of Education and Training is an agency of the Government, performing the function of state management over preschool education, general education, vocational education, higher education, and continuing education; state management of the Vietnamese language and languages of ethnic groups; state management of public services within the scope of state management of the ministry.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Education and Training performs tasks and powers as prescribed by the Law on the Organization of the Government, regulations of the Government on functions, tasks, powers, and organizational structure of ministries, ministerial-level agencies, and specific tasks and powers as follows:
1. Submit to the Government draft laws, resolutions of the National Assembly, draft ordinances, resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government; draft decisions of the Prime Minister in fields under its state management according to the annual legislative program and plan already approved and other projects and programs assigned by the Government and the Prime Minister.
2. Submit to the Government, the Prime Minister or issue within its authority strategies, plans, projects, long-term, medium-term, and annual plans, national target programs, national programs, national action programs, and important national works under its state management as prescribed.
3. Issuing circulars, decisions, directives, and other documents within the scope of its state management.
4. Direct, guide, promote, disseminate, supervise the implementation, inspect, and organize the execution of normative legal documents, strategies, plans, programs, projects, and programs already approved under its state management.
5. Regarding educational goals, programs, and contents
a) Submit to the competent authority for issuance or issue within its authority documents stipulating, guiding the implementation, and managing uniformly educational goals, programs, and contents in the national education system as prescribed by law;
b) Specify standards, procedures for compiling, revising, and reviewing textbooks, teaching materials, and educational materials; specify standards, procedures for compiling, revising, and reviewing local educational materials; guide the selection of toys and learning materials used in preschool education facilities;
c) Submit to the Government for the regulation on free provision of textbooks to students; decide on a unified set of textbooks for general education nationwide;
d) Specify programs, contents, and organization of implementation of national defense and security education programs for learners from secondary school to university and in vocational education institutions;
đ) Specify contents and programs of environmental protection education and human resource development for environmental protection;
e) Issue within its authority or submit to the competent authority for issuance guidelines for developing open education systems, building a learning society, and promoting lifelong learning.
6. Serve as the focal point for the Government to implement state management over the Vietnamese language and languages of ethnic groups; issue within its authority or submit to the competent authority for issuance, guide and implement the development and preservation of the Vietnamese language and languages of ethnic groups as prescribed by law.
7. Regarding examinations, inspections, evaluations, admissions, training, recognition of learning outcomes, and diplomas, certificates
a) Submit to the competent authority for issuance or issue within its authority documents stipulating, guiding the implementation of examination, inspection, evaluation, admission, training, and recognition of learning outcomes, ensuring uniformity in the national education system;
b) Guide the management of diplomas and certificates and implement the recognition of diplomas issued by foreign educational institutions for use in Vietnam, certificates used in the national education system except where otherwise provided by specialized laws.
8. Regarding teachers, managers, and personnel in the sector
a) Submit to the competent authority for issuance or issue within its authority documents stipulating, guiding the implementation of teacher recruitment, utilization, job positions, titles, occupational standards, professional activities, working conditions, ethics, conduct rules, rights, and obligations of teachers, educational institution managers, educational support personnel, and other personnel in the national education system as prescribed by law;
b) Advise the Government on salary and benefits for teachers, educational managers, educational institution managers, educational support personnel, and other personnel in the national education system as prescribed by law.
9. Regarding student management and support
a) Submit to the competent authority for issuance or issue within its authority documents stipulating, guiding the implementation of student management in the national education system as prescribed by law and policies for students; commendation and disciplinary measures for students;
b) Guide and organize the implementation of school health work to ensure health care for students in schools and other educational institutions; comprehensive education and development of students in the national education system; prevention and control of accidents and injuries to students in schools and other educational institutions;
c) Specify, guide, and organize sports activities, sports movement development in schools.
10. Regarding public service facilities, educational infrastructure, and specialized equipment in the field of education and training: submit to the competent authority for issuance or issue within its authority documents stipulating, guiding, organizing the implementation of lists, standards, and criteria for educational infrastructure, libraries, classrooms, subject rooms, laboratories, practice facilities, construction serving educational activities, and educational equipment; standards and usage quotas for public service construction areas, specialized equipment in the field of education and training under its state management; guide, inspect the management, exploitation, use, arrangement, and disposal of public service facilities, infrastructure, and specialized equipment in educational institutions as prescribed by law.
11. Regarding financial management, state assets, public investment, construction investment, and bidding
a) Submit to or promulgate within its authority the regulations and guidelines on service fees for education in accordance with the Law on Prices and other relevant laws; economic and technical norms and financial mechanisms in the field of education in accordance with the division of authority and the provisions of the law;
b) Manage state finance, public assets, public investment, construction investment, and tendering in accordance with the provisions of the law; exercise the rights and responsibilities of the state owner towards enterprises in accordance with the provisions of the law; exercise the rights and responsibilities of the state owner's representative towards the state capital in enterprises in accordance with the law;
12. On ensuring and certifying educational quality
a) Issue within its authority or submit to the competent authority for issuance the regulations, guidelines, and organization of implementation for ensuring and certifying educational quality;
b) Build, manage, and supervise the system for ensuring educational quality in the national education system; manage activities of evaluating and certifying educational quality; exploit and utilize the results of evaluation and certification of educational quality to serve state management, supervision, and policy planning in education in accordance with the law;
c) Guide and organize the public disclosure of activities and accountability of educational institutions in accordance with the law;
13. On science, technology, innovation, and digital transformation in the education sector
a) Submit to the competent authority for issuance or issue within its authority the regulations, guidelines, mechanisms, and policies to promote scientific, technological, and innovative activities in educational institutions;
b) Guide and organize the implementation of scientific, technological, and innovative tasks in the education sector; guide and organize the implementation of comprehensive digital transformation, promoting the development and application of digital technology and artificial intelligence in the education sector;
c) Build, manage information systems, digital platforms, national databases, and specialized databases in accordance with the law;
14. Implement state management tasks related to statistics in the education sector. Issue, manage, and guide the uniform use of forms, documents, and ledgers in areas under the state management of the ministry in accordance with the law; implement reporting, statistical work, and archival storage of materials and data in areas under the state management of the ministry in accordance with the law;
15. On managing educational institutions and training
a) Submit to the competent authority for issuance or issue within its authority the regulations, guidelines, and organization of implementation for the charter, rules of organization and operation of educational institutions; establishment, recognition, restructuring, dissolution, conversion of type, renaming, and granting permission for educational activities of educational institutions in accordance with the law;
b) Decide on the establishment, restructuring, dissolution, and renaming of defense and security education centers in higher education institutions and vocational education institutions (excluding military schools);
c) Implement classification and ranking of educational institutions and public service units under its management in accordance with the law;
d) Perform the role of direct management agency for national universities and other public service units in accordance with the law; approve specific missions and development strategies of public higher education institutions directly under the ministry in accordance with the law;
16. On international cooperation and foreign investment in the education sector
a) Submit to the competent authority for issuance or issue within its authority the regulations, guidelines, and organization of implementation for cooperation, linkage training, and foreign investment in the education sector;
b) Propose the signing and implementation of international treaties and agreements on education within the scope of the ministry's state management; propose joining and participating in international organizations on education; be the national focal point of Vietnam in relations with international education organizations that Vietnam is a member of, as assigned by the Government and the Prime Minister;
c) Submit to the Government for issuance of regulations and guidelines on accepting training and managing foreigners studying at Vietnamese educational institutions in accordance with the law; management work for foreigners entering to manage, teach, conduct scientific research, and academic exchange at Vietnamese educational institutions; implement management over Vietnamese citizens studying, teaching, conducting scientific research, and academic exchange abroad within the scope of the ministry's state management on education;
17. On commendation and reward in the education sector
a) Submit to the competent authority for issuance or issue within its authority the regulations, guidelines, and organization of implementation for commendation and reward work in the education sector;
b) Guide commendation and reward work in educational institutions; organize mass movements and implement commendation and reward work in the education sector;
c) Guide and implement the honoring of teachers, and the awarding of titles of People's Teacher and Excellent Teacher in accordance with the law;
18. Decide and direct the implementation of the program for administrative reform of the ministry in accordance with the goals and content of the government's administrative reform program approved by the Government and the Prime Minister;
19. Manage associations, non-governmental organizations, and public services in areas under the ministry's state management in accordance with the law;
20. Manage organizational structure, job positions, staffing, civil servants, public officials, employees, and implement salary systems, benefits, rewards, disciplinary measures, professional training, and capacity building for civil servants, public officials, and employees under the ministry's management in accordance with the law;
21. Implement inspection, specialized inspection, handling complaints, accusations, suggestions, reflections, citizen reception, anti-corruption, thrift, and the handling of violations of the law in areas under the ministry's state management in accordance with the law;
22. Perform other tasks and powers delegated by the Government and the Prime Minister or as provided by law;
Article 3. Organizational Structure
1. Early Childhood Education Department.
2. The General Department of Primary and Secondary Education.
3. Higher Education Department.
4. National Defense and Security Education Department.
5. Students and Trainees Department.
6. Legal Affairs Department.
7. Cadre and Civil Servant Organization Department.
8. Planning and Finance Department.
9. Office.
10. Teachers and Educational Management Staff Administration Bureau.
11. Quality Management Bureau.
12. Science, Technology and Information Bureau.
13. International Cooperation Bureau.
14. Vocational and Continuing Education Bureau.
15. Education and Times Newspaper.
16. Education Strategy and Policy Institute.
The units specified from Clause 1 to Clause 14 of this Article are administrative organizations under the Ministry assisting the Minister in performing state management functions; the units specified in Clause 15 and Clause 16 of this Article are public service units serving the state management functions of the Ministry.
The Minister of Education and Training shall submit to the Prime Minister for issuance the list of other public service units directly under the Ministry.
The Minister of Education and Training shall issue a Decision stipulating the functions, tasks, powers, and organizational structure of units under and directly under the Ministry in accordance with the provisions of the law, except for units within the decision-making authority of the Government and the Prime Minister.
Article 4. Transitional Provisions
The Education Journal and the Vietnam Education Science Institute shall continue to perform their duties and powers as currently prescribed until the Minister of Education and Training's Decision on the functions, tasks, powers, and organizational structure of the Education Strategy and Policy Institute takes effect. The completion deadline is before August 1, 2026.
Article 5. Effective Date
1. This Decree shall take effect from July 12, 2026.
2. This Decree replaces Decree No. 37/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training.
Article 6. Responsibility for Implementation
The Minister of Education and Training, ministers, heads of ministerial-level agencies, and chairpersons of provincial and centrally-run city People's Committees are responsible for implementing this Decree.
