DECISION OF THE MINISTER OF FINANCE

Issuing the Schedule of Fees and Charges for Domain Name and Internet Address Licensing and Management

in Vietnam

THE MINISTER OF FINANCE

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 55/2001/ND-CP dated August 23, 2001 of the Government on management, provision, and use of Internet services;

After receiving comments from the Ministry of Posts and Telecommunications (in Circular No. 1112/BBCVT-KHTC dated June 11, 2004) and upon the proposal of the Director of the Tax Policy Department,

 DECISION:

Clause 4 of Article 6This Decision hereby promulgates the Schedule of Fees and Charges for Domain Name and Internet Address Licensing and Management in Vietnam.

Article 2. The entities subject to payment of fees and charges at the rates prescribed in Article 1 of this Decision are organizations and individuals within Vietnam and foreign organizations and individuals licensed and managed for domain names and Internet addresses in Vietnam as stipulated in Decree No. 55/2001/ND-CP dated August 23, 2001 of the Government on management, provision, and use of Internet services.

Article 3. The agency assigned by the Ministry of Posts and Telecommunications to manage state administration over the Internet in Vietnam shall be responsible for collecting, depositing, managing, and using fees and charges as prescribed in this Decision (hereinafter referred to as the collection agency). Fees and charges for licensing and managing domain names and Internet addresses in Vietnam are revenue under the state budget, which shall be managed and used as follows:

1. The collection agency is entitled to retain 90% (ninety percent) of the collected fees and charges before depositing them into the state budget to cover expenses for issuing and managing domain names and Internet addresses in Vietnam and for collecting fees and charges according to the provisions set forth in Point 4-b, Section C, Part III of Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges and the following items:

- Annual membership fees for international and regional organizations responsible for domain names, addresses, and Internet network numbers that Vietnam participates in;

- Participation in international meetings, seminars, and training sessions on the Internet where Vietnam must bear its own costs;

- Commission (if any) for organizations and individuals participating or acting as agents for issuing domain name licenses in Vietnam.

2. The collection agency is responsible for declaring, depositing, and settling 10% (ten percent) of the collected fees and charges into the state budget according to the current state budget classification and the provisions set forth in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance.

Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette. This Decision replaces Decision No. 84/2001/QD-BTC dated September 5, 2001 of the Minister of Finance promulgating the Schedule of Fees and Charges for Domain Name and Internet Address Licensing and Management in Vietnam. Other issues related to the collection, deposit, management, use, and public disclosure of fee and charge regimes not addressed in this Decision shall be implemented according to the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges.

Article 5. Organizations and individuals subject to payment of fees, the agency assigned by the Ministry of Posts and Telecommunications to manage state administration over the Internet in Vietnam, and relevant agencies are responsible for implementing this Decision.
