DECISION OF THE MINISTER OF AQUATIC RESOURCES

Regarding the Provisional Regulations on Principles for Allocating Central Budget Funds to Support Localities and Units for the 2006-2010 Plan to Implement Projects under the Aquaculture Development Program and the Aquatic Seed Development Program

To implement the Decree No. 43/2003/NĐ-CP dated May 3, 2003 of the Government on the tasks, powers, and organizational structure of the Ministry of Fisheries.

To implement Decision No. 224/1999/QĐ-TTg dated December 8, 1999 of the Prime Minister approving the Aquaculture Development Program for the period 1999-2010;

To implement Decision No. 112/2004/QĐ-TTg dated June 23, 2004 of the Prime Minister approving the Aquatic Seed Development Program until 2010;

Based on the Construction Law and current regulations on investment and construction;

At the proposal of the Director of the Department of Planning and Finance,

Issued herewith are the Provisional Regulations on Principles for Allocating Central Budget Funds to Support Localities and Units for the 2006-2010 Plan to Implement Projects under the Aquaculture Development Program and the Aquatic Seed Development Program.

The Heads of the Office of the Ministry, Heads of Departments, Inspectorates, subordinate units of the Ministry, Heads of Committees implementing the Aquaculture Development Program, Directors of Provincial Fisheries Services, Provincial Departments of Agriculture and Rural Development managing aquaculture, and Heads of related units shall be responsible for enforcing this decision.

Article 1. PROVISIONAL REGULATIONS ON PRINCIPLES FOR ALLOCATING CENTRAL BUDGET FUNDS TO SUPPORT LOCALITIES AND UNITS FOR THE 2006-2010 PLAN TO IMPLEMENT PROJECTS

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

AQUATIC SEED DEVELOPMENT PROGRAM

These regulations stipulate the necessary conditions for investment, mechanisms, and principles for allocating central budget funds to support projects for developing aquaculture and aquatic seed as per Decision No. 224/1999/QĐ-TTg and Decision No. 112/2004/QĐ-TTg of the Prime Minister.

Scope of Application:

These regulations apply to investment projects for developing aquaculture and aquatic seed managed and implemented by Ministries, sectors, provinces, and centrally-administered cities.

PART I

GENERAL PROVISIONS

Article 1. Scope of application

Purpose of Application:

Article 2. - To serve as a basis for reviewing and adjusting plans for developing aquaculture and aquatic seed.

- To serve as a basis for preparing, examining, approving, investing, and pre-investigation, during and post-investment supervision of projects and works serving aquaculture and aquatic seed.

- To serve as a basis for allocating annual investment support plans from the central budget from 2006 to 2010 for projects constructing concentrated aquaculture zones, concentrated seed production zones, and provincial aquatic seed centers managed by the fisheries sector.

SOURCES OF INVESTMENT, MECHANISMS, AND PRINCIPLES FOR ALLOCATING CENTRAL BUDGET FUNDS TO SUPPORT DEVELOPMENT OF AQUACULTURE

AND AQUATIC SEED

Investment sources for developing aquaculture and aquatic seed come from various sources. The central state budget will support investment in construction of works specified in Article 6 of these regulations for projects that align with local socio-economic development plans, industry development plans, and are approved by competent state authorities for the use of state budget funds.

Chapter II

Investment Works:

1. Investment in planning and reviewing adjustments to aquaculture and aquatic seed plans, construction of marine conservation areas, and inland aquatic species conservation areas.

2. Infrastructure works for concentrated aquaculture zones include zones for concentrated aquaculture and zones converted to aquaculture supported by central state budget investment, including: embankments, water intake and drainage structures, water supply and drainage channels, pumping stations, environmental treatment facilities (water supply and wastewater treatment areas), main roads, power lines to project areas, testing areas, testing equipment, aquatic quarantine facilities.

Article 4. 3. Aquatic seed investment works supported by the central budget include those specified in the standards for Class I Aquatic Seed Centers issued together with Decision No. 935/2001/QĐ-BTS dated November 12, 2001 of the Ministry of Fisheries.

Article 5. Hierarchical Management of Investment:

1. The Ministry of Fisheries directly manages:

a) Planning for the development of aquaculture and aquatic seed, production of key aquatic products across the country, ecological regions, and key economic zones.

b) Investment in construction of aquaculture zones for units directly under the Ministry of Fisheries, national aquatic seed centers mentioned in point a, Clause 1, Section II, Article 1 of Decision No. 112/2004/QĐ-TTg (including three national freshwater seed centers, three national marine seed centers in the North, Central, and South regions), concentrated seed production zones with large seed yields over 500 million Penaeus monodon seeds, 5 million marine fish seeds at 25 days old, and 200 million Tra and Basa fish eggs.

Article 6. c) Investment in construction and equipping modern laboratories for genetic breeding selection, molecular biology analysis, environmental research, and disease diagnosis for the Institute of Aquaculture I, II, III, and some specialized training schools.

2. Ministries, sectors, provinces, and centrally-administered cities directly manage:

a) Investment in infrastructure construction of works specified in Article 5 of these regulations for Class I aquatic seed centers named in point b, Clause 1, Section II, Article 1 and provincial aquatic seed centers mentioned in point c, Clause 1, Section II, Article 1 of Decision No. 112/2004/QĐ-TTg dated June 23, 2004;

b) Investment in construction of components of concentrated aquaculture zone projects specified in point 2, Article 5 of these regulations.

c) Investment in concentrated seed production zones not directly managed by the Ministry of Fisheries.

Principles for Allocating Central Budget Funds to Support Investment in Aquaculture and Aquatic Seed Projects:

a) Investment in infrastructure construction for the works specified in Article 5 of this Regulation for Level I Aquatic Seed Centers named in Point b, Clause 1, Section II, Article 1 and aquatic seed centers of the provinces named in Point c, Clause 1, Section II, Article 1 Decision No. 112/2004/QĐ-TTg dated June 23, 2004;

b) Investment in construction of project components in the concentrated aquaculture production area specified in Point 2, Article 5 of this Regulation.

c) Investment in centralized breeding production areas managed by the Ministry of Fisheries but not directly overseen.

Article 7. Principles for allocating central budget funds to support investment in aquaculture and aquatic seed projects:

a) Investment projects must be located within the national socio-economic development plan, regional plans, and provincial plans, and must align with approved industry development plans according to their respective authorities.

b) Capital allocation must ensure the implementation of objectives for concentrated aquaculture production zones, concentrated aquatic seed production zones, and aquatic seed centers as stipulated in the investment project; it must also guarantee the achievement of targets set out in programs approved by the Prime Minister, ensuring efficient, focused investment without dispersion, and ensuring that the implementation period for Group B projects does not exceed four years and for Group C projects does not exceed two years.

c) The investment project must have been approved by the competent authority before October 31 of the year preceding the planning year.

d) Central budget funds will be concentrated on investing in National Seed Centers in the three regions of North, Central, and South. Regions with advantages in developing aquatic seed, areas focusing on key species with high aquaculture yields serving export processing (the Mekong Delta, the South Central Coast), will also be prioritized.

e) Priority will be given to capital support for projects in mountainous provinces, ethnic minority regions, island areas, and economically disadvantaged regions with low initial revenue and tax income levels, aiming to eradicate poverty.

f) Budget funds will be allocated to support projects to successfully implement resolutions of the Politburo and decisions of the Prime Minister regarding the Government's action program for socio-economic development and national defense security in various regions.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Responsibilities for Implementation:

1. The Ministry of Fisheries shall instruct the Department of Planning and Finance to coordinate with the Steering Committee for the Aquaculture Development Program to guide, monitor, inspect, and periodically report to the Minister on the implementation of investments in aquaculture zones, concentrated aquatic seed production zones, and aquatic seed centers as prescribed.

2. Provincial People's Committees shall direct the Fisheries Departments and Agriculture and Rural Development Departments to select projects in accordance with the plans and decide on investments in concentrated aquaculture zones, concentrated aquatic seed production zones, and aquatic seed centers within their jurisdictions in accordance with current regulations on basic construction investment.

Article 9. Responsibilities of the Project Proponent:

Project proponents shall base their selection of the scale and location of investment projects for aquaculture zones, concentrated aquatic seed production zones, and aquatic seed centers on current State regulations on construction investment and the principles of capital allocation set forth herein, submit these projects for approval by the competent authority, and organize the implementation of the investment projects for aquatic works in accordance with schedules and achieve efficiency.
