Guidelines for implementing wage systems and allowances for workers, employees, and officials constructing five hydropower projects

Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government on the wage scale, salary table, and allowance system in state-owned enterprises, and Circular No. 3657/VPCP-VX dated July 1, 2005 of the Government Office, the Ministry of Labour, Invalids and Social Affairs hereby provides guidelines for implementing wage systems and allowances for workers, employees, and officials constructing five hydropower projects as follows:

I. SCOPE AND APPLICABLE SUBJECTS

Article 1. Scope of Application:

The scope of application includes workers, employees, and officials directly involved in constructing the following hydropower projects:

a) Son La Hydropower Project located in Son La Province;

b) A. Vuong Hydropower Project located in Quang Nam Province;

c) Buon Kup Hydropower Project located in Dak Lak Province;

d) Pleikuong Hydropower Project located in Kon Tum Province;

e) Ban La Hydropower Project (now Ban Ve) located in Nghe An Province.

a) Workers, employees, and officials directly involved in constructing the project;

b) Workers, employees, and officials under the Project Management Board directly involved in constructing the project;

c) Workers, employees, and officials providing consultancy and design services directly working at the project site;

d) Workers, employees, and officials directly involved in surveying to serve the technical design of the project.

The subjects mentioned in points c and d above shall not apply to those receiving attraction allowances and hazardous work allowances as agreed upon in Circular No. 2807/LDTBXH-TL dated August 29, 2005 of the Ministry of Labour, Invalids and Social Affairs regarding the allowance system for workers and officials involved in surveying electrical works.

II. APPLIED REGIME:

1. Wage and Allowance System:

a) Minimum Wage:

- Prior to October 1, 2005, the general minimum wage of 290,000 VND/month as stipulated in Decree No. 203/2004/NĐ-CP dated December 14, 2004 shall be applied;

- From October 1, 2005 onwards, the minimum wage of 350,000 VND/month as stipulated in Decree No. 118/2005/NĐ-CP dated September 15, 2005 shall be applied.

b) Job Grade Salary:

- Job grade: determined according to specific tasks based on the basic construction cost estimate issued by the Ministry of Construction;

- Job grade salary: calculated according to the corresponding job grade salary coefficient of each specific task based on the aforementioned estimate.

c) Allowance System:

- Regional allowance: If the construction project or its component lies within a certain administrative area (district, commune), the regional allowance rate applicable to that area shall be applied;

- Attraction allowance: applied at 30% of the job grade salary, position salary, or specialized salary;

- Mobility allowance: applied at 0.4 times the general minimum wage.

d) Job grade salary and allowances as specified in points b and c above shall be calculated as follows:

- For construction work volume completed before October 1, 2004, including wages and allowances for workers, employees, and officials involved in surveying, designing, and consulting, the A6 wage scale, Group IV issued with Decree No. 26/CP dated May 23, 1993 shall be applied; allowance systems according to Joint Circular No. 03/2001/TTLT-BLDTXH-BTC-UBDTMN dated January 18, 2001 guiding the implementation of regional allowances; Circulars No. 16/LDTXH-TT and 19/LDTXH-TT dated June 2, 1993 guiding the implementation of attraction allowances and mobility allowances.

- For construction work volume carried out from October 1, 2004 onwards, including wages and allowances for workers, employees, and officials involved in surveying, designing, and consulting, the A.1.8 wage scale, Group III issued with Decree No. 205/2004/NĐ-CP dated December 14, 2004 shall be applied; allowance systems according to Joint Circulars No. 10/2005/TTLT-BNV-BLDTXH-BTC and 11/2005/TTLT-BNV-BLDTXH-BTC-UBDT dated January 5, 2005 guiding the implementation of attraction allowances and regional allowances; Circular No. 05/2005/TT-BLDTXH dated January 5, 2005 guiding the implementation of mobility allowances in state-owned enterprises.

2. Unstable Production Coefficient: Applied at 15% of job grade salary, position salary, or specialized salary.

3. Midday Meal System:Applied at 5,000 VND/person/day. The organization and implementation of midday meals shall follow the provisions of Circular No. 15/1999/TT-BLDTXH dated June 22, 1999 guiding the implementation of midday meal systems for workers and officials working in state-owned enterprises.

III. IMPLEMENTATION:

a) The Health Insurance Fund;

a) The provisions set forth in points 1, 2, and 3, Section II of this Circular shall apply to workers, employees, and officials engaged in construction work included in the labor cost in the construction estimate;

b) The provisions set forth in points 1, 2, and 3, Section II of this Circular shall apply to workers, employees, and officials involved in surveying, designing, and consulting services directly working at the project site included in the labor cost in the consultancy design cost estimate;

c) Midday meal costs shall be included in the project estimate but not in the labor cost;

d) Additional funds required to implement the provisions set forth in Section II of this Circular shall be sourced from the contingency fund of the project.

2. Responsibilities of Vietnam Electricity Corporation (Project Owner):

a) Based on the quantity determined according to the technical design or construction drawings or the work requirements of the project; the applicable regimes stipulated in Section II of this Circular and Circulars guiding the preparation and management of project investment construction cost estimates to calculate labor costs in the project estimate.

b) Based on the quantity of work completed and accepted, and the unit price of wages and midday meals included in the estimate, temporarily advance and settle payments to the construction units.

3. Construction units shall base their payment to workers on the completed work volume, unit prices of wages and midday meals included in the project estimate already advanced or settled by the owner, ensuring timely, full payment linked to productivity, workload, quality, and progress of the project.

4. The Ministry of Industry shall examine the Project Owner's application of the regimes prescribed in Section II of this Circular to the unit prices and project estimates.

5. The Ministry of Construction shall examine the construction units' implementation of the regimes stipulated in this Circular.

IV. EFFECTIVE IMPLEMENTATION:

This Circular takes effect fifteen days after its publication in the Official Gazette.

The regimes prescribed in this Circular shall be implemented from the commencement of the construction works until their completion.

In the course of implementation, if there are any difficulties, the Ministries and enterprises are requested to report them to the Ministry of Labor - Invalids and Social Affairs for study and resolution./.
