Regulations on training and issuing certificates for educational management vocational training

Pursuant to the Education Law on June 14, 2005; the Law Amending and Supplementing Certain Articles of the Education Law on November 25, 2009;
Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law and Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and implementing certain provisions of the Education Law;
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
At the proposal of the Director of the General Department of Teachers and Educational Management Staff;
The Minister of Education and Training issues this Circular prescribing regulations on training and issuing certificates for educational management vocational training (hereinafter referred to as training), including: conditions, authority, files, procedures, and processes for assigning training tasks; organizing training, examination, classification, and issuing training certificates.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability

This Circular applies to educational institutions, including teacher training schools, higher education institutions with departments or majors in educational management, and educational institutions assigned tasks for educational management vocational training.

a) This Circular applies to managers at preschool, primary, secondary, and continuing education institutions, managers of departments and offices in higher education institutions, managers of provincial education and training departments, district education and training offices, civil servants and employees who have been planned for managerial positions (hereinafter referred to as managers) and related organizations and individuals.
1. Initial, mandatory, and minimum knowledge about management practices, methods, and skills for managers to meet the criteria for appointment to educational management positions.
Article 3. Purpose of Capacity Building
2. Updating knowledge on politics, economy-society, specialized subjects, and vocational training; enhancing leadership and management skills in education to improve political quality, professional ethics, and the effectiveness of educational management work to meet the requirements of educational development.
Article 3. Subjects of training for educational institutions
1. Managers specified in point b, Clause 2, Article 1 of this Circular are the subjects of training for teacher training universities, universities, academies, and universities with departments or majors in educational management.
2. Managers of secondary, elementary, and preschool educational institutions are the subjects of training for teacher training colleges.
3. The subjects of training for other educational institutions shall be determined based on their functions and tasks as recorded in their establishment decisions.
In this Circular, the term "managers" is understood as follows:
Article 4. Definitions
1. Principals and vice-principals of general education and preschool schools.
2. Directors and deputy directors of continuing education institutions.
3. Principals and vice-principals, department heads, and deputy department heads in vocational secondary education institutions.
4. Department heads and deputy department heads, and office heads in higher education institutions.
5. Office heads and deputy office heads in provincial education and training departments; district and county education and training office heads and deputy heads.
6. Civil servants and employees who have been planned for managerial positions as specified in Clauses 1, 2, 3, 4, and 5 of this Article.
6. Civil servants and officials who have been planned as sources for the managerial positions specified in Clauses 1, 2, 3, 4, and 5 of this Article.
Chapter II
CONDITIONS, AUTHORITY, FILE, PROCEDURE, AND PROCEDURES FOR ASSIGNING TRAINING TASKS
ASSIGNING TRAINING TASKS
Article 5. Conditions for educational institutions to be assigned training tasks
1. Having sufficient full-time lecturers to teach at least 70% of the training program's workload, including at least four lecturers with a master’s degree in education management (for training targets being middle school, primary school, and kindergarten managers) and at least one lecturer with a doctoral degree and three lecturers with a master’s degree in education management (for training targets specified in Clause 1, Article 3 of this Circular)..
2. Having a team of invited lecturers and speakers who participate in teaching or assisting in teaching, consisting of experienced scientists in training work; managers from educational administration agencies and educational institutions.
3. Applying the training program for educational management staff issued by the Minister of Education and Training and developing, updating contents to meet requirements and suit the characteristics of the school and locality.
4. Having material facilities and equipment to ensure the training requirements, including:
a) Having sufficient classrooms, functional rooms, and necessary equipment to meet teaching and learning requirements for each training course;
b) The library having a room for information search, software, and equipment for document search; having adequate sources of information materials: books, textbooks, lectures, related documents serving the training work;
c) The school's electronic information website being updated regularly, publicly announcing quality training and development commitments, publicly disclosing quality assurance conditions, and financial income and expenditure.
5. Having a specialized unit organizing and managing the training process, meeting professional management requirements for training work.
6. Regularly or periodically sending school lecturers to practical education in localities to supplement knowledge and practical experience in education.
Article 6. Authority, file, procedure, and procedures for assigning training tasks
1. The Minister of Education and Training issues a decision to assign training tasks to educational institutions.
2. The registration file for training tasks includes:
a) A letter registering training tasks from the educational institution;
b) The registered training task proposal (Annex I);
c) Supporting documents and evidence, including:
- Scientific curriculum vitae of lecturers and speakers (Annex II);
- Training plan: organization form of training; total training time for the entire course; training period; plan for sending school lecturers to practical education in localities on a regular basis to supplement practical education knowledge;
- Some basic training textbooks and materials to be used in the training program;
- The developed and updated training program and materials to meet requirements and suit the characteristics of the school and locality.
The file is established in one copy.
3. Procedure and procedures for assigning training tasks are as follows:
a) Educational institutions specified in point a, Clause 2, Article 1 of this Circular send the file to the Department of Education and Training where the educational institution is located, requesting on-site inspection and confirmation of conditions ensuring training work;
b) The Department of Education and Training conducts inspections and confirms the conditions ensuring training work as stipulated in Article 5 of this Circular;
Within 15 working days from the date of receiving complete valid files, the Director of the Department of Education and Training issues a decision to establish an inspection team. The inspection team consists of: 1 leader of the Department as Team Leader, 1 leader of the Personnel Organization Department, 1 leader of the Planning and Finance Department, 1 leader of the Professional Education/Continuing Education Department, 1 personnel officer of the Personnel Organization Department as secretary.
The inspection team conducts verification of the contents declared in the file against actual conditions such as salary sheets, social insurance books, certificates of lecturers, equipment, libraries, and prepares an inspection report (Annex III);
The inspection team is responsible for the accuracy of the inspection contents. Within seven working days after the on-site inspection, the Department of Education and Training responds to the educational institution about the review results.
c) The educational institution directly submits or sends by post the confirmed file to the Ministry of Education and Training;
d) Within 30 working days from the date of receiving complete valid files, the Ministry of Education and Training reviews the file and the conditions for registering training tasks as stipulated in Article 5 of this Circular. In case the educational institution meets all conditions, the Ministry of Education and Training will issue a decision to assign training tasks. In case the educational institution does not meet the prescribed conditions, the Ministry of Education and Training will notify the review results and specify the reasons in writing.
4. Educational institutions with functions and responsibilities to train education management majors at bachelor level and above, if they wish to undertake training tasks, do not need to develop proposals, only conduct reviews according to the conditions stipulated in Article 5, and report to the Ministry of Education and Training for consideration and decision.
5. In cases deemed necessary, the Ministry of Education and Training may organize pre-inspections before making decisions.
Chapter III
ORGANIZING TRAINING, GRADING, INSPECTION, AND ISSUING CERTIFICATES
Article 7. Training Program and Duration
1. The training program shall be implemented according to the training program for education management officials issued by the Minister of Education and Training.
2. Duration of training: 360 hours
Article 8. Forms of Organizing Training
Depending on the actual conditions of the educational institution undertaking the training (hereinafter referred to as the training institution) and the needs of the trainees, the training institution has the right to independently choose one of the following two forms:
1. Concentrated training: attending classes at the training institution for 8 weeks (315 hours); the remaining 4 weeks (45 hours) will be spent on practical work and writing a term paper at the local level; evaluating the term paper and concluding the course at the training institution.
2. Semi-concentrated training (part-time): trainees must ensure all contents and training hours as in the concentrated form, but the total duration of training shall not exceed 20 weeks.
Article 9. Examination and Evaluation of Training Results
1. At the end of each module of the training program, trainees must complete a written test lasting a minimum of 60 minutes. The test will be scored out of 10 points.
2. Trainees who participate in at least 80% of the training program's duration specified for each module may take the final module examination. Trainees who achieve a score of 5 points or higher in all final module examinations are eligible to write a final term paper.
3. The final term paper must apply knowledge learned to solve practical problems at their current workplace (with comments from the direct supervising authority). The final term paper will be evaluated out of 10 points.
Article 10. Classification of Training Results
1. The classification score for training results is the average of scores from all modules and the final term paper, rounded to one decimal place.
Example: Trainee A has module scores sequentially as follows: 5.0; 6.0; 6.5; 8.0; 9.0 and a final term paper score of 9.5, then the classification score for training results is: (5.0 + 6.0 + 6.5 + 8.0 + 9.0 + 9.5) : 6 = 44 : 6 = 7.33, rounded to 7.3.
2. Classification of training results.
a) Average: classification score reaches from 5 points to below 7 points;
b) Good: classification score reaches from 7 points to below 9 points (no score below 6);
c) Excellent: classification score reaches from 9 points to 10 points (no score below 7).
3. Trainees will not be recognized as having completed the training program if the classification score is below 5 points or if they have not met the required number of module scores and term paper scores as stipulated.
Article 11. Issuance of Training Certificates
1. Trainees will be issued a training certificate upon completion of the program and achieving a classification score as prescribed in Clause 1, Article 10 of 5 points or higher.
2. Training institutions issue certificates to trainees meeting the conditions stipulated in Clause 1 of this Article.
3. Management and issuance of training certificates shall be carried out in accordance with Decision No. 33/2007/QD-BGDĐT dated June 20, 2007, of the Minister of Education and Training promulgating the Regulations on Diplomas and Certificates of the National Education System, and Decision No. 34/2008/QD-BGDĐT dated July 10, 2008, of the Minister of Education and Training promulgating the model certificates of the National Education System.
Article 12. Training Expenses
1. Training expenses for educational management include:
a) State budget allocated for regular training and development within the sector and localities;
b) Expenses from units sending personnel for training;
c) Funds from other legitimate sources of support.
2. Annually, the training institution must report on the settlement of training expenses according to current regulations.
Chapter IV
IMPLEMENTATION
Article 13. Responsibilities of Units under the Ministry of Education and Training
1. The Department of Teachers and Educational Management Staff
a) Take the lead and coordinate with functional units under the Ministry to review applications and conditions for training tasks, and submit to the Minister for decision on assigning training tasks to educational institutions applying for such tasks;
b) Take the lead and coordinate with functional units under the Ministry to inspect and supervise training activities.
2. Other units under the Ministry
a) The Inspectorate General of the Ministry shall take the lead in inspecting training activities;
b) Other units under the Ministry shall cooperate in reviewing applications and conditions for training tasks, conducting inspections and checks to ensure quality and effectiveness of training activities.
Article 14. Responsibilities of the Department of Education and Training
1. Inspect and confirm the conditions for ensuring training work of the training institution as stipulated in Clause 2, Article 6 of Circular No. 08/2011/TT-BGDĐT dated February 11, 2011 of the Minister of Education and Training on Conditions, Application Forms, and Procedures for Opening Academic Programs, Suspension of Admissions, and Revocation of Decisions to Open Academic Programs at University and College Levels (using Appendix III attached to this Circular).
2. Annually, develop plans for training of provincial education and training departments, directly subordinate educational institutions, and consolidate plans for training of district education and training departments and educational institutions under the People's Committees of districts for monitoring and overall regulation.
3. Coordinate with training institutions to effectively implement training activities.
4. Be subject to inspection and audit by the Ministry of Education and Training and competent authorities regarding responsibilities for managing and directing training activities of training institutions under their jurisdiction.
Article 15. Responsibilities of Agencies and Units with Trainees Participating in Training
Annually, develop plans for training managerial staff of agencies and units as specified in Point b, Clause 2, Article 1, report to the direct supervisory agency (for agencies and units directly subordinate to provincial education and training departments, district education and training departments), in accordance with their functions and responsibilities, and coordinate with training institutions to organize training according to the plan.
Article 16. Responsibilities of Training Institutions
1. Bear full responsibility for training activities.
2. Coordinate with provincial education and training departments and agencies and units with trainees participating in training to develop class schedules and implement activities to ensure the quality of training work.
3. Be subject to inspection and audit by the Ministry of Education and Training and competent authorities.
Article 17. Handling Violations
1. Based on the level of violation, the Minister of Education and Training shall issue a decision to suspend or revoke the decision allowing the performance of training tasks for the training institution as prescribed in Article 6 of Decree No. 138/2013/NĐ-CP dated October 22, 2013 of the Government on Administrative Penalties in the Field of Education.
2. Organizations or individuals violating the provisions of this Circular shall be disciplined, administratively penalized, or criminally prosecuted depending on the severity, and if the violation causes damage, they must compensate according to the law.
Article 18. Information and Reporting System
After the completion of each training session, the training institution sends statistical results, reports on organizational activities and outcomes of the training work to the Ministry of Education and Training and direct supervisory agencies.
Article 19. Effective Date
This Circular takes effect from October 10, 2014.
