Regulations on land statistics, inventory, and creation of current land use maps

Pursuant to the Law on Statistics dated June 26, 2003;

The Government issues this Decree on management and development of industrial clusters.

Pursuant to the Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

Pursuant to Decree No. 43/2014/NĐ-CP dated May 15, 2014 of the Government detailing implementation of certain provisions of the Land Law;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director General of the Land Administration General Department and the Head of the Legal Department,

The Minister of Natural Resources and Environment issues this Circular regulating land statistics, inventory, and creation of current land use maps.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular stipulates the time frame for implementation, indicators, forms, contents, methods, procedures, inspection, submission, storage of results of periodic land statistics and inventory, and creation of current land use maps at the national level; provincial and centrally governed cities; districts, towns, and provincial-level cities; communes, wards, and towns.

2. Specialized land inventory to serve management requirements shall be carried out according to the Prime Minister's decision and the Minister of Natural Resources and Environment's decision.

Article 2. Applicability

1. State management agencies, specialized agencies on natural resources and environment at all levels; land administration officials at commune, ward, and town levels (hereinafter referred to collectively as commune-level land administration officials).

2. Land users, those entrusted by the State to manage land, and other organizations and individuals related to the implementation of land statistics, inventory, and creation of current land use maps.

Article 3. Purpose of land statistics and inventory

1. To assess the current land use status and provide a basis for effective land management and utilization.

2. To provide information, data, and materials as a basis for planning and adjusting land use plans.

3. To provide a basis for proposing adjustments to land policies and laws.

4. To provide data for compiling statistical yearbooks at various levels and to meet the information needs of economic, social activities, national defense, security, scientific research, education and training, and other state and societal needs.

Article 4. Principles for implementing land statistics, inventory, and creation of current land use maps

1. Types of land, land users, and land managers are inventoried based on the actual land use status at the time of inventory.

In cases where there are decisions on land allocation, land leasing, or land use purpose conversion but these have not been implemented at the time of inventory, they should be inventoried based on the current use status; simultaneously, separate inventories must be made according to the unimplemented land allocation, leasing, or use purpose conversion decisions for monitoring and management purposes.

In cases where the current land use purpose has changed from that recorded in the land registry, the inventory should reflect the current use status, while also including additional inventories of self-conversion of land use purposes.

2. For lands used for multiple purposes, in addition to inventorying based on the primary land use purpose, additional inventories should be made for combined uses with other purposes. The primary land use purpose is determined according to Article 11 of the Land Law and Article 3 of Decree No. 43/2014/NĐ-CP issued May 15, 2014, detailing certain provisions of the Land Law. 3. Land inventory data and current land use map data are compiled uniformly from maps used for investigation and delineation of each type of land for each type of land user and land manager entrusted by the State (hereinafter referred to as investigation and inventory result maps) as stipulated in this Circular.

Land statistics data are compiled based on the consolidation of land use changes during the statistical year from land records and other relevant land-related documents, consistent with actual land use, to adjust previous statistical and inventory data.

4. The area of delineated land on commune-level investigation and inventory result land maps is calculated in square meters (m

); land statistics and inventory data are expressed in hectares (ha); figures are rounded to two decimal places (0.01ha) for commune level; to one decimal place (0.1ha) for district level; and to whole hectares (1ha) for provincial and national levels.²; land statistics data on land inventory tables shall be expressed in hectares (ha); for commune level, it shall be rounded to two decimal places (0.01 ha); for district level, it shall be rounded to one decimal place (0.1 ha); for provincial and national levels, it shall be rounded to one whole hectare.

Article 5. Time of Implementation and Submission of Land Statistics Report Results

1. The time for annual land statistics shall be counted up to December 31 of each year (except for the year of land inventory).

2. The time for completion and submission of the annual land statistics report results shall be as follows:

a) The People's Committee of communes, wards, towns (hereinafter referred to as the People's Committee at the commune level) shall complete and submit the report results to the People's Committee of districts, cities under provinces, provincial cities (hereinafter referred to as the People's Committee at the district level) before February 1 of the following year;

b) The People's Committee at the district level shall complete and submit the report results to the People's Committee of provinces, centrally-administered municipalities (hereinafter referred to as the People's Committee at the provincial level) before February 16 of the following year;

c) The People's Committee at the provincial level shall complete and submit the report results to the Ministry of Natural Resources and Environment before March 1 of the following year;

d) The Ministry of Natural Resources and Environment shall complete and report the results to the Prime Minister before March 31 of the following year.

Article 6. Time of Implementation and Submission of Land Inventory Report Results and Current Land Use Map

1. The time for land inventory and current land use map preparation every five years shall be counted up to December 31 of the year ending in 4 and 9.

2. The time for completion and submission of the land inventory report results and current land use map every five years shall be as follows:

a) The People's Committee at the commune level shall complete and submit the report results to the People's Committee at the district level before June 1 of the following year;

b) The People's Committee at the district level shall complete and submit the report results to the People's Committee at the provincial level before July 15 of the following year;

c) The People's Committee at the provincial level shall complete and submit the report results to the Ministry of Natural Resources and Environment before September 1 of the following year;

d) The Ministry of Natural Resources and Environment shall complete and submit the report results to the Prime Minister before November 1 of the following year.

Article 7. Responsibilities for Implementation, Approval Authority, and Announcement of Land Statistics Results

1. Commune-level land statistics shall be organized and implemented by the People's Committee at the commune level; the commune-level land management civil servant shall assist the People's Committee at the commune level in implementation and sign confirmation on land statistics forms; the Chairman of the People's Committee at the commune level shall approve the land statistics forms and submit the land statistics report results to the People's Committee at the district level.

2. District-level land statistics shall be assisted by the Department of Natural Resources and Environment in implementing the People's Committee at the district level; the Director of the Department of Natural Resources and Environment shall sign confirmation on land statistics forms; the Chairman of the People's Committee at the district level shall approve land statistics form number 01/TKDD and sign the land statistics report results submitted to the People's Committee at the provincial level.

3. Provincial-level land statistics shall be organized and implemented with assistance from the Department of Natural Resources and Environment for the People's Committee at the provincial level; the Director of the Department of Natural Resources and Environment shall sign confirmation on land statistics forms; the Chairman of the People's Committee at the provincial level shall approve land statistics form number 01/TKDD and submit the land statistics report results to the Ministry of Natural Resources and Environment.

4. National land statistics shall be implemented with assistance from the General Department of Land Management for the Minister of Natural Resources and Environment; the Director of the General Department of Land Management shall sign confirmation on land statistics forms; the Minister of Natural Resources and Environment shall sign the national land statistics report results submitted to the Prime Minister, decide to announce the national land statistics results.

Article 8. Responsibilities for implementation, authority to approve and announce the results of land inventory and current land use map compilation

1. The land inventory and current land use map compilation at the commune level shall be organized and implemented by the People's Committee of the commune; the commune-level land management officer shall assist the People's Committee of the commune in implementing and signing off on the land inventory forms and current land use maps; the Chairman of the People's Committee of the commune shall approve the land inventory forms and current land use maps and report the results of the land inventory to the People's Committee of the district.

2. The land inventory and current land use map compilation at the district level shall be assisted by the Department of Natural Resources and Environment in implementing under the direction of the People's Committee of the district; the Director of the Department of Natural Resources and Environment shall sign off on the land inventory forms and current land use maps; the Chairman of the People's Committee of the district shall approve the land inventory form number 01/TKDD and the current land use map and report the results of the land inventory to the People's Committee of the province.

3. The land inventory and current land use map compilation at the provincial level shall be organized and implemented with assistance from the Department of Natural Resources and Environment under the direction of the People's Committee of the province; the Director of the Department of Natural Resources and Environment shall sign off on the land inventory forms and current land use maps; the Chairman of the People's Committee of the province shall approve the land inventory form number 01/TKDD and the current land use map and report the results of the land inventory to the Ministry of Natural Resources and Environment.

4. The national land inventory and current land use map compilation shall be carried out with assistance from the National Land Management Agency under the direction of the Minister of Natural Resources and Environment; the Director of the National Land Management Agency shall sign off on the land inventory forms and current land use maps; the Minister of Natural Resources and Environment shall submit the report on the results of the national land inventory to the Prime Minister, and issue a decision to announce the results of the national land inventory.

5. The People's Committee of the province shall decide based on the actual situation of the locality to hire consulting units to carry out the land inventory and current land use map compilation throughout the province or within each administrative unit at the district level to ensure quality requirements and implementation timeframes according to this Circular. The National Land Management Agency may hire consulting units to perform specific tasks during the process of carrying out the land inventory and current land use map compilation.

Chapter II
SYSTEM OF INDICATORS AND STATISTICAL FORMS

FOR LAND INVENTORY

Article 9. Indicators for statistics and land inventory by type of land

The indicators for land statistics and inventory are classified according to land use purposes and are divided from general to detailed as follows:

1. Agricultural land group, including:

a) Agricultural production land comprising annual crop land and perennial crop land;

Annual crop land includes types such as paddy field land (including dedicated paddy fields, remaining paddy fields, and upland paddy fields); other annual crop land (including flat land for other annual crops and upland-rubber land for other annual crops).

b) Forestry land comprising productive forest land, protective forest land, and special-use forest land;

c) Aquaculture land;

d) Salt-making land;

đ) Other agricultural land.

2. Non-agricultural land group, including:

a) Residential land comprising rural residential land and urban residential land;

b) Land for building government offices;

c) Defense land;

d) Security land;

đ) Land for construction of public works comprising land for building organizational public facilities; cultural facility land; social service facility land; medical facility land; educational and training facility land; sports and physical education facility land; scientific and technological facility land; diplomatic facility land; and other public works land;

e) Non-agricultural production and business land comprising industrial zone land; industrial cluster land; export processing zone land; commercial and service land; non-agricultural production facility land; land for mineral activities; construction material and pottery production land;

g) Public purpose land comprising transportation land; water conservancy land; historical-cultural relic land; scenic spot land; community activity land; public entertainment land; energy project land; postal and telecommunications project land; market land; waste disposal land; and other public facility land;

h) Religious facility land;

i) Belief facility land;

k) Cemetery, graveyard, funeral home, crematorium land;

l) River, stream, canal, creek, brook land;

m) Dedicated water body land;

n) Other non-agricultural land.

3. Unused land group comprising flat unused land; hill and mountain unused land; barren rock without trees.

4. The explanation of how to determine each type of land is carried out according to Appendix No. 01 attached to this Circular.

Article 10. Statistical and inventory indicators for land objects regarding types of land users and types of entities managed by the State

1. Statistical and inventory indicators for land objects regarding types of land users include:

a) Households and individuals within the country;

b) Domestic organizations including:

- Economic organizations comprising enterprises and cooperatives;

- State agencies including state agencies (including People's Committees at commune level); political organizations, political-social organizations; defense and security units;

- Public service organizations comprising units established by competent state agencies, political organizations, political-social organizations with functions to provide public services as prescribed by law;

- Other organizations comprising social organizations, social-professional organizations, other organizations (excluding state agencies, public service organizations, economic organizations);

c) Foreign organizations including:

- Foreign-invested enterprises comprising wholly foreign-owned enterprises, joint ventures, Vietnamese enterprises where foreign investors hold shares, mergers, acquisitions according to laws on investment;

- Foreign organizations with diplomatic functions comprising diplomatic missions, consular offices, other foreign representative offices with diplomatic functions recognized by the Government of Vietnam; representative offices of United Nations organizations, intergovernmental organizations, representative offices of intergovernmental organizations;

d) Overseas Vietnamese including overseas Vietnamese owning houses attached to residential land rights; enterprises of overseas Vietnamese or joint ventures between overseas Vietnamese and domestic economic organizations, individuals; overseas Vietnamese enterprises receiving capital contributions through land use rights of domestic organizations, individuals to implement investment projects in Vietnam;

đ) Community residents and religious institutions including:

- Community residents comprising communities of Vietnamese living in the same village, town, ward, hamlet, commune, tribe, quarter, group, and similar settlement areas with common customs, traditions, or family lineage granted land by the State or recognized land use rights, inheritance, gift of land use rights for preserving ethnic identity, such as land for communal houses, temples, shrines, hermitages, ancestral halls, family shrines;

- Religious institutions comprising temples, churches, chapels, sanctuaries, mosques, monasteries, specialized training schools of religions, headquarters of religious organizations, and other religious facilities.

2. Statistical and inventory indicators for land objects regarding types of entities managed by the State include:

a) People's Committees at commune level managed by the State including: Unallocated land, unleased land; land for public construction directly managed by People's Committees at commune level (rural roads, irrigation works; squares, monuments, memorials of commune level); rivers, streams within communes; dedicated water surfaces without users; agricultural land recovered by the State in rural areas as stipulated in Clause 1 of Article 64 and Points a, b, c, and d of Clause 1 of Article 65 of the Land Law;

b) Land Development Funds managed by the State for land recovered according to land laws;

c) Community residents and other organizations managed by the State include:

- Community residents managed by the State for forest protection and development according to the Forest Protection and Development Law;

- Organizations managed by the State for public infrastructure comprising roads, bridges, culverts from inter-commune level upwards; road systems, drainage systems, dedicated water surfaces in urban areas; hydropower systems, dykes, dams, rivers, streams from inter-commune level upwards; squares, monuments, memorials managed by district and provincial levels; uninhabited islands; organizations given land by the State to implement investment projects under build-transfer (BT) model.

3. The explanation of how to determine each type of land user and entity managed by the State shall be implemented according to Appendix No. 01 attached to this Circular.

Article 11. Land statistics and inventory indicators by area

1. Rural residential land: Includes various types of land within areas primarily designated for constructing houses, public facilities serving residents' daily life and activities; garden and pond land attached to houses, and other types of land within the boundaries of rural residential areas in communes, excluding new urban areas as specified in Clause 2 of this Article.

The boundaries of rural residential areas are determined according to land use plans or rural residential area construction plans approved by competent authorities; in cases where rural residential areas have not been approved with such plans, the boundaries are determined based on the limits of the outermost plots of land with houses in villages, hamlets, wards, villages, clusters, settlements, and similar existing residential points.

For cases where residents live along canals, ditches, roads, or reside individually in areas without planning or outside the approved boundaries of rural residential areas, only the area of plots with houses and gardens/ponds attached to houses will be inventoried; if the boundaries of residential land and attached gardens/ponds cannot be determined, only the recognized residential land area will be inventoried; in cases where land use rights certificates have not been issued, the temporary residential land area will be determined by the newly set land allocation limit for residential purposes as prescribed by the provincial People's Committee.

2. Urban land: Includes various types of land within the administrative boundaries of wards and towns; new urban areas that have actually formed within the development planning scope of districts, townships, and cities under provinces, as approved by competent authorities.

3. High-tech zone land: Includes various types of land within high-tech zones established by the Prime Minister's decision for purposes of serving high-tech product production, research and application of high technology, and training of high-tech human resources.

4. Economic zone land: Includes various types of land within economic zones and border economic zones established by the Prime Minister's decision for purposes of building duty-free zones, bonded warehouses, export processing zones, industrial parks, entertainment zones, tourist zones, urban zones, residential zones, administrative zones, and other functional zones suitable for each economic zone.

5. Natural conservation area land: Designated for purposes as stipulated by the Land Law and simultaneously for natural conservation and biodiversity preservation; natural conservation areas established by the Prime Minister's decision include national parks, nature reserves, species and habitat conservation areas, scenic protection areas.

6. Biodiversity conservation facility land: Designated for purposes of caring for, breeding, rescuing, and propagating wild animal and plant species, microorganisms, and endemic fungi of value; preserving genetic sources and genetic samples for conservation and biodiversity development purposes.

7. Coastal water body land: Refers to areas of land beyond the average low tide line of the sea, not within the administrative boundaries of provinces, and currently used for various purposes, including coastal water body land for aquaculture; coastal water body land with forests; and coastal water body land used for other purposes.

Article 12. Statistical Indicators for the Total Land Area of Administrative Units

1. The statistical indicator for the total land area of administrative units shall include the entire area of all types of land within the territorial boundaries of each administrative unit as defined by law.

2. For administrative units bordering the sea, the area of such units shall include the area of all types of land on the mainland and islands at sea (if any), up to the mean high tide line over many years (referred to collectively as the shoreline); if the mean high tide line over many years cannot be determined, it shall be based on the high tide line at the time of inventory. Coastal water areas outside the shoreline that are currently being used shall be separately recorded and not included in the total area of the administrative unit.

3. In cases where there are disputes or inconsistencies regarding administrative boundaries, the following principles shall apply for statistical recording and inventory:

a) Where the actual administrative boundary on the ground does not match the administrative boundary shown on the officially recognized administrative boundary map, the total land area of the administrative unit shall be recorded according to the actual administrative boundary being managed.

b) In cases of administrative boundary disputes, the following measures shall be taken:

- The land statistics and inventory for the disputed area shall be carried out by the local authority temporarily managing the disputed area; if it cannot be determined which party is managing the disputed area, all parties shall jointly conduct the statistics and inventory for the disputed area.

The disputed administrative boundary area shall be recorded and inventoried to determine its location and area by type of land, type of land user, and type of state-managed land object, listed separately, and clearly reflected in the report on the results of land statistics and inventory and the current land use map;

- The area of the disputed administrative boundary shall not be included in the total land area of the administrative units involved in the dispute but must be aggregated into the total land area of the higher-level administrative unit directly above those administrative units with disputed boundaries.

Article 13. System of Statistical and Inventory Forms for Land

1. The system of statistical and inventory forms for land includes:

a) Form 01/TKDD - Statistics and Inventory of Land Area: Applied in land statistics and inventory to comprehensively aggregate various types of land belonging to agricultural land, non-agricultural land, unused land, and coastal water areas currently in use for various purposes;

b) Form 02/TKDD - Statistics and Inventory of Agricultural Land Area: Applied in land statistics and inventory to aggregate detailed types of agricultural land; in cases where land is used for multiple purposes, this form only aggregates according to the main purpose of land use;

c) Form 03/TKDD - Statistics and Inventory of Non-Agricultural Land Area: Applied in land statistics and inventory to aggregate detailed types of non-agricultural land; in cases where land is used for multiple purposes, this form only aggregates according to the main purpose of land use;

d) Form 04/TKDD - Statistics and Inventory of Land Area by Administrative Unit: Applied in land statistics and inventory to aggregate data on land area by each lower-level administrative unit under the level conducting the statistics and inventory (including district, provincial, regional, and national levels);

đ) Form 05a/TKDD - Statistics and Inventory of Land Area According to Assigned, Leased, or Changed Land Use Purpose But Not Yet Implemented: Applied in land statistics and inventory to aggregate cases where decisions have been made to assign land, lease land, or change land use purpose, but at the time of statistics and inventory, the land has not yet been used according to the new purpose. The land use purpose in this form is aggregated according to the land use purpose assigned, leased, or permitted to change by the State.

Form 05b/TKDD - Summary of Cases Assigned, Leased, or Changed Land Use Purpose But Not Yet Implemented: Applied in land statistics and inventory to list cases assigned, leased, or changed land use purpose but not yet implemented;

e) Form 06a/TKDD - Inventory of Land Area Changed Land Use Purpose Differently from Land Administration Records: Applied in land inventory to aggregate cases where the current land use purpose has changed compared to existing land rights documents and land administration records, including cases where the legal status of the land use purpose change has been identified or not yet identified;

Form 06b/TKDD - List of Cases Changed Land Use Purpose Differently from Land Administration Records: Applied in land inventory to list cases where the current land use purpose has changed compared to existing land rights documents and land administration records, including cases where the legal status of the land use purpose change has been identified or not yet identified;

g) Form 07/TKDD - Inventory of Land Area Used for Combined Purposes: Applied in land inventory to aggregate cases where land is primarily used for main purposes (including paddy fields, perennial crop lands, forestry lands, residential lands, defense lands, security lands, irrigation lands, energy project lands, river, stream, canal, creek, spring, and dedicated water surface lands) combined with other purposes (agriculture production, forestry, aquaculture, or non-agricultural production and business);

h) Form 08/TKDD - Inventory of Land Area in Nature Reserves and Biodiversity Conservation Areas: Applied in land inventory to aggregate according to types of land and types of land users in nature reserves and biodiversity conservation facilities;

i) Form 09/TKDD - Inventory of Land Area in Comprehensive Areas: Applied in land inventory to aggregate land area according to types of land in comprehensive areas;

k) Form 10/TKĐĐ - Analysis of Reasons for Increases and Decreases in Land Areas: Used to analyze reasons for increases and decreases in land areas according to land use purposes during the statistical period.

l) Form 11/TKĐĐ - Structure of Land Area According to Land Use Purposes and Users: Used to calculate the structure of land area according to land use purposes and users of Form 03/TKĐĐ.

m) Form 12/TKĐĐ - Changes in Land Area According to Land Use Purposes: Used in land statistics and inventory to calculate changes in land areas due to changes in land use purposes based on data from Form 10/TKĐĐ. For statistical data, compare with data from the previous statistical period and the most recent inventory period; for inventory data, compare with data from the two most recent inventory periods.

n) Form 13/TKĐĐ - Comparison of Current Land Use Status and Land Use Plan During the Planning Period: Used in land statistics and inventory to compare the current land use status at the time of land statistics and inventory with the land use plan for the year of statistics and inventory.

o) Form 14/TKĐĐ - Statistics and Inventory of National Defense and Security Land Areas: Used in land statistics and inventory to compile types of land currently being used in national defense and security areas.

2. The content, code symbols of indicators, and formats of land statistics and inventory forms shall be implemented in accordance with the provisions set out in Appendix No. 02 attached hereto.

3. Forms 01/TKĐĐ, 02/TKĐĐ, and 03/TKĐĐ prescribed in Clause 1 of this Article, in addition to being used to statistically and inventory all areas within administrative boundaries, are also used to statistically and inventory and report land areas of specific administrative boundary dispute areas as stipulated in Point b, Clause 3, Article 12 of this Circular.

Chapter III
CONTENTS OF IMPLEMENTATION OF LAND STATISTICS AND INVENTORY

AND DRAWING UP CURRENT STATUS LAND USE MAPS

Article 14. Contents of Annual Land Statistics Implementation

1. Collecting relevant files, documents, and data related to land changes during the statistical period; land inventory data or land statistics data conducted in the previous year.

2. Processing, summarizing data, and preparing land statistics tables at various levels as prescribed.

3. Analyzing and evaluating the current land use status, land changes, and proposing measures to enhance land management and improve land use efficiency.

4. Preparing land statistics reports.

Article 15. Contents of Land Inventory Implementation and Drawing Up Current Status Land Use Maps

1. Collecting files, documents, maps, and data on land management during the inventory period; results of the previous land inventory and annual statistics results during the inventory period; preparing maps for inventory surveys.

2. Surveying, delineating, or adjusting land plots according to inventory criteria on the survey inventory map; calculating the area of each plot and compiling a list of surveyed and inventoried land plots. The list of surveyed and inventoried land plots shall be prepared in accordance with the provisions set out in Appendix No. 03 attached hereto.

3. Processing, summarizing data, and preparing land inventory tables for each administrative level as prescribed; drafting explanatory reports on the current land use status.

4. Preparing current status land use maps at various levels; drafting explanatory reports on the current status land use maps.

5. Analyzing and evaluating the current land use status and land change situations during the inventory period; proposing measures to enhance land management and improve land use efficiency.

6. Preparing land inventory result reports and drawing up current status land use maps.

Article 16. Land Use Status Map

1. The land use status map is prepared to reflect the distribution of various types of land at the time of land inventory, and it is prepared for each administrative unit level.

2. The scale of the land use status maps at each level shall be established according to the following provisions:

In cases where an administrative unit establishes a land use status map with a special shape (length much greater than width), it may choose a larger or smaller scale than specified above.

3. The contents displayed on the land use status map include:

a) Mathematical basis including the map frame, kilometer grid, latitude and longitude grid, legends, presentation outside the frame, and related contents;

b) National borders and administrative boundary lines at all levels: For the economic and social region land use status map on paper, it only shows up to the district administrative boundaries; for the national land use status map on paper, it only shows up to the provincial administrative boundaries. When administrative boundary lines at different levels overlap, the highest-level administrative boundary line is indicated.

In cases where there is inconsistency between the actual managed administrative boundaries and the administrative boundary records, the actual managed administrative boundaries must be shown on the land use status map. In cases of administrative boundary disputes, the disputed area's administrative boundaries according to the opinions of the relevant parties must be shown on the land use status map;

c) Boundaries of land plots in the commune-level land use status map show the boundaries and symbols of land plots according to land inventory criteria. Boundaries of land plots in the district-level, provincial-level, economic and social region, and national land use status maps are shown according to comprehensive criteria; they are summarized and generalized according to the compilation regulations of land use status maps at each level;

d) Topography: It reflects the topographic characteristics of the area (excluding seabed terrain, rocky areas, and artificial sand beaches) and is represented by contour lines, elevation points, and elevation annotations. In high mountainous areas with steep slopes, only characteristic contour lines and elevation points are indicated;

đ) Water systems and related objects that must be shown include sea, lake, pond, swamp, reservoir, excavated pit, river, stream, canal, creek, and brook. For the sea, it is shown according to the average low tide shoreline over many years; if the average low tide shoreline over many years cannot be determined, it is shown according to the low tide shoreline at the time of inventory. Other water system elements with embankments are shown according to the outer edge of the embankment (opposite the water system); if the water system adjoins a dike or road, it is shown according to the toe of the dike fill, the road adjacent to the water system; if the water system has no embankment and does not adjoin a dike or road, it is shown according to the crest of the water system's slide slope;

e) Transportation and related objects show the land occupied by railway, road, and transportation works on those systems as follows:

- Commune-level land use status map shows all types of roads at all levels, including main roads within residential areas, field roads, and footpaths in mountainous and midland communes;

- District-level land use status map shows roads from inter-commune roads upwards; in mountainous areas, small dirt roads must also be shown;

- Provincial-level land use status map shows roads from inter-district roads upwards;

- On the economic and social region and national land use status maps, expressways and above are shown; in mountainous areas, inter-district roads must also be shown;

g) Economic and social factors;

h) Annotations and explanations.

4. The form of displaying the contents of the land use status maps at each level shall be implemented according to the provisions in Appendix No. 04 attached hereto.

5. The explanatory report of the land use status map includes the following contents:

a) Legal basis; purpose and requirements for establishing the land use status map;

b) Overview of natural conditions and socio-economic conditions of the administrative unit;

c) Time of construction and completion of the establishment of the land use status map;

d) Sources of materials used and methods and technology for establishing the land use status map;

đ) Evaluation of the quality of the land use status map regarding the completeness, detail, and accuracy of content elements;

e) Existing issues and limitations of the land use status map;

g) Conclusions and recommendations for measures to address limitations and issues.

Article 17. Report on the Results of Land Statistics and Inventory

1. The contents of the Report on the Results of Land Statistics include:

a) The situation of organization and implementation, sources of data, and materials used for compiling land statistics at the commune level and evaluation of the reliability of collected data and materials;

b) Evaluation of the current status of land use; assessment of changes in land use and analysis of reasons for such changes between the year of statistics and the previous year's statistical data and the most recent inventory data; the situation of land use according to decisions on land allocation, land lease, and change of land use purpose but not yet implemented; assessment of the implementation of annual land use plans;

c) Proposals and recommendations for measures to strengthen land management.

2. The contents of the Report on the Results of Land Inventory include:

a) The situation of organization and implementation; methods of surveying and collecting land inventory data, origin of collected data at the commune level and evaluation of the reliability of collected data and compiled data; other information related to data; sources of materials and methods for preparing current land use maps;

b) Analysis and evaluation of the current status of land use according to inventory indicators; assessment of changes in land use and analysis of reasons for such changes between the year of inventory and the two most recent inventory periods; assessment of the implementation of plans for changing land use purposes during the inventory period; the situation of land use according to decisions on land allocation, land lease, and change of land use purpose; the situation of changing land use purposes different from cadastral records; the situation of administrative boundary disputes (if any);

c) Proposals and recommendations for measures to strengthen land management and use.

Chapter IV
METHODS AND PROCEDURES FOR IMPLEMENTING LAND STATISTICS, INVENTORY AND PREPARATION OF CURRENT LAND USE MAPS

Article 18. Methods for Implementing Land Statistics

1. The method for implementing land statistics at the commune level is as follows:

a) Land statistics at the commune level are carried out based on the consolidation of cases of land changes during the statistical period to serve as the basis for adjusting statistical and inventory data of the previous year;

The results of consolidating cases of land changes must be updated in the List of Land Plots for Statistical and Inventory Purposes of each commune;

b) For communes, wards, and towns that have established cadastral files or land databases and have been regularly updated with full information on land allocation, land lease, land recovery, change of land use purpose, and registration of land rights transfer, the consolidation of cases of land changes is based on the cadastral files, taking into account the actual land use situation to consolidate; additionally, it is necessary to base on inspection reports, land use inspection records conducted during the period, taking into account the actual compliance with inspection conclusions and inspections to supplement cases of changes that have not completed administrative procedures for land according to regulations;

c) For communes, wards, and towns that have cadastral files or land databases but have not been fully and regularly updated with information on land allocation, land lease, land recovery, change of land use purpose, and registration of land rights transfer during the statistical period, the consolidation of cases of land changes is based on the cadastral files and files on land allocation, land lease, land recovery, change of land use purpose, inspection files, dispute resolution files, and land use inspection records of various levels during the period, taking into account the actual land use situation at the time of statistics to compile the data.

2. The method for consolidating land statistics data at various levels, economic and social regions, and nationwide is carried out using electronic computers with unified software of the Ministry of Natural Resources and Environment.

For communes without conditions to consolidate land statistics data using software, the Department of Natural Resources and Environment will re-consolidate using software for verification and submission of products.

For communes that have not yet had the conditions to compile land statistics data using software, the Department of Natural Resources and Environment shall recompile using software for verification and submission of results.

Article 19. Method for conducting land inventory

1. The method for collecting current land use information to serve the compilation of commune-level land inventory data shall be carried out as follows:

a) Current land use information for compiling commune-level land inventory data shall be collected through surveys, delineation from cadastral records and other administrative procedures related to land, inspection and supervision records on land use at all levels during the period, combined with field surveys to review and adjust areas of change and delineate additional cases of land use not reflected on the investigation and inventory maps.

Survey and delineation results must reflect land plots according to the inventory indicators specified in Articles 9 and 10 of this Circular on the investigation and inventory map (each plot must be consistent with one type of land, used by one type of user or managed by the State for inventory purposes) to calculate area and compile into the List of Plots for Statistical Inventory of Land Use as the basis for compiling land inventory data and creating the current land use map;

b) Maps used for investigation and inventory at the commune level are defined as follows:

- If the locality has a cadastral map or a basic cadastral map or a parcel division map (old), it must be used for investigation and inventory. Before using such maps, they must be checked, reviewed, and adjusted consistently with land allocation, lease, land use purpose change, and land use right recognition records already implemented in the locality; compiled according to the inventory plots. In cases where the locality has cadastral maps at different scales, they can be unified to the same scale to serve field surveys;

- Areas without cadastral maps, basic cadastral maps but have recent satellite or aerial photographs (within two years before the inventory date) with accuracy equivalent to or higher than the accuracy of the required current land use map, shall use rectified satellite image maps based on the mathematical foundation of the required current land use map; delineate and draw internal work for clear content according to the requirements of the investigation and inventory result map, update and adjust geographic elements, administrative boundary lines, and delineation factors on the most recently established current land use map, in case there are discrepancies between satellite images and the current land use map, adjust according to satellite images, retain raster elements unchanged to serve investigation and delineation;

- Areas without cadastral maps, basic cadastral maps, recent satellite or aerial photographs shall use the previous current land use map for investigation and inventory;

Before using the current land use map, the contents of each map fragment must be compared, create a chart to indicate the use and integration of specific map fragments for investigation and inventory;

- Localities with topographic maps or basic cadastral maps at equivalent or larger scales than the required current land use map, forestry inventory maps of the agriculture sector may be combined for use to serve investigation and delineation of plots and linear objects;

- All types of maps used for investigation and inventory as stipulated above must be converted to the mathematical foundation of the required current land use map. In cases where the selected investigation and inventory map is still in paper form, digitization must be performed to serve editing the investigation and inventory result map. The resolution when scanning the map must be at least 150 dpi; the map can only be digitized after the scanned image has met the specified error limits;

c) Delineation of plot boundaries is carried out in the following order:

- Internal delineation of plots from allocation, lease, recovery, purpose change, recognition of land use rights, inspection and supervision records on land use at all levels; forestry inventory records of the agriculture sector (if available);

- On-site delineation of plots is carried out by direct observation, based on clear features on the map and on-site to determine the location of plots and delineate them on the map.

In cases where the size and area of the object to be delineated can be determined, the delineation results must ensure consistency with the determined size and area of the object.

In cases where the boundary of the plot cannot be determined corresponding to linear features on the map and on-site, the intersection method or perpendicular coordinates from clearly marked points on-site already represented on the map shall be applied to express the corner points of the plot boundary on the map; the determination of the length of the intersecting side or perpendicular side can be measured with a measuring tape or other tools with equivalent accuracy.

2. The method for establishing the investigation and inventory result map of the commune administrative unit is carried out as follows:

a) The investigation and inventory result map is established for each commune administrative unit in digital form within the VN-2000 coordinate system, zone 3⁰, central meridian of each province and centrally-administered city, based on the integration and connection of mapping materials used for on-site investigation and delineation; used as material to serve the calculation and compilation of land inventory data and creation of the current land use map at the commune level;

b) The content of the investigation and inventory result map needs to include:

- Boundaries and symbols of plots according to inventory indicators;

- National borders and administrative boundary lines at various levels;

- Water systems and related objects;

- Transportation and related objects;

- Mathematical elements including map frame, orthogonal coordinate grid, terrain elements (landform, elevation points and elevation notes) and other contents (excluding parcel boundaries) of the map used for investigation and inventory (if applicable);

- Economic and social elements;

- Notes and explanations.

The delineated plots on the map of the survey and inventory results must include labels for the delineated plots consisting of the plot number; plot area; land type code; land user object code or land management object code as follows:

* In cases where a plot has a primary purpose and a secondary purpose, the primary purpose should be indicated first, followed by the secondary purpose in parentheses:

* In cases where a plot has multiple uses without distinguishing between primary and secondary purposes, it should be indicated as:

The plot label is created in a cell format. The land type code, user object code, and land management object code are specified in Appendix No. 04 issued together with this Circular.

The plot number is indicated using Arabic numerals from 01 to the end within the entire commune, numbered sequentially from top to bottom, left to right, in a zigzag pattern. For elements occupying land that do not form a parcel, they are enclosed by administrative boundary lines and numbered like parcels.

d) In cases where the map used for survey and inventory is in digital form, the integration and stitching of digital map fragments must be performed; compare the plot boundaries on the documentation map used for surveying and delineating with the content of the digital map to determine and represent the plot boundaries on the integrated digital map.

If the plot boundaries are determined by intersection methods or orthogonal coordinates, they can be transferred to the integrated digital map using one of the following methods: scanning and digitizing the delineated content outside the field that needs to be transferred to the survey result map, or calculating the coordinates of the vertices of the plot and transferring them to the map by loading coordinate points or constructing shapes using intersection or orthogonal coordinate methods.

đ) In cases where the map used for survey and inventory does not have a digital original, scanning and digitizing of the content elements of the survey result map, integration, and further processing of the edges on the digital survey result map must be carried out.

e) Map information is organized into layers, where the boundaries of plots within the same set of indicators are defined in the same map information layer. The classification of map information layers for the survey results is implemented according to the regulations on current map layer classification in Appendix No. 04 attached to this Circular.

g) The accuracy of digitization, transfer drawing, and delineation of the content elements of the survey result map is carried out as follows:

- The digital map must ensure that the dimensional error of the inner frame edges after alignment does not exceed 0.2 mm and the diagonal does not exceed 0.3 mm according to the map scale;

- The mutual transfer drawing error of the plots does not exceed ± 0.5 mm according to the current map scale;

- The transfer drawing error of the positions of the current land use content elements does not exceed ± 0.3 mm according to the current map scale;

3. The calculation of the areas of the delineated plots is carried out as follows:

On the map of the survey and inventory results, objects requiring area calculation (plots, land occupation objects not forming parcels) must be enclosed, and their spatial relationships (topology) must be determined;

In cases where region-type objects of the same kind (same kind of traffic or water objects...) intersect at the same level, the object is calculated based on the outermost land occupation boundary. In cases where region-type objects are of different kinds (different kinds of traffic or water objects) or of the same kind but intersect at different levels, the area of the overlapping part of the vertical projections of these objects on the ground is calculated for the object directly on the ground;

The areas of the delineated plots are calculated using analytical methods on the digital map;

The results of the area calculations of the delineated plots are compiled into a List of Delineated Plots showing the information: Plot code number, plot area, plot attributes corresponding to specific inventory indicators.

4. The method of compiling inventory data is carried out as follows:

a) Commune-level inventory data is compiled from the List of Delineated Plots Statistics, conducted using unified software of the Ministry of Natural Resources and Environment.

For inventory indicators surveyed through direct investigation questionnaires or other specialized inventory indicators that cannot be compiled using software, traditional calculation tools are used, and specific regulations are provided for each inventory period;

b) District, provincial, economic-social region, and national-level inventory data is compiled from the inventory data of subordinate administrative units using unified software of the Ministry of Natural Resources and Environment.

Article 20. Establishment of Land Use Status Maps

1. The mathematical basis for land use status maps is specified as follows:

a) Village-level, district-level, and provincial-level land use status maps are established on a conic projection surface with a longitudinal meridian correction factor ko = 0.9999. The central meridians of each province and centrally-administered city are defined in Appendix 04 attached to this Circular;⁰ with a scale distortion correction factor ko = 0.9999. The central meridian of each province and centrally governed city is specified in Appendix No. 04 attached hereto;

b) Economic and social region-level land use status maps use a transverse cylindrical equal-area projection with a longitudinal meridian correction factor ko = 0.9996;⁰with a scale distortion correction factor ko = 0.9996;

c) National land use status maps use a conical equal-area projection with standard parallels at 11 and 21 degrees latitude, with the origin parallel at 4 degrees latitude, and the central meridian at 108 degrees longitude for the entire territory of Vietnam;⁰ and 21⁰, the prime parallel is 4⁰, the central meridian is 108⁰ for the entire territory of Vietnam;

d) The layout of land use status maps is presented as follows:

- For land use status maps at scales of 1:1000, 1:2000, 1:5000, and 1:10000, only the kilometer grid is shown, with the size of the square kilometer grid cells being 10cm x 10cm;

- Current land use map at a scale of 1:25000 showing a kilometer grid, with the size of each square grid cell being 8 cm x 8 cm;

- For land use status maps at a scale of 1:25000, the kilometer grid is shown, with the size of the square kilometer grid cells being 8cm x 8cm;^'. The size of the longitude and latitude grid cells on the current land use map at a scale of 1:1000000 is 1⁰ - For land use status maps at scales of 1:50000, 1:100000, 1:250000, and 1:1000000, only the meridian and parallel grids are shown. The size of the meridian and parallel grid cells for land use status maps at a scale of 1:50000 is 5' x 5'. The size of the meridian and parallel grid cells for land use status maps at a scale of 1:100000 is 10' x 10'. The size of the meridian and parallel grid cells for land use status maps at a scale of 1:250000 is 20' x 20'. The size of the meridian and parallel grid cells for land use status maps at a scale of 1:1000000 is 1' x 1';⁰;

d) The parameters of the standard file of the current land use map are as follows:

- The coordinate system of the current land use map is based on the national coordinate system VN-2000;

d) The parameters of the standard file of land use status maps are as follows:

- The coordinate system of the land use status map is based on the national coordinate system VN-2000;

- Working units include the main working unit (Master Units) which is meters (m), the secondary working unit (Sub Units) which is millimeters (mm), and resolution which is 1000.

2. Village-level land use status maps are established based on editing, compiling, and generalizing from land survey and inventory result maps. District-level and provincial-level land use status maps are established based on integrating, connecting, compiling, and generalizing content from land use status maps of subordinate units. Land use status maps of economic and social regions and nationwide are established based on integrating, connecting, compiling, and generalizing content from land use status maps of provincial administrative units and regions.

Localities that have topographic maps, forestry inventory maps of the agriculture sector, and cadastral base maps may use these additional maps for reference or to supplement necessary content beyond the boundaries of the plots not covered by the land survey and inventory result maps.

3. The compilation and generalization of the content of land use status maps at each level must meet the following requirements:

a) The degree of compilation and generalization of the content of land use status maps at each level must correspond to the scale of the printed paper map. Plot boundaries and linear elements are generalized and smoothed;

c) Land parcels depicted on the current land use map shall be shown as follows when they meet the specified area requirements:

From 1:25000 to 1:100000

≥ 9 mm

From 1:250000 to 1:1000000

≥ 4 mm

In cases where plots have smaller areas than those specified above, they are merged into adjacent larger plots. For small islands with areas smaller than those specified above, they must still be shown on land use status maps with island names noted (if applicable) without generalization;

e) Topographic features, objects, and other explanatory notes shall be selected, supplemented, or removed to ensure suitability regarding information density, readability, and aesthetic quality of the map;

d) Linear elements (rivers, streams, canals...) shorter than 2 cm on the map may be omitted; linear elements narrower than 0.5mm on the map are compiled into a single line centered on the element.

In cases where railway and road lines run close together, the position of the road line may be shifted to ensure the correct position of the railway line;

When compiling hydrographic linear elements, their distinctive characteristics must be maintained to accurately reflect density, distribution patterns, usage features, and the source locations, and special water flows such as hot springs and mineral springs must not be omitted;

e) For coastline generalization, the characteristic shape of each type of coast must be preserved. In areas with many river mouths, curved coastlines may be combined into two or three small bends but must retain river mouths, outflows into the sea, and tidal flats;

f) Topographic and other descriptive elements must be selected, supplemented, or removed to ensure appropriate information density, readability, and aesthetic quality of the map;

d) The objects on the map must be correctly represented according to the class, color, line strength, and accompanying parameters as specified in the object classification table. For objects participating in delineating the land plot boundary drawn at scale (such as roads, administrative boundaries...) the original state of the participating part should be preserved and transferred to a separate class for delineation purposes. Each land plot must have a land type code, which should not be deleted during editing but transferred to a separate class for storage. The product must include a history note attached.

e) The current land use map data file must be in the *.dgn format of the Microstation software, accompanied by the source symbol file and map history file; the file must be in an open format, allowing for editing and updating information when necessary and having the ability to convert formats; Vietnamese character fonts, Unicode encoding tables; independent symbol libraries pre-created in the "HT" library for corresponding scale series named ht1-5.cell, ht10-25.cell, ht50-100.cell, ht250-1tr.cell,...; symbol libraries for linear features according to scale series named ht1-5.rsc, ht10-25.rsc, ht50-100.rsc, ht250-1tr.rsc...; the color palette named ht.tbl.

Article 21. Procedure for annual land statistics

1. Preparation work at all levels shall be carried out as follows:

a) The Land Management General Department shall perform the following tasks:

- Issuing guidance documents for periodic land statistics in cases deemed necessary three months before the statistical period;

- Collecting documentation of the previous year's land statistics results, land inventory results, and the most recent land use status map of the entire country; land use plan for the year of statistics;

b) Provincial and district People's Committees shall direct and carry out the following tasks:

- Issuing guidance documents and urging periodic land statistics in cases deemed necessary one month before the statistical period;

- Collecting the previous year's land statistics results, land inventory results, and the most recent land use status map; land use plan documentation for the year of statistics; collecting, reviewing, and summarizing land change cases resolved during the statistical period (including land allocation, lease, recovery, purpose change, registration of changes, inspection, and land use verification records) and transferring them to the commune level for consolidation where notification of land change correction has not been sent to the commune according to regulations on land record correction;

c) Commune People's Committees shall perform the following tasks:

- Collecting, evaluating, and selecting relevant materials for land statistics work including the previous year's land statistics results, land inventory results, and the most recent land use status map; land use plan documentation for the year of statistics; land registry files; land allocation, lease, recovery, purpose change, registration of changes, and inspection records established at various levels during the period;

- Preparing forms for land statistics.

2. Implementation of land statistics at all levels shall be carried out as follows:

a) Commune People's Committees shall perform the following tasks:

- Identifying and compiling land use change cases in the statistical year, listing the cases in the Land Plot Statistics and Inventory List form; identifying and compiling lists of completed administrative procedures but not yet implemented in reality; updating changes in the land item register where there is a cadastral map;

- Compiling commune-level land use status statistics data including Forms: 01/TKDD, 02/TKDD, 03/TKDD, 05a/TKDD, and 05b/TKDD;

- Analyzing land use status statistics data and land change situations in the locality, compiling Forms: 10/TKDD, 11/TKDD, and 12/TKDD;

- Preparing a report on land statistics results;

- Reviewing, completing, approving, printing, and submitting the commune-level land statistics result report to the district level;

b) District and provincial People's Committees shall direct and carry out the following tasks:

- Receiving and checking land statistics data submitted by subordinate levels. Directing subordinate levels to correct and complete statistics data and reports (if necessary);

- Compiling district and provincial-level land use status statistics data including Forms: 01/TKDD, 02/TKDD, 03/TKDD, 04/TKDD, and 05a/TKDD;

- Analyzing statistics data, assessing land use status and land use change situations in the locality, compiling Forms: 10/TKDD, 11/TKDD, 12/TKDD, and 13/TKDD;

- Preparing a report on district and provincial-level land statistics results;

- Reviewing, completing, approving, printing, and submitting the local land statistics result report to the superior authority according to Article 5 of this Circular;

c) The Land Management General Department shall direct and carry out the following tasks:

- Receiving and checking, processing land statistics data and reports from the provincial level; directing provinces to correct and complete statistics data and reports (if necessary);

- Compiling national and regional land use status statistics data including Forms: 01/TKDD, 02/TKDD, 03/TKDD, 04/TKDD, and 05a/TKDD;

- Analyzing statistics data, assessing land use status and land change situations in regions and nationwide, compiling Forms: 10/TKDD, 11/TKDD, 12/TKDD, and 13/TKDD;

- Preparing a National Land Statistics Result Report;

- Reviewing, completing, approving, printing, and sending the report to the Prime Minister on land statistics results for regions and nationwide;

- Submitting to the Minister for decision to announce the national land statistics results.

Article 22. Procedures for conducting land inventory and preparing current land use maps

1. Preparation work at all levels shall be carried out as follows:

a) The Land Management General Department shall perform the following tasks:

- Eighteen months prior to the land inventory date, the plan for implementation must be completed and submitted to the Minister;

- Six months prior to the land inventory date, the land inventory project and the preparation of current land use maps must be completed and submitted to the Minister for approval by the Government;

- Four months prior to the land inventory date, the guiding and directing documents must be completed;

- Two months prior to the land inventory date, training must be completed;

- Collect planning and land use plans; results of land statistics from the last five years, results of the previous two land inventories and current land use maps;

b) The provincial People's Committee shall organize and direct the following tasks:

- Five months prior to the land inventory date, the land inventory plan and current land use maps at all administrative levels in the locality must be completed;

- Three months prior to the land inventory date, the Land Inventory Steering Committee must be established; completing the guiding and directing documents for the land inventory (if any);

- One month prior to the land inventory date, human resources, technical equipment, and financial preparations according to regulations must be completed and training organized for commune and district levels;

- One month prior to the land inventory date, collecting, evaluating, and selecting relevant land-related materials for the land inventory including planning and land use plans; results of land statistics from the last five years, results of the previous two land inventories and current land use maps; collecting, reviewing, and summarizing cases of land changes resolved during the previous provincial inventory period that have not been reported to the communes;

- Preparing digital maps for the land inventory and current land use maps at all levels according to the approved plan and transferring them to the communes and districts for implementation;

- Reviewing administrative boundaries; identifying cases where provincial administrative boundary lines are disputed or inconsistent between records and actual conditions; working with the People's Committees of related administrative units to unify the scope of the inventory and directing districts and communes to implement;

- Disseminating and implementing tasks to relevant departments and levels and publicizing the policy and plan for the land inventory to the people;

c) The district People's Committee shall organize and direct the following tasks:

- Developing the land inventory plan and current land use maps and organizing their implementation within the district;

- Preparing human resources, technical equipment, and finances according to regulations to serve the land inventory and current land use map preparation;

- Collecting, evaluating, and selecting relevant land-related materials for the land inventory including planning and land use plans; results of land statistics from the last five years, results of the previous two land inventories and current land use maps; collecting, reviewing, and summarizing cases of land changes resolved during the previous inventory period and transferring them to the communes for unresolved cases;

- Disseminating and implementing tasks to relevant departments and levels and publicizing the policy and plan for the land inventory to the people;

- Reviewing administrative boundaries; identifying cases where administrative boundary lines are disputed or inconsistent between records and actual conditions; working with the People's Committees of related administrative units to unify the scope of the inventory and directing communes to implement;

d) The commune People's Committee shall organize the following tasks:

- Developing the land inventory plan within the commune;

- Preparing human resources and technical equipment to serve the land inventory;

- Collecting existing land-related materials and data for the land inventory including various maps for surveying and delineating current status; cadastral records; land allocation, lease, recovery, change of purpose, registration of land changes, inspection and supervision records; land use planning records; results of land statistics from the last five years, results of the previous two land inventories and current land use maps, and other related land records and materials;

- Reviewing, comparing, and evaluating the usability of collected materials, data, and maps for the land inventory;

- Printing maps and forms for the survey and inventory;

- Reviewing administrative boundaries; if there are disputes or inconsistencies between administrative boundary records and actual conditions, working with the People's Committees of related administrative units to unify the scope of the inventory;

- Disseminating and implementing tasks to cadres and publicizing the policy and plan for the land inventory to the people;

- Reviewing, correcting, and updating current land use information from land allocation, lease, change of purpose, recognition of land use rights, inspection and supervision records during the land inventory period onto the maps used for the survey and inventory;

- Reviewing and collecting opinions to identify areas with changes on the ground during the inventory period requiring map corrections and additional surveys;

2. Implementation of land inventory and preparation of current land use maps at all levels as follows:

a) The commune People's Committee shall organize the following tasks:

- Conducting field surveys and delineations to supplement and correct land plots according to the inventory criteria specified in Articles 9, 10, and 11 of this Circular;

- Transferring, processing, and finalizing the delineation of land plots on the digital inventory result map and finalizing the delineation of land plots according to the detailed inventory requirements; calculating the area of each land plot;

- Compiling a list of land plots for statistical and inventory purposes based on the results of the field survey;

- Summarizing the current land use data at the commune level including Tables: 01/TKDD, 02/TKDD, 03/TKDD, 05a/TKDD, 06a/TKDD, 05b/TKDD, 06b/TKDD, 07/TKDD, 08/TKDD, and 09/TKDD;

- Analyze and evaluate the current land use status and land movement situation, prepare Forms: 10/TKDD, 11/TKDD, and 12/TKDD; establish a report explaining the current land use status;

- Prepare the current land use status map at the commune level, establish a report explaining the current land use status;

- Establish a report on the results of the land inventory;

- Inspect and accept the results of the land inventory, prepare the current land use status map at the commune level;

- Complete, review, print copies, and submit the land inventory report and the current land use status map to the district level;

b) The People's Committee at the district and provincial levels organize, direct, and implement the land inventory and prepare the current land use status map for each level, including the following tasks:

- Supervise, urge, guide, and direct implementation at all levels;

- Receive and inspect the results of the land inventory and the current land use status map submitted by lower levels. Direct corrections and completion of data and reports on the land inventory and the current land use status map (if necessary);

- Aggregate the current land use status data at the district and provincial levels, including Forms: 01/TKDD, 02/TKDD, 03/TKDD, 04/TKDD, 05a/TKDD, 06a/TKDD, 07/TKDD, 08/TKDD, and 09/TKDD;

- Analyze and evaluate the current land use status and land movement situation in the locality, prepare Forms: 10/TKDD, 11/TKDD, 12/TKDD, and 13/TKDD; establish a report explaining the current land use status;

- Prepare the current land use status map at the district and provincial levels and establish a report explaining the current land use status;

- Establish a report on the results of the land inventory and prepare the current land use status map at the district and provincial levels;

- Inspect and accept the results of the land inventory and the current land use status map at the district and provincial levels;

- Complete, review, print copies, and submit the land inventory report to the immediate superior level;

c) The Land Management General Department shall direct and carry out the following tasks:

- Supervise, urge, guide, and direct implementation in localities;

- Receive and inspect the results of the land inventory and the current land use status map submitted by the province; direct the province to correct and complete data and reports on the land inventory and establish the current land use status map of the locality (if necessary);

- Aggregate the current land use status data of regions and nationwide, including Forms: 01/TKDD, 02/TKDD, 03/TKDD, 04/TKDD, 05a/TKDD, 06a/TKDD, 07/TKDD, 08/TKDD, and 09/TKDD;

- Analyze and evaluate the current land use status and land movement situation nationwide; prepare Forms: 10/TKDD, 11/TKDD, 12/TKDD, and 13/TKDD; establish a report explaining the current land use status;

- Prepare the current land use status map of regions and nationwide; establish a report explaining the current land use status;

- Establish a report on the results of the national land inventory to be approved by the Minister;

- Accept the results of the land inventory and prepare the current land use status map of regions and nationwide;

- Complete, review, print copies, and send the report to the Prime Minister on the results of the land inventory of regions and nationwide;

- Submit to the Minister to decide on the announcement of the results of the land inventory and the preparation of the current land use status map of nationwide;

Article 23. Periodic Statistics and Inventory of National Defense and Security Land.

1. The periodic statistics and inventory of national defense land and security land shall be organized and implemented by the Ministry of National Defense and the Ministry of Public Security in coordination with the People's Committees at the provincial level.

2. Local People's Committees at all levels shall cooperate with the Ministry of National Defense and the Ministry of Public Security to review locations and areas of land used for national defense and security purposes; unify statistical and inventory data on national defense and security land in their respective localities.

3. The indicators for periodic statistics and inventory of national defense and security land include types of land as prescribed in Article 61 of the Land Law.

The statistical and inventory forms for national defense and security land shall be carried out according to Form 14/TKDD as stipulated in Appendix No. 02 attached hereto.

4. The submission of periodic statistics and inventory results of national defense and security land shall be as follows:

a) The Ministry of National Defense and the Ministry of Public Security shall be responsible for sending the results of periodic statistics and inventory of national defense and security land in each locality to the People's Committee at the provincial level for consolidation; and sending the results of statistics and inventory of national defense and security land nationwide to the Ministry of Natural Resources and Environment for consolidation and reporting to the Prime Minister.

b) The results of periodic statistics of national defense and security land include:

- Statistical data form on the current status of national defense and security land use;

- Report on the results of periodic statistics of national defense and security land;

c) The results of periodic inventory of national defense and security land include:

- Statistical data form on the current status of national defense and security land use;

- Current status map of national defense and security land use;

- Report on the results of the inventory and preparation of the current status map of national defense and security land use;

đ) The time for submitting the results of periodic statistics and inventory of national defense and security land to the Ministry of Natural Resources and Environment shall be as follows:

- Results of periodic statistics: Before March 15 of the year implementing land statistics;

- Results of periodic inventory: Before September 1 of the year implementing land inventory.

Chapter V
INSPECTION AND REVIEW OF STATISTICAL RESULTS,

LAND INVENTORY

Article 24. Periodic land statistics results inspection

1. The content of the examination includes:

a) The completeness level of documents and data, and the legality of the land statistics file;

b) The completeness and accuracy level of the results regarding land cases listed in the table of land changes at the commune level;

c) The accuracy in compiling data in statistical tables;

d) The consistency of data between each level's inventory data tables; between the data table and the land statistics results report;

đ) The quality of the land statistics results report concerning the completeness level of content; the quality of analysis reflecting the current land use status; the quality of content proposing management and utilization solutions for land;

2. Responsibilities for inspecting land statistics results are stipulated as follows:

a) Units and individuals directly implementing land statistics have the responsibility to self-inspect results throughout the implementation process;

b) The Department of Natural Resources and Environment inspects land statistics results at the commune level before acceptance; inspects land statistics results at the district level before submitting to the District People's Committee for approval;

c) The Land Registration Office or the Land Use Right Registration Office at the provincial level (for places where a Land Registration Office has not been established) inspects land statistics results at the district level before acceptance;

d) The Department of Natural Resources and Environment inspects land statistics results at the provincial level before submitting to the Provincial People's Committee for approval;

đ) The National Land Management Agency is responsible for inspecting land statistics results of provinces and nationwide before submitting to the Minister of Natural Resources and Environment;

Article 25. Inspection and Review of Land Inventory Results and Establishment of Current Land Use Maps Periodically

1. Contents of inspection and review include:

a) The completeness level of documents and data, and the legality of the land inventory file;

b) The accuracy of determining land types, land user categories, and land management, and the delineation on the commune-level investigation inventory map;

c) The accuracy in compiling data in tables;

d) The consistency of data between the commune-level data table and the commune-level investigation inventory map; between each level's inventory data tables; between the data table and the current land use map of each level; between the data table and the land inventory results report and establishment of the current land use map;

đ) The quality of the land inventory results report and establishment of the current land use map concerning the completeness level of content; the quality of analysis reflecting the current land use status; the quality of content proposing management and utilization solutions for land;

e) The quality of the current land use map concerning form, completeness level of content; consistency between color and symbols of land types; accuracy of delineated land areas on the map; discrepancy in area of different land types between the current land use map and inventory data;

2. Responsibilities for inspecting and reviewing land inventory results and establishing current land use maps are stipulated as follows:

a) Units and individuals directly implementing tasks related to land inventory and establishment of current land use maps have the responsibility to self-inspect results throughout the implementation process;

b) The Department of Natural Resources and Environment inspects and reviews commune-level results before acceptance; inspects district-level results before submitting to the District People's Committee for approval;

d) The Department of Natural Resources and Environment inspects and reviews provincial-level results before submitting to the Provincial People's Committee for approval;

đ) The National Land Management Agency inspects and reviews provincial-level results; inspects military and police results before acceptance; inspects and reviews nationwide results before submitting to the Minister of Natural Resources and Environment;

Article 26. Submission Documents

1. The submission documents for land statistics results are specified as follows:

a) Submission documents of commune level include:

- List of delineated land parcels for statistics and inventory (list of cases of change - 01 set of paper or digital format);

- Land statistics data table (02 sets of paper and 01 set of digital format - if applicable);

- Report on land statistics results (01 set of paper);

b) Submission documents of district level include:

- Commune-level land statistics data table (01 set of digital format);

- District-level land statistics data table (01 set of paper and 01 set of digital format);

- Report on district-level land statistics results (01 set of paper and 01 set of digital format);

c) Submission documents of provincial level include:

- Commune and district-level land statistics data tables (01 set of digital format);

- Provincial-level land statistics data table (01 set of paper and 01 set of digital format);

- Report on provincial-level land statistics results (01 set of paper and 01 set of digital format);

d) Submission documents of land statistics results for regions and nationwide sent to the Prime Minister include:

- Land statistics data table (paper format);

- Report on nationwide land statistics results (paper format).

2. The submission documents for land inventory results and current land use map creation are specified as follows:

a) Submission documents of commune level include:

- Inventory result map file area *.POL connecting database of the map and list of delineated land parcels for statistics and inventory attached (01 set of digital format);

- Land inventory data table (02 sets of paper and 01 set of digital format - if applicable);

- Current land use map (01 set of paper and 01 set of digital format in *.DGN format; file area *.POL and report explaining the current land use map);

- Report on land inventory results (01 set of paper);

b) Submission documents of district level include:

- Inventory result map and list of delineated land parcels for statistics and inventory attached (01 set of digital format);

- Commune-level land inventory data table (01 set of paper and 01 set of digital format);

- Commune-level current land use map (01 set of digital format);

- District-level land inventory data table (01 set of paper and 01 set of digital format);

- District-level current land use map (01 set of paper and 01 set of digital format);

- Report on district-level land inventory results (01 set of paper and 01 set of digital format);

- Explanation report on current land use status and explanation report on current land use map (01 set of paper and 01 set of digital format);

c) Submission documents of provincial level include:

- Inventory result map and list of delineated land parcels for statistics and inventory attached (01 set of digital format);

- County-level land inventory data table and current land use map (01 set of digital format);

- Provincial-level land inventory data table (01 set of paper and 01 set of digital format);

- Provincial-level current land use map (01 set of paper and 01 set of digital format);

- Report on provincial-level land inventory results (01 set of paper and 01 set of digital format);

- Explanation report on current land use status and explanation report on current land use map (01 set of paper and 01 set of digital format);

d) Submission documents of regions and nationwide sent to the Prime Minister include:

- Nationwide and regional land inventory data table with detailed information down to each province (01 set of paper);

- Report on nationwide land inventory results (01 set of paper);

- Nationwide current land use map (01 set of paper).

Article 27. Storage, Management, and Provision of Statistical and Inventory Data

1. The statistical and inventory results documents of communes, districts, provinces, and nationwide (in paper and digital formats) as stipulated in Clause 1 of Article 26 shall be managed and stored permanently.

2. Commune-level statistical and inventory documents are stored at the People's Committee of the commune and the Department of Natural Resources and Environment. The commune-level inventory investigation result map is stored at the commune, district, provincial levels, and the Ministry of Natural Resources and Environment.

3. District-level statistical and inventory documents are stored at the Department of Natural Resources and Environment and the Provincial Department of Natural Resources and Environment.

4. Provincial-level statistical and inventory documents are stored at the Provincial Department of Natural Resources and Environment and the Ministry of Natural Resources and Environment.

5. Regional and nationwide statistical and inventory documents are stored at the Ministry of Natural Resources and Environment.

6. The management and provision of statistical and inventory data and current land use maps shall be carried out according to regulations on the management and provision of cadastral documents of the Ministry of Natural Resources and Environment.

Chapter VI
IMPLEMENTATION

Article 28. Effective Date

1. This Circular takes effect from July 17, 2014.

2. This Circular replaces Circular No. 08/2007/TT-BTNMT dated August 2, 2007 of the Minister of Natural Resources and Environment guiding the implementation of land statistics and inventory and the construction of current land use maps; Decision No. 22/2007/QĐ-BTNMT dated December 17, 2007 of the Minister of Natural Resources and Environment promulgating regulations on the establishment of current land use maps; and Decision No. 23/2007/QĐ-BTNMT dated December 17, 2007 of the Minister of Natural Resources and Environment promulgating symbols for current land use maps and land use planning maps.

Article 29. Implementation Organization

1. Ministries, ministerial-level agencies, government agencies; Provincial People's Committees, centrally governed cities shall be responsible for directing the implementation of this circular.

2. The General Department of Land Administration shall be responsible for inspecting the implementation of this Circular.

3. Departments of Natural Resources and Environment shall assist provincial People's Committees and municipal People's Committees directly under the Central Government in implementing this Circular at local levels.

During the process of implementation, if there are difficulties or obstacles, agencies, organizations, and individuals should reflect them to the Ministry of Natural Resources and Environment for consideration and resolution./.
