Amending and supplementing Circular No. 06/2009/TT-NHNN dated April 9, 2009
detailing the preferential interest rate lending policy under the Program
to support poor districts as stipulated in Resolution No. 30a/2008/NQ-CP

Pursuant to the Law on the State Bank of Vietnam No. 46/2010/QH12 dated June 16, 2010;
Pursuant to the Law on Credit Institutions No. 47/2010/QH12 dated June 16, 2010;
On the basis of Government Decree No. Decree No. 156/2013/NĐ-CP dated November 11, 2013 of At the proposal of stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
Pursuant to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on the program hỗ trợ for rapid and sustainable poverty reduction in 61 poor districts;

Article 1. Amending and supplementing Clause 2, Article 3 of Circular No. 06/2009/TT-NHNN dated April 9, 2009 detailing the preferential interest rate lending policy under the Program to support poor districts as stipulated in Resolution No. 30a/2008/NQ-CP (hereinafter referred to as Circular No. 06/2009/TT-NHNN) dated December 27, 2008 of the Government as follows:
"2. In addition to the policies stipulated in Article 2 of this Circular and Clause 1 of this Article, households in poor areas of poor districts may borrow funds from the Social Policy Bank at preferential rates to purchase livestock, poultry, aquatic products, or develop industries as follows:
a) The maximum loan amount is 10 million VND per household;
b) The interest rate on the loan is 50% of the interest rate for poor households during each period;
c) The application period for the interest rate stipulated in point b, clause 2 of this Article is three years from the date the poor household begins to receive the loan."
Article 2.
Replacing the phrase "Department of Credit" with the phrase "Department of Credit for Industries" in Articles 5, 6, and 7 of Circular No. 06/2009/TT-NHNN.
Article 3. Transitional Provisions
1. For loans under Circular No. 06/2009/TT-NHNN that were issued before December 31, 2013 and still have outstanding balances at the Social Policy Bank, they shall continue to be implemented in accordance with the credit contracts already signed, in compliance with the laws at the time of signing the contract. The preferential loans as stipulated in Decision No. 2621/QĐ-TTg and this Circular shall be implemented after the expiration of the loan term and when poor households in poor districts have fulfilled their debt obligations under the aforementioned contract.
2. For loans issued in accordance with the guidance of the State Bank of Vietnam in Circular No. 06/2009/TT-NHNN from December 31, 2013 to the date this Circular takes effect, the Social Policy Bank shall compile statistics and implement support policies for poor households under Resolution 30a/2008/NQ-CP and Circular 06/2009/TT-NHNN.
3. For loans issued under Decision No. 2621/QĐ-TTg from December 31, 2013 to the date this Circular takes effect, the Social Policy Bank shall continue to implement in accordance with Decision No. 2621/QĐ-TTg.
Article 4. Implementation provisions
1. This Circular shall take effect from October 2, 2014.
2. The Director of the Office, Heads of the Department of Credit for Industries, and Heads of units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally-administered cities; the Board of Directors and General Directors of the Social Policy Bank are responsible for organizing the implementation of this Circular./.
