CIRCULAR

Amending and supplementing some articles of theCirculars stipulating recruitment, utilization, training, andworking conditions for vocational education teachers

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Labor Code on November 20, 2019;

Pursuant to the Law oniPublic Officials enacted on November 15, 2010;

Pursuant to the Law amending and supplementing some articles of the Law on Civil Servants and the Law on Public Officials enacted on November 25, 2019;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Pursuant to Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of public officials;iPursuant to the request of the Director General of the Department of Vocational Education;

Decree No. 1The Minister of Labor, Invalids and Social Affairs issues this Circular to amend and supplement some articles of the Circulars stipulating recruitment, utilization, training, and working conditions for vocational education teachers.

Pursuant to Decree No. 84/2020/NĐ-CP dated July 17, 2020, of the Government detailing certain provisions of the Education Law;

Article 1. Amending and supplementing some articles of Circular No. 06/2017/TT-BLDTBX dated March 8, 2017 of the Minister of Labor, Invalids and Social Affairs stipulating recruitment, utilization, and training for vocational education teachers.development1. This Circular stipulates recruitment for vocational education teachers in public vocational education institutions; utilization, standardization training, and advanced training for vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers. reason 2. This Circular applies to vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers; other relevant agencies, organizations, and individuals.

3. This Circular does not apply to teachers teaching teacher training programs under the jurisdiction of the Ministry of Education and Training. Recruitment and utilization provisions in this Circular do not apply to teachers at colleges and secondary vocational schools under the jurisdiction of the Ministry of Public Security and the Ministry of Defense."June 2024;2. Amending and supplementing Clause 2 of Article 2 as follows:

The Minister of Labor, Invalids and Social Affairs issues this Circular stipulating the adjustment rate for monthly salary and income already paid for social insurance;i"2. Vocational education teachers in public vocational education institutions and vocational education and general education centers who are sent for training shall be entitled to their full salary and other benefits as prescribed by law.", amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPm, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP 2. For private vocational education institutions and vocational education institutions with foreign investment, funding for training activities shall be provided from the financial resources of the vocational education institution."June 2024;Recruitment of teachers in public vocational education institutions shall be carried out in accordance with Chapter II of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of public officials."

1. Persons recruited to the position of vocational education public official must undergo a probation period as prescribed in Article 21 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of public officials.

1. Amend and supplement Article 1 as follows:

"Article 1. Scope of Regulation and Applicability

2. Vocational education institutions, vocational education activity institutions, and vocational education and general education centers must employ vocational education teachers who meet the standards as prescribed, are suitable for the trained professions, and comply with the agreements in the employment contracts."

"1. Direct vocational education institutions, vocational education activity institutions, and vocational education and general education centers under their jurisdiction to implement the provisions of this Circular."

"3. Manage, direct, inspect, and supervise the recruitment of teachers in public vocational education institutions; utilization and training of vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers under their jurisdiction; report annually and periodically on the implementation of teacher training work to the Ministry of Labor, Invalids and Social Affairs (Department of Vocational Education)."

"1. Assist provincial People's Committees in directing and guiding vocational education institutions, vocational education activity institutions, and vocational education and general education centers under their jurisdiction to implement the provisions of this Circular."

"3. Inspect and check the organization of teacher recruitment in public vocational education institutions under their jurisdiction; utilization and training of vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers. Report annually and periodically on the implementation of teacher recruitment, utilization, and training work to the provincial People's Committee."

3. Amend and supplement Article 3 as follows:

"Article 3. Funding for training activities

1. For public institutions, funding for training activities shall be guaranteed from the following sources:

a) State budget funds according to the legal provisions on the financial autonomy mechanism of public institutions;

b) Income from tuition fees and service charges;

c) Other income as prescribed by law.

a) Amend and supplement the name of Article 15 as follows:

4. Amending and supplementing Article 4 as follows:

"Article 4. Recruitment of Teachers

The recruitment of teachers in public vocational education institutions shall be carried out in accordance with the provisions set forth in Chapter II of Decree No. 115/2020/NĐ-CP dated September 25, 2020, of the Government on the recruitment, utilization, and management of civil servants.

5. Amend and supplement Article 5 as follows:

"Article 5. Use of Teachers

1. Persons recruited to the position of civil servant in the vocational education profession must undergo the probation period as stipulated in Article 21 of Decree No. 115/2020/NĐ-CP dated September 25, 2020, of the Government on the recruitment, utilization, and management of civil servants.

2. Vocational education institutions, vocational education activity institutions, and vocational training centers - regular education must employ vocational education teachers who meet the standards as prescribed, are suitable for the fields they have been trained in, and comply with the agreements in their employment contracts or labor contracts.

6. Amend and supplement Article 13 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Direct vocational education institutions, vocational education activity institutions, and vocational training centers - regular education under their jurisdiction to implement the provisions of this Circular."

b) Amend and supplement Clause 3 as follows:

"3. Manage, direct, inspect, and supervise the recruitment of teachers in public vocational education institutions; utilize and train vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational training centers - regular education under their jurisdiction; report annually and at any time on the implementation of teacher training work to the Ministry of Labor, Invalids and Social Affairs (General Department of Vocational Education)."

7. Amend and supplement Article 14 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Assist provincial People's Committees and municipal People's Committees directly under the Central Government in directing and guiding vocational education institutions, vocational education activity institutions, and vocational training centers - regular education under their jurisdiction to implement the provisions of this Circular."

b) Amend and supplement Clause 3 as follows:

"3. Inspect and check the organization and implementation of teacher recruitment in public vocational education institutions under their jurisdiction; the utilization and training of vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational training centers - regular education. Report annually and at any time on the implementation of teacher recruitment, utilization, and training work to provincial People's Committees and municipal People's Committees directly under the Central Government."

8. Amend and supplement Article 15 as follows:

a) Amend and supplement the name of Article 15 as follows:

"Article 15. Responsibilities of vocational education institutions, vocational education activity institutions, and vocational education - general education centers.

b) Amend and supplement Clause 1 as follows:

"1. Develop recruitment plans for teachers in public vocational education institutions; plans for using and training vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education - general education centers for each phase and annually to be submitted to the competent authority for approval."

Article 2. Amending and supplementing some articles of Circular No. 07/2017/TT-BLDTBXH dated March 10, 2017, issued by the Minister of Labor, Invalids and Social Affairs, on the working regime of vocational education teachers.

1. Amend and supplement Article 1 as follows:

"Article 1. Scope of Regulation and Applicability
1. This Circular stipulates the working regime of vocational education teachers teaching in vocational education institutions, vocational education activity institutions, and vocational education - general education centers.

2. This Circular applies to vocational education teachers, management officials, and those participating in teaching at college, intermediate, and primary levels, and other vocational training programs specified in points a, b, c, and d of Clause 1, Article 40 of the Vocational Education Law (hereinafter referred to as other vocational training programs) in vocational education institutions, vocational education activity institutions, and vocational education - general education centers; relevant agencies, organizations, and individuals.

3. This Circular does not apply to teachers teaching teacher training programs under the management of the Ministry of Education and Training; teachers currently teaching at colleges and intermediate schools as prescribed in Circular No. 96/2017/TT-BQP dated April 27, 2017, issued by the Minister of National Defense, on the standard teaching hours and scientific research hours for teachers in the Vietnam People's Army.

2. Amending and supplementing Article 2 as follows:

"Article 2. Standard hours, teaching time, lecture hour quota

1. Standard hour is a unit of time converted from the necessary labor hours before, during, and after class to complete direct or online teaching tasks. One standard hour of online teaching equals one standard hour of direct teaching.

A standard hour is calculated for theoretical teaching with no more than 35 students; practical and integrated teaching with no more than 18 students; and for heavy, toxic, and dangerous trades according to the list issued by the Minister of Labor, Invalids and Social Affairs with no more than 10 students. The Principal, Director of vocational education institutions, vocational education activity institutions, and vocational education - general education centers shall base the specific number of students in each class to convert standard hours appropriately to fit actual conditions and characteristics of each trade.

2. Teaching time in the training plan is calculated in standard hours, including:

a) One theoretical teaching hour of 45 minutes is equivalent to one standard hour;

b) One integrated teaching hour (combining both theory and practice) of 60 minutes is equivalent to one standard hour;

c) One practical teaching hour is 60 minutes equivalent to one standard hour. 3. The teaching quota is determined as the number of standard hours that each teacher must teach, regulated annually.

3. Amend and supplement Clause 12 of Article 3 as follows:

"12. Perform other tasks as required by the Principal, Director of vocational education institutions, vocational education activity institutions."

4. Amending and supplementing Article 4 as follows:

a) Amending and supplementing Point b Clause 1 as follows:

"b) Study, standardization training, advanced training, scientific research: 08 weeks for college-level teachers; 04 weeks for intermediate-level teachers. The Principal, Director of vocational education institutions, vocational education activity institutions shall base on actual conditions and characteristics of each training program to specify scientific research requirements for teachers and decide the minimum number of research hours that teachers must complete in a school year;"

b) Amend and supplement Clause 2 as follows:

"2. The annual summer vacation period for teachers is 06 weeks; for management officials and those holding lecturer positions in vocational education who participate in teaching as prescribed in Clause 5 of Article 5 of this Circular is 04 weeks, including annual leave. During the summer vacation, teachers receive full salary and allowances (if applicable). In addition to the summer vacation, teachers also enjoy holidays and other days off as stipulated in the Labor Code. The summer vacation of teachers in vocational education institutions under the Ministry of Public Security and the Ministry of National Defense shall be implemented according to Clause 4 of Article 3 of Decree No. 84/2020/NĐ-CP dated July 17, 2020, of the Government detailing certain provisions of the Education Law."

Based on the academic year plan and actual conditions, the Principal, Director of vocational education institutions, vocational education activity institutions shall arrange for teachers to take summer vacation at appropriate times.

5. Amend and supplement Article 5 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Teaching quota of teachers in one academic year: From 350 to 450 standard hours for college-level teachers; from 400 to 510 standard hours for intermediate-level teachers.

The Principal, Director of vocational education institutions, vocational education activity institutions shall base on actual conditions and characteristics of each training program to decide the teaching quota and the minimum number of hours that teachers must teach in accordance with the academic year."

b) Amend and supplement Clauses 4 and 5 as follows:

"4. The teaching quota of teachers participating in teaching multiple levels in one academic year is calculated and applied according to the teaching quota at the highest level. The Principal, Director of vocational education institutions, vocational education activity institutions shall stipulate conversion factors for lower levels to calculate the standard hours quota in one academic year for teachers in line with actual conditions and characteristics of each training program.

5. The teaching quota for management officials; those holding lecturer positions in vocational education is defined as follows:

a) Chairman of the School Council, Principal: 8% of the teaching hour quota per year;

b) Deputy Principal: 10% of the teaching hour quota per year;

c) Department Heads and equivalents: 14% of the teaching hour quota per year;

d) Deputy Department Heads and equivalents: 18% of the annual teaching quota; d) For other officials: 20% of the annual teaching quota."

6. Amend and supplement Clause 10 of Article 6 as follows:

"10. Perform other tasks as required by the Principal, Director of vocational education institutions, vocational education activity institutions, vocational education - general education centers."

7. Amend and supplement Article 7 as follows:

a) Amend and supplement Point d Clause 1 as follows:

"d) In cases where teachers do not use up all the time allocated for training, standardization enhancement, advanced enhancement; observing classes, exchanging teaching experience; participating in professional and vocational activities as prescribed, the Principal, Director of vocational education institutions, vocational education activity institutions, vocational education and general education centers shall convert the remaining time to teaching work or other tasks assigned by the Principal, Director, and such converted hours shall be added to the teacher's annual teaching quota. The number of converted hours shall be calculated based on the ratio between the unused time for training, standardization enhancement, advanced enhancement, observing classes and exchanging teaching experience with the actual time spent on teaching and educating students as stipulated in point a, Clause 1 of this Article. In cases where teachers participate in training courses exceeding two weeks, they shall have their teaching hours reduced according to the provisions of point a, Clause 4, Article 10 of this Circular."

b) Amend and supplement Clause 2 as follows:

"2. The annual summer vacation period for teachers is four weeks; for management staff, lecturers, and vocational education teachers who engage in teaching as specified in Clause 2, Article 8 of this Circular is three weeks, including annual leave. During the summer vacation, teachers shall receive full salary and allowances (if applicable). In addition to the summer vacation, teachers also enjoy holidays and other days off as prescribed by the Labor Code. The summer vacation arrangements for teachers in vocational education institutions under the Ministry of Public Security and the Ministry of National Defense shall be implemented according to the provisions of Clause 4, Article 3 of Decree No. 84/2020/NĐ-CP dated July 17, 2020 of the Government detailing certain provisions of the Vocational Education Law."

Based on the academic year plan and actual conditions, the Principal, Director of vocational education institutions, vocational education activity institutions, vocational education and general education centers shall arrange for teachers to take summer vacation at appropriate times.

8. Amend and supplement Article 8 as follows:

"Article 8. Teaching Hour Standards

1. The annual teaching quota for teachers teaching primary level and other vocational training programs as stipulated in points a, b, c, and d, Clause 1, Article 40 of the Vocational Education Law is from 450 to 580 standard hours.

The Principal, Director of vocational education institutions, vocational education activity institutions, vocational education and general education centers shall determine the teaching quota and the minimum number of teaching hours required for teachers each academic year based on actual circumstances and the characteristics of each training program.

2. The teaching hour standards for managerial staff; lecturers and vocational education teachers holding current positions are defined as follows:

a) Director: 8% of the teaching hour standard/year;

b) Deputy Director: 10% of the teaching hour standard/year;

c) Department Head or equivalent: 14% of the teaching hour standard/year;

d) Deputy Department Head or equivalent: 18% of the annual teaching quota; d) For other staff members: 20% of the annual teaching quota.

9. Amend and supplement Article 9 as follows:

a) Amend and supplement Clause 1 as follows:

"1. During the academic year, teachers, management staff; lecturers and vocational education teachers engaged in teaching whose teaching hours exceed the teaching quota prescribed in Clauses 1, 2, 3, and 5 of Article 5 and Article 8 of this Circular shall be counted as additional teaching hours."

b) Amend and supplement Clause 3 as follows:

"3. For management staff; lecturers and vocational education teachers engaged in teaching: the additional teaching hours shall not exceed 50% of the teaching quota prescribed in Clause 5, Article 5 and Clause 2, Article 8 of this Circular."

10. Amend and supplement Article 10 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Teachers may be appointed to leadership positions or concurrently undertake management duties:"

a) Teachers responsible for class counseling or study advising: Reduced by 15% of the teaching hour standard/class;

b) Teachers responsible for specialized classrooms/workshops: With dedicated staff, 10% reduction in teaching quota per classroom/workshop; without dedicated staff, 15% reduction in teaching quota per classroom/workshop;

c) Teachers serving as department heads, station chiefs, camp chiefs and equivalents; deputy department heads, deputy station chiefs, camp chiefs and equivalents; subject heads and equivalents; concurrently responsible for libraries: Shall be granted a reduction of 15% to 30% in teaching quota;

Teachers concurrently undertaking multiple duties as stipulated in points a, b, and c of this Clause shall be granted a total reduction in teaching quota but not exceeding 50% of the teaching quota. The Principal, Director of vocational education institutions, vocational education activity institutions, vocational education and general education centers shall decide on the specific percentage of teaching hour reduction based on actual conditions, the number of teachers, students, and trainees.

b) Amend and supplement Clause 3 as follows:

"3. The reduction in teaching hours prescribed in points a, b, and c of Clause 1 and Clause 2 of this Article shall not apply to management staff; lecturers and vocational education teachers as stipulated in Clause 5, Article 5 and Clause 2, Article 8 of this Circular."

11. Amend and supplement Article 11 as follows:

"Article 11. Conversion of other specialized activities into standard hours

1. Teaching:

a) One hour of teaching in a foreign language for subjects or modules that are not foreign languages shall be counted as 1.5 to 2.0 standard hours;

b) One hour of theoretical teaching for classes with a number of students exceeding the provisions set forth in Clause 4, Article 2 of this Circular shall be converted at a factor but not exceeding 1.5 standard hours;

c) One hour of teaching, guiding, and enhancing the professional skills of other teachers shall be counted as 1.5 standard hours;

d) Time spent on designing, improving, and making educational vocational equipment (approved at the department level or higher) shall be converted into standard hours;

đ) For physical education and national defense education teachers, the time spent on sports movement activities and military training for staff, teachers, and employees of vocational education activity institutions shall be counted as teaching time.

The Principal, Director of vocational education institutions, vocational education activity institutions, vocational education and general education centers shall specify the conversion to standard hours for calculating teaching workload for teachers as stipulated in points a, b, d, and đ of this Article.

2. The Principal, Director of vocational education institutions, vocational education activity institutions, vocational education and general education centers shall specify the conversion of activities such as preparing exams, invigilating, marking final module and subject exams; preparing graduation exams, invigilating, and marking graduation exams; guiding special topics and graduation projects (if any); marking special topics and graduation projects (if any); guiding internships and production-internship combinations; enhancing teachers participating in teaching contests at various levels; enhancing students participating in skill contests at various levels and other professional and vocational activities to standard hours for calculating annual teaching workload for teachers based on actual conditions.

12. Amend and supplement Article 13 as follows:

"Article 13. Responsibilities of Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and municipal People's Committees directly under the central government

Direct, guide, and inspect the implementation of the provisions of this Circular for vocational education institutions, vocational education activity institutions, vocational education and general education centers under their jurisdiction.

13. Amend and supplement Clause 2, Article 14 as follows:

"2. Inspect, examine, evaluate, compile, report periodically and at any time on the implementation of the working regime for vocational education teachers at vocational education institutions, vocational education activity institutions, vocational education and general education centers under the management authority of the People's Committee of provinces and centrally governed cities."

14. Amend and supplement Article 15 as follows:

a) Amend and supplement the name of Article 15 as follows:

"Article 15. Responsibilities of vocational education institutions, vocational education activity institutions, vocational education and general education centers"

b) Amend and supplement Clause 1 as follows:

"1. Specify in detail the working regime for teachers teaching all levels of vocational education at vocational education institutions, vocational education activity institutions, vocational education and general education centers in accordance with this Circular."

Article 3. Effectiveness

1. This Circular takes effect from March 1, 2023.

2. Repeal Clause 3, Clause 4 of Article 12 of Circular No. 06/2017/TT-BLDTBXH dated March 8, 2017 of the Minister of Labor, War Invalids and Social Affairs regarding recruitment, utilization, and training for vocational education teachers; Clause 1 of Article 3 of Circular No. 34/2018/TT-BLDTBXH dated December 26, 2018 of the Minister of Labor, War Invalids and Social Affairs amending and supplementing certain articles of Circular No. 42/2015/TT-BLDTBXH dated October 20, 2015 on primary vocational training, Circular No. 43/2015/TT-BLDTBXH dated October 20, 2015 on regular vocational training, Circular No. 07/2017/TT-BLDTBXH dated March 10, 2017 on the working regime for vocational education teachers, Circular No. 08/2017/TT-BLDTBXH dated March 10, 2017 on standards for professional expertise for vocational education teachers, Circular No. 10/2017/TT-BLDTBXH dated March 13, 2017 on graduation certificates for intermediate and college levels; printing, managing, issuing, recovering, and canceling graduation certificates for intermediate and college levels, and Circular No. 31/2017/TT-BLDTBXH dated December 28, 2017 on college, intermediate, and primary level training through combined work and study programs.
