Regulations on standard teaching hours and scientific research for teachers in the Vietnam People's Army

Pursuant to Decree No. 34/2016/ND-CP dated May 15, 2016 of the Government detailing certain provisions and implementing mechanisms of the Law on Enacting Legal Normative Documents; lPursuant to Decree No. 75/2006/ND-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law; Decree No. 31/2011/ND-CP dated May 11, 2011 of the Government amending and supplementing certain articles of Decree No. 75/2006/ND-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law; Decree No. 07/2013/ND-CP dated January 9, 2013 of the Government amending Point b Clause 13 Article 1 of Decree No. 31/2011/ND-CP dated May 11, 2011 of the Government amending and supplementing certain articles of Decree No. 75/2006/ND-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law;

Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Pursuant to Circular Joint No. 36/2014/TTLT-BGDĐT-BNV dated November 28, 2014 of the Minister of Education and Training and the Minister of Home Affairs stipulating codes and standards for job titles of teaching staff in public higher education institutions;ướPursuant to the proposal of the Chief of General Staff,

Pursuant to the Government Decree No. 141/2013/NĐ-CP dated October 24, 2013 detailing and guiding the implementation of certain articles of the Higher Education Law;

The Minister of National Defense promulgates this Circular on regulations regarding standard teaching hours and scientific research for teachers in the Vietnam People's Army.No. Article 1. This Circular stipulates standard teaching hours and scientific research for lecturers, teachers, educational management officers concurrently teaching, institute staff, and research fellows of institutes under academies when participating in teaching (hereinafter referred to collectively as teachers) in the Vietnam People's Army.

Article 2. This Circular applies to academies, universities, military officer schools, vocational colleges, secondary technical schools, and military schools (hereinafter referred to collectively as military schools) that organize training in accordance with the law, and related agencies, units, organizations, and individuals; it does not apply to teachers teaching at kindergartens, general education schools, national defense education centers, and security education centers.

AND trArticle 3. Teachers during maternity leave or long-term sick leave shall be exempted according to the corresponding ratio to the time they receive social insurance benefits. Female teachers with children under 36 months old shall be exempted from duties according to the corresponding ratio to the working time exempted under the current Labor Code.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 4. To improve the quality and effectiveness of teaching and scientific research; ensure transparency, fairness, and democracy in the implementation of teacher policies, rights, and obligations.

Article 5. To serve as a basis for the heads of military schools to assign, arrange, utilize, evaluate, and classify teachers annually; educational management agencies to inspect, review, evaluate, build policies, training programs, and enhance the capacity of the teacher workforce.

Article 6. To serve as a foundation for teachers to develop plans for teaching, scientific research, and professional development.

Article 2. Purpose

STANDARD TEACHING HOURS AND SCIENTIFIC RESEARCH

2. As the basis for the Head of Military School to assign, arrange, utilize, evaluate, and classify teachers annually; educational management agencies to inspect, review, assess, develop policies, training programs, and teacher development programs.

3. As the foundation for teachers to build teaching plans, scientific research, and study plans to enhance their professional expertise.

Chapter II

REGULAR TEACHING AND RESEARCH HOURS

Article 3. Standard Teaching Hours

1. Standard teaching hours (hereinafter referred to as standard hours) are units of time converted for performing an equivalent task for one class period (45 minutes) of direct theoretical instruction in classrooms.

2. The standard hour quota for teachers in one academic year

a) Teachers working at academies, military officer schools, universities, and colleges shall have 270 standard hours.

b) Teachers of secondary vocational schools, military district schools, corps schools, the Military School under the Command of Hanoi, provincial military schools, and city military schools shall have 300 standard hours.

c) Heads of educational institutions shall set appropriate standard hour quotas for pilot training, submarine training, tank driving, armored vehicle driving, special forces, missile training based on the nature, characteristics, and conditions of pedagogical labor, but not exceeding the standard hour quota prescribed herein.

d) Direct classroom teaching hours must account for at least 50% of the prescribed quota.

3. During their probationary or trial periods, teachers shall only implement up to 50% of the prescribed standard hour quota as stipulated in Clause 2 of Article 3 of this Circular.

Article 4. Conversion to Standard Hours

1. One class period of theoretical or integrated (both theory and practice) instruction in a classroom for one class is counted as 1.0 standard hour. One class period of theoretical instruction outside the training ground, practice field, or production workshop for one class is counted as 1.2 standard hours.

2. One class period of exercise guidance, practical work, experimentation, discussion in a classroom is counted as a maximum of 1.0 standard hour. One class period of daytime practical instruction outside the training ground, practice field, or production workshop such as live-fire exercises, tactics, command and staff training, comprehensive training, field training, technical training, skill practice in tactical, military engineering, general military, and specialized subjects is counted as 1.2 standard hours.

3. One evening class period, except for field training or physical training, is counted as 1.2 standard hours.

4. One class period of specialized lectures or theoretical instruction for master's degree classes is counted as 1.5 standard hours, and for doctoral degree classes is counted as 2.0 standard hours.

5. One class period of instruction in a foreign language for non-language subjects is counted as 2.0 standard hours.

6. One class period of instruction for special military training environments such as pilot training, submarine training, tank driving, armored vehicle driving, missile training, special forces training, teaching in self-propelled artillery, military-specific vehicles, live-fire exercises, based on the nature, characteristics, and conditions of pedagogical labor, heads of educational institutions may apply specific conversion of standard hours but not exceeding 2.0 standard hours.

7. Guidance for student field trips, internships, practical experiences: One working day is counted as a maximum of 2.5 standard hours.

8. Guidance for one major assignment (a compulsory assignment with unique characteristics of the subject) is counted as a maximum of 0.5 standard hours. Guidance for course projects is counted as a maximum of 1 standard hour for each project. Guidance for graduation projects, thesis is counted as a maximum of 25 standard hours for each project, thesis.

9. Guidance for master's theses is counted as a maximum of 70 standard hours for each thesis.

10. Guidance for doctoral dissertations is counted as a maximum of 200 standard hours for each dissertation, where the first supervisor is counted as 120 standard hours, and the second supervisor is counted as 80 standard hours.

11. Reading and reviewing graduation projects, theses is counted as a maximum of 5 standard hours for each project, thesis.

12. Reading and reviewing master's theses is counted as a maximum of 10 standard hours for each thesis.

13. Reading and reviewing doctoral dissertations is counted as a maximum of 20 standard hours for each dissertation.

14. Each member of the examination board evaluating: one major assignment is counted as a maximum of 0.2 standard hours; three course projects are counted as 1 standard hour; one graduation project, thesis is counted as a maximum of 1.5 standard hours.

15. Each member of the examination board evaluating: one master's thesis (with a review) is counted as a maximum of 3 standard hours; one doctoral dissertation (with a review) is counted as a maximum of 5 standard hours.

16. Heads of educational institutions shall specify the conversion of time spent on tasks such as setting examination questions, preparing examination answers, participating in examination boards, supervising examinations, grading final exams for courses, teacher excellence competitions, graduation examinations for primary, secondary, college, and university levels, training for competition teams, and sports events.

Article 5. Standard hour quota for teachers holding leadership, command, management positions, and mass organization work in schools

1. The standard hour quota for teachers holding leadership, command, management positions, and mass organization work in schools shall be calculated as a percentage of the standard hour quota prescribed in Clause 2, Article 3 of this Circular as follows:

a) Director (principal), political commissar: 10%.

b) Deputy director (deputy principal), Deputy political commissar: 15%.

c) Department head (equivalent position): 25%.

d) Deputy department head, section chief and equivalent: 30%.

đ) Head of faculty (equivalent position) holding the position of party branch secretary: 50%; holding the position of deputy secretary: 60%; otherwise: 70%.

e) Deputy head of faculty (equivalent position) holding the position of party branch secretary: 60%; holding the position of deputy secretary: 65%; otherwise: 75%.

g) Head of discipline holding the position of party cell secretary, assistant to the faculty: 75%; head of discipline (not holding the position of party cell secretary): 80%.

2. For teachers concurrently holding multiple positions, the lowest standard hour quota among the concurrently held positions as stipulated in Article 5 of this Circular shall apply.

Article 6. Scientific Research

1. The time quota for scientific research for teachers in one academic year

a) Teachers working at academies, officer training schools, universities, and colleges: 360 standard hours.

b) Teachers working at secondary vocational schools, military district schools, corps schools, Military Command School of the Capital Command, provincial military schools: 200 standard hours.

2. Military schools must assign scientific research tasks to teachers in accordance with the school's conditions, scientific potential, scientific and technological development orientation, and the teachers' professional capabilities.

3. Each year, teachers will be recognized as having completed their scientific research tasks if they meet one of the following criteria:

a) Leading or participating in a scientific research project or initiative at the faculty level (equivalent) or higher.

b) At least one scientific article published in a peer-reviewed journal or a scientific report presented at a specialized scientific conference.

c) Serving as editor or co-authoring and being evaluated as meeting or exceeding requirements for at least one textbook, regulation manual, combat tactics, or battle manual at the institutional level or higher.

d) Converting research time into standard hours to meet the scientific research time quota as prescribed in Clause 1, Article 6 of this Circular.

4. If teachers fail to complete the quota set out in Clauses 1 and 3 of this Article, the school head shall assess the results of their performance in the academic year based on the specific circumstances, rank them for commendation, and address related policies; if they exceed the research quota, in addition to considering rewards, the school head shall decide to include it in the teaching hour quota for teachers.

Article 7. Conversion of Scientific Research Time into Standard Hours, Unused Scientific Research Time into Teaching Time

1. Participating in compiling textbooks and materials at the faculty level or higher, reviewing, revising, editing, proofreading, reading, and commenting on textbooks and materials at all levels

a) Participating in compiling textbooks and materials at the faculty level or higher: 1 page (350 words) is equivalent to 1.2 standard hours, 1 page with illustrations is equivalent to 1.0 standard hour.

b) Reviewing, revising, editing, proofreading, reading, and commenting on textbooks and materials at the faculty level (equivalent) or higher: 1 page is equivalent to 0.1 standard hour; at the school level (equivalent) or higher: 1 page is equivalent to 0.2 standard hours.

2. Scientific Research

a) A non-peer-reviewed scientific article published in a scientific journal with an ISSN index, each page (350 words) is equivalent to 15 standard hours.

b) An article presented at a seminar published in the proceedings of academies, subordinate schools under the Ministry, services, arms, and equivalents, each page (350 words) is equivalent to 10 standard hours.

c) A teacher guiding a student research project, if the result is good, is equivalent to 10 standard hours; if excellent, is equivalent to 25 standard hours.

d) A teacher directly guiding students who win national-level Olympiads, skill competitions, or defense ministry youth innovation contests, or advance to round 2 (regional level) or higher in the national Robocon competition is equivalent to 50 standard hours.

đ) A teacher reading and commenting on 1 project proposal or initiative is equivalent to 5 standard hours.

e) A teacher reading and commenting on 1 draft project or initiative is equivalent to 10 standard hours.

g) A member of the acceptance committee for 1 project or initiative is equivalent to 2.0 standard hours.

3. Calculation method for converting unused scientific research time as follows: Unused time equals the scientific research time quota minus the used time.

4. If teachers do not use up their scientific research time quota, they must convert that time into teaching time and add it to their teaching time quota.

Article 8. Provisions on the calculation of excess standard hour quota

1. The time exceeding the standard hour quota shall be calculated collectively for subjects or departments that have only one subject.

2. The method of calculating the excess standard hour quota for subjects (departments) is as follows: The total number of excess standard hours equals the total number of standard hours performed in a year minus the total number of standard hours required to be performed according to the prescribed quota.

3. Each subject determines the excess standard hours for each teacher, compiles a report to be reviewed and decided by the head of the school.

4. Postgraduate teaching hours, reading and reviewing, guiding, grading graduation theses, master's theses, doctoral dissertations, invigilation, grading graduation exams for training courses, time for command exercise at the operational and tactical level in the basic training program of schools as stipulated by the Ministry of National Defense or authorized agencies, shall be included in the teaching time quota, but if they exceed the standard hour quota, those hours will not be paid as overtime compensation for exceeding the standard hour quota.

5. If teachers are invited to teach outside the school, such teaching time shall not be counted towards the standard hour quota.

Article 9. Benefits when exceeding the standard hour quota

1. Teachers who exceed the standard hour quota shall be entitled to receive overtime compensation for exceeding the standard hour quota as prescribed.

2. Overtime pay for teachers who exceed the standard hour quota shall be paid according to the regulations of the Ministry of National Defense; the number of hours to be paid shall not exceed the standard hour quota as stipulated in Clause 2, Article 3 and Article 5 of this Circular.

3. For management staff in Military Schools, if they meet the conditions stipulated and directly teach 25% or more of the standard hour quota, they may be recognized as part-time teachers and enjoy the same benefits and policies as teachers.

Chapter III

IMPLEMENTATION

Article 10. Responsibilities of Military Schools

Based on the provisions of this Circular and the specific characteristics of each subject and specialty, as well as the practical conditions of the school, they shall issue or submit to the competent authority for issuance detailed regulations on the teaching hour quota and scientific research for teachers.

Article 11. Implementation Provisions

1. This Circular takes effect from June 12, 2017.

2. Upon the effectiveness of this Circular, Decision No. 744/QĐ-TM dated December 5, 1994 of the General Staff on the tasks and working time quotas for teachers in Military Schools shall be abolished.

The General Staff Chief, heads of agencies, units, organizations, and individuals concerned shall be responsible for implementing this Circular.
