Directive No. 280-TTg Regarding the Acceptance of Foreign Nationals for Scientific Research and Study in Vietnam

DIRECTIVE

OF THE PRIME MINISTER

Regarding the reception of foreign individuals for scientific research and study in Vietnam

In recent years, pursuant to cooperation training agreements between our country and other countries, some of our scientific research and education institutions have received foreign individuals for scientific research and study.

With the expansion of international exchanges and cooperation in economic, cultural, scientific and technological, educational and training fields, the number of foreign individuals coming to Vietnam for scientific research and study will increase in quantity and diversify in form.

To meet the aforementioned needs and to unify state management, the Prime Minister issues the following directive:

1. Scientific research institutions, educational and training establishments shall create favorable conditions for foreign individuals (including overseas Vietnamese) who have the willingness and meet the prescribed conditions to engage in scientific research and study at Vietnamese research facilities, educational and training establishments through the following channels:

a) Pursuant to agreements between the Government of Vietnam and foreign governments or international organizations.

b) Through agreements within joint ventures, projects, or cooperation plans between sectors, localities, economic, cultural, social organizations, Vietnamese educational and training, research establishments with corresponding organizations abroad or international organizations.

c) Through sponsorship or patronage by individual Vietnamese or foreign scientists, social activists, relatives residing and operating production, business activities in Vietnam or abroad, Vietnamese organizations, international organizations, directly through contracts signed between educational, training, research establishments and individuals coming to study or research, or through intermediary organizations.

2. The Ministry of Science, Technology, and Environment shall be responsible for managing the reception of foreigners for scientific research, while the Ministry of Education and Training shall be responsible for managing and receiving foreigners for study.

The two Ministries shall coordinate with relevant sectors to issue regulations on:

Fields of science and technology, professions permitted to receive foreigners.

Conditions and standards required of establishments permitted to receive foreigners.

Responsibilities of Vietnamese or foreign organizations (or individuals) in sponsoring (signing contracts, intermediating, etc.) for foreigners to study or research in Vietnam.

Qualifications, diplomas, health conditions of foreigners accepted for study and research.

Scholarship, tuition fee, insurance systems...

Review procedures and formalities.

Management system for foreigners in entry, exit, and during their study and research period in Vietnam.

3. The Ministry of Home Affairs and the Ministry of Foreign Affairs shall cooperate with the Ministry of Science, Technology, and Environment and the Ministry of Education and Training to carry out necessary procedures for foreigners to conduct scientific research and study in our country according to current regulations.

4. Ministers of Ministries, Heads of agencies equivalent to Ministries, agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Directive.

4. The Ministers of the ministries, the Heads of ministerial-level agencies, the agencies under the Government, and the Chairpersons of the People's Committees of the provinces and centrally governed cities shall be responsible for implementing this Directive.
