CIRCULAR
REGULATIONS ON THE FRAMEWORK PRICES FOR PLANT PROTECTION CHEMICAL TESTING SERVICES
Pursuant to the Law on Fees and Charges No. 97/2015/QH13 dated November 25, 2015;
Pursuant to the Law on Prices No. 11/2012/QH13 dated June 20, 2012;
Pursuant to Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing certain provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

At the proposal of the Director of the Price Management Department;
The Minister of Finance issues this Circular regulating the framework prices for plant protection chemical testing services as follows:
Article 1. Scope of Regulation
This Circular regulates the framework prices for plant protection chemical testing services.
Article 2. Applicability
This Circular applies to units, organizations, and individuals providing and using plant protection chemical testing services; state management agencies for plant protection and other related organizations and individuals.
Article 3. Plant Protection Chemical Testing Service Prices

2. The framework prices stipulated in this Circular include value-added tax as prescribed by law.
3. The framework prices for plant protection chemical testing services in this Circular are collected in Vietnamese dong.
Article 4. Management and Use of Service Prices
1. When collecting fees for plant protection chemical testing services, the service provider must use invoices for service provision according to Decree No. 51/2010/NĐ-CP dated May 14, 2010 of the Government on sales invoices and service supply invoices; Decree No. 04/2014/NĐ-CP dated January 17, 2014 of the Government amending and supplementing some articles of Decree No. 51/2010/NĐ-CP dated May 14, 2010 of the Government on sales invoices and service supply invoices; Circular No. 39/2014/TT-BTC dated March 31, 2014 of the Ministry of Finance guiding the implementation of Decree No. 51/2010/NĐ-CP dated May 14, 2010 and Decree No. 04/2014/NĐ-CP dated January 17, 2014 of the Government on sales invoices and service supply invoices and any replacement or supplementary documents (if any).
2. Revenue from supplying plant protection chemical testing services, after fulfilling obligations to the state budget as prescribed by law, the head of the unit has the right to manage, use, and allocate funds according to the law.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. Based on the framework prices issued with this Circular, the head of the organization or unit providing plant protection chemical testing services shall specify specific service prices for plant protection chemical testing services in accordance with the law.
2. Units providing plant protection chemical testing services must display and publicly announce prices in accordance with the law on prices.
Article 6. Implementation Provisions
1. This Circular takes effect from January 1, 2017.
During implementation, if any difficulties arise, organizations and individuals are requested to promptly reflect them to the Ministry of Finance for study and supplementary guidance./.

Travel costs are agreed upon between the service testing agency and the organization or individual using the plant protection chemical testing service.
