Decree No. 285/2025/NĐ-CP Abolishes Certain Government Decrees

ABOLISHING CERTAIN DECREES OF THE GOVERNMENT

Pursuant to Law on Government Organization No. 63/2025/QH15;

Pursuant to Law on Issuance of Legal Regulatory Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

At the proposal of the Minister of Justice;

The Government promulgates this Decree to abolish certain decrees of the Government.

Article 1. Abolish the following decrees in their entirety:

Abolish the following decrees in their entirety:

1. Decree No. 35/2005/NĐ-CP dated March 17, 2005 of the Government on disciplinary measures for civil servants and public officials.

2. Decree No. 105/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Intellectual Property Law regarding the protection of intellectual property rights and state management of intellectual property.

3. Decree No. 35/2007/NĐ-CP dated March 8, 2007 of the Government on electronic transactions in banking activities.

4. Decree No. 27/2010/NĐ-CP dated March 24, 2010 of the Government on mobilizing other police forces and village militia to cooperate with traffic police in patrolling and controlling traffic order and safety on roads when necessary.

5. Decree No. 119/2010/NĐ-CP dated December 30, 2010 of the Government amending and supplementing certain provisions of Decree No. 105/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Intellectual Property Law regarding the protection of intellectual property rights and state management of intellectual property.

6. Decree No. 137/2013/NĐ-CP dated October 21, 2013 of the Government detailing the implementation of certain provisions of the Electricity Law and the Law Amending and Supplementing Certain Provisions of the Electricity Law.

7. Decree No. 04/2015/NĐ-CP dated January 9, 2015 of the Government on implementing democracy in the operations of administrative agencies and public service units.

8. Decree No. 63/2020/NĐ-CP dated June 8, 2020 of the Government on the security industry.

Article 2. Abolish part of the following decrees:

Abolish part of the following decrees:

1. Abolish Clause 1, Article 12 of Decree No. 65/2017/NĐ-CP dated May 19, 2017 of the Government on special policies on varieties, capital, and technology in the development of cultivation and harvesting of medicinal plants.

2. Abolish Chapter III of Decree No. 08/2018/NĐ-CP dated January 15, 2018 of the Government amending certain decrees related to investment conditions under the management of the Ministry of Industry and Trade.

Article 3. Implementation Provisions

1. This Decree takes effect from December 30, 2025.

2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees, and relevant agencies and units shall be responsible for implementing this Decree.
