On the functions, tasks, powers, and organizational structure of the Telecommunications Department

THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Telecommunications Department,

Pursuant to …;

Article 1: The Telecommunications Department is the advisory body assisting the Minister in exercising state management functions in the field of telecommunications and the Internet as prescribed by law.

Article 2: The Telecommunications Department has the following tasks and powers:

1. To take the lead or participate in drafting normative legal documents on telecommunications and the Internet.

2. To take the lead or participate in drafting mechanisms and policies for the development and management of telecommunications and the Internet.

3. To propose the suspension of enforcement or amendment, abolition of documents issued by Ministries, People's Councils, People's Committees, Chairpersons of Provincial People's Committees, and directly governed cities that contravene normative legal documents on telecommunications and the Internet.

4. To take the lead in reviewing applications for permits related to telecommunications and the Internet; to submit to the Minister for issuance, temporary suspension, suspension, or revocation of telecommunications and Internet licenses; to organize inspections of the implementation of issued licenses.

5. To manage business operations concerning the connection of telecommunications networks and the Internet.

6. To take the lead in drafting, amending, supplementing, or reviewing telecommunication resource planning, management regulations; to allocate and reclaim telecommunications codes and numbers.

7. To submit to the Minister for decision-making on measures to mobilize means, equipment, networks, and services for telecommunications and the Internet to serve urgent national security and disaster situations as prescribed by law..

8. To manage the activities of associations and non-governmental organizations in the field of telecommunications and the Internet according to the division of labor by the Minister..

9. To resolve disputes between enterprises in the provision and use of telecommunications and Internet services; to participate in resolving disputes between individuals and enterprises in the provision and use of telecommunications and Internet services.

10. To participate in reviewing projects, strategies, plans, mechanisms, and policies for the development of telecommunications and the Internet both within and outside the sector.

11. To take the lead in coordinating and harmonizing the Ministry’s state management work on the Internet with other Ministries, agencies at the ministerial level, government agencies, provincial People's Committees, and directly governed cities under the authorization of the Minister.

12. To direct, guide, and inspect the implementation of tasks serving communication needs, ensuring safety and security in telecommunications and Internet activities.

13. To participate in guiding the implementation of normative legal documents on telecommunications and the Internet.

14. To participate in drafting quality standards and regulations on the application of quality standards in the field of telecommunications and the Internet.

15. To participate in drafting or reviewing fees, charges, prices, and tariffs for telecommunications products and services.

16. To participate in drafting or reviewing radio frequency planning and allocation; to inspect the use of frequencies and radio wave transmission equipment.

17. To participate in international cooperation activities, conferences in the field of telecommunications and the Internet both domestically and internationally; to participate in preparing content on telecommunications and Internet business for the Minister to attend domestic and international telecommunications and Internet conferences.

18. To participate with departments and units under the Ministry in training and issuing certificates in telecommunications and the Internet.

19. To participate in inspection and supervision of the implementation of policies, laws, and regulations on telecommunications and the Internet by organizations and individuals.

20. To prepare content related to telecommunications and the Internet and assist the Minister in participating in the Ministry's councils, steering committees, inter-ministerial councils, and command headquarters as assigned by the Minister.

21. To participate in researching and providing comments on draft normative legal documents of other ministries and sectors related to the field of telecommunications and the Internet.

22. To manage organization, civil servants, documents, and assets of the Department in accordance with the law and the delegation of the Minister.

23. To perform other tasks assigned by the Minister.

Article 3: The Telecommunications Department is headed by the Director and includes Deputy Directors, specialized staff members to assist.

The Director is responsible to the Minister for the results of performing the functions, tasks, and powers stipulated in Article 1 and Article 2 of this Decision.

Deputy Directors assist the Director and are responsible to the Director for the tasks assigned to them.

The tasks and powers of staff members in the Department are defined by the Director.

Article 4: This Decision takes effect from the date of signature. Previous provisions contrary to this Decision are abolished.

Article 5: The Head of the Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Telecommunications Department, heads of departments and units under the Ministry are responsible for implementing this Decision.
