PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Article 1. Other types of artistic performances

Pursuant to the Ordinance on Representative Agencies of the Socialist Republic of Vietnam Abroad issued in 1993;

Pursuant to Decree No. 183/CP dated November 18, 1994 of the Government detailing the implementation of the Ordinance on Representative Agencies of the Socialist Republic of Vietnam Abroad;

Considering the proposal of the Minister of Culture, Sports and Tourism.

DECISION:

Article 1. Establishment and definition of the position and functions of the Vietnam Cultural Center in the French Republic

1. Establish the Vietnam Cultural Center in the French Republic.

2. The Vietnam Cultural Center in the French Republic, abbreviated as the Vietnam Cultural Center in France, is a cultural public service unit, a representative agency of the Ministry of Culture, Sports and Tourism of Vietnam abroad, with the function of organizing cultural exchange activities, information dissemination, and tourism aimed at enhancing the understanding of the people of France and Europe about Vietnam; providing information on economic and social conditions, policies, laws, and promoting tourism and supporting sports activities.

3. The Vietnam Cultural Center in France has legal personality, its own bank account and seal; its name in French is "Centre culturel du Vietnam en France," abbreviated as CCV.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Vietnam Cultural Center in France shall perform the following tasks and powers:

1. Submit to the Minister of Culture, Sports and Tourism for decision:

a) The long-term and annual activity plans of the Vietnam Cultural Center in France;

b) Issuing or submitting to competent authorities for issuance mechanisms and preferential policies to support other cultural and social institutions in Europe, appropriate to each stage, period, and significant national anniversaries;

c) The regulations on organization, operation, and management of the Vietnam Cultural Center in France.

2. Organize the following activities:

a) Cultural, artistic, educational, scientific and technological, trade promotion, investment, tourism, culinary, sports, traditional medicine, and other activities that need to be promoted in Europe;

b) Introducing Vietnam's past and present in various aspects of social life;

c) Researching and organizing cultural, sports, and tourism exchanges between Vietnam and France and other European countries;

d) Teaching Vietnamese language and arts classes and maintaining the Vietnamese language within the Vietnamese community in France.

3. Organize the following activities to support related cultural institutions in Europe:

a) Cultural programs in Europe involving domestic units and overseas Vietnamese;

b) Tours and cultural exploration trips for Vietnamese research teams;

c) Seminars, discussions, exchanges, and lectures on Vietnamese and international culture, art, tourism, economy, investment, and social sciences;

d) Report to the Minister of Culture, Sports and Tourism on major cultural and artistic activities related to Vietnam and the activities of the Vietnamese community in European countries.

4. Implement investment projects, renovation, and repair of premises; engage domestic and foreign organizations and individuals as consultants, participants in the renovation, construction, and operation of the Vietnam Cultural Center in France according to the directives of the Minister of Culture, Sports and Tourism and in accordance with international treaties and agreements between the Socialist Republic of Vietnam and the French Republic.

5. Study the operational experience of cultural institutions from other countries located in France and Vietnam to serve the organization and operation of the Vietnam Cultural Center in France.

6. Coordinate with relevant agencies in implementing external information work tasks in France and Europe.

7. Coordinate with the authorities of the French Republic in researching cultural and information activity needs in France and European countries, proposing and organizing the activities of overseas Vietnamese cultural centers, including mechanisms, policies, organizational structures, forms, and contents of activities.

8. Manage the organizational structure and staffing; implement salary, bonus systems, and other policies for staff of the Vietnam Cultural Center in France as prescribed by law.

9. Manage and utilize technical facilities, finance, and assets of the Vietnam Cultural Center in France in accordance with state regulations.

10. Comply with Vietnamese law, French law, international treaties, and agreements related to the organization and operation of the Vietnam Cultural Center in France.

11. Implement reporting requirements to the Minister of Culture, Sports and Tourism and competent state agencies as prescribed by law.

12. Perform other tasks and powers assigned by the Minister of Culture, Sports and Tourism or as prescribed by law.

đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;

1. The Vietnam Cultural Center in France has five positions, including:

b) Deputy Director;

b) One Deputy Director;

c) One specialist responsible for cultural and artistic activities, tourism promotion, and sports events;

d) One specialist responsible for the library, internet space, and information communication work兼任会计和出纳。

e) One accountant兼文书。

2. Based on the nature and job requirements, the Director may enter into contracts for two positions: class instructor and driver兼保安。In addition, depending on the needs and content of activities, the Director may enter into other temporary labor contracts.

3. The Director is appointed by the Minister of Culture, Sports and Tourism and appointed by the Minister of Foreign Affairs, and enjoys diplomatic privileges and immunities as prescribed by law.

Article 4. Operation Mechanism and Operating Expenses

1. The Vietnam Cultural Center in France shall be directly managed by the Minister of Culture, Sports and Tourism in terms of expertise and business operations, and shall be directed politically by the Vietnamese Embassy in France regarding external information.

2. The Ministry of Culture, Sports and Tourism shall be responsible for coordinating with the Ministry of Foreign Affairs and relevant ministries and sectors in the development and issuance according to its authority or submission to competent authorities for issuance of mechanisms and policies serving the organization and operation of the Vietnam Cultural Center in France.

3. Regarding the financial mechanism, the Vietnam Cultural Center in France shall operate in accordance with the guidelines of the Ministry of Finance applicable to Vietnamese representative offices abroad.

4. The sources of operating expenses for the Vietnam Cultural Center in France include:

a) Annual state budget allocated according to the approved annual budget estimate by the competent authority;

b) Revenue from the center's public service activities and services permitted by the State to retain according to regulations.

c) Other lawful sources (if any).

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

2. The Minister of Culture, Sports and Tourism, other Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, Director of the Vietnam Cultural Center in France, and related agencies, organizations, and individuals shall be responsible for implementing this Decision./.
