Provisions on registration for vocational training activities

Pursuant to the Vocational Training Law dated November 29, 2006;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Pursuant to Resolution No. 48/NQ-CP dated December 9, 2010 of the Government on simplifying administrative procedures within the scope of the Ministry of Labor - Invalids and Social Affairs' management functions;
The Ministry of Labor - Invalids and Social Affairs hereby stipulates provisions on registration for vocational training activities as follows:
PART I
GENERAL PROVISIONS
Article 1: Scope of Regulation
This Circular stipulates the authority, procedure, and process for registering and issuing certificates of registration for vocational training activities at the level of college vocational training, intermediate vocational training, and basic vocational training; additional registration for vocational training activities; submission and revocation of certificates of registration for vocational training activities.
Article 2. Applicability
This Circular applies to:
1. College vocational training schools, intermediate vocational training schools, public and private vocational training centers, and vocational training centers with foreign investment capital (hereinafter referred to collectively as vocational training establishments).
2. Universities, colleges, intermediate specialized schools, and other educational institutions (hereinafter referred to collectively as educational institutions).
3. Enterprises, cooperatives, production, business, and service establishments (hereinafter referred to collectively as enterprises).
Article 3. Purpose of Registration for Vocational Training Activities
Registration for vocational training activities aims to strengthen quality management of vocational training activities, ensuring that such activities are carried out in accordance with the provisions of the law.
PART I
PROCEDURE AND AUTHORITY FOR REGISTRATION AND ISSUANCE OF CERTIFICATE OF REGISTRATION FOR VOCATIONAL TRAINING ACTIVITIES
ISSUANCE OF THE CERTIFICATE OF REGISTRATION FOR VOCATIONAL TRAINING ACTIVITIES
Article 4. Documents for Registration for Vocational Training Activities
1. For college vocational training schools, intermediate vocational training schools, public and private vocational training centers, the documents for registration for vocational training activities include:
a) A letter of application for registration of vocational training activities (in accordance with the form attached as Appendix 1 to this Circular);
b) A report on the current status of conditions ensuring vocational training activities (in accordance with the form attached as Appendix 2 to this Circular);
c) Additionally, for public college vocational training schools, there must be a copy of the school charter approved according to regulations;
d) Additionally, for intermediate vocational training schools and vocational training centers under Ministries, agencies equivalent to Ministries, government agencies, and central organizations of political-social groups, there must be:
- A copy of the decision establishing the school or center;
- A copy of the intermediate vocational training school charter or vocational training center regulation approved according to regulations.
2. For college vocational training schools, intermediate vocational training schools, and vocational training centers with foreign investment capital, the documents for registration for vocational training activities can be in Vietnamese or both Vietnamese and English, including:
a) A letter of application for registration of vocational training activities (in accordance with the form attached as Appendix 1);
b) A copy of the Investment License or Decision establishing the school or center;
c) A report on the current status of conditions ensuring vocational training activities (in accordance with the form attached as Appendix 2).
3. For educational institutions and enterprises specified in Clauses 2 and 3 of Article 2 of this Circular, the documents for registration include:
a) A letter of application for registration of vocational training activities (in accordance with the form attached as Appendix 1);
b) A copy of the establishment decision;
c) A report on the current status of conditions ensuring vocational training activities (in accordance with the form attached as Appendix 3 to this Circular);
d) A copy of the charter or organizational regulation.
Article 5. Procedure and Process for Registration and Issuance of Certificate of Registration for Vocational Training Activities
1. For college vocational training schools, colleges, and universities:
a) Submit one set of documents for registration of vocational training activities to the General Department of Vocational Training;
b) Within twenty working days from the date of receiving complete and valid documents, the General Department of Vocational Training will organize the inspection of conditions ensuring vocational training activities and issue the certificate of registration for vocational training activities (in accordance with the form attached as Appendix 4 to this Circular); if the certificate is not issued, a written response must be provided, specifying the reasons;
c) Within ten working days from the date of issuance of the certificate of registration for vocational training activities, the General Department of Vocational Training will send a copy of the certificate of registration for vocational training activities to the Department of Labor - Invalids and Social Affairs where the college vocational training school, college, or university conducts vocational training activities, for area-based management.
2. For intermediate vocational training schools, vocational training centers, intermediate specialized schools, other educational institutions, and enterprises:
a) Submit one set of documents for registration of vocational training activities to the Department of Labor - Invalids and Social Affairs where the main office of the unit is located. In cases where vocational training activities are registered at branch offices/training facilities located in different provinces or centrally-administered cities from the main office, submit one set of documents for registration of vocational training activities to the Department of Labor - Invalids and Social Affairs where the branch office/training facility is located;
b) Within fifteen working days from the date of receiving complete and valid documents, the Department of Labor - Invalids and Social Affairs will organize the inspection of conditions ensuring vocational training activities and issue the certificate of registration for vocational training activities (in accordance with the form attached as Appendix 4); if the certificate is not issued, a written response must be provided, specifying the reasons;
c) Within ten working days from the date of issuance of the certificate of registration for vocational training activities, the Department of Labor - Invalids and Social Affairs will send a copy of the certificate of registration for vocational training activities to the General Department of Vocational Training for overall management.
Article 6. Conditions for Issuing a Registration Certificate for Vocational Training Activities
1. For trades training at the intermediate vocational level and college vocational level
a) The registered trades must be included in the list of trades for training issued by the Minister of Labor, Invalids and Social Affairs;
b) There must be appropriate physical facilities suitable to the trade, scale, and level of training, designed and constructed according to Vietnam Construction Standard TCXD VN 60: 2003 "Vocational School - Design Standards" issued by Decision No. 21/2003/QD-BXD dated July 28, 2003 of the Minister of Construction, specifically:
- Adequate theoretical classroom space to meet the training scale as prescribed. Theoretical classes shall not exceed 35 students;
- Practical classrooms and workshops that meet the practical requirements of the vocational training program. Practical classes shall not exceed 18 students.
c) There must be sufficient vocational training equipment as stipulated for trades with a list of vocational training equipment issued by the Minister of Labor, Invalids and Social Affairs. In cases where there is no specified list of vocational training equipment, it must ensure adequate vocational training equipment as stipulated in the training program corresponding to the scale of the registered trades;
d) There must be a teaching staff, lecturers, and management personnel in sufficient quantity and structure suitable to the trade and level of training; meeting the standards, professional qualifications, vocational skills, and pedagogical expertise required for vocational training; ensuring the implementation of the vocational training objectives and programs, including:
- The maximum ratio of converted students to converted teachers is 20 students per one teacher;
- The minimum proportion of full-time teachers among the total number of teachers is 70% for public vocational colleges, colleges, universities, intermediate vocational schools, and intermediate specialized schools; 50% for private vocational colleges, colleges, universities, intermediate vocational schools, and intermediate specialized schools; there must be full-time teachers for each trade organized for training;
đ) There must be detailed vocational training programs established based on the framework programs issued by the Minister of Labor, Invalids and Social Affairs.
2. For trades training at the basic vocational level
a) There must be appropriate physical facilities and vocational training equipment suitable to the trade, scale, and basic vocational training level. The minimum area of theoretical classroom space per converted student is 1.3 m²; the minimum area of practical classroom space per converted student is 2.5 m²;2/01 equivalent student; minimum practical classroom area of 2.5 m2/ 01 equivalent student;
b) There must be a teaching staff meeting the standards, professional qualifications, vocational skills, and pedagogical expertise required for vocational training as stipulated by law; ensuring the maximum ratio of converted students to converted teachers is 20 students per one teacher; there must be full-time teachers for each trade organized for training;
c) There must be sufficient vocational training programs and learning materials as stipulated.
Article 7. Authority to Issue a Registration Certificate for Vocational Training Activities
1. The Director of the General Department of Vocational Training, Ministry of Labor, Invalids and Social Affairs issues the registration certificate for vocational training activities for vocational colleges, colleges, and universities.
2. The Directors of Provincial Departments of Labor, Invalids and Social Affairs under central cities issue the registration certificate for vocational training activities for intermediate vocational schools, vocational training centers, intermediate specialized schools, other educational institutions, and enterprises.
Chapter III
REGISTRATION OF SUPPLEMENTARY VOCATIONAL TRAINING ACTIVITIES; SUBMISSION AND WITHDRAWAL
REGISTRATION CERTIFICATE FOR VOCATIONAL TRAINING ACTIVITIES
Article 8. Cases for supplementary registration of vocational training activities
Vocational training establishments, educational institutions, and enterprises specified in Clauses 1, 2, and 3 of Article 2 of this Circular that have been granted certificates of registration for vocational training activities must carry out supplementary registration of vocational training activities in the following cases:
1. Increasing the enrollment scale for each trade at the college level; exceeding 10% for the intermediate level and 20% for the basic level compared to the enrollment scale recorded in the certificate of registration for vocational training activities.
2. Adding new trades to be trained.
3. Supplementing or changing the level of training or adjusting the admission scale among different levels of training and among different trades within the same group of trades.
4. Dividing, splitting, merging, or changing investment permits related to the contents recorded in the certificate of registration for vocational training activities.
5. Moving the main office or branch/training facility to another location where the main office or branch/training facility directly organizes vocational training activities.
6. Establishing new branches/training facilities that organize vocational training activities.
7. Opening new training locations or collaborating with organizations and individuals to organize vocational training activities.
Article 9. Documents for supplementary registration of vocational training activities
1. The documents for supplementary registration of vocational training activities in the cases stipulated in Clauses 1, 2, 3, and 4 of Article 8 of this Circular include:
a) A letter registering supplementary vocational training activities (in accordance with Form 5 attached to this Circular);
b) A report on registering supplementary vocational training activities (in accordance with Form 6 attached to this Circular).
2. The documents for supplementary registration of vocational training activities in the cases stipulated in Clauses 5, 6, and 7 of Article 8 of this Circular:
a) For vocational college, college, and university, it shall be carried out in accordance with Clause 1 of this Article;
b) For vocational secondary schools, vocational training centers, vocational secondary specialized schools, other educational institutions, and enterprises: If the supplementary vocational training activities are conducted within the same province or centrally administered city as the main office, then the registration documents shall be carried out in accordance with Clause 1 of this Article; if the supplementary vocational training activities are conducted in a different province or centrally administered city from the main office, then in addition to the documents required under Clause 1 of this Article, the following documents must also be included:
- A copy of the decision on establishment or investment certificate;
- A copy of the appointment or recognition decision for the head of the vocational training establishment, educational institution, or enterprise;
- Official documents from the competent authority regarding the transfer of the main office/branch/training facility or the establishment of a new branch/training facility or training location.
Article 10. Procedures, formalities, conditions for registration, and authority to issue certificates of supplementary registration for vocational training activities
1. The procedures and formalities for supplementary registration of vocational training activities are implemented as follows:
a) For the cases stipulated in Clauses 1, 2, 3, and 4 of Article 8 of this Circular, they shall be carried out according to the procedures and formalities prescribed in Article 5 of this Circular;
b) For the cases stipulated in Clauses 5, 6, and 7 of Article 8 of this Circular, the procedures and formalities for supplementary registration of vocational training activities are as follows:
- In the case of establishing new branches/training facilities, training locations, or linking training or transferring the main office/branch/training facility, training location of the vocational training establishment, educational institution, or enterprise to another location within the same province or centrally administered city, the procedures and formalities for supplementary registration of vocational training activities shall be carried out in accordance with Article 5 of this Circular;
- In the case of establishing new branches/training facilities, training locations, or linking training or transferring the main office/branch/training facility, training location of vocational secondary schools, vocational training centers, vocational secondary specialized schools, other educational institutions, or enterprises to another location outside the province or centrally administered city where the main office is located, the vocational secondary schools, vocational training centers, vocational secondary specialized schools, other educational institutions, or enterprises must send a notification letter to the state agency that issued the certificate of registration for vocational training activities for the unit and submit the supplementary registration documents for vocational training activities to the Department of Labor, Invalids, and Social Affairs where the new branch/training facility, training location of the unit is located, in accordance with Clause 2, Article 5 of this Circular.
2. The conditions for registration and the authority to issue certificates of supplementary registration for vocational training activities shall be implemented in accordance with Articles 6 and 7 of this Circular.
3. The certificate of supplementary registration for vocational training activities shall be implemented in accordance with the form prescribed in Form 7 attached to this Circular.
Article 11. Submission, recovery of certificates of registration for vocational training activities1. Vocational training establishments, educational institutions, and enterprises that have been granted certificates of registration for vocational training activities must return the certificate of registration for vocational training activities to the issuing agency in the event of cessation of operations.
2. The agency issuing the certificate of registration for vocational training activities stipulated in Article 7 of this Circular has the right to revoke the certificate of registration for vocational training activities already issued when the vocational training establishment, educational institution, or enterprise is deprived of the right to use the certificate of registration for vocational training activities in accordance with Decree No. 116/2009/NĐ-CP dated December 31, 2009 of the Government on administrative penalties in the field of vocational training.
Responsibilities of the General Bureau of Vocational Training
Chapter IV
IMPLEMENTATION
Article 121. Directing, guiding, and organizing the implementation of registration for vocational training activities.
2. Receiving documents, organizing inspections of conditions ensuring vocational training activities, issuing, and recovering certificates of registration and supplementary registration for vocational training activities in the cases stipulated in Clause 1 of Article 7 and Clause 2 of Article 10 of this Circular.
3. Sending copies of certificates of registration for vocational training activities to the Department of Labor, Invalids, and Social Affairs in accordance with Point c, Clause 1 of Article 5 of this Circular.
4. Inspecting and supervising the implementation of registration for vocational training activities in accordance with the provisions of the law.
Responsibilities of the Department of Labor, Invalids, and Social Affairs
Article 131. Directing, guiding, and organizing the implementation of registration for vocational training activities at the local level.
1. Direct, guide, and organize the registration of vocational training activities at the local level.
2. Accept registration files, organize inspections of conditions ensuring vocational training activities, issue, recover certificates of registration for and additional registrations of vocational training activities as prescribed in Clause 2 Article 7 and Clause 2 Article 10 of this Circular.
3. Send copies of certificates of registration for vocational training activities to the General Department of Vocational Training as prescribed in Point c Clause 2 Article 5 of this Circular.
4. Annually, every six months, compile and report to the General Department of Vocational Training on the situation of registration for vocational training activities within their jurisdiction.
5. Inspect and check the implementation of registration for vocational training activities at localities in accordance with the provisions of the law.
Article 14. Responsibilities of Ministries, sectors; People's Committees of provinces and centrally governed cities
1. Direct, guide, and urge vocational training establishments (or educational institutions and enterprises participating in vocational training activities) under their management to implement registration for vocational training activities.
2. Organize inspections of the operations of vocational training establishments, educational institutions, and enterprises that have registered for vocational training activities within their management scope.
Article 15Responsibilities of vocational training establishments
1. Within twenty-four months from the date of the decision on establishment or permission to establish or investment certificate for vocational colleges, twelve months for vocational secondary schools and vocational training centers, must carry out registration for vocational training activities.
2. Educational institutions and enterprises specified in Clauses 2 and 3 Article 2 of this Circular, when they meet the conditions to organize vocational training activities as prescribed, shall register for vocational training activities and may only recruit students for vocational training after obtaining a certificate of registration for vocational training activities.
Article 16. Implementation Provisions
1. This Circular takes effect from January 1, 2012, and replaces Decision No. 72/2008/QĐ-BLĐTBXH dated December 30, 2008, issued by the Minister of Labor, Invalids, and Social Affairs regarding regulations on registration for vocational training activities.
2. Agencies and organizations during the implementation of this Circular, if encountering difficulties, obstacles, or discovering new issues arising, shall promptly reflect them to the Ministry of Labor, Invalids, and Social Affairs for guidance or supplementation and adjustment to be appropriate./.

The evidence file includes Land Use Right Certificate or lease, purchase, transfer contracts for training sites. If it is a lease contract, the training facilities and equipment must have at least a five-year validity period;

- Employment decision or labor contract (for permanent teachers); visiting lecturer contract (for visiting teachers);
- Professional degree certificates;
