Article 24Regulations on the modification of motor vehicles

Based on the Road Traffic Law dated 13 months 11 BASED ON THE CIVIL SERVANT LAW ON JANUARY 1,
Pursuant to Decree No. 51Decree No. 249/2008/NĐ-CP dated April 22, 2008 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Transport;amendThis Circular stipulates the procedures for modifying motor vehicles (hereinafter referred to as motor vehicles) that have been registered with license plates or have been used and are permitted to be imported.
This Circular does not apply to the following motor vehicles:;

Chapter I
GENERAL PROVISIONS
Article 1. Scope of Application
1. Motorcycles, motorbikes; lMotor vehicles modified for use in national defense and security purposes by the Ministry of National Defense and the Ministry of Public Security.
2. Motor vehicles operating on roads (excluding motorcycles and motorbikes) as defined in the Vietnamese Standard TCVN 7271 - Road Traffic Vehicles - Cars - Classification According to Purpose of Use, including taxis. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Engine, frame, driver's cabin, body, or cargo box, specialized equipment installed on the vehicle.
a) Power transmission system, drive system, suspension system, braking system, steering system, fuel system, electrical system, lighting and signaling systems.
b) Refers to the alteration of the construction, shape, arrangement, working principle, specifications, technical characteristics of part or all of the systems and assemblies of motor vehicles. In cases where the system or assembly is replaced by another system or assembly of the same type from the same manufacturer (same model code), it shall not be considered as modification.
Article 2. Applicability
This Circular applies to organizations and individuals related to the activity of modifying motor vehicles.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Motor vehicles Refers to motor vehicles without changes in construction, shape, arrangement, working principle, specifications, technical characteristics of all systems and assemblies compared to the initial state of the manufacturer.
2. Main assembly lPassenger car trRefers to cars with structures and equipment designed to carry passengers and luggage.
3. System" The competent authority for design approval

5. Original Motor Vehicle Refers to the examination, inspection, and comparison of the contents of the design modification documents to ensure compliance with technical standards, regulations, and relevant provisions.
6. Vehicle ng Refers to the inspection and evaluation of motor vehicles that have been modified according to the approved design documents to ensure requirements for quality, safety, and environmental protection. Article 4. Provisions on the modification of motor vehicles
7. After modification, motor vehicles must comply with technical standards and regulations, meet the requirements for quality, safety, and environmental protection when participating in traffic, and must comply with the following provisions:rime Minister cModification to change the purpose of use (functionality) is not allowed for motor vehicles that have been in use for more than 15 years since the year of manufacture until the date of design modification approval. Modification of specialized trucks imported within five years and refrigerated trucks imported within three years from the date of registration plate issuance is not allowed.iModification of other types of trucks into passenger vehicles (passenger cars) is not allowed.
8. Design entity Modification of passenger vehicles into various types of trucks is not allowed, except for the conversion of passenger vehicles with up to 16 seats (including the driver's seat) into vans.
9. Modification of tractor trucks into trucks is not allowed, except for specialized trucks. Modification to change tire size, number of axles, and wheelbase of trucks is not allowed.
10. Design review Modification to increase the wheelbase of trucks is not allowed, even when converting one type of truck to another and vice versa, except for specialized trucks and cases of returning to the original vehicle.
11. Acceptance of modified motor vehicles lIncreasing the length, width, and height of the cargo box of trucks is not allowed, except for specialized trucks. If installing a closed cargo box or adding a rain and sun protection canopy, the total height of the modified motor vehicle must comply with the National Technical Regulation QCVN 09: 2011/BGTVT on the quality, safety, and environmental protection of trucks.
Increasing the length, width, and height of the cargo box of dump trucks is not allowed. If reducing the cargo box size, the capacity of the cargo box of the truck after modification must satisfy the following formula:y V: Cargo volume (m³)i Q: Design load capacity (tons)
The total weight of the motor vehicle after modification must meet the following requirements:
1. For passenger vehicles: Not exceeding the total weight corresponding to the maximum number of passengers allowed according to the manufacturer's regulations.
2. For trucks: Not exceeding the maximum total weight of the original vehicle and not exceeding the permissible total weight for traffic participation.
3. Used systems and assemblies shall not be used in the modification of motor vehicles, except for engines and specialized equipment. Lifting equipment and tanks for hazardous goods must have a Certificate of Quality and Safety Technical Equipment for Loading and Unloading, Boilers, Pressure Equipment Used in Transportation issued in accordance with Circular No. 35/2011/TT-BGTVT dated May 6, 2011 of the Minister of Transport on the procedures for issuing Certificates of Quality and Safety Technical Equipment for Loading and Unloading, Boilers, Pressure Equipment Used in Transportation.ng Throughout the usage period, each motor vehicle can only be modified or changed in one of the two main assemblies, either the engine or the frame, and no more than three out of six systems and assemblies listed below:
4. Power transmission system including clutch, gearbox, propeller shaft, and main power transmission; ng Drive system including wheels, driven axle;

6. Braking system;
7. Driver's cabin, body, or cargo box. lModifying a system or assembly that affects the performance characteristics of related systems or assemblies must be specifically considered and calculated, and must be treated as modification of the related systems or assemblies.
8. DESIGN AND APPROVAL OF DESIGNnationalAND MODIFICATION DESIGN - PROCEDURES
9. It is not allowed to modify to increase the length, width, or height of the cargo box of a dump truck. If modifying to reduce the size of the cargo box, it must ensure that the cargo box volume of the motor vehicle after modification satisfies the following formula:development V: Cargo box volume (m³)in Q: Design payload (tons)
Where:
- The total weight of the motor vehicle after modification must meet the following requirements:3)
- For passenger cars: Not exceeding the total weight corresponding to the maximum number of passengers allowed according to the manufacturer's regulations.
10. For trucks: Not exceeding the maximum total weight of the original vehicle and not exceeding the permitted total weight for traffic participation.
a) Do not use systems or assemblies that have been used before in the modification of motor vehicles, except for the engine assembly and specialized equipment. Lifting devices and tanks for transporting dangerous goods must have a Certificate of Quality and Technical Safety for Loading and Unloading Equipment, Boilers, and Pressure Equipment Used in Road Transport as stipulated in Circular No. 35/2011/TT-BGTVT dated May 6, 2011, issued by the Minister of Transport regarding procedures for issuing Certificates of Quality and Technical Safety for Loading and Unloading Equipment, Boilers, and Pressure Equipment Used in Road Transport. trThroughout the usage period, each motor vehicle can only be modified or changed in one of the two main assemblies, either the engine or the chassis, and no more than three out of six systems or assemblies listed below:
b) Power transmission system including clutch, gearbox, drive shafts, and main power transmission;

Article 6. Exemption from preparing design documents for motor vehicles undergoing modification:policies).
i) Modificationớof ordinary cargo trucks by changing the cargo box according to a model design and vice versa.
Modified motor vehicles in the following cases are exempted from preparing design documentation:
1ii) Driving and testing cars equipped with auxiliary brake pedals connected to the main brake pedal through a mechanical lever and vice versa.
2. Installing additional dust covers on the cargo boxes of self-dumping trucks.
3. Design documents for motor vehicles undergoing modification must be reviewed and approved by the Design Review Authority, which issues a Design Review Certificate according to the format specified in Appendix I of this Circular. The validity period of the Design Review Certificate is 12 months from the date of issuance.
Article 7. Examination of Design for Motor Vehicle Retrofitting
1. Staff assigned to review designs by the Design Review Authority must be automotive mechanical engineers who have obtained certificates after attending training sessions on motor vehicle modification work according to the format specified in Appendix II of this Circular.
2. In cases where provincial Departments of Transport do not have the necessary conditions to review designs, the Vietnam Vehicle Inspection Center will undertake the task.
3. Application documents for design review include:amendA request for design review (original) according to the format specified in Appendix III of this Circular.
4. Four sets of design documents, components as stipulated in Article 5 of this Circular.
a) Business registration certificate (certified copy) of the design entity for the first-time design review.
b) Certified copies or certified photocopies issued by the design entity: Vehicle Registration Certificate, Transfer Form (for cases currently processing transfer procedures), Certificate of Motor Vehicle Safety and Environmental Protection Quality (for used imported motor vehicles).
c) d) Technical documentation of the modified motor vehicle.
d) Procedure and process for design review
Organizations and individuals prepare one set of application documents for design review
5. as prescribed and submit them directly or via postal service to the Design Review Authority;
a) The Design Review Authority receives and checks the completeness of the documents; if the documents are incomplete, they guide organizations and individuals to supplement and complete them; if the documents are complete, they issue a receiptpolicies for the time to return the design review results;
b) The Design Review Authority conducts the design review; if the design documents do not meet requirements, they notify the need for supplementation and modification; if the design documents meet requirements, they issue a Design Review Certificate for Modified Motor Vehicles; For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;Organizations and individuals can submit documents and collect results directly at the Design Review Authority's office or via postal service;ì Within 10 working days from the date of receiving complete design documents, the Design Review Authority issues a Design Review Certificate for Modified Motor Vehicles if the documents meet requirements; or notifies organizations and individuals if the documents do not meet requirements.This Resolution takes effect from the date it is adopted by the National Assembly.Design documents after being issued a Design Review Certificate for Modified Motor Vehicles are stored at the Design Review Authority and sent to the following agencies: the modification design entity, the construction entity, and the Vehicle Inspection Unit responsible for inspecting modified motor vehicles.
c) When new technical standards, regulations, or provisions are issued or amended before the design is reviewed,
d) the Design Review Authority and the Inspection Units must inform and guide design entities to supplement and amend the new design documents.
e) Responsibility for reviewing the design of modified motor vehiclesầProvincial Departments of Transport are responsible for reviewing the design of modifications for motor vehicles registered under their jurisdiction according to the following regulations:
6. Modification and installation of systems and assemblies: frame, power transmission, suspension, cab, cargo box, electrical system, lighting and signaling system of:in Cargo trucks (according to items 3.2.1 to 3.2.9 of TCVN 7271);
7. Specialized cargo trucks for transporting construction motorcycles (item 3.2.10.2 of TCVN 7271);rime Minister cSemi-trailers, trailers;N ||| declaration of customs import procedures. Passenger vehicles up to 25 seats (including driver seat).
Article 8. Installation of additional equipment specifically for loading and unloading goods for ordinary cargo trucks; installation of seating on the cargo box of driving and testing passenger vehicles;
1. Modification of passenger vehicles into ambulances or funeral vehicles;
a) Modification of passenger vehicles with 16 seats or less (including driver seat) into cargo vans;
- d) Replacement of engines of different types for ordinary cargo trucks, self-dumping trucks, specialized cargo trucks for transporting construction motorcycles, passenger vehicles up to 25 seats (including driver seat) must ensure that the replacement engine has the maximum power, maximum speed corresponding to maximum power, maximum torque, with changes not exceeding 10% reduction or 15% increase.

Approval documents from the design review agency;amendComplete acceptance documents for modifications as specified in points a, d, đ, e, and point g Clause 4 of this Article. trIn case of motor vehicle modifications, the validity period of the Certificate of Quality and Technical Safety and Environmental Protection for modified motor vehicles is six months from the date of issuance. If the vehicle owner exceeds the validity period or loses the Certificate of Quality and Technical Safety and Environmental Protection for modified motor vehicles, they must bring the vehicle to the inspection unit that accepted the modification for re-inspection and reissue.
a) If the certificate of technical safety and environmental protection for motor vehicles is complete according to regulations, then schedule the time for inspecting modified motor vehicles at the motor vehicle inspection unit.

Chapter III
CONSTRUCTION OF MOTOR VEHICLE MODIFICATIONS, ACCEPTANCE AND ISSUANCE OF QUALITY SAFETY TECHNICAL CERTIFICATE AND ENVIRONMENTAL PROTECTION FOR MODIFIED MOTOR VEHICLESỨ |||QUALITY SAFETY TECHNICAL CERTIFICATE AND ENVIRONMENTAL PROTECTION FOR MODIFIED MOTOR VEHICLESI DIO
Article 9. Constructioni of modificationsi Training,
1. The construction of modified motor vehicles must be carried out at production facilities that have legal personality and are registered to operate in the business of modifying motor vehicles in accordance with relevant laws.
2. The construction of modified motor vehicles must strictly follow the reviewed design, ensuring requirements for quality, safety technical standards, and environmental protection.
3. Modified motor vehicles upon completion must be inspected by the construction facility to ensure product quality.in inspection results are recorded in the Certificate of Acceptance for Modified Motor Vehicles' Factory Exit Inspection according to the model specified in Appendix IV of this Circular.n l acceptance of modified motor vehicles
Article 10. RESOLUTIONiModified motor vehicles after construction according to the reviewed design must be accepted and issued a Quality Safety Technical Certificate and Environmental Protection Certificate for Modified Motor Vehicles.
1. The acceptance of modified motor vehicles is conducted at Vehicle Inspection Units under Departments of Transport, and the Vietnam Vehicle Inspection Corporation. The acceptance team includes Unit Leaders, inspectors who have certificates confirming their training in vehicle modification operations according to the model specified in Appendix II of this Circular, and the construction facility.
2. In cases of frame and chassis modification for passenger cars, each part must be inspected according to the design at the construction facility. Implementation in the preceding year Documents for acceptance of modified motor vehicles include:
3. a) A request for quality inspection of modified motor vehicles according to the model specified in Appendix V of this Circular. For cases stipulated in Clause 3 of this Article, the construction facility must register partial inspections with the Inspection Unit responsible for issuing the Quality Safety Technical Certificate and Environmental Protection Certificate for Modified Motor Vehicles;
4. A certified copy of the business registration certificate of the construction facility for the first quality inspection;
The reviewed design;
b) Certified copies or photocopies confirmed by the construction facility: Vehicle Registration Certificate, Transfer and Movement Form (for cases undergoing name transfer or movement procedures), Certificate of Quality Safety Technical Standards and Environmental Protection for Imported Motor Vehicles (for used imported vehicles);
c) Photocopies of the body style; systems and assemblies of the modified motor vehicle after modification.
d) Certificate of Factory Exit Acceptance for Modified Motor Vehicles;
đ) Ag) Certificates for special equipment and specialized equipment as prescribed.
e) Inspection Equipment: Quality Safety Technical Standards and Environmental Protection inspections for modified motor vehicles must use appropriate inspection devices and tools to check items, systems, and assemblies related to the modification content as prescribed.
The acceptance results are recorded in the Certificate of Quality Safety Technical Standards and Environmental Protection Inspection for Modified Motor Vehicles according to the model specified in Appendix VI of this Circular.
5. Acceptance of modified motor vehicles with the same brand, type number, engine, basic dimensions, weight, and constructed according to the same design as those already issued a Quality Safety Technical Certificate and Environmental Protection Certificate for Modified Motor Vehicles can only be conducted at the Inspection Unit that accepted the first product. The acceptance documents include:
6. Approval document from the Design Review Authority;
7. Complete acceptance documents for modifications as prescribed in Points a, d, đ, e, and Point g Clause 4 of this Article.
a) Decree of the Minister of Transport on Technical Safety and Environmental Protection for Motor Vehicles;
b) Director of the Vietnam Vehicle Inspection Agency, Directors of Provincial Departments of Transport, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
Article 11. Issuance of Certificate on Technical Safety and Environmental Protection for Motor Vehiclesi motor vehicle category alli Training,
1. After being inspected and found to meet technical standards and regulations, motor vehicles that have been overhauled shall be issued a Certificate on Technical Safety and Environmental Protection for Overhauled Motor Vehicles according to the model specified in Appendix VII of this Circular.êThe Certificate on Technical Safety and Environmental Protection for Overhauled Motor Vehicles consists of two copies provided to the vehicle owner for inspection procedures and registration of license plates.
2. The validity period of the Certificate on Technical Safety and Environmental Protection for Overhauled Motor Vehicles is six months from the date of issuance. In cases where the vehicle owner exceeds the validity period or loses the Certificate on Technical Safety and Environmental Protection for Overhauled Motor Vehicles, the vehicle must be brought to the Inspection Unit that conducted the acceptance inspection for re-inspection and reissue.
3. Validity period ofDeputy ministers of ministerial-level agencies,the Certificate of Technical Quality and Environmental Protection for retrofitted motor vehicles is six months from the date of issuance. In cases where the vehicle owner exceeds the validity period or loses the Certificate of Technical Quality and Environmental Protection for retrofitted motor vehicles, they must bring the vehicle to the Inspection Unit that initially inspected it for re-inspection and reissue of the certificate.o technical quality and environmental protection for retrofitted motor vehicles according to regulations, then schedule the time for inspecting the retrofitted motor vehicle at the Inspection Unit for motor vehicles.
Article 12. Procedures and Formalities for Issuing Certificates on Technical Safety and Environmental Protection for Overhauled Motor Vehiclesithat certification technical Actual status of operation of equipment safety and environmental protection for retrofitted motor category Organizations and individuals complete one set of documents in accordance with Clause 4, Article 10 and submit them directly or through postal services to the Inspection Unit responsible for acceptance inspections.
1. The Inspection Unit receives and reviews the documents: If the documents are not complete as required, they will guide organizations and individuals to supplement and perfect them; if the documents comply with the requirements, they will schedule the time for inspecting the overhauled motor vehicle at the Inspection Unit.
2. The Inspection Unit proceeds with the acceptance inspection of the overhauled motor vehicle. Chapter IV
IMPLEMENTATION RESPONSIBILITY
Article 13. Responsibilities for implementation and organization of enforcementie of Inspection Officers|||Inspection Officersệb) For parts of the dossier that are photocopies, the organization may choose to submit photocopies with certification, photocopies from original books, or photocopies confirmed by the organization regarding their accuracy compared to the originals. If the organization submits the dossier directly to the State Bank of Vietnam (Department of Foreign Exchange Management) and the photocopies are not certified photocopies, photocopies from original books, or photocopies confirmed by the organization, the organization must present the original documents for comparison. The person comparing the dossier must sign confirmation on the photocopy and bear responsibility for its accuracy compared to the original.
1. Organize and guide professional training and inspect the implementation of this Circular.
2. Develop, manage, and guide the use of software programs for managing the overhaul work of motor vehicles; manage data on overhauled motor vehicles of Design Approval Authorities and Inspection Units conducting acceptance inspections. lon using the software program to manage the retrofitting work of motor vehicles; managing data of retrofitted motorớvehicles of Design Approval Authorities, Implementation in the preceding year Units conducting acceptance inspections of retrofits.
3. Review and issue the Design Approval Certificate for overhauled motor vehicles in accordance with this Circular.
4. Issue and announce sample designs for cargo trucks and body assembly frames. lassembly of frame and roof.
5. Organize training and issue certificates of participation in professional training on the overhaul work of motor vehicles for staff and inspection officers implementing the overhaul work.amendInspection Officers performing the work of retrofitting motor vehicles;
6. Uniformly issue, manage, guide, and inspect the use of blank Certificates on Technical Safety and Environmental Protection for Overhauled Motor Vehicles.
7. Summarize the results of the overhaul work of motor vehicles to periodically report to the Ministry of Transport.
Article 14. Responsibilities of Provincial Departments of Transport
1. Allocate staff to conduct design reviews and issue Design Approval Certificates for overhauled motor vehicles in accordance with this Circular.
2. Guide local design units to comply with the provisions of this Circular.
3. Implement reporting, archiving of documents, and using software for managing overhauled motor vehicles in accordance with regulations. Send lists of design review staff to the Vietnam Inspection Corporation. For coal-fired thermal power plants where the enterprise holds 100% of the registered capital and uses 100% of its own capital to invest in the project approved by the competent authority, E is determined as 100%;use the management software for retrofitted motor vehicles in accordance with regulations. Submit a list of design approval officers to the Vietnam Inspection Authority.
Article 15. Responsibilities of Units Conducting Vehicle Technical Inspection
1. Inspect and issue Certificates of Quality, Safety, Technical Standards, and Environmental Protection for modified motor vehicles in accordance with the provisions of this Circular.
2. Use Certificate templates and management software for modified motor vehicles in compliance with regulations.
3. Transmit data and submit periodic reports before the 5th day of each month regarding inspection activities and the use of Certificate templates as specified in Appendix VIII of this Circular to the Vietnam Vehicle Inspection Department and Provincial Departments of Transport.amendthe Vietnam Inspection Authority and Provincial Departments of Transport.
4. Have the responsibility to report and provide complete files and data for regular and spot checks on the modification of motor vehicles.
Article 16. Fees and Charges
Authorities responsible for design approval, design approval and Units conducting vehicle technical inspections for modifications may collect fees and charges in accordance with current regulations.N ||| declaration of customs import procedures. Article 18. 3. The Police Station of the district bordering the Vietnam-China border: ADJUSTMENT
1. This Circular takes effect from October 1, 2012, and repeals the following documents:
a) Decision No. 15/2005/QĐ-BGTVT dated February 15, 2005, issued by the Minister of Transport on Regulations for the Modification of Road Motor Vehicles;
b) Article 1 of Circular No. 37/2011/TT-BGTVT dated May 6, 2011, issued by the Ministry of Transport amending and supplementing certain articles of the Regulations for the Modification of Road Motor Vehicles issued together with Decision No.15/2005/QĐ-BGTVT dated February 15, 2005, Regulations on Conditions for Establishing and Operating Vehicle Inspection Centers issued together with Decision No. 45/2005/QĐ-BGTVT dated September 23, 2005, Circular No. 10/2009/TT-BGTVT dated June 24, 2009 on Technical Safety and Environmental Protection Inspections of Road Motor Vehicles, and Circular No. 22/2009/TT-BGTVT dated October 6, 2009 on Procedures for Technical Safety and Environmental Protection Inspections of Road Motor Vehicles issued by the Minister of Transport;councillORSTechnical Regulations on Safety and Environmental Protection for Road Motor Vehicles issued by the Minister of Transport;
c) Content in other conflicting documents in the Field of Teachers and Educational Institution Managers as prescribed in this Circular.
2. Certificates of Quality, Safety, Technical Standards, and Environmental Protection for modified motor vehicles issued prior to the effective date of this Circular remain valid until their expiration date.
Article 19. Implementation
