Provisions on vocational training, professional development, and aviation security training

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;

Pursuant to the Vocational Training Law dated November 29, 2006;

Based on the Education Law dated June 14, 2005 and the Law Amending and Supplementing Certain Articles of the Education Law dated December 4, 2009;

Based on Decree No. 81/2010/NĐ-CP dated July 14, 2010 of the Government on civil aviation security;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Cadre and Personnel Department and the Director of the Civil Aviation Administration,

The Minister of Transport issues this Circular to stipulate provisions on vocational training, professional development, and aviation security training.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates provisions on vocational training, professional development, and aviation security training in civil aviation activities.

Article 2. Applicability

This Circular applies to organizations and individuals related to vocational training, professional development, and aviation security training in civil aviation activities.

Chapter II

PROGRAM ON VOCATIONAL TRAINING, PROFESSIONAL DEVELOPMENT, AND AVIATION SECURITY TRAINING

Section 1

BASIC TRAINING

Article 3. Vocational training in aviation security screening

1. Objective: To equip trainees with professional knowledge, skills, and attitudes in conducting security checks, screening, and visual inspections of passengers, baggage, cargo, mail, and items brought onto aircraft.

2. Participants must meet the following conditions:

a) Vietnamese citizens aged 18 years or older;

b) Graduated from high school or equivalent;

c) Meeting health standards as prescribed;

d) Having good political qualities, moral character, and clear background;

e) Having no criminal record or being under investigation for criminal offenses; not using drugs or stimulants prohibited by law.

3. Duration of the course: 332 hours.

4. Allocation of time for subjects:

Article 4. Vocational training in aviation security control

1. Objective: To equip trainees with professional knowledge, skills, and attitudes in conducting security checks and surveillance at terminals, public areas, airports, and guarding restricted areas.

2. Participants must meet the following conditions:

a) Vietnamese citizens aged 18 years or older;

b) Graduated from high school or equivalent;

c) Meeting health standards as prescribed;

d) Having good political qualities, moral character, and clear background;

e) Having no criminal record or being under investigation for criminal offenses; not using drugs or stimulants prohibited by law.

3. Duration of the course: 330 hours.

4. Allocation of time for subjects:

Article 5. Training in Mobile Security Operations

1. Objective: Equip trainees with specialized knowledge, skills, and attitudes for patrolling, guarding, escorting, crowd control, inspecting, and searching aircraft and means of transport.

2. Participants must meet the following conditions:

a) Vietnamese citizens aged 18 years or older;

b) Graduated from high school or equivalent;

c) Meeting health standards as prescribed;

d) Having good political qualities, moral character, and clear background;

e) Having no criminal record or being under investigation for criminal offenses; not using drugs or stimulants prohibited by law.

3. Duration: 415 hours.

4. Allocation of time for subjects:

Article 6. Training in In-flight Security Operations

1. Objective: Equip trainees with specialized knowledge, skills, and attitudes for protecting and maintaining order, managing crowds on board aircraft during flight, using weapons and support equipment to restrain and apprehend violators on flights, and promptly responding to illegal interventions.

2. Participants: Personnel assigned to perform in-flight security duties on flights.

3. Duration: 270 hours.

Section 2

CONTINUING EDUCATION

Article 7. Continuing Education in Air Transport Security Management

1. Objective: To equip trainees with knowledge, skills, and aviation security management operations.

2. Target Audience: Managers at all levels within the air transport security force of airport enterprises, airlines, air navigation service providers, aircraft maintenance and repair enterprises, civil aviation authorities, and related state management agencies.

3. Duration: 40 hours.

4. Allocation of time for subjects:

Article 8. Continuing Education in Crisis Management for Air Transport Security

1. Objective: Equip trainees with knowledge, skills, and specialized training in developing emergency plans for air transport security, and measures to counter illegal interventions.

2. Target Audience: Managers at all levels within the air transport security force and units involved in implementing countermeasures against illegal interventions in civil aviation activities.

3. Duration: 24 hours.

4. Allocation of time for subjects:

Article 9. Continuing Education in Teaching Air Transport Security

1. Objective: Equip trainees with knowledge and skills for preparing and using teaching materials and equipment, organizing classes, and teaching methods in air transport security.

2. Target Audience: Air transport security instructors and teaching staff.

3. Duration

a) Continuing education for air transport security instructors: 56 hours;

b) Continuing education for air transport security teaching staff: 85 hours.

a) Continuing education for air transport security instructors

Article 10. Professional Training for Air Security Supervisors

1. Objective: Equip trainees with knowledge on air security, preparation work, methods and skills, inspection and supervision procedures related to air security.

2. Target Audience: Inspectors and air security supervisors.

3. Duration: 56 hours.

4. Allocation of time for subjects:

Section 3

TRAINING ON AIR SECURITY KNOWLEDGE

FOR RELEVANT PARTIES

Article 11. Training on Air Security Knowledge for Flight Crews

1. Objective: Equip trainees with necessary knowledge on air security and handling situations related to their duties.

2. Target Audience: Pilots and flight attendants.

3. Duration

a) Training on air security knowledge for pilots and flight attendants, except those specified in point b, Clause 3, Article 11: 32 hours;

b) Training on air security knowledge for lead flight attendants: 40 hours.

4. Allocation of course time

a) Training on air security knowledge for the subjects specified in point a, Clause 3, Article 11

b) Training on air security knowledge for lead flight attendants

Article 12. Training on Air Security Knowledge for Management Staff of Airlines

1. Objective: Equip trainees with necessary knowledge on air security and handling situations related to their management duties.

2. Target Audience: Management staff of airlines.

3. Duration: 12 hours.

4. Allocation of time for subjects:

Article 13. Training on Air Security Knowledge for Supervisors, Operational Managers, and Representatives of Airlines

1. Objective: Equip trainees with necessary knowledge on air security and handling situations related to their supervisory and managerial duties.

2. Target Audience: Supervisors, operational managers, and representatives of airlines.

3. Duration: 12 hours.

4. Allocation of time for subjects:

Article 14. Training on Air Security Knowledge for Ground Operations Personnel of Airlines

1. Objective: Equip trainees with necessary knowledge on air security and handling situations related to their ground operations duties.

2. Target Audience: Ground operations personnel of airlines.

3. Duration: 12 hours.

4. Allocation of time for subjects:

Article 15. Training on aviation security knowledge for ground service staff serving flights

1. Objective: To equip trainees with necessary knowledge about aviation security and to enable them to handle situations related to aviation security in their flight service duties.

2. Objects

a) Ground service staff serving flights;

b) Staff operating ground equipment;

c) Drivers refueling aircraft.

3. Duration: 12 hours.

4. Allocation of time for subjects:

Article 16. Training on aviation security knowledge for aircraft maintenance and repair staff

1. Objective: To equip trainees with necessary knowledge about aviation security and to enable them to handle situations related to aviation security in their aircraft maintenance and repair duties.

2. Target group: Aircraft maintenance and repair staff.

3. Duration: 12 hours.

4. Allocation of time for subjects:

Article 17. Training on aviation security knowledge for air traffic controllers

1. Objective: To equip trainees with necessary knowledge about aviation security and to enable them to handle situations related to aviation security in their air traffic control duties.

2. Eligibility:

a) Air traffic controllers, information and communication staff, air navigation assistants, air traffic surveillance personnel;

b) Schedulers and operators of airlines.

3. Duration: 16 hours.

4. Allocation of time for subjects:

Article 18. Training on aviation security knowledge for enterprises providing air cargo services

1. Objective: To equip trainees with necessary knowledge about aviation security and to enable them to handle situations related to aviation security in their cargo service duties.

2. Target group: Managers, supervisors, and staff of enterprises providing air cargo services.

3. Duration

a) Training on aviation security knowledge for staff of enterprises providing air cargo services: 12 hours;

b) Training on aviation security knowledge for managers and supervisors of enterprises providing air cargo services: 16 hours.

4. Allocation of course time

a) Training on aviation security knowledge for staff of enterprises providing air cargo services

Article 19. Training on aviation security knowledge for enterprises providing in-flight catering services

1. Objective: To equip trainees with necessary knowledge about aviation security and to enable them to handle situations related to aviation security in their in-flight catering service duties.

2. Target group: Managers, supervisors, and staff of enterprises providing in-flight catering services.

3. Duration

a) Training on aviation security knowledge for staff of enterprises providing in-flight catering services: 12 hours;

b) Training on aviation security knowledge for managers and supervisors of enterprises providing in-flight catering services: 16 hours.

4. Allocation of course time

a) Program for staff of enterprises providing in-flight catering services

b) Program for managers and supervisors of meal service providers

Article 20. Aviation security training for aircraft cleaning service providers

1. Objective: Equip trainees with necessary knowledge on aviation security and handling related aviation security situations in their cleaning service duties.

2. Participants: Managers, supervisors, and employees of aircraft cleaning service providers.

3. Duration

a) Aviation security training for aircraft cleaning service provider employees: 12 hours;

b) Aviation security training for managers and supervisors of aircraft cleaning service providers: 16 hours.

4. Allocation of course time

a) Program for aircraft cleaning service provider employees

b) Program for managers and supervisors of aircraft cleaning service providers

Article 21. Aviation security training for air postal service providers

1. Objective: Equip trainees with necessary knowledge on aviation security and handling related aviation security situations in their air postal service duties.

2. Participants: Managers, supervisors, and employees of air postal service providers.

3. Duration

a) Aviation security training for air postal service provider employees: 12 hours;

b) Aviation security training for managers and supervisors of air postal service providers: 16 hours.

4. Allocation of course time

Article 22. Aviation security training for security forces of air service providers

1. Objective: Equip trainees with necessary knowledge on air security and handling situations related to their duties.

2. Participants: Dedicated security personnel of air cargo, airline meal, and aviation fuel service providers; aircraft maintenance and repair facilities; air navigation service providers.

3. Duration: 24 hours.

4. Allocation of time for subjects:

Article 23. Training on aviation security knowledge for relevant subjects

1. Objective: Equip trainees with necessary knowledge about aviation security and know-how to handle situations related to aviation security within restricted areas.

2. Objects

a) Personnel of non-aircraft service enterprises working in restricted areas of airports;

b) Personnel of aircraft technical service enterprises engaged in repair and maintenance of aircraft equipment working in restricted areas of airports;

c) Personnel of cleaning and working environment service enterprises working in restricted areas of airports.

3. Duration: 08 hours.

REGULAR TRAINING

Article 24. Regular training on aviation security screening operations

1. Objective: Review and update knowledge, new regulations, and enhance practical skills in aviation security inspection and screening.

2. Target group: Aviation security screeners.

3. Duration: 24 hours.

Article 25. Regular training on aviation security control operations

1. Objective: Review and update knowledge, new regulations, and enhance practical skills in aviation security control, supervision, and guarding.

2. Target group: Aviation security controllers.

3. Duration: 24 hours.

Article 26. Regular training on aviation security mobile operations

1. Objective: Review and update knowledge, new regulations, and enhance practical skills in aviation security mobile operations.

2. Target group: Aviation security mobile personnel.

Article 27. Regular training on aviation security in-flight operations

1. Objective: Review and update knowledge, new regulations, and enhance practical skills in dealing effectively with illegal interference.

2. Target group: Personnel assigned to serve as in-flight aviation security officers on flights.

3. Duration: 24 hours.

4. Allocation of time for subjects:

Article 28. Regular training on aviation security management operations

1. Objective: Review and update knowledge, new regulations on aviation security management.

2. Target Audience: Managers at all levels within the air transport security force of airport enterprises, airlines, air navigation service providers, aircraft maintenance and repair enterprises, civil aviation authorities, and related state management agencies.

3. Duration: 16 hours.

4. Allocation of time for subjects:

Article 29. Regular training on aviation security crisis management operations

1. Objective: Review and update knowledge, new regulations, skills, and practical operations in developing emergency plans for aviation security and measures to counter illegal interference.

2. Target Audience: Managers at all levels within the air transport security force and units involved in implementing countermeasures against illegal interventions in civil aviation activities.

3. Duration: 16 hours.

4. Allocation of time for subjects:

Article 30. Regular training on teaching aviation security

1. Objective: Review and update knowledge, skills in preparing and using teaching materials and equipment, organizing classes, and teaching methods in aviation security.

2. Target group: Aviation security teachers, instructors in aviation security.

3. Duration

a) Regular training for aviation security teachers: 16 hours;

b) Regular training for aviation security instructors: 16 hours.

4. Allocation of course time

Article 31. Periodic Training for Air Security Inspectors

1. Objective: To review and update knowledge, skills, and inspection, supervision, and security check procedures related to aviation security.

2. Target Audience: Inspectors and air security supervisors.

3. Duration: 16 hours.

4. Allocation of time for subjects:

Article 32. Periodic Training on Aviation Security for Flight Crews

1. Objective: To review and update knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Target Audience: Pilots and flight attendants.

3. Duration: 08 hours.

Article 33. Periodic Training on Aviation Security for Management Staff of Airlines

1. Objective: To review and update knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

Article 34. Periodic Training on Aviation Security for Supervisors, Managers, and Representatives of Airlines

1. Objective: To review and update knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Target Audience: Supervisors, operational managers, and representatives of airlines.

3. Duration: 08 hours.

Article 35. Periodic Training on Aviation Security for Ground Operations Staff of Airlines

1. Objective: To review and update necessary knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Target Audience: Ground operations personnel of airlines.

3. Duration: Six hours.

4. Allocation of time for subjects:

Article 36. Periodic Training on Aviation Security for Ground Operations Staff Serving Flights

1. Objective: To review and update knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Eligibility:

c) Ground operations staff serving flights;

d) Staff controlling and operating ground equipment;

c) Drivers refueling aircraft.

3. Duration: Six hours.

4. Allocation of time for subjects:

Article 37. Periodic Training on Aviation Security for Aircraft Maintenance and Repair Staff

1. Objective: To review and update knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Target group: Aircraft maintenance and repair staff.

3. Duration: Six hours.

4. Allocation of time for subjects:

Article 38. Periodic Training on Aviation Security for Air Traffic Controllers

1. Objective: To review and update necessary knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Objects

a) Periodic training on aviation security for employees of enterprises providing air cargo services: Eight hours;

b) Periodic training on aviation security for management and supervisory staff of enterprises providing air cargo services: Eight hours.

Article 40. Periodic Training on Aviation Security for Enterprises Providing In-flight Catering Services

1. Objective: To review and update necessary knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Target group: Managers, supervisors, and staff of enterprises providing in-flight catering services.

3. Duration

a) Periodic training on aviation security for employees of enterprises providing in-flight catering services: Eight hours;

b) Periodic training on aviation security for management and supervisory staff of enterprises providing in-flight catering services: Eight hours.

4. Allocation of course time

a) Periodic training on aviation security for employees of enterprises providing in-flight catering services

b) Periodic training on aviation security for management and supervisory staff of enterprises providing in-flight catering services

Article 41. Periodic Training on Aviation Security for Enterprises Providing Aircraft Cleaning Services

1. Objective: To review and update knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Participants: Managers, supervisors, and employees of aircraft cleaning service providers.

3. Duration

a) Periodic training on aviation security for employees of enterprises providing aircraft cleaning services: Eight hours;

b) Periodic training on aviation security for management and supervisory staff of enterprises providing aircraft cleaning services: Eight hours.

4. Allocation of course time

a) Program for aircraft cleaning service provider employees

b) Periodic training on aviation security for management and supervisory staff of enterprises providing aircraft cleaning services

Article 42. Periodic aviation security training for postal air service providers

1. Objective: To review and update necessary knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Participants: Managers, supervisors, and employees of air postal service providers.

3. Duration

a) Periodic aviation security training for employees of postal air service providers: 08 hours;

b) Periodic aviation security training for management and supervisory staff of postal air service providers: 08 hours.

4. Allocation of course time

a) Periodic aviation security training for employees of postal air service providers

b) Periodic aviation security training for management and supervisory staff of postal air service providers

Article 43. Periodic aviation security training for security forces of air service providers

1. Objective: To review and update necessary knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Target group: Full-time security personnel of air cargo service providers, airline catering service providers, aircraft fuel service providers, and aircraft maintenance and repair facilities.

3. Duration: 08 hours.

4. Allocation of time for subjects:

Independence - freedom - happinessANNEX I.A[31]Article 44. Periodic aviation security knowledge training for relevant parties

1. Objective: To review and update necessary knowledge on aviation security and to know how to handle situations related to aviation security in connection with their duties.

2. Objects

a) Personnel of non-aircraft service enterprises working in restricted areas of airports;

b) Personnel of aircraft technical service enterprises engaged in repair and maintenance of aircraft equipment working in restricted areas of airports;

c) Personnel of cleaning and working environment service enterprises working in restricted areas of airports.

3. Duration: 05 hours.

4. Allocation of time for subjects:

Article 45. Duration of periodic training

1. The subjects specified in Articles 24, 25, 26, 27, and Article 32 of this Circular must undergo periodic training once every year.

2. The subjects specified in Articles 28, 29, 30, and Article 31 of this Circular must undergo periodic training once every two years.

3. The subjects specified in Articles 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and Article 44 of this Circular must undergo periodic training once every three years.

4. Security screening personnel who allow dangerous items to pass through during their duties, or aviation security personnel who have not performed their duties continuously for more than six months according to their professional certificates, must undergo corresponding periodic training before resuming their duties.

CPart III

CURRICULUM, MATERIALS, CERTIFICATES, RECOGNITION AND STANDARDS

AVIATION SECURITY INSTRUCTORS

Section 1

CURRICULUM AND TEACHING MATERIALS

Article 46. Requirements for programs, curricula, and materials

1. The vocational training, development, and aviation security training programs stipulated in Articles 3, 4, 5, 6, 7, 8, 9, 10, 24, 25, 26, 27, 28, 29, 30, and Article 31 of this Circular must be approved by the Civil Aviation Administration of Vietnam.

2. The aviation security training programs stipulated in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and Article 44 of this Circular must be issued by the Civil Aviation Administration of Vietnam.

3. Teaching materials of the vocational training, development, and aviation security training programs stipulated in this Circular must comply with Vietnamese laws, aviation security programs, aviation security regulations, standards, and International Civil Aviation Organization practice recommendations.

4. Teaching materials of the vocational training, development, and aviation security training programs stipulated in this Circular must be consistent with the curriculum and actual conditions.

Article 47. Compilation, review, and issuance of curricula and materials

1. Training institutions for aviation security personnel organize the compilation, review, and issuance of curricula and materials for vocational training, development, and aviation security training programs in accordance with the provisions of the law.

2. Airports, airlines, and organizations without training institutions for aviation security personnel when organizing aviation security training programs for internal staff as stipulated in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and Article 44 of this Circular must compile curricula and materials and submit them to the Civil Aviation Administration of Vietnam for approval. The application for approval includes:

a) A request for approval in the format prescribed in Appendix 1 attached to this Circular;

b) Curriculum and materials.

3. Within ten working days from the date of receipt of complete files as prescribed, the Civil Aviation Administration of Vietnam will review and issue an approval letter. In case the file is incomplete or the curriculum and materials do not meet the requirements, within five working days from the date of receipt of the file, the Civil Aviation Administration of Vietnam will issue a rejection letter or request the applicant to provide additional explanations on related contents, stating the reasons.

Section 2

INSPECTION, ISSUANCE OF CERTIFICATES AND RECOGNITION

Article 48. Inspection and Issuance of Training Certificates for Aviation Security Operations

1. For the training programs on aviation security operations specified in Articles 3, 4, 5, and 6 of this Circular, students must take an examination at the end of each course. At the conclusion of the program, students must take both a theoretical and practical examination to assess the results of the program.

2. The theoretical examination shall be conducted through one or a combination of multiple-choice tests, written exams, and oral examinations. The practical examination shall be conducted using available equipment, facilities, and premises or simulation software.

3. Both the theoretical and practical examinations will be scored out of 100 points. Students will be issued an aviation security operations professional certificate when they achieve a score of 75 or higher in both the theoretical and practical examinations at the end of the program.

4. The training institutions for aviation security personnel shall issue certificates to students who complete the program according to the model prescribed in Circular No. 61/2011/TT-BGTVT dated December 21, 2011, issued by the Minister of Transport regarding aviation personnel, training institutions, and evaluation centers for English language proficiency of aviation personnel.

Article 49. Inspection and Issuance of Certificates for Aviation Security Operations Refresher Courses

1. For refresher courses on aviation security operations, students must take a theoretical examination at the end of the course. Students participating in refresher courses for aviation security instructors and supervisors as stipulated in this Circular must also take a practical examination.

2. The theoretical examination shall be conducted through one or a combination of multiple-choice tests, written exams, and oral examinations. The practical examination shall be conducted using available equipment, facilities, and premises.

3. Both the theoretical and practical examinations will be scored out of 100 points. Students will be issued a completion certificate when they achieve a score of 75 or higher in both the theoretical and practical examinations.

4. The training institutions for aviation security personnel shall issue refresher course certificates to students who complete the course according to the model prescribed in Appendix 2 attached to this Circular.

Article 50. Inspection and Issuance of Aviation Security Training Certificates

1. Examination for knowledge and periodic training programs on aviation security operations

a) For the knowledge training programs on aviation security operations specified in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, and 23 of this Circular, students must take a theoretical examination at the end of the course;

b) For the periodic training programs on aviation security operations specified in Articles 24, 25, 26, and 27 of this Circular, students must take both a theoretical and practical examination at the end of the course;

c) For the periodic training programs on aviation security operations specified in Articles 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and 44 of this Circular, students must take a theoretical examination at the end of the course;

d) The theoretical examination shall be conducted through one or a combination of multiple-choice tests, written exams, and oral examinations. The practical examination shall be conducted using available equipment, facilities, and premises or simulation software. Both the theoretical and practical examinations will be scored out of 100 points.

2. Issuance of Certificates for Completion of Knowledge and Periodic Training Programs on Aviation Security Operations

a) For the knowledge and periodic training programs on aviation security operations specified in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and 44 of this Circular, students will be issued a certificate when they achieve a score of 75 or higher in the theoretical examination. The training institutions for aviation security personnel, airport companies, airlines, and other related organizations shall issue certificates to students who complete the course according to the model prescribed in Appendix 3 attached to this Circular;

b) For the periodic training programs on aviation security operations specified in Articles 24, 25, 26, and 27 of this Circular, students will be issued a certificate when they achieve a score of 75 or higher in both the theoretical and practical examinations. The training institutions for aviation security personnel shall issue certificates to students who complete the course according to the model prescribed in Appendix 4 attached to this Circular;

c) For the periodic training programs specified in Articles 28, 29, 30, and 31 of this Circular, students will be issued a certificate when they achieve a score of 75 or higher in the theoretical examination. The training institutions for aviation security personnel shall issue certificates to students who complete the course according to the model prescribed in Appendix 4 attached to this Circular.

Article 51. Aviation Security Training Abroad and Foreign Organizations and Individuals Conducting Aviation Security Training in Vietnam

Clause 1. The Civil Aviation Authority of Vietnam recognizes diplomas, certificates, and certifications of aviation security courses from training organizations under the International Civil Aviation Organization, the International Air Transport Association, and foreign vocational aviation security staff training institutions that have been recognized by the Civil Aviation Authority of Vietnam.

Clause 2. Foreign organizations and individuals are permitted to organize aviation security training courses as stipulated in this Circular in Vietnam after receiving approval from the Civil Aviation Authority of Vietnam.

Clause 3. Foreign organizations and individuals submit (01) a complete set of application documents in person, through postal service, or other appropriate methods to the Civil Aviation Authority of Vietnam. The application includes:

Point a) A request for approval according to the form prescribed in Appendix 5 issued together with this Circular;

Point b) The training program;

Point c) A list of teaching staff.

Clause 4. Within ten working days from the date of receipt of a complete application as prescribed, the Civil Aviation Authority of Vietnam issues a written approval. In cases where the application is incomplete or does not meet the required conditions, within five working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam issues a written rejection or requests the applicant to provide additional explanations on relevant contents, clearly stating the reasons.

Section 3

AVIATION SECURITY INSTRUCTORS

Article 52. Standards for Aviation Security Instructors and Teaching Staff

Clause 1. Aviation security instructors teach training programs, vocational training, and aviation security training courses as prescribed in this Circular.

Clause 2. Teaching staff on aviation security teach knowledge training and periodic aviation security training programs as stipulated in Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and Article 44 of this Circular.

Clause 3. Standards for Aviation Security Instructors

Point a) Good moral character and ideological qualities;

b) Meet health standards as prescribed;

Point c) Clear personal history;

Point d) No criminal record or being investigated in criminal cases; no use of drugs or stimulants prohibited by law;

Point đ) Possess a professional certificate in aviation security or have at least five years of work experience in the aviation security field related to the subject taught;

Point e) Hold a certificate in vocational pedagogical training.

Clause 4. Standards for Teaching Staff on Aviation Security

Point a) Meet the standards prescribed in points a, b, c, d, and point e of Clause 3 of this Article;

Point b) Hold a certificate for the course specified in point b of Clause 4 of Article 9 of this Circular and have at least five years of work experience in the aviation industry.

Article 53. Approval of Lists of Aviation Security Instructors and Teaching Staff on Aviation Security

Clause 1. The Civil Aviation Authority of Vietnam approves lists of aviation security instructors and teaching staff on aviation security.

Clause 2. Units submit (01) a complete set of application documents for approval in person, through postal service, or other suitable methods to the Civil Aviation Authority of Vietnam. The application includes:

Point a) An application according to the form prescribed in Appendix 6 issued together with this Circular;

Point b) A judicial background verification of the proposed candidate;

Point c) A resume of the proposed candidate with confirmation and stamp of the unit's head;

Point d) A certificate in vocational pedagogical training (a certified copy or a copy accompanied by the original for comparison);

Point đ) Relevant academic degrees and certificates related to the professional and vocational qualifications of the proposed candidate (a certified copy or a copy accompanied by the original for comparison);

Point e) A health certificate issued by a competent medical facility as prescribed.

Clause 3. Within ten working days from the date of receipt of a complete application as prescribed, the Civil Aviation Authority of Vietnam issues a written approval. In cases where the application is incomplete or does not meet the required conditions, within five working days from the date of receipt of the application, the Civil Aviation Authority of Vietnam issues a written rejection or requests the applicant to provide additional explanations on relevant contents, clearly stating the reasons.

Chapter IV

RESPONSIBILITIES OF AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS

IN TRAINING AND VOCATIONAL TRAINING,

AVIATION SECURITY TRAINING

Article 54. Responsibilities of the Civil Aviation Authority of Vietnam

1. Guide, inspect, check, and supervise training institutions, organizations, and individuals related to the implementation of this Circular regarding the training and professional instruction of aviation security personnel.

2. Appraise and issue certificates for training institutions and programs for the professional instruction of aviation security personnel according to Circular No. 61/2011/TT-BGTVT dated December 21, 2011, issued by the Minister of Transport on aviation security personnel, training institutions, and language proficiency assessment centers for aviation personnel.

3. Approve lists of aviation security instructors and lecturers on aviation security; training programs and refresher courses for aviation security personnel as stipulated in Articles 3, 4, 5, 6, 7, 8, 9, 10, 24, 25, 26, 27, 28, 29, 30, and 31 of this Circular. Approve training manuals and materials for business entities operating airports, airlines, and organizations without training facilities for aviation security personnel.

4. Organize quality assessments of training programs and refresher courses for aviation security personnel at training institutions every two years.

5. Serve as the focal point for international cooperation in aviation security training.

Article 55. Responsibilities of Training Institutions for Professional Instruction of Aviation Security Personnel

1. Organize training programs and refresher courses for aviation security personnel as stipulated in this Circular.

2. Coordinate with organizations and individuals to organize aviation security courses. In cases where coordination is with foreign organizations or individuals to organize aviation security courses in Vietnam, the training institution must follow the procedures specified in Article 51 of this Circular.

3. Establish lists of aviation security instructors and lecturers and develop training and refresher course programs for aviation security personnel as stipulated in Articles 3, 4, 5, 6, 7, 8, 9, 10, 24, 25, 26, 27, 28, 29,

30, and 31 of this Circular for approval by the Civil Aviation Authority of Vietnam.

4. Compile and appraise training manuals and materials based on approved training and refresher course programs for aviation security personnel issued by the Civil Aviation Authority of Vietnam.

5. Annually conduct evaluations of training and instruction quality; compile results of aviation security training activities and report to the Civil Aviation Authority of Vietnam before December 15.

6. Maintain training records for refresher courses and aviation security instruction of participants throughout their employment period. Training records must be managed in accordance with regulations on restricted aviation security documentation.

7. The training record for refresher courses and aviation security instruction includes:

a) Student profiles;

b) Grade sheets;

c) Certificates and completion certificates of the course (copies).

Article 56. Responsibilities of Airports Enterprises, Airlines, and Other Related Organizations

1. Enterprises and organizations related must arrange for the subjects specified in this Circular to participate in training programs, vocational enhancement, and aviation security training as prescribed and bear all costs for such training, enhancement, and instruction.

2. Enterprises and organizations without facilities for training aviation security staff shall implement knowledge training on aviation security and regular training for internal staff according to Articles 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, and Article 44 of this Circular.

3. Annually report to the Civil Aviation Administration of Vietnam the results of aviation security training before December 15.

4. Maintain training records in accordance with Clause 6 and Clause 7 of Article 55 of this Circular.

IMPLEMENTING PROVISIONS

This Circular takes effect from September 20, 2014, and replaces Circular No. 25/2009/TT-BGTVT dated October 16, 2009, issued by the Minister of Transport regarding the training, enhancement, and aviation security instruction.
