REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL COUNCIL FOR MOTIVATION AND RECOGNITION UNDER THE MINISTRY OF HOME AFFAIRS

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Motivation and Recognition dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Motivation and Recognition dated June 14, 2005; and the Law Amending and Supplementing Certain Provisions of the Law on Motivation and Recognition dated November 16, 2013;

Decree No. Decision No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies; dated September 1, 2016 of the Government stipulating the functions, duties, powers and organizational structure of ministries and ministerial-level agencies;

Decree No. 34/2017/NĐ-CP April 3, 2017 Government Decree stipulating functions, tasks, authorities, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Minister of Home Affairs;

The Prime Minister promulgates this Decision stipulating the functions, tasks, powers, and organizational structure of the National Council for Motivation and Recognition under the Ministry of Home Affairs.

Article 1. Position and Functions

1. The National Council for Motivation and Recognition is an agency equivalent to a General Department under the Ministry of Home Affairs, performing the function of advising the Minister of Home Affairs on state management in the field of motivation and recognition.

2. The National Council for Motivation and Recognition is an entity with legal personality, bearing the State Emblem seal, and having its own account in accordance with the provisions of the law; its office is located in Hanoi City.

Article 2. Tasks and Authorities

The National Council for Motivation and Recognition performs the tasks and powers as prescribed by the Law on Motivation and Recognition, relevant laws, and the following tasks and powers:

1. It is the permanent body of the National Council for Motivation and Recognition.

2. Submit to the Minister of Home Affairs for submission to the Government,

a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government; draft decisions, directives of

b) Strategies, plans, national target programs, action programs, projects, and important initiatives concerning motivation and recognition.

3. Submit to the Minister of Home Affairs for consideration and decision,

a) Long-term, five-year, and annual development plans for the sector of motivation and recognition and related projects and initiatives;

b) Plans for coordinated activities between ministries, ministerial-level agencies, government agencies, provincial people's committees (hereinafter collectively referred to as ministries, sectors, and localities), the Vietnam Fatherland Front, political organizations, political-social organizations, and social organizations at the central level in implementing tasks related to motivation and recognition.

4. Guide, urge, and inspect ministries, sectors, localities, the Vietnam Fatherland Front, political organizations, political-social organizations, and social organizations at the central level in organizing and implementing motivational campaigns and implementing reward policies of the Party and the State.

5. Review files submitted for rewards by ministries, sectors, localities, the Vietnam Fatherland Front, political organizations, political-social organizations, and social organizations at the central level. Implement according to the authorization of the Minister of Home Affairs to submit to the Government,

6. Direct and organize the implementation of programs, plans, projects, and initiatives on motivation and recognition after approval by competent authorities.

7. Develop content, programs, and conduct training sessions for officials, civil servants, and employees working in the field of motivation and recognition at ministries, sectors, and localities. Organize research and application of science and technology in the field of motivation and recognition.

8. Coordinate with the Vietnam Fatherland Front, political organizations, political-social organizations, social organizations at the central level, and mass media organizations to organize motivational campaigns and promote exemplary models.

9. Manage and archive reward files in accordance with the law. Build and manage databases on motivation and recognition.

10. Prepare, preserve, and distribute award items accompanying various forms of recognition.

11. Implement administrative reform programs in accordance with approved objectives and contents of state administrative reform programs.

12. Conduct inspections, handle complaints and denunciations; process according to their authority or recommend competent authorities to process in accordance with the law regarding violations of laws on motivation and recognition; prevent corruption, thrift, waste, and malpractice in the field of motivation and recognition in accordance with the law.

13. Implement international cooperation in the field of motivation and recognition.

14. Manage organizational structures, staffing, finance, and assets assigned. Implement salary systems and benefits, incentives, disciplinary measures, training, and capacity building for civil servants, employees, and workers under the management of the Council in accordance with the law and the delegation of the Minister of Home Affairs.

15. Summarize, conclude, and present awards; evaluate the effectiveness of organizing patriotic motivational campaigns and implementing reward policies and laws.

16. Perform other tasks and powers delegated by the Minister of Home Affairs and as prescribed by law.

Article 3. Organizational Structure

1. Research and Synthesis Department (referred to as Department I).

2. Department of Motivation and Recognition for Central Ministries, Sectoral Organizations (referred to as Department II).

3. Department of Motivation and Recognition for Central Provinces and Cities (referred to as Department III).

4. Cadres and Civil Servants Organization Department.

5. Office.

6. Legal Affairs and Inspection Department.

7. Journal of Motivation and Recognition.

8. Information Technology Center.

In this Article, the organizations from Clause 1 to Clause 6 are administrative bodies assisting the Director in performing state management tasks; the organizations specified in Clauses 7 and 8 are service units supporting the functional management of the National Council for Motivation and Recognition.

Article 4. Leadership

1. The National Council for Motivation and Recognition has a Director and not more than three Deputy Directors.

The Minister of Home Affairs assigns a Deputy Minister of Home Affairs to concurrently serve as the Director of the National Council for Motivation and Recognition, responsible before the Minister and the law for all activities of the Council. The Director of the National Council for Motivation and Recognition is the Vice Chairman of the National Council for Motivation and Recognition.

2. The Minister of Home Affairs appoints and dismisses Deputy Directors upon the recommendation of the Director of the National Council for Motivation and Recognition and assigns one Deputy Director as a member of the National Council for Motivation and Recognition. Deputy Directors are responsible before the Director and the law for the areas of work they are assigned.

3. The Chairman of the Central Steering Committee for Commendation and Award shall issue the Operational Regulations of the Committee; recruit, utilize, manage civil servants, public officials, and employees under his/her jurisdiction; appoint and relieve from duty civil servants and public officials holding leadership and management positions within the Committee; define the functions, tasks, powers, and organizational structure of units subordinate to the Committee in accordance with the provisions of the law and the delegation of the Minister of Interior Affairs.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from August 30, 2018, replacing Decision No. 05/2015/QĐ-TTg dated February 12, 2015 of the Government Chairman on the functions, tasks, powers, and organizational structure of the Central Steering Committee for Commendation and Award under the Ministry of Interior Affairs. 1. The Prime Minister's Decision No. 05/2015/QĐ-TTg dated February 12, 2015 stipulates the functions, tasks, powers, and organizational structure of the Central Steering Committee for Commendation and Award under the Ministry of Interior Affairs.

2. The Minister of Interior Affairs, the Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under central cities, and the Chairman of the Central Steering Committee for Commendation and Award are responsible for implementing this Decision./.
