PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the working relationship of the People's Militia Command at the commune level and the People's Militia Command of agencies and organizations; duties, tasks, working relationships of positions in the command of the People's Militia Self-Defense Force.

Article 2. Applicability

1. The People's Militia Command of central ministries and departments; military agencies at all levels; the People's Militia Command of agencies and organizations; units of the People's Militia Self-Defense Force.

2. Agencies and units under the Ministry of National Defense, central ministries and departments, people's committees at all levels, and agencies, organizations, units, and individuals related to the matter.

Chapter II

3. Relationship with the People's Committee at commune level is a relationship of obedience to guidance, management, and direction on defense and military affairs at the commune level.

4. Relationship with the military commissariat at district level is a relationship of obedience to guidance and command on local defense and military affairs.

5. Relationship with public security, agencies, organizations at commune level is a relationship of coordination and cooperation in work. The military commissariat at commune level takes the lead in advising, directing, and guiding the implementation of defense and military affairs at the commune level.

3. Relationship with the Commune People's Committee is a relationship of obedience to guidance, management, and control over defense and military affairs at the commune level.

6. Relationship with: Military commissariat of agencies and organizations; commanders of self-defense units where there is no military commissariat of agencies and organizations; agencies and organizations that have not organized self-defense; units of the People's Army and People's Public Security standing or operating in the area is a relationship of coordination and cooperation in implementing related defense and military affairs.

Advising the Party Committee (Branch) and the administration at commune level to lead, direct, manage, and implement defense and military tasks at the commune level in accordance with the law.

b) Coordinating with the political commissar to carry out party work and political work within the militia and reserve forces and in the implementation of defense and military tasks at the commune level.

a) Relationship with the commander of the military commissariat at district level is a relationship of obedience to guidance and command on local defense and military affairs;

Article 4. Duties, tasks, and working relationships of the Commandant

1. Responsibilities

b) Relationship with the Party Committee (Branch) at commune level and the Military Branch Committee (Branch) at commune level is a relationship of obedience to leadership and guidance on defense and military affairs at the commune level;

2. Tasks

a) Chair the implementation of tasks prescribed in Clause 3, Article 20 of the Law on Militia and Self-Defense Forces;

c) Relationship with the Chairman of the People's Committee at commune level is a relationship of obedience to guidance, management, and direction on defense and military affairs at the commune level;

3. Working Relationships

e) Relationship with the head of public security and heads of agencies, organizations at commune level is a relationship of coordination and cooperation in work. In emergency situations regarding national defense and war, the commander of the military commissariat at commune level commands the armed forces of the commune uniformly to perform combat readiness, combat, and support combat tasks in the area in accordance with the law;

Relationship with the commander of the militia unit under their management is a superior-subordinate relationship. Relationship with the commander of the militia self-defense unit not under their management is a relationship of coordination in work.

Advising and being responsible to superiors, the Party Committee (Branch), and the administration at commune level for party work and political work in the implementation of defense and military tasks at the commune level. Taking the lead in political matters within the militia and reserve forces; directly carrying out party work and political work within the militia and reserve forces and in defense and military tasks at the commune level; together with the commander of the military commissariat at commune level proposing contents and measures for leading defense and military work for the Party Committee (Branch) at commune level to decide.

d) The relationship with the Political Instructor of the commune-level Military Command is one of coordination;

đ) The relationship with the Deputy Commandant and Deputy Political Instructor of the commune-level Military Command is one between superiors and subordinates;

a) Advising and proposing for the Party Committee (Branch) at commune level to decide on the contents and measures for leading all activities of the militia and reserve forces and in the implementation of defense and military tasks at the commune level in accordance with the Party's guidelines and policies, state laws, resolutions, directives, and orders from superiors on defense and military work. Proposing to the political commissar of the military commissariat at district level the contents and measures for conducting party work and political work. Building plans and directly carrying out party work and political work within the militia and reserve forces, in the implementation of defense and military tasks at the commune level;

g) The relationship with the heads of agencies, organizations, units stationed or operating in the commune area is one of coordination and cooperation related to national defense and military work;

b) Conducting political education and ideological construction; building the militia and reserve forces at the commune level absolutely loyal to the Party, the country, and the people, with firm political resolve; without signs of ideological and moral degradation, self-transformation; ready to accept and complete all assigned tasks; organizing together with agencies, organizations at commune level education on national defense and security, mobilizing the people to participate in building the armed forces, consolidating the whole-people national defense;

Article 5. Duties, tasks, and working relationships of the Political Instructor

1. Responsibilities

c) Conducting organizational and party-building work; building the Military Branch Committee (if any) clean and strong, focusing on building the core political force within the militia and reserve forces; identifying and nurturing candidates for party membership and youth league membership within the militia and reserve forces. Building temporary branch committees within the militia and reserve forces (if any) clean and strong, successfully completing all assigned tasks;

2. Tasks

d) Conducting cadre work; building militia command positions and a cadre reserve force sufficient in quantity and high in quality, capable of fulfilling assigned duties and meeting the requirements of defense and military tasks at the local level in all situations; coordinating with mobilization units to arrange, manage, and organize the training of reserve officers at the local level;

b) Carry out political and ideological education work; build the civilian militia and reserve forces at the commune level to be absolutely loyal to the Party, the country, and the people, with firm political resolve; show no signs of ideological and moral degradation, self-deterioration, or self-transformation; be ready to accept and fulfill all assigned tasks; organize national defense and security education together with commune-level departments, associations, and mass organizations, mobilize the people to participate in building armed forces, and consolidate the whole-people national defense foundation;

c) Carry out organizational construction work for the Party; build the military branch Party cell (if any) clean and strong, focusing on building a solid political core within the civilian militia and reserve forces; identify and nurture candidates for Party membership and Youth Union membership among the civilian militia and reserve forces. Build temporary Party cells within the civilian militia and reserve forces (if any) clean and strong, successfully fulfilling all assigned tasks;

d) Carry out cadre work; build positions of civilian militia commanders and a cadre corps of reserve forces with adequate numbers and high quality, effectively performing assigned duties and responsibilities, meeting the requirements of local national defense and military tasks in all situations; coordinate with mobilization units to arrange, manage, and organize the training of reserve officers at the local level;

d) Conduct internal political protection work; build the civilian militia and reserve forces clean politically and safe in all aspects; promote education to raise vigilance among the civilian militia, reserve forces, and the people to combat the plots and tactics of hostile forces, contributing to maintaining political security at the local level;

e) Guide the civilian militia and reserve forces to carry out mass mobilization work; participate in implementing movements and campaigns launched by the Party, State, Vietnam Fatherland Front, Military, and local authorities, contributing to maintaining political stability, economic development, cultural and social progress, consolidating national defense and security, and building a strong political foundation at the local level, creating a secure area;

g) Organize the implementation of the Party and State's policies towards the civilian militia and reserve forces and the rear support policy for the Military; study and propose to higher authorities to improve the system and policies for the civilian militia and reserve forces, the rear support policy for the Military, and local defense and military tasks;

h) Carry out Party and political work in the construction, training, and activities of the civilian militia and reserve forces, in preparing and calling up citizens for military service, and in implementing mobilization tasks; build combat villages, communes, wards, and towns; organize civil defense and perform other national defense and military tasks at the commune level;

i) Conduct mid-term and final reviews of party work and political work for the civilian militia, reserve forces, and in national defense and military tasks at the commune level.

3. Working Relationships

a) Relationship with: The county-level Military Party Committee; the political department under the county-level Military Command Department is a relationship of obedience to leadership, guidance, and direction on Party and political work in implementing local national defense and military tasks;

b) Relationship with the political commissar and chief political officer of the county-level Military Command Department is a relationship of obedience to direction and guidance on Party and political work in implementing local national defense and military tasks;

c) Relationship with the commune-level Party Committee (branch) and administrative authority and the military branch committee (branch) is a relationship of obedience to leadership and direction on Party and political work in implementing commune-level national defense and military tasks;

d) Relations with the Commander of the Commune-level Military Command are relations of cooperation in work;

đ) Relations with the heads of agencies, organizations, units stationed or operating within the commune are relations of cooperation in work;

e) Relationship with the commander of the civilian militia unit under their management is a superior-subordinate relationship. Relationship with the commander of the civilian militia unit not under their management is a cooperative work relationship;

Article 6. Responsibilities, Tasks, and Work Relationships of the Deputy Commander

1. Responsibilities Be responsible before the commander and political commissar of the commune-level Military Command Department for assigned tasks; replace the commander when authorized by the competent authority;

2. Tasks

a) Advise and propose to the Commander and Political Commissar of the Commune-level Military Command on plans, contents, measures for directing and organizing the implementation of assigned tasks;

b) Summarize the results of assigned tasks, report to the Commander and Political Commissar of the Commune-level Military Command as prescribed.

3. Working Relationships

a) Relationship with the commander and political commissar of the commune-level Military Command Department is a subordinate-superior relationship;

b) Relationship with the deputy political commissar of the commune-level Military Command Department is a cooperative work relationship;

c) Relationship with the commander of the civilian militia unit under their management is a superior-subordinate relationship. Relationship with the commander of the civilian militia unit not under their management is a cooperative work relationship;

Article 7. Responsibilities, Tasks, and Work Relationships of the Deputy Political Commissar

1. Responsibilities

Be responsible before the political commissar and commander of the commune-level Military Command Department for assigned tasks; replace the political commissar when authorized by the competent authority;

2. Tasks

Advise, propose, and assist the political commissar and commander of the commune-level Military Command Department to develop plans for Party and political work in implementing commune-level national defense and military tasks;

3. Working Relationships

a) Relationship with the political commissar and commander of the commune-level Military Command Department is a subordinate-superior relationship;

b) Relationship with the deputy commander of the commune-level Military Command Department is a cooperative work relationship;

c) Relationship with the commander of the civilian militia unit under their management is a superior-subordinate relationship. Relationship with the commander of the civilian militia unit not under their management is a cooperative work relationship;

Article 8. Duties, tasks, and working relationships of the village militia team leader

1. Responsibilities

Advise the village party cell (village party branch) on leading, directing, and implementing national defense and military tasks at the village level.

2. Tasks

a) Implement the tasks prescribed in Clause 4, Article 20 of the Law on Militia and Self-Defense Force.

b) Perform other tasks assigned by competent authorities.

3. Working Relationships

a) The relationship with the village party cell (village party branch) is a relationship of obedience to leadership and direction regarding village-level national defense and military work.

b) The relationship with the village head and heads of village-level mass organizations is a relationship of cooperation in work.

c) The relationship with command positions in the commune-level military command board is a relationship of obedience to direction and command.

d) Relationship with the commander of the civilian militia unit at the commune level and the civilian militia unit under provincial and county management is a cooperative and coordinated work relationship;

d) The relationship with the commander and soldiers of the local militia unit within the village is a relationship between superiors and subordinates.

Chapter III

RELATIONSHIPS OF WORK OF THE MILITARY COMMAND DEPARTMENT'S ORGANIZATION AND FUNCTIONALITY; RESPONSIBILITIES, TASKS, AND RELATIONSHIPS OF WORK OF THE MILITARY COMMAND DEPARTMENT'S COMMAND POSITIONS OF THE ORGANIZATION AND FUNCTIONALITY

Article 9. Working relationships of the military command board of the organization

1. The relationship with the party committee (party branch) at the same level is a relationship of obedience to leadership and direction regarding organizational national defense and military work.

2. Relationship with the head of the organization (in cases where the commander is a deputy to the head) is a relationship of obedience to direction, management, and operation regarding national defense and military affairs within their authority;

3. Relationship with the regional military command, local military agencies at the provincial and county levels, military command departments of central ministries and sectors under their management, and military command departments of vertical organizations at higher levels is a relationship of obedience to direction and guidance on national defense and military affairs within their authority;

4. Relationship between the military command department of the organization managed by the province standing or operating in the county or commune area with the county and commune-level military command departments and related organizations and units is a cooperative and coordinated work relationship;

5. Relationship between the military command department of the organization managed by the county standing or operating in the commune area with the commune-level military command department is a cooperative and coordinated work relationship;

Article 10. Duties, tasks, and working relationships of the commander

1. Responsibilities

Advise the party committee (party branch) and the head of the organization at the same level (in cases where the commander is a deputy to the head) on national defense and military work within authority.

2. Tasks

a) Take the lead in implementing the tasks prescribed in Clause 4, Article 21 of the Law on Civilian Militia and Reserve Forces;

b) Coordinate with the political commissar to conduct party work and political work in the self-defense force, reserve mobilization forces, and implement national defense and military tasks within their own organization.

3. Working Relationships

a) The relationship with the party committee (party branch) at the same level is a relationship of obedience to leadership and direction regarding national defense and military work within authority.

b) The relationship with the head of the organization at the same level (in cases where the commander is a deputy to the head of the organization) is a relationship of subordinates to superiors regarding national defense and military work.

c) Relationship with the commander and political commissar (political commissar) of the provincial and county-level local military agencies is a relationship of being directed and commanded on national defense and military work;

d) Relationship with the regional military command, provincial and county-level local military agencies where the military command department of the organization stands or operates on the territory, central ministries and sectors' military command departments, and vertical military command departments under their management is a relationship of obedience to leadership, direction, and guidance on national defense and military affairs within their authority;

d) Relationship with the political commissar of the military command department of the organization at the same level is a cooperative work relationship;

e) Relationship with the deputy commander and deputy political commissar of the military command department of the organization at the same level is a superior-subordinate relationship;

The relationship with the commander of the self-defense unit within their own organization is a relationship of direction and command.

h) The relationship with the commander of the self-defense unit within their own agency or organization is a directive and command relationship.

Article 11. Duties, tasks, and working relationships of the political commissar

1. Duties and Responsibilities Advising and being accountable to superiors, party committees (branch committees), heads of agencies and organizations at the same level regarding party work and political work in the performance of national defense and military tasks. Taking the lead in political work within self-defense forces and reserve mobilization forces; directly conducting party work and political work within self-defense forces and reserve mobilization forces and in national defense and military tasks at agencies and organizations; jointly with the head of the military command board of the agency or organization proposing contents and measures for leading national defense and military work for the party committee (branch committee) of the agency or organization to decide.

2. Tasks

a) Advising and proposing to the party committee (branch committee) at the same level to decide on policies and measures for leading the performance of national defense and military tasks at agencies and organizations in accordance with the Party's guidelines and policies, state laws, resolutions, directives, and orders from superiors. Building plans and directly conducting party work and political work within self-defense forces and reserve mobilization forces and in national defense and military tasks at agencies and organizations;

b) Conducting political and ideological education; building self-defense forces and reserve mobilization forces of agencies and organizations absolutely loyal to the Party, the country, and the people, with firm political resolve, ready to accept and complete all assigned tasks; coordinating to implement national defense and security education; mobilizing civil servants, public officials, employees, and workers to participate in building local armed forces, consolidating the whole-people national defense;

c) Building a core political force, developing party members and youth league members within the reserve forces and mobilization reserves of agencies and organizations;

d) Proposing the construction of command positions for self-defense units and a cadre reserve force sufficient in number, high in quality, capable of fulfilling assigned responsibilities and tasks, meeting the requirements of national defense and military tasks at agencies and organizations in all situations; coordinating with reserve mobilization units to receive sources from agencies and organizations for arranging, managing, and organizing the training of reserve officers;

đ) Conducting internal political protection work; building self-defense forces and reserve mobilization forces clean politically and safe in all aspects; propagandizing and educating self-defense forces and reserve mobilization forces and civil servants, public officials, employees, and workers to enhance revolutionary vigilance, combat and frustrate every plot and trick of hostile forces, contributing to maintaining political security at agencies and organizations;

e) Guiding self-defense forces and reserve mobilization forces to conduct mass mobilization work, participating in implementing movements and campaigns launched by the Party, the State, the Vietnam Fatherland Front, the Military, and localities; contributing to building strong agencies and organizations and safe areas;

g) Organizing the implementation of the Party and State's policies towards self-defense forces and reserve mobilization forces and the rear support policies for the Military; researching and proposing to superiors to improve systems and policies for self-defense forces and reserve mobilization forces, rear support policies for the Military, and national defense and military tasks;

h) Conducting party work and political work in the construction, training, and activities of self-defense forces and reserve mobilization forces; preparing and calling up citizens for military service, implementing mobilization tasks; protecting agency and organizational activities and performing other national defense and military tasks assigned by competent authorities;

i) Conducting mid-term and final reviews of party work and political work for the reserve forces and mobilization reserves in the implementation of national defense and military tasks at agencies and organizations.

a) The relationship with the party committee (party branch) at the same level is a relationship of obedience to leadership and direction regarding national defense and military work within authority.

b) The relationship with the head of the military command board of the agency or organization at the same level is a cooperative working relationship;

b) Summarize the results of the assigned tasks, report to the commander and political commissar of the military command agency or organization at the same level as prescribed.

3. Working Relationships

a) The relationship with the commander and political commissar of the military command agency or organization at the same level is a relationship between subordinate and superior;

b) The relationship with the deputy political commissar of the military command agency or organization at the same level is a cooperative working relationship.

Article 13. Duties, tasks, and working relationships of the deputy political commissar

1. Responsibilities

Shall be responsible before the political commissar and commander of the military command agency or organization at the same level for the assigned tasks; shall replace the political commissar when authorized by the competent authority.

2. Tasks

Advising, proposing, and assisting the political commissar and the head of the military command board of the agency or organization at the same level to establish plans for party work and political work in the performance of national defense and military tasks within their authority.

b) The relationship with the deputy commander of the military command agency or organization at the same level is a cooperative working relationship.

Chapter IV

DUTIES, TASKS, AND RELATIONSHIPS IN WORK OF COMMAND POSITIONS FOR SELF-DEFENSE UNITS

Article 14. Duties, tasks, and working relationships of battalion commanders, maritime squadron commanders, company commanders, maritime company commanders, platoon commanders, squad commanders, ship captains, gun crew commanders

1. Responsibilities

Being accountable under the law, to the party committee (branch committee), superior commanders, political commissars, and political commissars, and to their own party committees (branch committees) regarding the construction, training, and activities of self-defense units under their jurisdiction.

2. Tasks

a) Commanders of self-defense units under their jurisdiction must comply with the Party's guidelines and policies, state laws, leadership resolutions of the party committee (branch committee), management and operation by municipal people's councils at various levels or the party committee (branch committee) and heads of agencies and organizations; directives and orders of superior commanders according to the management hierarchy;

b) Mastering all aspects of the situation, establishing plans, submitting to competent authorities for approval; organizing the implementation of tasks related to the construction, training, readiness for combat, combat, serving combat, civilian defense, and systems and policies of self-defense units under their jurisdiction;

c) Register, manage, and monitor the political, ideological situation, qualifications, and capabilities of the commanders and militiamen under their command;

d) Battalion commanders, maritime squadron commanders, company commanders, maritime company commanders cooperate with political commissars at the same level to conduct party work and political work for their units;

đ) Inspect, coordinate inspections, conduct mid-term reviews, final summaries, and report as prescribed.

3. Working Relationships

a) The relationship with the higher-level Party committee (branch) and the same-level Party committee (branch) is a relationship of obedience to leadership and direction regarding People's Militia work;

b) Relations with local military offices at the provincial, district, and commune levels, and military command boards of agencies and organizations according to the management hierarchy are relations of obedience to guidance, command, and management in self-defense work;

c) The relationship with superiors' commanders, political commissars, and political commissars is a relationship between subordinate and superior;

d) The relationship with the political commissar of the same-level People's Militia unit is a cooperative working relationship;

đ) The relationship with agencies, organizations, or units stationed or operating in the area is a cooperative working relationship;

e) The relationship with commanders of the People's Militia units under their command is a relationship between superior and subordinate.

Article 15. Duties, Tasks, and Working Relationships of the Political Commissar of the Battalion, Naval Squadron, Company, and Naval Company

1. Responsibilities

Being accountable under the law, to the party committee (branch committee), superior commanders, political commissars, and political commissars, and to their own party committees (branch committees) regarding party work and political work in the construction, training, and activities of self-defense units under their jurisdiction.

2. Tasks

a) Leading and directing units to comply with the Party's guidelines and policies, state laws, leadership resolutions of the party committee, management by municipal people's councils at various levels or heads of agencies and organizations; directives and orders of superior commanders, political commissars, and political commissars;

b) Mastering all aspects of the situation; taking the lead and coordinating with commanders of self-defense units at the same level to establish plans for party work and political work in the construction, training, and activities of self-defense units, submitting to competent authorities for approval and organizing implementation;

c) Inspect, summarize, and conclude the work of the Party and political work, report according to regulations.

3. Working Relationships

a) The relationship with the superior Party Committee (branch) and their own Party Committee (branch) is a relationship of obedience to leadership and direction on the work of the People's Militia.

b) The relationship with the commander, political commissar, and superior political commissar is a relationship between subordinates and superiors.

c) Relations with the political department of local military offices at the provincial and district levels are relations of obedience to guidance in party work and political work;

d) Relations with military command boards at the commune level and military command boards of agencies and organizations according to the management hierarchy are relations of obedience to guidance, command, and management in party work and political work;

đ) The relationship with the commander of the People's Militia unit at the same level is a relationship of coordinating work.

e) The relationship with the agencies, organizations, or units stationed or operating in the area is a relationship of coordinating and cooperating work.

g) The relationship with the commander of the People's Militia unit under their authority is a relationship between superiors and subordinates.

Article 16. Duties, Tasks, and Working Relationships of the Deputy Battalion Commander, Deputy Naval Squadron Commander, Deputy Company Commander, and Deputy Naval Company Commander

1. Responsibilities

Shall be responsible before the commander and political commissar of the People's Militia unit at the same level for the assigned tasks; replace the commander when assigned.

2. Tasks

a) Advise and propose to the commander and political commissar of the People's Militia unit at the same level regarding the plan, content, methods of direction, and organization of the implementation of the assigned tasks.

b) Summarize the results of the assigned tasks and report to the commander and political commissar of the People's Militia unit at the same level.

3. Working Relationships

a) The relationship with the commander and political commissar of the People's Militia unit at the same level is a relationship between subordinates and superiors.

b) The relationship with the deputy political commissar of the People's Militia unit at the same level is a relationship of coordinating work.

Article 17. Duties, Tasks, and Working Relationships of the Deputy Political Commissar of the Battalion, Naval Squadron, Company, and Naval Company

1. Responsibilities

Shall be responsible before the political commissar and commander of the People's Militia unit at the same level for the assigned tasks; replace the political commissar when assigned.

2. Tasks

Advising, proposing, and assisting the political commissar and commander of self-defense units at the same level to establish plans for party work and political work in the construction, training, and activities of self-defense units under their jurisdiction.

3. Working Relationships

a) The relationship with the political commissar and commander of the People's Militia unit at the same level is a relationship between subordinates and superiors.

b) The relationship with the deputy battalion commander, deputy naval squadron commander, deputy company commander, and deputy naval company commander is a relationship of coordinating work; with subordinate deputies under their management, it is a relationship between superiors and subordinates.

c) The relationship with the platoon leaders, boat captains, and team leaders under their authority is a relationship between superiors and subordinates.

Chapter V

IMPLEMENTING PROVISIONS

Article 18. Effective Date

This Circular takes effect from July 1, 2020, and replaces Circular No. 79/2016/TT-BQP dated June 16, 2016, issued by the Minister of National Defense, which stipulates the working relationships of cadres in the People's Militia and Self-Defense Force Committee at commune, ward, town level, and at the grassroots level organizations and agencies; responsibilities, tasks, and working relationships of cadres in the People's Militia and Self-Defense Force Committee at the central ministries and departments, at the commune, ward, town level, at the grassroots level organizations and agencies, and commanders of Civilian Militia Self-Defense Units.

2. The Chief of General Staff, Director of the Political Department of the Vietnam People's Army, Heads of agencies, organizations, units, localities, and related individuals shall be responsible for implementing this Circular./.
