CIRCULAR
Regulations on suspending the effect of training qualification standards for teachers stipulated in certain Circulars issued by the Minister of Education and Training
Pursuant to Article 69/2017/ND-CP dated May 25, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to the Education Law dated June 14, 2019;
Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;
Pursuant to the Government Decree number The Minister of Education and Training issues this Circular regulating the suspension of the effect of training qualification standards for teachers stipulated in certain Circulars issued by the Minister of Education and Training.
At the proposal of the Director of the Department of Teachers and Educational Management Staff;
Article 1. Suspension of the effect of training qualification standards for teachers stipulated in certain Circulars issued by the Minister of Education and Training
1. Suspension of the effect of the requirement to meet the training qualification standard set out in point a, Clause 3, Article 4 of the Standards for Principals of General Education Schools Circular No. 14/2018/TT-BGDĐT dated July 20, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 14/2018/TT-BGDĐT).
2. Suspension of the effect of the requirement to meet the training qualification standard set out in point a, Clause 1, Article 5 of the Professional Standards for Teachers of General Education Schools Circular No. 20/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 20/2018/TT-BGDĐT).
3. Suspension of the effect of the requirement to meet the training qualification standard set out in point a, Clause 3, Article 4 of the Standards for Principals of Preschool Education Institutions Circular No. 25/2018/TT-BGDĐT dated October 8, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 25/2018/TT-BGDĐT).
4. Suspension of the effect of the requirement to meet the training qualification standard set out in point a, Clause 1, Article 5 of the Professional Standards for Preschool Teachers Circular No. 26/2018/TT-BGDĐT dated October 8, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 26/2018/TT-BGDĐT).
5. Suspension of the effect of the requirement to meet the training qualification standard set out in point a, Clause 2, Article 5 of the Standards for Directors of Continuing Education Centers Circular No. 42/2010/TT-BGDĐT dated December 30, 2010 of the Minister of Education and Training (hereinafter referred to as Circular No. 42/2010/TT-BGDĐT).
6. Suspension of the effect of the requirement to meet the training qualification standard set out in point b, Clause 2, Article 8, and the requirement to exceed the training qualification standard set out in point a, Clause 2, Article 13 and point a, Clause 2, Article 18 of the Regulations on Quality Assessment and Recognition of National Standards for Primary Schools Circular No. 17/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 17/2018/TT-BGDĐT).
7. Suspension of the effect of the requirement to meet the training qualification standard set out in point b, Clause 2, Article 8, and the requirement to exceed the training qualification standard set out in point a, Clause 2, Article 13 of the Regulations on Quality Assessment and Recognition of National Standards for Lower Secondary Schools, Upper Secondary Schools, and Comprehensive Schools Circular No. 18/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 18/2018/TT-BGDĐT).
8. Suspension of the effect of the requirement to meet the training qualification standard set out in point b, Clause 2, Article 8, and the requirement to exceed the training qualification standard set out in point a, Clause 2, Article 13 and point a, Clause 2, Article 18 of the Regulations on Quality Assessment and Recognition of National Standards for Preschools Circular No. 19/2018/TT-BGDĐT dated August 22, 2018 of the Minister of Education and Training (hereinafter referred to as Circular No. 19/2018/TT-BGDĐT).
9. Suspension of the effect of the requirement to meet the training qualification standard set out in point b, Clause 2, Article 16 of the Regulations on Quality Standards and Evaluation Procedures for General Education Schools and Continuing Education Centers Circular No. 42/2012/TT-BGDĐT dated November 23, 2012 of the Minister of Education and Training (hereinafter referred to as Circular No. 42/2012/TT-BGDĐT).
10. Suspension of the effect of the requirement to meet the training qualification standard set out in certain provisions of Circular No. 07/2016/TT-BGDĐT dated March 22, 2016 on Conditions for Ensuring and Content, Procedures, and Formalities for Recognizing Achievement of Universal Education and Illiteracy Eradication (hereinafter referred to as Circular No. 07/2016/TT-BGDĐT) as follows:
a) Point c, Clause 1, Article 3 (amended by Clause 1, Article 1 of Decision No. 1387/QD-BGDĐT dated April 29, 2016 of the Minister of Education and Training);
b) Point b, Clause 1, Article 4 (amended by Clause 2, Article 1 of Decision No. 1387/QD-BGDĐT dated April 29, 2016 of the Minister of Education and Training);
c) Point b, Clause 1, Article 5.
2. The period during which the contents specified in Article 1 of this Circular are suspended shall be from the date this Circular takes effect until the date when new legal documents take effect and provide regulations on these matters.
Article 2. Effective Date
1. This Circular takes effect from the date of signature.
1. During the period during which the contents specified in Article 1 of this Circular are suspended, organizations and individuals concerned shall not base their assessment or self-assessment according to the principal standards, teacher profession standards, director standards of continuing education centers, quality assessment, recognition of national standards, or inspection for recognizing achievement of universal education and illiteracy eradication on the requirements to meet the training qualification standard or exceed the training qualification standard for principals, teachers, directors of continuing education centers, or quality assessment and recognition of national standards for preschools, general education schools, and continuing education centers. Other provisions in Circulars No. 42/2010/TT-BGDĐT, No. 42/2012/TT-BGDĐT, No. 07/2016/TT-BGDĐT, No. 14/2018/TT-BGDĐT, No. 17/2018/TT-BGDĐT, No. 18/2018/TT-BGDĐT, No. 19/2018/TT-BGDĐT, No. 20/2018/TT-BGDĐT, No. 25/2018/TT-BGDĐT, and No. 26/2018/TT-BGDĐT shall continue to be implemented as prescribed.
Article 3. Implementation Organization
1. During the period when the contents prescribed in Article 1 of this Circular are suspended, organizations and individuals concerned shall not base their assessment or self-assessment according to the headmaster standards, teacher profession standards, continuing education center director standards, or educational quality accreditation, national standard recognition, universal education attainment and illiteracy eradication certification checks on the criteria of meeting or exceeding training qualification standards for early childhood education, primary and secondary schools, and continuing education institutions. Other provisions in Circulars No. 42/2010/TT-BGDĐT, No. 42/2012/TT-BGDĐT, No. 07/2016/TT-BGDĐT, No. 14/2018/TT-BGDĐT, No. 17/2018/TT-BGDĐT, No. 18/2018/TT-BGDĐT, No. 19/2018/TT-BGDĐT, No. 20/2018/TT-BGDĐT, No. 25/2018/TT-BGDĐT, and No. 26/2018/TT-BGDĐT shall continue to be implemented as prescribed.
The Director of the Office, the Director of the Teacher and Educational Managerial Staff Department, the Heads of units under the Ministry of Education and Training, the Directors of Departments of Education and Training, the Director of the Department of Education, Science and Technology of Bac Lieu Province, the Heads of units and related organizations and individuals are responsible for implementing this Circular./.
