Frequency Band Plan for the 2300-2400 MHz Band for the IMT Mobile Communication System in Vietnam

Pursuant to the Radio Frequency Law dated November 23, 2009;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No. 71/2013/QĐ-TTG dated November 21, 2013 of the Prime Minister promulgating the National Radio Frequency Spectrum Plan;

Pursuant to Decision No. 02/2017/QĐ-TTg dated January 17, 2017 of the Prime Minister amending and supplementing the National Radio Frequency Spectrum Plan issued pursuant to Decision No. 71/2013/QĐ-TTG dated November 21, 2013 of the Prime Minister;

At the proposal of the Director of the Radio Frequency Management Department,

The Minister of Information and Communications issues this Circular on the frequency band plan for the 2300-2400 MHz band for the IMT mobile communication system in Vietnam.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular plans the 2300-2400 MHz frequency band for deploying mobile communication systems according to the IMT-Advanced standard^[1]and subsequent versions.

This Circular applies to organizations, businesses, and individuals producing, importing, operating, and using radio equipment in Vietnam.

Article 2. Content of Planning

1. The 2300-2400 MHz frequency band shall be divided as follows:

a) The 2300-2390 MHz frequency band shall be divided into three time-division duplex (TDD) paired blocks, namely A1, A2, A3, each block having a width of 30 MHz.^[2]) là A1, A2, A3, mỗi khối có宽带为30 MHz。

b) The 2390-2400 MHz frequency band shall be reserved as a guard band.

c) Each business shall be considered for authorization of not more than one block among the total of three blocks A1, A2, A3.

2. Businesses authorized to use frequencies within the 2300-2400 MHz frequency band shall cooperate with each other to avoid harmful interference, synchronize data frames of the TDD method, and comply with the contents of the frequency band usage permit.

Article 3. Implementation Provisions

1. This Circular takes effect from February 15, 2022.

2. Article 2, Clause 1, Clause 3, and other relevant provisions concerning the 2300-2400 MHz frequency band stipulated in Circular No. 18/2020/TT-BTTTT dated August 20, 2020 of the Ministry of Information and Communications on the frequency band plan for the 2300-2400 MHz and 2500-2690 MHz bands for the IMT mobile communication system in Vietnam are hereby repealed.

3. The Director of the Office, the Director of the Radio Frequency Management Department, the Heads of agencies and units under the Ministry of Information and Communications, and related organizations, businesses, and individuals are responsible for implementing this Circular.

4. In case of difficulties during implementation, they are requested to promptly report to the Ministry of Information and Communications (Radio Frequency Management Department) for guidance or consideration and resolution.
