REGULATIONS
ON THE WORK OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
(Adopted with Resolution No. 29/2022/UBTVQH15
dated December 12, 2022 of the Standing Committee of the National Assembly)
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
These regulations stipulate the principles, systems, forms of work, working relationships, procedures, and responsibilities for handling tasks of the Standing Committee of the National Assembly; the implementation of duties and powers of
Article 2. Principles and Working System of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly operates under a collective system and decides by majority. Decisions of the Standing Committee of the National Assembly must be approved by more than half of the total number of members of the Standing Committee of the National Assembly.
2. Activities of the Standing Committee of the National Assembly and its members must ensure the leadership of the Party, comply with the Constitution and laws.
3. The Standing Committee of the National Assembly builds a work program to proactively handle tasks within its jurisdiction according to the procedures and formalities prescribed in this Regulation and other relevant laws.
4. Members of the Standing Committee of the National Assembly actively handle tasks within their assigned scope and fields and according to this Regulation; ensuring requirements for coordination in work, information exchange in handling tasks, and collectively bearing responsibility for the implementation of the duties and powers of the Standing Committee of the National Assembly, and individually bearing responsibility before the Standing Committee of the National Assembly for issues assigned by the Standing Committee of the National Assembly.
5. Activities of the Standing Committee of the National Assembly are ensured to be transparent and open, except where otherwise provided by law.
Article 3. Forms of Work of the Standing Committee of the National Assembly
1. Sessions of the Standing Committee of the National Assembly.
2. The Standing Committee of the National Assembly examines, gives opinions, and decides by written document.
3. Conferences and meetings organized by the Standing Committee of the National Assembly.
4. Delegations of the Standing Committee of the National Assembly.
5. Activities of the Chairman of the National Assembly, Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly when performing the duties and powers of the Standing Committee of the National Assembly.
Article 4. Implementation of Duties and Powers of the Chairman of the National Assembly
1. Leading and directing the organization to implement the duties and powers of the Standing Committee of the National Assembly;
2. Directing the construction and implementation of the work program of the Standing Committee of the National Assembly;
3. Summoning and chairing sessions of the Standing Committee of the National Assembly; chairing conferences of specialized representatives of the National Assembly and other conferences organized by the Standing Committee of the National Assembly; chairing meetings with leaders of ministries, sectors, localities, agencies, organizations, and individuals;
4. Summoning and chairing meetings and conferences with the Secretary-General of the National Assembly - Head of the National Assembly Office, Chairman of the Ethnic Council, Heads of Committees of the National Assembly, heads of agencies under the Standing Committee of the National Assembly regarding the program and content of work of the National Assembly, agencies of the National Assembly, the Secretary-General of the National Assembly, the National Assembly Office, agencies under the Standing Committee of the National Assembly; attending sessions of the Ethnic Council, Committees of the National Assembly, meetings of the National Assembly Office, and agencies under the Standing Committee of the National Assembly when necessary;
5. Directing the preparation of content to be submitted to the National Assembly and the Standing Committee of the National Assembly;
6. Signing ordinances and resolutions of the Standing Committee of the National Assembly;
7. Representing the Standing Committee of the National Assembly to maintain working relations with
8. Regularly, monthly, chairing coordination meetings with Vice
9. Directing the organization of external activities of the Standing Committee of the National Assembly; directing, coordinating, and coordinating external activities and international cooperation of the Ethnic Council, Committees of the National Assembly, State Audit of Vietnam, the National Assembly Office, agencies under the Standing Committee of the National Assembly, the Vietnam Parliamentary Friendship Group, parliamentary friendship groups, and other groups of National Assembly representatives;
10. Participating in discussions and voting on matters of work of the Standing Committee of the National Assembly;
11. Performing other duties and powers as prescribed by law, this Regulation, and assignments from the Standing Committee of the National Assembly.
Article 5. The performance of duties and powers of the Vice Chairman of the National Assembly
1. Assist the Chairman of the National Assembly in performing tasks according to the division of labor by the Chairman of the National Assembly; perform tasks according to the division of labor by the Standing Committee of the National Assembly; be responsible before the Chairman of the National Assembly and the Standing Committee of the National Assembly for the assigned tasks.
2. Represent the Chairman of the National Assembly to perform tasks and exercise powers when authorized by the Chairman of the National Assembly.
3. Lead and direct the organization and handling of work within the scope of responsibility assigned; promptly report to the Chairman of the National Assembly in case of major issues arising.
4. Chair discussions and conclude sessions of the Standing Committee of the National Assembly, specialized meetings of National Assembly delegates, and other meetings of the Standing Committee of the National Assembly on matters within the assigned field of responsibility and other matters assigned by the Chairman of the National Assembly; chair meetings with leaders of ministries, sectors, localities, agencies, organizations, and individuals according to the division of labor.
5. Chair meetings and conferences with the Secretary-General of the National Assembly, the Standing Committee of the Ethnic Council, the Standing Committee of the National Assembly's Committees, leaders of the National Assembly Office, and leaders of agencies under the Standing Committee of the National Assembly to direct the implementation of tasks within the assigned field of responsibility; attend sessions of the Ethnic Council, National Assembly's Committees, the Standing Committee of the Ethnic Council, the Standing Committee of the National Assembly's Committees, meetings of the National Assembly Office, and agencies under the Standing Committee of the National Assembly when necessary.
6. Monthly, the Vice Chairman of the National Assembly, according to the division of labor, chairs a coordination meeting with the Secretary-General of the National Assembly - Director of the National Assembly Office, the Chairman of the Ethnic Council, the Chairman of the National Assembly's Committees, and heads of agencies under the Standing Committee of the National Assembly.
7. Assist the Chairman of the National Assembly in directing the preparation of contents to be submitted to the National Assembly and the Standing Committee of the National Assembly according to the division of labor.
8. Assist the Chairman of the National Assembly in directing the organization of the implementation of external activities of the Standing Committee of the National Assembly; direct, coordinate, and harmonize external activities and international cooperation of the Ethnic Council, National Assembly's Committees, State Audit Agency, National Assembly Office, agencies under the Standing Committee of the National Assembly, Vietnam Friendship Parliamentarian Group, friendship parliamentary groups, and other National Assembly delegate groups.
9. Participate in discussions and vote on matters of work of the Standing Committee of the National Assembly.
10. Perform other duties and exercise other powers as prescribed by law, this Regulation, and the division of labor by the Standing Committee of the National Assembly and the Chairman of the National Assembly.
Article 6. The performance of duties and powers of Members of the Standing Committee of the National Assembly
1. Perform tasks according to the division of labor by the Standing Committee of the National Assembly,
2. Direct the organization and implementation of work contents according to the division of labor by the Standing Committee of the National Assembly,
3. In cases where the Standing Committee of the National Assembly assigns,
4. Assist the Standing Committee of the National Assembly in maintaining working relations with the Secretary-General of the National Assembly, the Ethnic Council, National Assembly's Committees, the National Assembly Office, and agencies under the Standing Committee of the National Assembly.
5. Participate in discussions and vote on matters of work of the Standing Committee of the National Assembly.
6. Perform other duties and exercise other powers as prescribed by law, this Regulation, and the division of labor by the Standing Committee of the National Assembly,
Article 7. Work relations between the Standing Committee of the National Assembly and the National Ethnic Council, Committees of the National Assembly
1. Assignment and adjustment of the assignment for the National Ethnic Council, Committees of the National Assembly to be in charge of reviewing and participating in reviewing draft laws, ordinances, draft resolutions, reports, projects, bills, and other draft documents in accordance with the field of responsibility of each agency, except where decided by the National Assembly.
2. Assignment for the National Ethnic Council, Committees of the National Assembly to implement contents in the supervision program of the National Assembly, the supervision program of the Standing Committee of the National Assembly, and other contents in accordance with the field of responsibility of each agency, except where decided by the National Assembly.
3. Coordination and cooperation in activities of the National Ethnic Council, Committees of the National Assembly taking place at the same time, location, agency, or organization.
4. Directing, coordinating, and cooperating in annual external activities and international cooperation of the National Ethnic Council, Committees of the National Assembly.
5. Directing, coordinating, and cooperating in organizing citizen reception activities of the National Ethnic Council, Committees of the National Assembly.
6. Considering and responding to recommendations of the National Ethnic Council, Committees of the National Assembly.
7. Issuing a model regulation on work procedures for the National Ethnic Council, Committees of the National Assembly and guiding the organization and implementation of other activities of the National Ethnic Council, Committees of the National Assembly.
8. In necessary cases,
Article 8. Work relations between the Standing Committee of the National Assembly and the Secretary-General of the National Assembly, the Office of the National Assembly, agencies under the Standing Committee of the National Assembly
1. Directing the Secretary-General of the National Assembly to prepare the proposed work program, session program, supervision program of the Standing Committee of the National Assembly; advising on the construction, implementation, and execution of programs and activities of the Standing Committee of the National Assembly; coordinating and cooperating in the activities of the National Ethnic Council, Committees of the National Assembly; advising on the procedures and processes for implementing activities of the Standing Committee of the National Assembly and performing other tasks and powers delegated by the Standing Committee of the National Assembly.
2. Directing the Office of the National Assembly to organize services for sessions and other activities of the Standing Committee of the National Assembly; ensuring material infrastructure and other conditions for the activities of the Standing Committee of the National Assembly.
3. Directing agencies under the Standing Committee of the National Assembly to advise and assist the Standing Committee of the National Assembly in their assigned fields.
Article 9. Work relations between the Standing Committee of the National Assembly and the State President
1. The State President has the right to attend meetings of the Standing Committee of the National Assembly and express opinions on matters included in the meeting agenda.
2. The Standing Committee of the National Assembly is responsible for reconsidering the content of ordinances that have been approved by the Standing Committee of the National Assembly according to the request of the State President at the most recent meeting; coordinating with the State President in presenting to the National Assembly for decision at the nearest session when the State President does not agree with the decision to reconsider made by the Standing Committee of the National Assembly.
3. In necessary cases, the Standing Committee of the National Assembly, the Chairman of the National Assembly will work with the State President on issues related to the performance of duties and powers as prescribed.
Article 10. Work relations between the Standing Committee of the National Assembly and the Government, the Prime Minister
1. The Standing Committee of the National Assembly informs the Government, the Prime Minister about the session program, resolutions of the National Assembly; the work program, session program, resolutions, conclusions of the Standing Committee of the National Assembly within the responsibility of the Government, the Prime Minister.
2. The Government reports its work to the Standing Committee of the National Assembly regularly every six months and annually; reports other contents as required by the Standing Committee of the National Assembly.
3. The Prime Minister may be invited to attend meetings of the Standing Committee of the National Assembly and express opinions on matters included in the meeting agenda. Other members of the Government may be invited to attend meetings of the Standing Committee of the National Assembly and express opinions on matters related to their assigned areas of responsibility or as designated by the Government, the Prime Minister.
4. In necessary cases, the Standing Committee of the National Assembly, the Chairman of the National Assembly will work with the Government, the Prime Minister on issues related to the performance of duties and powers as prescribed.
Article 11. Working relationship between the Standing Committee of the National Assembly and the National Election Council
1. Representatives of the National Election Council shall be invited to attend meetings of the Standing Committee of the National Assembly when discussing the proposed number of National Assembly deputies to be elected; determining the structure and composition of individuals recommended for candidacy as National Assembly deputies; guiding the determination of the proposed structure and composition, allocation of the number of individuals recommended for candidacy as People's Council deputies at all levels, and other related issues.
2. The Standing Committee of the National Assembly shall cooperate with the National Election Council in establishing inspection teams for the election of National Assembly deputies and People's Council deputies at all levels. The Standing Committee of the National Assembly shall appoint persons to participate in the inspection team of the National Election Council regarding the election work; the National Election Council shall appoint persons to participate in the supervision team of the Standing Committee of the National Assembly regarding the election work.
3. After soliciting opinions from the National Election Council, the Standing Committee of the National Assembly shall establish the administrative apparatus assisting the National Election Council.
4. In cases where necessary, when examining and promulgating resolutions interpreting constitutional provisions, laws, and issuing detailed regulations and guidance related to election work, the Standing Committee of the National Assembly shall seek the opinion of the National Election Council. The Standing Committee of the National Assembly shall provide comments on draft guidance documents on election work upon request of the National Election Council.
5. The Standing Committee of the National Assembly shall provide comments on the report of the National Election Council on the nationwide election summary and results of confirming the qualifications of elected National Assembly deputies before submitting to the National Assembly.
6. The Standing Committee of the National Assembly shall be responsible for receiving and processing complaints and reports related to elected National Assembly deputies, final reports, and election-related files and materials transferred by the National Election Council prior to its conclusion of duties.
7. In cases where necessary, the Standing Committee of the National Assembly and the Chairman of the National Assembly shall work with the National Election Council on matters related to the implementation of tasks and powers as prescribed.
Article 12. Working relationship between the Standing Committee of the National Assembly and the Central Steering Committee of the Vietnam Fatherland Front, the Chairman of the Central Steering Committee of the Vietnam Fatherland Front, and the heads of member organizations of the Front
1. The Chairman of the Central Steering Committee of the Vietnam Fatherland Front and the heads of member organizations of the Front shall be invited to attend meetings of the Standing Committee of the National Assembly and express their opinions on related issues.
2. The Standing Committee of the National Assembly shall provide comments on the draft report of the Central Steering Committee of the Vietnam Fatherland Front summarizing the opinions and recommendations of voters and the people to be reported to the National Assembly.
3. In cases where necessary, the Standing Committee of the National Assembly and the Chairman of the National Assembly shall direct the submission of draft laws and resolutions of the National Assembly, draft ordinances and resolutions of the Standing Committee of the National Assembly to solicit the opinion of the Central Steering Committee of the Vietnam Fatherland Front, the Vietnam Chamber of Commerce and Industry, and other relevant member organizations of the Front.
4. In cases where necessary, the Standing Committee of the National Assembly and the Chairman of the National Assembly shall work with the Central Steering Committee and the Chairman of the Central Steering Committee of the Vietnam Fatherland Front on matters related to the implementation of tasks and powers as prescribed.
Article 13. Working relationship between the Standing Committee of the National Assembly and the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General
1. The President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General shall be invited to attend meetings of the Standing Committee of the National Assembly and express their opinions on related issues.
2. The Standing Committee of the National Assembly shall inform the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General about the agenda of the session, resolutions of the National Assembly; work programs, meeting agendas, resolutions, and conclusions of the Standing Committee of the National Assembly that fall within the responsibility of the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Office.
3. The President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General shall report their work to the Standing Committee of the National Assembly during periods when the National Assembly is not in session.
4. In necessary cases, the Standing Committee of the National Assembly, the Chairman of the National Assembly shall meet with the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General regarding issues related to the performance of their duties and powers as prescribed.
Article 14. Working relationship between the Standing Committee of the National Assembly and the People's Councils at provincial level
1. The Chairman of the National Assembly decides on inviting the Standing Body of the People's Council, the Chairman of the Provincial People's Council to attend meetings of the Standing Committee of the National Assembly on related issues.
2. The Standing Committee of the National Assembly organizes annual conferences to review the activities of the Provincial People's Councils, mid-term reviews, and term-end summaries; thematic conferences; other conferences related to the activities of the People's Councils.
3. The Standing Committee of the National Assembly supervises and guides the activities of the People's Councils; directs the organization of training for the knowledge and skills of People's Council deputies according to the proposal of the Standing Body of the Provincial People's Council.
4. The Standing Body of the Provincial People's Council invites representatives of the Standing Committee of the National Assembly to attend sessions of the People's Council.
5. The Standing Body of the Provincial People's Council sends resolutions, draft plans, reports, minutes of sessions, and semi-annual and annual activity reports of the People's Council to the Standing Committee of the National Assembly.
6. In necessary cases, the Standing Committee of the National Assembly, the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly assigned by the Chairman shall meet with the Standing Body of the Provincial People's Council.
Chapter II
FORMS OF WORK OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Section 1
MEETING OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Article 15. Organization of meetings of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly examines and decides on matters within its tasks and powers at the meeting, except for cases stipulated in Article 27 of this Regulation.
2. Meetings of the Standing Committee of the National Assembly include:
a) Regular sessions;
b) Specialized sessions;
c) Extraordinary meetings;
d) Other meetings.
3. Regular meetings begin on the tenth day of each month; if the tenth day of the month coincides with a statutory holiday, the start date of the meeting will be the next working day. If the meeting begins at another time, it is decided by the Chairman of the National Assembly.
Thematic meetings and other meetings are organized based on decisions of the Chairman of the National Assembly or upon proposals from the President of the State, the Prime Minister, or at least one-third of the total number of members of the Standing Committee of the National Assembly. The start time of the meeting is decided by the Chairman of the National Assembly.
An extraordinary meeting is a meeting outside regular meetings, thematic meetings, and other meetings, convened by the Chairman of the National Assembly to address urgent matters within the authority of the Standing Committee of the National Assembly as prescribed by law.
4. The Standing Committee of the National Assembly meets in public. In necessary cases, the Standing Committee of the National Assembly may organize closed meetings according to the decision of the Chairman of the National Assembly.
Article 16. Agenda of the Standing Committee of the National Assembly's Session
1. The planning of the agenda and the convening of regular meetings, thematic meetings, and other meetings are carried out in accordance with Article 62 of the Law on the Organization of the National Assembly. The planning of the agenda and the convening of extraordinary meetings are done by
2. The Standing Committee of the National Assembly decides on the agenda before starting the meeting content.
3. In necessary cases, based on actual circumstances or upon the proposal of a member of the Standing Committee of the National Assembly, relevant agencies, organizations, or individuals, the Chairman of the National Assembly considers and decides to adjust the agenda of the meeting.
Article 17. Preparation of the Content for the Meeting of the Standing Committee of the National Assembly
1. The Chairman of the National Assembly directs the preparation of the content for the meeting of the Standing Committee of the National Assembly. The Vice-Chairman of the National Assembly and the member of the Standing Committee of the National Assembly direct the preparation of the content according to the division of labor assigned by the Standing Committee of the National Assembly and the Chairman of the National Assembly.
2. The Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Office of the National Assembly, agencies under the Standing Committee of the National Assembly, and related agencies, organizations, and individuals have the responsibility to prepare the content for the meeting in accordance with regulations or according to their assigned tasks.
Article 18. Participants in the Meeting of the Standing Committee of the National Assembly
1. The participants include:
a) Members of the Standing Committee of the National Assembly are responsible for attending all meetings of the Standing Committee of the National Assembly; in case they cannot attend, they must obtain the consent of the Chairman of the National Assembly.
In the absence of a member of the Standing Committee of the National Assembly who is also the Secretary-General of the National Assembly - the Director of the Office of the National Assembly, the Chairman of the Ethnic Council, the Director of the Committee of the National Assembly, or the Head of a Department under the Standing Committee of the National Assembly, a deputy may be appointed to attend the meeting. The person attending in place of the member may present the opinions of the member of the Standing Committee of the National Assembly upon authorization; they may express personal opinions when the Chairman of the National Assembly or the Vice-Chairman of the National Assembly agrees during the conduct of the meeting's content but do not have the right to vote;
b) Representatives of agencies, organizations, and individuals presenting and agencies reviewing and preparing opinions are responsible for attending the meeting regarding the content they oversee;
c) The President has the right to attend the meeting of the Standing Committee of the National Assembly;
d) The Prime Minister, the Chairman of the Vietnam Fatherland Front Central Committee, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the State Auditor General are invited to attend the meetings of the Standing Committee of the National Assembly;
đ) Representatives of relevant agencies and organizations are invited to attend the meeting of the Standing Committee of the National Assembly when discussing matters related to their responsibilities; they are required to attend the meeting or appoint someone with authority to attend; if attendance is not possible, they must notify the Secretary-General of the National Assembly in writing to report to the Chairman of the National Assembly;
e) Deputy Secretaries-General of the National Assembly, Deputy Chairmen of the Ethnic Council, Deputy Directors of the Committees of the National Assembly, representatives of the leadership of the Office of the National Assembly, and representatives of the leadership of agencies under the Standing Committee of the National Assembly are invited to attend the meetings of the Standing Committee of the National Assembly;
g) Regular members and specialized members of the Ethnic Council and the Committees of the National Assembly are invited to attend the meetings of the Standing Committee of the National Assembly to discuss matters within the scope of the Ethnic Council and the Committees of the National Assembly's responsibilities.
2. The Secretary-General of the National Assembly coordinates with the Permanent Delegation of the Ethnic Council, the Permanent Delegation of the Committees of the National Assembly, the leadership of the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly to host the content in the proposed agenda of the meeting to predict the participants, report to the Chairman of the National Assembly for consideration and decision.
Article 19. Documents for the Meeting of the Standing Committee of the National Assembly
1. Official documents for the meeting of the Standing Committee of the National Assembly are prepared by related agencies, organizations, and individuals according to the proposed agenda of the meeting. Other documents (if any) are prepared by
2. Agencies presenting, agencies reviewing draft projects, proposals, reports send electronic and paper versions of all types of documents for the meeting of the Standing Committee of the National Assembly to the Office of the National Assembly.
a) For regular sessions and specialized sessions, the submitting agency must send documents to the main reviewing agency at least twenty days before the start of the session, except in cases where the law provides otherwise; documents must be sent to members of the Standing Committee of the National Assembly within the time limit prescribed by the Law on the Organization of the National Assembly and the Law on Enacting Legal Normative Documents, except in cases provided for in point c of this clause and where the law provides otherwise;
a) For regular meetings and special topic meetings, documents submitted to the Standing Committee of the National Assembly must be sent simultaneously to the agency in charge of review at least 20 days before the start of the meeting, except where otherwise provided by law; documents for the meeting are sent to members of the Standing Committee of the National Assembly in accordance with the Law on the Organization of the National Assembly and the Law on Legislative Procedures, except as provided in point d of this clause and where otherwise provided by law;
b) For other meetings, documents submitted to the Standing Committee of the National Assembly must be sent simultaneously to the agency in charge of review at least 5 days before the start of the meeting; documents for the meeting must be sent to members of the Standing Committee of the National Assembly at least 2 days before the start of the meeting, except as provided in point d of this clause;
c) For extraordinary meetings, the time for sending documents is determined by
d) The time for sending documents about plans for economic and social development, state budget estimates, and personnel work is decided by the Chairman of the National Assembly; the time for sending documents about investment programs and national target programs, important national projects, and investment projects within the scope of approval of the National Assembly as stipulated in Clause 1, Article 83 of this Regulation.
4. At least 25 days before the start of the meeting of the Standing Committee of the National Assembly, files and documents of the content proposed to be added to the regular meeting agenda and special topic meetings must be sent to the Secretary-General of the National Assembly for reporting
Article 20. Chairing the Meeting of the Standing Committee of the National Assembly
1. The Chairman of the National Assembly shall chair the meeting of the Standing Committee of the National Assembly and perform the following tasks and powers:
a) Opening and closing the meeting;
b) Determining the validity of the meeting based on the composition of participants and the content of documents submitted to the Standing Committee of the National Assembly;
c) Proposing the topics for the Standing Committee of the National Assembly to focus on discussing;
d) Inviting members of the Standing Committee of the National Assembly to speak in the order of registration or inviting representatives attending the meeting to express their opinions;
đ) Deciding to extend or shorten the discussion time on the agenda of the meeting;
e) Concluding the discussions at the meeting;
g) Proposing issues for the Standing Committee of the National Assembly to vote on;
h) Managing the voting process;
i) Ensuring the implementation of the meeting program and signing the minutes of the meeting.
2. The Vice-Chairman of the National Assembly shall manage the content of the meeting and perform the tasks and powers stipulated in Clause 1 of this Article according to the division of labor by the Chairman of the National Assembly.
Article 21. Reporting at the Meeting of the Standing Committee of the National Assembly
1. Members of the Government authorized by the Prime Minister shall directly report at the meeting of the Standing Committee of the National Assembly on projects, draft laws, programs, and reports.
The Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General, heads of agencies and organizations presenting projects, draft laws, programs, and reports, or agencies preparing opinions on these matters shall directly report at the meeting of the Standing Committee of the National Assembly upon request of the Chairman of the National Assembly or the Vice-Chairman of the National Assembly managing the meeting content. In special cases, with the consent of the Chairman of the National Assembly, heads of agencies and organizations may authorize deputies to report instead.
2. The presentation of reports on projects, draft laws, programs, and reports at the meeting shall not exceed 15 minutes. Based on the content and actual situation, the Chairman of the National Assembly or the Vice-Chairman of the National Assembly managing the meeting may decide to adjust the presentation time or request additional reporting and explanations.
Article 22. Discussion at the Meeting of the Standing Committee of the National Assembly
1. The Chairman of the National Assembly or the Vice-Chairman of the National Assembly managing the meeting shall determine the purpose, requirements, and content of the discussion; invite members of the Standing Committee of the National Assembly to speak; and invite representatives attending the meeting to express their opinions when necessary.
2. For projects, draft laws, programs, and reports submitted to the Standing Committee of the National Assembly for comments before being presented to the National Assembly, the Standing Committee of the National Assembly shall concentrate on discussing and providing opinions on major viewpoints, policies, or controversial issues, progress, and conditions for submission to the National Assembly.
For projects, draft laws, programs, and reports submitted to the Standing Committee of the National Assembly for decision within its authority, the Standing Committee of the National Assembly shall comprehensively examine and discuss all issues before making a decision.
Article 23. Providing Opinions on Content Submitted to the National Assembly at the Meeting of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly shall provide opinions on content submitted to the National Assembly at the meeting in the following sequence:
a) Agencies, organizations, or individuals submitting projects, draft laws, programs, and reports, or agencies assigned to lead research, explain, adopt, and revise such projects, draft laws, programs, and reports shall present the report;
b) The National Ethnic Council and Committees of the National Assembly shall present audit reports or opinion reports (if applicable); the Secretary-General of the National Assembly, the Office of the National Assembly, and Departments under the Standing Committee of the National Assembly shall present opinion reports (if applicable);
d) The Standing Committee of the National Assembly shall discuss;
đ) Agencies, organizations, or individuals submitting draft projects, proposals, programs, reports, requests, or suggestions may express their opinions (if applicable);
đ) Agencies, organizations, or individuals submitting or agencies assigned to lead research, explain, adopt, and revise shall present opinions (if applicable);
2. The issuance of documents concluding the content of the session shall be carried out in accordance with the provisions of Article 26 of this Regulation.”

Article 24. Examination and Decision on Matters within the Authority at the Session of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly shall consider and decide on matters within its authority at the meeting in the following sequence:
b) The Ethnic Council and Committees of the National Assembly shall present review reports or opinion reports (if applicable); the General Secretary of the National Assembly - Director of the National Assembly Office and the National Assembly Office shall present opinion reports (if applicable);
b) The National Ethnic Council and Committees of the National Assembly shall present audit reports or opinion reports (if applicable); the Secretary-General of the National Assembly, the Office of the National Assembly, and Departments under the Standing Committee of the National Assembly shall present opinion reports (if applicable);
d) The Standing Committee of the National Assembly shall discuss;
đ) Agencies, organizations, or individuals submitting draft projects, proposals, programs, reports, requests, or suggestions may express their opinions (if applicable);
đ) Agencies, organizations, or individuals submitting projects, draft laws, programs, and reports shall present explanatory opinions (if applicable);
e) The Chairman or Vice-Chairman of the National Assembly shall chair the session's proceedings, conclude, and raise issues for the Standing Committee of the National Assembly to vote on;
g) The Standing Committee of the National Assembly shall vote;
h) If the Standing Committee of the National Assembly has not approved or decided not to vote but needs to continue considering and deciding at the next meeting, the Chairman of the National Assembly or the Vice-Chairman of the National Assembly managing the meeting content shall conclude and assign agencies, organizations, or individuals to lead and coordinate research, explanation, adoption, and revision.
2. The Standing Committee of the National Assembly shall consider and decide on content that has been commented on at the previous meeting in the following sequence:
a) Agencies, organizations, or individuals assigned to lead research, explanation, adoption, and revision shall present reports;
b) Representatives invited to attend the meeting shall present opinions;
c) The Standing Committee of the National Assembly shall discuss.
d) Agencies, organizations, or individuals assigned to lead research, explanation, adoption, and revision shall present explanatory opinions (if applicable);
đ) The Chairman of the National Assembly or the Vice-Chairman of the National Assembly managing the meeting content shall conclude and propose issues for the Standing Committee of the National Assembly to vote on;
e) The Standing Committee of the National Assembly shall vote.
3. If necessary, based on the opinions of the Standing Committee of the National Assembly, the Chairman of the National Assembly shall decide on the issuance of conclusions for content that has been approved by the Standing Committee of the National Assembly. The issuance of conclusion documents shall be carried out in accordance with Article 26 of this Regulation.
Article 25. Voting at the session of the Standing Committee of the National Assembly
1. The Standing Committee of the National Assembly decides to apply one of the following voting methods:
a) Secret ballot voting;
b) Hand-raising voting;
c) Electronic voting system.
2. Secret ballot voting shall be conducted in the following sequence:
a) The Chairman of the National Assembly or Vice-Chairman of the National Assembly directs the content of the session, raising the issue for voting;
b) The Secretary-General of the National Assembly proposes the list of the Counting Board to be submitted to the Standing Committee of the National Assembly for consideration and decision; in cases of voting on personnel matters, the list of the Counting Board is proposed by the Delegation Work Board;
c) The Standing Committee of the National Assembly discusses and votes to approve the list of the Counting Board through hand-raising method;
d) The Counting Board guides the recording of ballots and disseminates the rules of secret ballot voting;
đ) Members of the Standing Committee of the National Assembly present at the session cast their votes;
e) The Counting Board conducts the vote counting and reports the results to the Standing Committee of the National Assembly.
3. Hand-raising voting or electronic voting system shall be conducted in the following sequence:
a) The Chairman of the National Assembly or Vice-Chairman of the National Assembly directs the content of the session, raising the issue for voting;
b) Members of the Standing Committee of the National Assembly present at the session vote; they have the right to vote in favor, against, or abstain;
c) The Chairman of the National Assembly or Vice-Chairman of the National Assembly directs the content of the session and announces the voting results.
4. In case it is necessary to re-vote on an issue already approved by the Standing Committee of the National Assembly, the Standing Committee of the National Assembly will discuss and decide.

1. After concluding each item considered and commented upon by the Standing Committee of the National Assembly at the session, based on the conclusions of the Chairman of the National Assembly or Vice-Chairman of the National Assembly directing the session, the Secretary-General of the National Assembly, the Permanent Delegation of the National Assembly, the Permanent Committees of the National Assembly, and agencies under the Standing Committee of the National Assembly draft the conclusion document of the Standing Committee of the National Assembly on each item within their respective areas of responsibility, to be sent to the Secretary-General of the National Assembly for comments from the Vice-Chairmen of the National Assembly before submitting to the Chairman of the National Assembly for consideration and decision.
2. Within no more than three working days from the date the item was considered and commented upon at the session of the Standing Committee of the National Assembly, the conclusion document of the Standing Committee of the National Assembly on that item shall be sent to relevant agencies, organizations, and individuals for further study, adoption, and implementation.
Section 2
CONSIDERATION, COMMENTARY, AND DECISION BY WRITTEN DOCUMENTS
Article 27. Cases of consideration, commentary, and decision by written documents
1. The Standing Committee of the National Assembly considers and comments by written documents in the following cases:
a) Written responses to agencies, organizations, and individuals requesting opinions from the Standing Committee of the National Assembly, except in cases stipulated in Article 53 of this Regulation;
b) Draft laws, resolutions of the National Assembly, draft ordinances, resolutions, proposals, projects, plans of the Standing Committee of the National Assembly after being prepared, adopted, and revised according to the conclusions of the Standing Committee of the National Assembly;
c) Agenda of sessions, work plans of the Standing Committee of the National Assembly;
d) Draft explanatory report, adoption, revision, and draft laws, resolutions of the National Assembly completed based on the opinions of National Assembly deputies during the session to be submitted to the National Assembly for voting approval;
đ) Reviewing reports on the activities of the People's Councils at provincial level;
e) Providing guidance on specific contents in the activities of the People's Councils;
g) Other necessary cases decided by the Chairman of the National Assembly.
2. The Standing Committee of the National Assembly considers and decides by written documents in the following cases:
a) Deciding on the establishment, dissolution, organization, and operation of the Vietnam Parliamentary Friendship Group, parliamentary friendship groups, Young Deputies Group, Women Deputies Group, and other deputy groups;
b) Considering, approving, and deciding on personnel issues of the Delegation of National Assembly Deputies;
c) Considering, approving, and deciding on personnel issues of the Chairperson and Deputy Chairpersons of the People's Councils at provincial level;
d) Issuing resolutions, programs, and plans to implement resolutions of the National Assembly;
đ) Deciding on the establishment of drafting boards for law, ordinance projects, and resolution drafts;
e) Other necessary cases decided by the Chairman of the National Assembly.
3. The Chairman of the National Assembly may himself or upon the proposal of the Vice-Chairman of the National Assembly responsible, the Secretary-General of the National Assembly, or the agency in charge of the content, decide to submit items specified in Clause 1 and Clause 2 of this Article to the session of the Standing Committee of the National Assembly for consideration, commentary, and decision.
Article 28. Documents to be submitted to the Standing Committee of the National Assembly for consideration, comments, and decision in writing
1. For cases prescribed in point a, Clause 1, Article 27 of this Regulation, the documents include:
a) Documents and materials sent by agencies, organizations, or individuals requesting opinions from the Standing Committee of the National Assembly;
b) Reports from the agency assigned to lead the research and prepare responses, clearly stating viewpoints and proposals on issues requiring opinions from the Standing Committee of the National Assembly;
c) Draft documents of the Standing Committee of the National Assembly or draft documents of the Secretary-General of the National Assembly announcing the opinions of the Standing Committee of the National Assembly;
d) Other documents (if any).
2. For cases prescribed in point b, Clause 1, Article 27 of this Regulation, the documents include:
a) Reports requesting opinions from the Standing Committee of the National Assembly;
b) Draft laws, resolutions of the National Assembly, draft ordinances, resolutions, reports, projects, programs prepared, adopted, and revised;
c) Draft reports explaining, adopting, and revising draft laws and resolutions of the National Assembly; reports explaining, adopting, and revising draft ordinances, resolutions, reports, projects, programs of the Standing Committee of the National Assembly;
d) Other documents (if any).
3. For cases prescribed in point c, Clause 1, Article 27 of this Regulation, the documents include:
a) Reports requesting opinions from the Standing Committee of the National Assembly;
b) Draft agenda for sessions, activity plans;
c) Other relevant materials (if any).
4. For cases prescribed in point d, Clause 1, Article 27 of this Regulation, the documents include:
a) Reports requesting opinions from the Standing Committee of the National Assembly from the permanent office of the leading inspection agency;
b) Draft reports of the Standing Committee of the National Assembly explaining, adopting, and revising draft laws and resolutions of the National Assembly;
c) Draft laws and resolutions of the National Assembly that have been adopted and revised;
d) Reports summarizing discussions by National Assembly deputies, provincial-level delegations, agencies, and organizations;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
5. For cases prescribed in point đ, Clause 1, Article 27 of this Regulation, the documents include:
a) Reports on the opinions of the Deputies' Working Group;
b) Reports on the activities of the People's Council at the provincial level;
c) Other relevant materials (if any).
6. For cases prescribed in point e, Clause 1, Article 27 of this Regulation, the documents include:
a) Documents submitted by the Deputies' Working Group;
b) Draft guiding documents of the Standing Committee of the National Assembly;
c) Documents proposing by the People's Council at the provincial level (if any);
d) Documents providing opinions of the Permanent Office of the Ethnic Council, Permanent Office of relevant Committees of the National Assembly;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
7. For cases prescribed in point a and point đ, Clause 2, Article 27 of this Regulation, the documents include:
a) Reports to the Standing Committee of the National Assembly;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Voting ballots;
d) Other documents (if any).
8. For cases prescribed in point b and point c, Clause 2, Article 27 of this Regulation, the documents include:
a) Reports from the Deputies' Working Group;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Voting ballots;
d) Copies of reports and materials from agencies, organizations, or authorized persons sent to the Standing Committee of the National Assembly;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
9. For cases prescribed in point d, Clause 2, Article 27 of this Regulation, the documents include:
a) Reports requesting opinions from the Standing Committee of the National Assembly;
b) Draft resolutions, agendas, plans;
c) Voting ballots;
d) Other documents (if any).
10. For cases prescribed in point g, Clause 1, and point e, Clause 2, Article 27 of this Regulation, the documents submitted to the Standing Committee of the National Assembly shall be carried out according to the provisions of Clause 1 of this Article and draft resolutions, voting ballots (if any).
Article 29. Procedure and formalities for the Standing Committee of the National Assembly to consider, provide opinions, and decide in writing
1. The leading agency of the content shall organize research, prepare draft documents or draft resolutions of the Standing Committee of the National Assembly on the content to be submitted for consideration, opinion provision, and decision-making by the Standing Committee of the National Assembly; related materials and draft voting sheets (if any); report to the Vice Chairman of the National Assembly responsible for considering and deciding to send the dossier and materials to members of the Standing Committee of the National Assembly.
2. Members of the Standing Committee of the National Assembly shall have the responsibility to study and clearly express their views in writing or on voting sheets and return them to the leading agency of the content no later than two working days from the date of receipt of the dossier and materials, except in cases where the Chairman of the National Assembly or the Vice Chairman of the National Assembly responsible has other requirements regarding time. For complex contents with many different opinions, it may be necessary to seek opinions from members of the Standing Committee of the National Assembly multiple times.
3. Within three working days from the end of the period for seeking opinions, except in cases where the Chairman of the National Assembly or the Vice Chairman of the National Assembly responsible has other requirements regarding time, the leading agency of the content shall be responsible for compiling, studying, adopting, explaining the opinions of members of the Standing Committee of the National Assembly or compiling the results of the voting sheets, reporting to the Vice Chairman of the National Assembly responsible for considering and deciding to submit to the Chairman of the National Assembly.
4. The dossier submitted to the Chairman of the National Assembly includes:
a) The document submitted to the Chairman of the National Assembly;
b) Draft documents sent for opinions according to Clause 1 of this Article after being adopted and completed;
c) Report on compiling, explaining, adopting opinions of members of the Standing Committee of the National Assembly or compiling the results of the voting sheets; opinions of the Vice Chairman of the National Assembly responsible;
d) Documents participating in opinions of members of the Standing Committee of the National Assembly.
5. Based on the content and nature of the document, the Chairman of the National Assembly signs the document or delegates the signing authority to the Vice Chairman of the National Assembly or instructs the Secretary-General of the National Assembly to issue a notification of the opinions of the Standing Committee of the National Assembly.
Section 3
MEETINGS ORGANIZED BY THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Article 30. Meetings of specialized representatives of the National Assembly
1. Based on the planned agenda of the National Assembly session and the work program of the Standing Committee of the National Assembly, the Secretary-General of the National Assembly shall coordinate with the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly, and agencies under the Standing Committee of the National Assembly to develop a Plan for organizing the Meeting to be decided by the Standing Committee of the National Assembly.
2. The Plan for organizing the Meeting shall be sent to the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly, the Office of the National Assembly, agencies under the Standing Committee of the National Assembly, Delegations of National Assembly representatives, and relevant agencies and organizations no later than ten days before the scheduled date of the Meeting and shall be publicly announced on the National Assembly's electronic information portal.
3. The Standing Committee of the National Assembly shall decide to convene representatives to attend the Meeting no later than seven days before the opening of the Meeting.
4. The participants in the Meeting include:
a) Specialized representatives of the National Assembly who are responsible for attending the Meeting; in case of absence, they must clearly state the reason and notify the Secretary-General of the National Assembly to report to the Chairman of the National Assembly for decision;
b) Representatives of agencies, organizations, individuals submitting projects, drafts, proposals, reports;
c) Non-specialized representatives of the National Assembly have the right to register to attend the Meeting and send registration documents to the Secretary-General of the National Assembly no later than five days before the opening of the Meeting for compilation and reporting to the Chairman of the National Assembly for consideration and decision;
d) Managers, experts, scientists, and representatives of relevant agencies and organizations may be invited to attend the Meeting based on the proposal of the leading agency of the content, the Secretary-General of the National Assembly, or the request of the Chairman of the National Assembly or the Vice Chairman of the National Assembly.
5. The Chairman of the National Assembly shall chair the Meeting. Depending on the nature and content of the draft laws, draft resolutions, proposals, and reports, the Chairman of the National Assembly may delegate the Vice Chairman of the National Assembly to manage the content of the Meeting.
6. Meeting materials shall be sent to participants no later than three working days before the opening of the Meeting, including:
a) For draft laws, draft resolutions, proposals, and reports that have been reviewed by the National Assembly at the previous session, the dossier shall include: revised draft laws, resolutions, proposals, and reports; reports of the agency assigned to lead the research, explanation, adoption, and revision or the agency submitting major issues still having different opinions in the draft, proposal, or report; draft report on explanation, adoption, and revision; summary report on the opinions of National Assembly representatives; other documents (if any);
b) For draft laws, draft resolutions, proposals, and reports to be submitted to the National Assembly for review and approval at one session, the dossier shall include: dossier of draft laws, draft resolutions, proposals, and reports submitted to the National Assembly; report of the reviewing agency; other documents (if any).
7. The submitting agency and the reviewing agency shall be responsible for reporting and clarifying issues raised by representatives at the Meeting; studying opinions at the Meeting to adopt and revise draft laws, draft resolutions, proposals, and reports.
Article 31. Other meetings or conferences
1. The Standing Committee of the National Assembly shall decide to organize other meetings or conferences upon the proposal of members of the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly, the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly to implement tasks and powers as prescribed.
2. The Chairman of the National Assembly, Vice Chairmen of the National Assembly, and members of the Standing Committee of the National Assembly assigned to chair meetings or conferences of the Standing Committee of the National Assembly with relevant agencies and organizations to implement assigned tasks.
3. Based on the conclusions of the chairperson, the Secretary-General of the National Assembly, the Standing Committee of the National Assembly's Ethnic Council, the Standing Committees of the National Assembly's Committees, the Office of the National Assembly, and the agency under the Standing Committee of the National Assembly responsible for the content, draft the conclusion document of the meeting or conference for each content item, send it to the Secretary-General of the National Assembly for the opinion of the chairperson before submitting it to the Chairman of the National Assembly for consideration and decision.
Section 4
DELEGATION OF WORK THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Article 32. Forms of organization of the Delegation of Work of the Standing Committee of the National Assembly
1. The domestic delegation of work of the Standing Committee of the National Assembly, the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, and the Members of the Standing Committee of the National Assembly shall work with the leadership of Ministries, sectors, localities, agencies, organizations, and individuals.
2. The foreign delegation of work of the Standing Committee of the National Assembly, the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, and the Members of the Standing Committee of the National Assembly shall carry out diplomatic activities.
Article 33. Establishment, Organization, and Reporting on the Results of Domestic Delegations of Work
1. Based on the annual program of work of the Standing Committee of the National Assembly, the monthly or weekly program of work of the Chairman of the National Assembly, the Vice Chairmen of the National Assembly, or urgent tasks within the jurisdiction of the Standing Committee of the National Assembly, the Standing Committee of the National Assembly decides to establish delegations of work, assigns the Head of the delegation, and other members of the delegation to work with the leadership of Ministries, sectors, localities, agencies, organizations, and individuals regarding relevant content.
2. The Head of the delegation has the responsibility to direct the development of plans, programs, and working contents of the delegation to submit to the Chairman of the National Assembly or the Vice Chairman of the National Assembly in charge for review and decision, and to send them to related agencies, organizations, and individuals.
3. After completing their activities, the delegation issues conclusions or reports on the results of their activities.
Article 34. Establishment, Organization, and Reporting on the Results of Foreign Delegations of Work
The establishment, organization, and reporting on the results of foreign delegations of work shall be carried out according to the regulations on the National Assembly's foreign activities promulgated by the Standing Committee of the National Assembly.
Section 5
ACTIVITIES OF THE CHAIRMAN OF THE NATIONAL ASSEMBLY, VICE CHAIRMEN OF THE NATIONAL ASSEMBLY, AND MEMBERS OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY WHEN PERFORMING
TASKS AND POWERS OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Article 35. Regular Briefings of the Chairman of the National Assembly and Vice Chairmen of the National Assembly
1. The Chairman of the National Assembly and the Vice Chairmen of the National Assembly organize regular briefings monthly or when requested by the Chairman of the National Assembly. The Chairman of the National Assembly decides on the content to be discussed at the briefing.
2. The Director of the National Assembly's Office prepares a comprehensive report on activities and leadership guidance of the Chairman of the National Assembly and the Vice Chairmen of the National Assembly and attends the meeting. In necessary cases, with the consent of the Chairman of the National Assembly, representatives of related agencies may be invited to attend the meeting.
3. The Director of the National Assembly's Office prepares the draft conclusion document, seeks opinions from the Vice Chairmen of the National Assembly to report to the Chairman of the National Assembly for consideration and decision. At the latest two working days after the end of the briefing, the conclusion document is sent to related agencies, organizations, and individuals for implementation.
Article 36. Periodic meetings of the National Assembly Chairperson, Vice Chairpersons with the General Secretary of the National Assembly, the National Ethnic Council, Committees of the National Assembly, the National Assembly Office, and agencies under the Standing Committee of the National Assembly1. The National Assembly Chairperson or Vice Chairperson, as assigned, shall preside over monthly and quarterly periodic meetings with the General Secretary of the National Assembly - Director of the National Assembly Office, Chairman of the National Ethnic Council, Director of the National Assembly Committees, and heads of agencies under the Standing Committee of the National Assembly.
2. The Director of the National Assembly Office shall prepare a consolidated report on the activities of the Standing Committee of the National Assembly, the National Assembly Chairperson, Vice Chairpersons, the General Secretary of the National Assembly, the National Ethnic Council, National Assembly Committees, the National Assembly Office, and agencies under the Standing Committee of the National Assembly.
3. The Director of the National Assembly Office shall draft the minutes of the meeting for review and decision by the chairperson. The minutes must be sent to relevant agencies, organizations, and individuals for implementation within two working days after the meeting concludes.
Article 37. The National Assembly Chairperson, Vice Chairpersons meet with the General Secretary of the National Assembly, the Standing Committee of the National Ethnic Council, the Standing Committee of the National Assembly Committees, leaders of the National Assembly Office, and leaders of agencies under the Standing Committee of the National Assembly
1. In cases where necessary or upon request from relevant agencies, the National Assembly Chairperson, Vice Chairpersons shall meet with the General Secretary of the National Assembly, the Standing Committee of the National Ethnic Council, the Standing Committee of the National Assembly Committees, leaders of the National Assembly Office, and leaders of agencies under the Standing Committee of the National Assembly.
2. The agency responsible for the main content shall prepare the materials for the meeting. The National Assembly Office shall be responsible for organizing and coordinating the provision of materials and ensuring the conditions for the meeting.
3. The agency responsible for the main content shall coordinate with the National Assembly Office to draft the minutes and report for review and decision by the National Assembly Chairperson, Vice Chairpersons, except when the Chairperson, Vice Chairpersons have other requirements. The minutes must be sent to relevant agencies, organizations, and individuals for implementation within three working days after the meeting concludes.
Article 38. The National Assembly Chairperson, Vice Chairpersons meet with leaders of Ministries, sectors, localities, agencies, organizations, and individuals
1. In cases where necessary or upon request from relevant agencies, the National Assembly Chairperson, Vice Chairpersons shall meet with leaders of Ministries, sectors, localities, agencies, organizations, and individuals.
2. At least seven days before the meeting, Ministries, sectors, localities, agencies, organizations, and individuals shall submit reports to the National Assembly Office for presentation to the National Assembly Chairperson, Vice Chairpersons. Based on the directives of the National Assembly Chairperson, Vice Chairpersons and their assigned functions and tasks, the General Secretary of the National Assembly, the Standing Committee of the National Ethnic Council, the Standing Committee of the National Assembly Committees, the National Assembly Office, and agencies under the Standing Committee of the National Assembly and relevant agencies shall provide advice and support for the meeting content and report to the National Assembly Chairperson, Vice Chairpersons.
3. The National Assembly Office shall be responsible for organizing the plan; coordinating with related agencies to provide materials and ensure the conditions for the meeting.
4. The National Assembly Office shall coordinate with related agencies to draft the minutes of the meeting of the National Assembly Chairperson, Vice Chairpersons, except when the Chairperson, Vice Chairpersons have other requirements. The draft minutes must be submitted for comments from Ministries, sectors, localities, agencies, organizations, and individuals before reporting to the National Assembly Chairperson, Vice Chairpersons for review and decision. The minutes must be sent to relevant Ministries, sectors, localities, agencies, organizations, and individuals for implementation within seven days after the meeting concludes.
4. The Office of the National Assembly shall coordinate with relevant agencies to prepare draft conclusions of the National Assembly Chairperson and Vice-Chairpersons, except where the National Assembly Chairperson or Vice-Chairpersons request otherwise. Draft conclusions must be submitted for comments from Ministries, sectors, localities, agencies, organizations, and individuals concerned before being reported to the National Assembly Chairperson and Vice-Chairpersons for consideration and decision. At the latest seven days after the end of the meeting, the conclusion document shall be sent to Ministries, sectors, localities, agencies, organizations, and individuals concerned for implementation.
Article 39. Members of the Standing Committee of the National Assembly work with leaders of Ministries, sectors, localities, agencies, organizations, and individuals
1. Members of the Standing Committee of the National Assembly work with leaders of Ministries, sectors, localities, agencies, organizations, and individuals according to the assignment of the Standing Committee of the National Assembly or the delegation of the Chairman or Vice-Chairman of the National Assembly.
2. The Office of the National Assembly shall develop plans for organization; coordinate with relevant agencies to provide materials and ensure working conditions.
3. Not later than seven days after the end of the working session, the report on the results of the working session must be submitted to the Standing Committee of the National Assembly and the relevant Ministries, sectors, localities, agencies, organizations, and individuals.
Article 40. Receiving domestic and international guests
1. The Chairman of the National Assembly directly or assigns the Vice-Chairmen of the National Assembly, members of the Standing Committee of the National Assembly to receive domestic guests of the Standing Committee of the National Assembly.
The Vice-Chairmen of the National Assembly, members of the Standing Committee of the National Assembly assigned to receive guests shall direct the preparation and personally receive guests; in necessary cases, they shall report to the Chairman of the National Assembly for instructions before receiving guests, and request the Office of the National Assembly to compile recommendations and proposals (if any) to report to the Chairman of the National Assembly or the Standing Committee of the National Assembly.
The Secretary-General of the National Assembly, the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly, the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly have the responsibility to prepare related information and documents and send representatives to attend guest receptions when requested.
The Office of the National Assembly shall advise and serve the reception of guests; issue regulations on serving the welcoming and reception of domestic guests.
2. Activities of welcoming and receiving international guests shall be carried out in accordance with the provisions of the Regulation on Foreign Relations Activities of the National Assembly issued by the Standing Committee of the National Assembly and the regulations on diplomatic protocol.
Chapter III
PROCEDURES AND RESPONSIBILITIES FOR HANDLING WORK
OF THE STANDING NATIONAL ASSEMBLY
Section 1
IN THE LEGISLATIVE FIELD
Subsection 1
ESTABLISHING, AMENDING, AND IMPLEMENTING THE PROGRAM TO BUILD LAWS AND ORDINANCES OF THE NATIONAL ASSEMBLY
Article 41. Drafting the anticipated program to build laws and ordinances
1. After receiving the dossier proposing the construction of laws, ordinances, resolutions, and suggestions regarding laws, ordinances, and resolutions, based on the areas of responsibility of the National Ethnic Council, Committees of the National Assembly, and the Standing Committee of the Legal Affairs Committee, it will propose the division of responsibilities for the competent agency and report to the Vice-Chairman of the National Assembly responsible for consideration and decision.
In cases where the proposal for the construction of laws, ordinances, resolutions, and suggestions regarding laws, ordinances, and resolutions involves overlapping areas under the responsibility of the National Ethnic Council and Committees of the National Assembly, the Standing Committee of the Legal Affairs Committee will propose the competent agency and report to the Vice-Chairman of the National Assembly responsible and other Vice-Chairmen of the National Assembly responsible for related areas for consideration and decision.
2. The Standing Committee of the Legal Affairs Committee transfers the dossier proposing the construction of laws, ordinances, resolutions, and suggestions regarding laws, ordinances, and resolutions to the competent agency for review, while also transferring it to the National Ethnic Council and other Committees of the National Assembly for their opinions.
3. The Legal Affairs Committee leads the review and drafting of the review report on the proposal for the construction of laws, ordinances, resolutions, and suggestions regarding laws, ordinances, and resolutions; the review report must reflect the review opinions and opinions from the National Ethnic Council and other Committees of the National Assembly.
4. Documents submitted to the Standing Committee of the National Assembly for consideration of the proposal for the construction of laws, ordinances, resolutions, and suggestions regarding laws, ordinances, and resolutions include:
a) The proposal of the Government, agencies, organizations, and National Assembly deputies;
b) The dossier proposing the construction of laws, ordinances, resolutions, and the dossier suggesting laws, ordinances, and resolutions;
c) The review report of the Legal Affairs Committee;
d) A copy of the review opinions and opinions from the National Ethnic Council and other Committees of the National Assembly;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
5. The procedure for the Standing Committee of the National Assembly to consider the proposal for the construction of laws, ordinances, resolutions, and suggestions regarding laws, ordinances, and resolutions shall be implemented in accordance with Clause 1 of Article 48 of the Law on Enacting Legislative Acts.
6. Based on the conclusions of the meeting, the Standing Committee of the Legal Affairs Committee shall lead and coordinate with relevant agencies and organizations to draft the draft proposal to the National Assembly of the Standing Committee of the National Assembly and the draft resolution of the National Assembly on the program to build laws and ordinances, report to the Vice-Chairman of the National Assembly responsible before submitting to the Standing Committee of the National Assembly.
7. The procedure for the Standing Committee of the National Assembly to consider and decide on the draft proposal to the National Assembly and the draft resolution of the National Assembly on the program to build laws and ordinances shall be implemented in accordance with Article 29 of this Regulation.
Article 42. The Standing Committee of the National Assembly adjusts the legislative drafting program and ordinances
1. During the period between two sessions of the National Assembly, the Standing Committee of the National Assembly examines and decides to adjust the legislative drafting program and ordinances in the following cases:
a) Supplementing draft laws, ordinances, and draft resolutions to the legislative drafting program and ordinances based on the proposal of agencies, organizations, and National Assembly deputies who have the right to submit draft projects and proposals;
b) Changing the scope of regulation, time for submission, or removing from the legislative drafting program and ordinances draft laws, ordinances, and draft resolutions based on the proposal of agencies, organizations, and National Assembly deputies submitting draft projects and proposals;
c) Adjusting the time for submission or removal from the program for draft laws, ordinances, and draft resolutions based on the examination of the preparation situation of relevant agencies and organizations.
2. The examination and adjustment of the legislative drafting program and ordinances in the case provided for in point a of Clause 1 of this Article shall be carried out as follows:
a) Based on the areas under the responsibility of the National Ethnic Council and Committees of the National Assembly, the Standing Committee of the Legal Affairs Committee transfers the dossier proposing the drafting of laws, ordinances, and resolutions to the National Ethnic Council and Committees of the National Assembly for review, and to other agencies for comments;
In the case where the proposal for drafting laws, ordinances, and resolutions involves overlapping areas under the responsibility of the National Ethnic Council and Committees of the National Assembly, the Standing Committee of the Legal Affairs Committee proposes the reviewing agency to report to the Vice Chairman of the National Assembly responsible for those areas and related Vice Chairmen for consideration and decision;
b) The Legal Affairs Committee takes the lead in reviewing and preparing a review report on the proposal for drafting laws, ordinances, and resolutions; the review report must reflect the opinions of the review, and the opinions of the National Ethnic Council and other Committees of the National Assembly;
c) Based on the results of the review, the Legal Affairs Committee prepares a draft resolution of the Standing Committee of the National Assembly regarding the adjustment of the legislative drafting program and ordinances (if necessary);
d) Documents submitted to the Standing Committee of the National Assembly for examination of the proposal for drafting laws, ordinances, and resolutions include the documents prescribed in Clause 4 of Article 41 of this Regulation and the draft resolution of the Standing Committee of the National Assembly (if necessary);
đ) The procedure for the Standing Committee of the National Assembly to examine the proposal for drafting laws, ordinances, and resolutions to decide on their inclusion in the legislative drafting program and ordinances is implemented according to the provisions of Clause 1 of Article 48 of the Law on Enacting Legal Normative Documents; if necessary, the Standing Committee of the National Assembly provides opinions to submit to the National Assembly for examination and decision on the inclusion of draft laws, ordinances, and draft resolutions in the legislative drafting program and ordinances;
3. The examination and adjustment of the legislative drafting program and ordinances in the case provided for in point b of Clause 1 of this Article shall be carried out according to the procedures stipulated in Clause 2 of this Article.
4. The examination and adjustment of the legislative drafting program and ordinances in the case provided for in point c of Clause 1 of this Article shall be carried out as follows:
a) Based on the conclusions of the Standing Committee of the National Assembly or the Chairman of the National Assembly, the Standing Committee of the Legal Affairs Committee takes the lead and coordinates with relevant agencies and organizations to prepare a draft resolution of the Standing Committee of the National Assembly regarding the adjustment of the legislative drafting program and ordinances to be submitted to the Standing Committee of the National Assembly;
b) The procedure for the Standing Committee of the National Assembly to examine and issue a resolution adjusting the legislative drafting program and ordinances is implemented according to the provisions of Article 24 of this Regulation.
5. The Standing Committee of the Legal Affairs Committee coordinates with the Secretary-General of the National Assembly to assist the Standing Committee of the National Assembly in preparing the content of the report to the National Assembly at the nearest session regarding the adjustment of the legislative drafting program and ordinances.
Article 43. Implementation of the legislative program
1. The Standing Committee of the National Assembly shall issue a resolution to implement the National Assembly's resolution on the legislative program. The Standing Committee of the Legal Affairs Committee shall take the lead and coordinate with the General Secretary of the National Assembly, the Standing Committee of the National Ethnic Council, other Standing Committees of the National Assembly, and relevant agencies to prepare the draft resolution of the Standing Committee of the National Assembly, including the proposed allocation of agencies, organizations, and National Assembly deputies responsible for presenting, the main drafting agency (for legislative projects and draft resolutions submitted by the Standing Committee of the National Assembly), the main reviewing agency, participating reviewing agencies, and the proposed timeline for submitting legislative projects and draft resolutions to the Standing Committee of the National Assembly.
2. The procedure for the Standing Committee of the National Assembly to consider and issue a resolution to implement the National Assembly's resolution on the legislative program shall be carried out in accordance with the provisions of Article 29 of this Regulation.
3. Based on actual circumstances, the Standing Committee of the National Assembly shall coordinate with the Government and relevant agencies to organize a meeting to implement the legislative program. The Standing Committee of the Legal Affairs Committee shall take the lead and coordinate with relevant agencies and organizations to assist the Standing Committee of the National Assembly in preparing the meeting agenda. The National Assembly Office shall be responsible for preparing the conditions to ensure the meeting.
4. The Standing Committee of the Legal Affairs Committee shall act as the focal point to assist the Standing Committee of the National Assembly in monitoring, summarizing, and reporting on the implementation of the legislative program.
5. The Standing Committee of the National Ethnic Council and the Standing Committees of the National Assembly assigned to review shall be responsible for coordinating, monitoring, urging the presenting agency, the main drafting agency, and regularly sending monthly reports on the preparation of legislative projects and draft resolutions to the Standing Committee of the Legal Affairs Committee for consolidation and reporting to the Standing Committee of the National Assembly.
Subsection 2
GIVE OPINIONS ON LEGISLATIVE PROJECTS AND DRAFT RESOLUTIONS
BEFORE SUBMITTING TO THE NATIONAL ASSEMBLY
Article 44. Giving opinions on legislative projects and draft resolutions of the National Assembly
1. The materials and time for submitting legislative project and draft resolution materials to the Standing Committee of the National Assembly for review shall be implemented in accordance with the provisions of Article 19 of this Regulation.
2. In cases where necessary, the Chairman of the National Assembly or the Vice-Chairman of the National Assembly in charge shall work with the Standing Committee of the main reviewing agency, the main drafting agency, and relevant agencies regarding the preparation of legislative projects and draft resolutions before submitting them to the Standing Committee of the National Assembly for opinion.
3. The procedure for the Standing Committee of the National Assembly to give opinions on legislative projects and draft resolutions of the National Assembly shall be carried out in accordance with the provisions of Article 71 of the Law on Enacting Regulatory Legal Documents.
4. The conclusion of the Standing Committee of the National Assembly on legislative projects and draft resolutions of the National Assembly must clearly state whether the legislative project or draft resolution is ready or not ready to be submitted to the National Assembly.
Article 45. Giving opinions on the explanation, adoption, and amendment of draft laws and draft resolutions of the National Assembly according to the opinions of National Assembly deputies
1. After the legislative project and draft resolution have been discussed and given opinions by the National Assembly, the Standing Committee of the main reviewing agency shall take the lead and coordinate with the main drafting agency and relevant agencies to organize the study and propose explanations, adoption, and amendment of the draft law and draft resolution to report to the Standing Committee of the National Assembly.
2. Upon the request of the Standing Committee of the main reviewing agency or when it deems necessary, the Standing Committee of the National Assembly shall examine and give opinions on the explanation, adoption, and amendment of the draft law and draft resolution at one or more meetings.
The procedure for the Standing Committee of the National Assembly to give opinions on the explanation, adoption, and amendment of the draft at the meeting shall be carried out in accordance with the provisions of Article 23 of this Regulation.
3. After the meeting, the Standing Committee of the main reviewing agency shall take the lead and coordinate with the main drafting agency and relevant agencies to adopt the opinions of the Standing Committee of the National Assembly, complete the draft law and resolution to seek opinions at the specialized National Assembly deputies' conference (if any), send to seek opinions from the National Assembly Deputies' Delegations and relevant agencies to adopt, amend the draft law and resolution, and complete the draft report on explanation, adoption, and amendment, to report to the Vice-Chairman of the National Assembly in charge before submitting to the Standing Committee of the National Assembly for consideration and decision on submission to the National Assembly. The documents submitted to the Standing Committee of the National Assembly shall be carried out in accordance with the provisions of Clause 4, Article 28 of this Regulation.
Subsection 3
CONSIDERATION AND APPROVAL OF LEGISLATIVE PROJECTS AND DRAFT RESOLUTIONS OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
Article 46. Examination and Approval of Draft Ordinances and Draft Resolutions of the Standing Committee of the National Assembly
1. The documents and time for submitting draft ordinances and draft resolutions to the Standing Committee of the National Assembly shall be carried out in accordance with the provisions of Article 19 of this Regulation.
2. In cases where necessary, the Chairman of the National Assembly or the Vice-Chairman of the National Assembly responsible may work with the Standing Office of the leading agency in charge of examination, the leading agency in charge of drafting, and related agencies on the preparation of draft ordinances and draft resolutions before submitting them to the Standing Committee of the National Assembly.
3. The procedure for the Standing Committee of the National Assembly to examine and approve draft ordinances and draft resolutions of the Standing Committee of the National Assembly shall be implemented in accordance with the provisions of Article 77 of the Law on Enacting Legal Normative Documents.
4. The Standing Office of the leading agency in charge of examination shall coordinate with relevant agencies to perfect the ordinance and resolution texts approved by the Standing Committee of the National Assembly to submit to the Chairman of the National Assembly for signature and promulgation in accordance with the provisions of Article 50 of this Regulation.
Article 47. Reconsidering Ordinances Already Passed Upon Proposal of the State President
1. The Standing Committee of the National Assembly assigns the leading agency in charge of examination or another agency of the National Assembly to take the lead and cooperate with related agencies to study the proposal of the President to report to the Standing Committee of the National Assembly.
2. The materials submitted to the Standing Committee of the National Assembly for reconsidering ordinances include:
a) Document of the State President proposing the Standing Committee of the National Assembly to reconsider the ordinance;
b) Dossier of the ordinance project;
c) Report the opinions of the agency assigned to study the proposal of the President;
d) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to reconsider ordinances is implemented as follows:
a) The State President presents the proposal for reconsidering the ordinance;
b) The agency assigned to study the opinion of the President presents the report;
c) Agencies and organizations related express their opinions;
d) Deputies attending the session are invited to express their opinions (if any);
đ) The Standing Committee of the National Assembly discusses;
e) The Chairman of the National Assembly concludes and raises issues for the Standing Committee of the National Assembly to vote on;
g) The Standing Committee of the National Assembly votes.
Subsection 4
EXAMINATION AND DECISION ON SOME OTHER MATTERS
WITHIN AUTHORITY
Article 48. Establishment of Drafting Committees for Draft Laws, Ordinances, and Draft Resolutions
1. The Standing Committee of the National Assembly establishes a Drafting Committee for draft laws, ordinances, and draft resolutions in cases provided for in Clause 1 of Article 52 of the Law on Enacting Legal Normative Documents.
2. The agency assigned by the Standing Committee of the National Assembly to take the lead in drafting prepares the dossier to request the establishment of a Drafting Committee in accordance with Clause 7 of Article 28 of this Regulation to submit to the Standing Committee of the National Assembly.
3. The procedure for the Standing Committee of the National Assembly to examine and approve the resolution establishing the Drafting Committee is implemented in accordance with the provisions of Article 29 of this Regulation.
Article 49. Examination and Decision on Dossiers of Draft Laws and Draft Resolutions Submitted by the Standing Committee of the National Assembly to the National Assembly
1. The leading agency in charge of drafting builds the dossier of draft laws and draft resolutions and reports to the Vice-Chairman of the National Assembly responsible before submitting it to the Standing Committee of the National Assembly.
2. The Standing Committee of the National Assembly examines and gives opinions on the contents and dossiers of draft laws and draft resolutions at one or more sessions.
3. The procedure for the Standing Committee of the National Assembly to examine and decide on the dossiers of draft laws and draft resolutions is implemented in accordance with the provisions of Article 24 of this Regulation.
Article 50. Perfecting Texts After Approval by the National Assembly or the Standing Committee of the National Assembly
1. For laws, ordinances, and resolutions containing legal norms that have been approved by the National Assembly or the Standing Committee of the National Assembly, the Standing Office of the leading agency in charge of examination leads and coordinates with the Standing Office of the Committee for Legal Affairs, the leading agency in charge of drafting, and related agencies to review and perfect the technical aspects of the text, seek opinions according to Clause c of this Article, and report to the Vice-Chairman of the National Assembly responsible for examination and decision-making to submit to the Chairman of the National Assembly for signing the text.
The dossier submitted to the Chairman of the National Assembly includes:
a) The submission document of the Standing Office of the leading agency in charge of examination;
b) The completed law, ordinance, or resolution document, signed off by the head of the leading agency in charge of examination at the end of the document;
c) A record of opinions from the Vice-Chairmen of the National Assembly responsible for the relevant fields, the head of the leading agency in charge of drafting, the head of the leading agency in charge of examination, the Chairperson of the Committee for Legal Affairs, and the Secretary-General of the National Assembly; for laws and ordinances, there must also be a record of opinions from the Chairperson of the Office of the President.
2. For other resolutions that have been approved, the Standing Committee of the National Assembly assigns the leading agency in charge of the content to coordinate with related agencies to complete the text, report to the Vice-Chairman of the National Assembly responsible for examination and decision-making to submit to the Chairman of the National Assembly for signing the text. The dossier submitted to the Chairman of the National Assembly includes:
a) The submission document of the leading agency in charge of the content;
b) The approval opinion of the Vice-Chairman of the National Assembly responsible for the relevant field;
c) The completed resolution document, signed off by the head of the leading agency in charge of the content at the end of the document.
Article 51. Interpretation of the Constitution, laws, and ordinances
1. On the basis of the proposal from agencies, organizations, or National Assembly deputies as stipulated in Clause 1 of Article 159 of the Law on Enacting Legal Normative Documents, or when it deems necessary, the Standing Committee of the National Assembly shall consider and decide on the interpretation of the Constitution, laws, and ordinances.
2. The procedure for the Standing Committee of the National Assembly to consider and decide on the interpretation of the Constitution, laws, and ordinances shall be carried out according to the provisions of Article 23 of this Regulation.
The conclusion of the Standing Committee of the National Assembly regarding the decision to interpret the Constitution, laws, and ordinances must clearly state the reasons and requirements for interpretation; assign the agency responsible for drafting, the agency responsible for reviewing, and the agency participating in reviewing the draft resolution on interpreting the Constitution, laws, and ordinances.
3. At least twenty days before the scheduled start date of the Standing Committee of the National Assembly's session, the agency responsible for drafting must submit the dossier of the draft resolution on interpreting the Constitution, laws, and ordinances to the Standing Committee of the National Assembly, while simultaneously sending it to the agency responsible for reviewing and the agency participating in reviewing to conduct the review.
4. The dossier submitted to the Standing Committee of the National Assembly includes:
a) The report on the draft resolution from the agency responsible for drafting;
b) The draft resolution on interpreting the Constitution, laws, and ordinances;
c) Examination report for the draft submitted by the Government; opinions of the Government on the draft not submitted by the Government;
d) A copy of opinions contributed; reports summarizing, explaining, and incorporating opinions from agencies and organizations;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
5. The agency responsible for reviewing and the agency participating in reviewing shall conduct the review to report to the Standing Committee of the National Assembly for consideration and decision.
6. The procedure for the Standing Committee of the National Assembly to consider and pass the draft resolution on interpreting the Constitution, laws, and ordinances shall be carried out according to the provisions of Clause 2 of Article 160 of the Law on Enacting Legal Normative Documents.
Article 52. Decision on Organizing Public Opinion Solicitation on Draft Laws
1. After the draft law has been discussed at the first session of the National Assembly, based on the nature and content of the draft law, the Standing Committee of the National Assembly decides on organizing public opinion solicitation, the content, scope, format, and time for soliciting public opinion on the draft law.
2. At least twenty days before the scheduled start date of the Standing Committee of the National Assembly's session, the agency, organization, or National Assembly deputy submitting the draft law must send the dossier on organizing public opinion solicitation on the draft law to the Standing Committee of the National Assembly, while simultaneously sending it to the agency responsible for reviewing the draft law for study and preparation of opinions.
3. The dossier submitted to the Standing Committee of the National Assembly includes:
a) The report from the agency, organization, or National Assembly deputy submitting the draft law on organizing public opinion solicitation;
b) The draft resolution of the Standing Committee of the National Assembly on organizing public opinion solicitation on the draft law;
c) The draft law that has been incorporated and revised according to the opinions of National Assembly deputies, the draft report explaining, incorporating, and revising the draft law, and the report on the proposed content for soliciting public opinion;
d) Other documents (if any).
4. The agency responsible for reviewing the draft law organizes research and prepares opinions to report to the Standing Committee of the National Assembly for consideration and decision.
5. The procedure for the Standing Committee of the National Assembly to consider and decide on organizing public opinion solicitation on the draft law shall be carried out according to the provisions of Article 24 of this Regulation.
Article 53. Soliciting opinions on the issuance of decrees concerning necessary issues within the jurisdiction of the National Assembly or the Standing Committee of the National Assembly but not yet meeting the conditions for drafting into laws or ordinances.
1. The Standing Committee of the National Assembly assigns the Ethnic Council and the National Assembly's Committees to be responsible for reviewing and participating in reviewing the draft decree.
2. The dossier submitted to the Standing Committee of the National Assembly shall be carried out according to the provisions of Clause 2 of Article 95 of the Law on Enacting Legal Normative Documents.
3. The procedure for the Standing Committee of the National Assembly to examine, solicit opinions, and decide on allowing the issuance of the decree shall be carried out according to the provisions of Article 24 of this Regulation.
4. The content of the opinions focuses on the necessity of promulgating; basic policies and main contents of the draft document; scope and subjects regulated by the document; issues requested for opinions by the Government or still having differing opinions, and other issues of concern to the Standing Committee of the National Assembly.
Section 2
IN THE FIELD OF SUPERVISION
Article 54. Supervisory Activities of the Standing Committee of the National Assembly
The Standing Committee of the National Assembly conducts supervisory activities and implements procedures and formalities as prescribed by the Law on the Supervisory Activities of the National Assembly and People's Councils, the Rules for Organizing Certain Supervisory Activities of the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Deputies.
- Prime Minister;55. Considering Ordinances and Resolutions of the Standing Committee of the National Assembly that appear to be contrary to the Constitution, laws, or resolutions of the National Assembly
1. When discovering or receiving proposals or recommendations from agencies, organizations, or individuals regarding the examination of ordinances and resolutions of the Standing Committee of the National Assembly that appear to be contrary to laws or resolutions of the National Assembly, the Standing Committee of the National Assembly assigns the Ethnic Council and Committees of the National Assembly to lead and participate in the review; for proposals or recommendations to examine ordinances and resolutions of the Standing Committee of the National Assembly that appear to be contrary to the Constitution, the Legal Committee of the National Assembly leads the review, with the Ethnic Council and other Committees of the National Assembly participating in the review as assigned by the Standing Committee of the National Assembly.
2. The procedure for the Standing Committee of the National Assembly to examine ordinances and resolutions that appear to be contrary to the Constitution, laws, or resolutions of the National Assembly shall be implemented according to the provisions of Article 24 of this Regulation.
3. In cases where it is determined that ordinances and resolutions of the Standing Committee of the National Assembly are contrary to the Constitution, laws, or resolutions of the National Assembly, the Standing Committee of the National Assembly suspends the implementation of the ordinances and resolutions; assigns the agency, organization, or individual that submitted the ordinances and resolutions to study and propose amendments to ensure compliance with the Constitution, laws, and resolutions of the National Assembly. Amendments to the ordinances and resolutions shall be carried out in accordance with the provisions of the Law on Enacting Normative Legal Documents.
Article 56. Examination and Decision on Matters to be Submitted to the National Assemblyfor Confidence Voting on Individuals Holding Positions Appointed or Approved by the National Assembly
1. The Representative Work Committee proposes a list of individuals subject to confidence voting, coordinates with relevant agencies to prepare the dossier for submission to the Standing Committee of the National Assembly for examination of matters to be submitted to the National Assembly for confidence voting on individuals holding positions appointed or approved by the National Assembly.
2. The dossier submitted to the Standing Committee of the National Assembly includes:
a) Documents submitted by the Deputies' Working Group;
b) Draft report of the Standing Committee of the National Assembly;
c) List of individuals subject to confidence voting;
d) Report of the individual subject to confidence voting;
đ) Report of the Vietnam Fatherland Front Central Committee summarizing opinions and recommendations of voters related to the individual subject to confidence voting;
e) Sample ballots for each position or group of positions;
g) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to examine matters to be submitted to the National Assembly for confidence voting on individuals holding positions appointed or approved by the National Assembly shall be implemented according to the provisions of Article 24 of this Regulation.
4. Based on the conclusions of the Standing Committee of the National Assembly, the Representative Work Committee assists the Standing Committee of the National Assembly in perfecting the dossier and documents to be sent to National Assembly deputies in accordance with the National Assembly's regulations on confidence voting on individuals holding positions appointed or approved by the National Assembly.
Article 57. Examination and Decision on Matters to be Submitted to the National Assembly for Trust Voting on Individuals Holding Positions Appointed or Approved by the National Assembly
1. The Representative Work Committee coordinates with relevant agencies to assist the Standing Committee of the National Assembly in preparing the dossier for submission to the National Assembly on matters concerning trust voting on individuals holding positions appointed or approved by the National Assembly, in accordance with the National Assembly's regulations on trust voting on individuals holding positions appointed or approved by the National Assembly.
2. The dossier submitted to the Standing Committee of the National Assembly includes:
a) Documents submitted by the Deputies' Working Group;
b) Draft report of the Standing Committee of the National Assembly on individuals to be put forward for trust voting;
c) Summary report of opinions and recommendations from relevant agencies and National Assembly deputies on individuals to be put forward for trust voting;
d) Notification document of the opinion of the competent authority on individuals to be put forward for trust voting (if any);
đ) Sample ballot for individuals to be put forward for trust voting;
e) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to examine and decide on matters to be submitted to the National Assembly for trust voting on individuals holding positions appointed or approved by the National Assembly shall be implemented according to the provisions of Article 24 of this Regulation.
4. Based on the conclusions of the Standing Committee of the National Assembly, the Representative Work Committee assists the Standing Committee of the National Assembly in perfecting the dossier and documents to submit to the National Assembly for trust voting on individuals holding positions appointed or approved by the National Assembly.
Section 3
ISSUES ON PERSONNEL AND ORGANIZATIONAL STRUCTURE OF THE STATE
Subsection 1
PREPARATION FOR SUBMISSION TO THE NATIONAL ASSEMBLY FOR EXAMINATION AND DECISION ON PERSONNEL AND ORGANIZATIONAL STRUCTURE OF THE STATE
Article 58. Examination and decision on personnel issues submitted by the Standing Committee of the National Assembly for examination and decision by the National Assembly
1. The Delegation Work Board shall coordinate with relevant agencies to assist the Standing Committee of the National Assembly in preparing files for the National Assembly to elect, appoint, dismiss, approve, and relieve duties of representatives according to the proposal of the Standing Committee of the National Assembly.
2. The dossier submitted to the Standing Committee of the National Assembly includes:
a) Documents submitted by the Deputies' Working Group;
b) Draft proposal of the Standing Committee of the National Assembly;
c) Personnel files of individuals proposed for each position, except in cases of appointment, dismissal, and relief of duties of representatives;
d) Draft resolution of the National Assembly;
đ) Resignation letter, application for relief of duties as a representative (if any);
e) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to examine and decide on personnel issues proposed for election, appointment, dismissal, approval, and relief of duties of representatives shall be carried out in accordance with the provisions of Article 24 of this Regulation.
4. Based on the conclusion of the Standing Committee of the National Assembly, the Delegation Work Board assists the Standing Committee of the National Assembly in perfecting the file to submit to the National Assembly.
Article 59. Examination and decision on the establishment of the National Election Council1. The Delegation Work Board shall coordinate with relevant agencies to assist the Standing Committee of the National Assembly in preparing files for the National Assembly to establish the National Election Council.
3. The procedure for the Standing Committee of the National Assembly to examine and decide on the establishment of the National Election Council shall be carried out in accordance with the provisions of Article 24 of this Regulation.
2. The dossier submitted to the Standing Committee of the National Assembly includes:
a) Documents submitted by the Deputies' Working Group;
b) Draft proposal of the Standing Committee of the National Assembly;
c) Draft resolution of the National Assembly;
d) Other documents (if any).
Article 60. Opinions on the organizational structure of the Government and the number of members of the Government
4. Based on the conclusion of the Standing Committee of the National Assembly, the Delegation Work Board assists the Standing Committee of the National Assembly in perfecting the file to submit to the National Assembly.
1. The Standing Committee of the National Assembly shall provide opinions on the organizational structure of the Government and the number of members of the Government to be submitted to the National Assembly for examination and decision.
a) The report of the Government on the organizational structure of the Government, the report of the Prime Minister on the number of members of the Government;
The dossier submitted to the Standing Committee of the National Assembly shall include:
b) Draft resolution of the National Assembly;
c) Proposal on related issues (if any);
2. The Committee for Legal Affairs shall review the report of the Government on the organizational structure of the Government and the report of the Prime Minister on the number of members of the Government.
d) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to provide opinions on the organizational structure of the Government and the number of members of the Government shall be carried out in accordance with the provisions of Article 23 of this Regulation.
4. Based on the conclusion of the Standing Committee of the National Assembly, the Government and the Prime Minister shall perfect the file to submit to the National Assembly.
Article 61. Opinions on the submission to the National Assembly for examination and decision on personnel issues proposed by the Chairman of the National Election Council, the President, and the Prime Minister
1. The Delegation Work Board shall coordinate with relevant agencies to receive files from the Chairman of the National Election Council, the President, and the Prime Minister regarding personnel issues within their authority; prepare opinions (if any) and draft resolutions of the National Assembly to be submitted to the Standing Committee of the National Assembly.2. The procedure for the Standing Committee of the National Assembly to provide opinions on the proposals of the Chairman of the National Election Council, the President, and the Prime Minister regarding personnel issues shall be carried out in accordance with the provisions of Article 23 of this Regulation.3. Based on the conclusion of the Standing Committee of the National Assembly, the Chairman of the National Election Council, the President, and the Prime Minister shall perfect the file; the Delegation Work Board shall assist the Standing Committee of the National Assembly in coordinating to perfect the file to submit to the National Assembly.
1. The Delegation Work Committee shall coordinate with relevant agencies to receive files from the Chairman of the National Election Council, the State President, and the Prime Minister regarding personnel matters within their authority; prepare opinions (if any) and draft resolutions of the National Assembly to submit to the Standing Committee of the National Assembly.
2. The procedure for the Standing Committee of the National Assembly to provide opinions on the personnel proposals of the Chairman of the National Election Council, the State President, and the Prime Minister shall be carried out in accordance with Article 23 of this Regulation.
3. Based on the conclusions of the Standing Committee of the National Assembly, the Chairman of the National Election Council, the State President, and the Prime Minister shall complete the files; the Delegation Work Committee shall assist the Standing Committee of the National Assembly in coordinating to complete the files for submission to the National Assembly.
Article 62. Comment on the proposal to submit to the National Assembly for approvalthe proposal of the President of the Supreme People's Court regarding the appointment of judges of the Supreme People's Courtproposal of the Chief Justice of the Supreme People's Court regarding the appointment of Supreme People's Court judges
1. The President of the Supreme People's Court shall submit to the Standing Committee of the National Assembly for comments on the proposal to submit to the National Assembly for approval the proposal for the appointment of judges of the Supreme People's Court.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) The report of the President of the Supreme People's Court;
b) The personnel file of the person proposed;
c) Draft resolution of the National Assembly;
d) The model of the National Assembly's approval certificate;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
2. The Committee on Legal Affairs shall examine the proposal of the President of the Supreme People's Court regarding the appointment of judges of the Supreme People's Court to be submitted to the National Assembly for consideration and approval.
3. The procedure for the Standing Committee of the National Assembly to comment on the proposal to submit to the National Assembly for approval the proposal of the President of the Supreme People's Court regarding the appointment of judges of the Supreme People's Court shall be carried out in accordance with the provisions of Article 23 of this Regulation.
4. On the basis of the conclusion of the Standing Committee of the National Assembly, the President of the Supreme People's Court shall coordinate with relevant agencies to complete the dossier to submit to the National Assembly.
Article 63. Responsibilities of the Ministry of Science and Technology Comment on the proposal to submit to the National Assembly for examination and decisionestablishment, dissolution, merger, division, adjustment administrative boundariesof provinces, centrally governed cities, special administrative-economic units
1. The Government shall submit to the Standing Committee of the National Assembly for comments on the proposal to submit to the National Assembly for examination and decision on the establishment, dissolution, merger, division, and adjustment of administrative boundaries of provinces, centrally governed cities, and special administrative-economic units.
2. The dossier for submission to the Standing Committee of the National Assembly for comments on the proposal to submit to the National Assembly for examination and decision on the establishment, dissolution, merger, division, and adjustment of administrative boundaries of provinces, centrally governed cities, and special administrative-economic units shall include the documents prescribed in Article 133 of the Law on Organization of Local Administration.
3. The Committee on Legal Affairs shall examine the report and project of the Government on the establishment, dissolution, merger, division, and adjustment of administrative boundaries of provinces, centrally governed cities, and special administrative-economic units. In cases where necessary, the Standing Committee of the National Assembly may propose to the National Assembly to establish a temporary committee to examine the report and project of the Government on the establishment and dissolution of special administrative-economic units.
4. The procedure for the Standing Committee of the National Assembly to comment on the proposal to submit to the National Assembly for examination and decision on the establishment, dissolution, merger, division, and adjustment of administrative boundaries of provinces, centrally governed cities, and special administrative-economic units shall be carried out in accordance with the provisions of Article 23 of this Regulation.
Article 64. Examine and decide on the proposal to submit to the National Assemblyto decidethe date of the national election for the election of members of the National Assembly and the election of members of People's Councils at all levels
1. The Delegation Work Committee shall cooperate with relevant agencies to assist the Standing Committee of the National Assembly in preparing the dossier to submit to the National Assembly to decide the date of the national election for the election of members of the National Assembly and the election of members of People's Councils at all levels.
2. The dossier submitted to the Standing Committee of the National Assembly includes:
a) Documents submitted by the Deputies' Working Group;
b) Draft proposal of the Standing Committee of the National Assembly;
c) Draft resolution of the National Assembly;
d) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to examine and decide on the proposal to submit to the National Assembly to decide the date of the national election for the election of members of the National Assembly and the election of members of People's Councils at all levels shall be carried out in accordance with the provisions of Article 24 of this Regulation.
4. Based on the conclusion of the Standing Committee of the National Assembly, the Delegation Work Board assists the Standing Committee of the National Assembly in perfecting the file to submit to the National Assembly.
- Prime Minister;65Examine anddecide on the proposalto submit to the National Assembly to decideand announce the dateof supplementary election of National Assembly deputies, to establish the Supplementary Election BoardMembers of the National Assembly
1. The Delegation Work Committee shall report to the Standing Committee of the National Assembly for examination and submit to the National Assembly to decide and announce the date of the supplementary election of National Assembly deputies.
2. The dossier for submission to the Standing Committee of the National Assembly for examination and submission to the National Assembly to decide and announce the date of the supplementary election of National Assembly deputies shall include:
a) The report of the Delegation Work Committee on the situation, number of National Assembly deputies; the necessity, basis for conducting the supplementary election of National Assembly deputies and other related issues;
b) Draft report of the Standing Committee of the National Assembly;
c) Draft resolution of the National Assembly;
d) The draft plan of the Standing Committee of the National Assembly on organizing the supplementary election of National Assembly deputies;
6. The procedure for the Standing Committee of the National Assembly to consider the draft legislative direction proposal for the National Assembly's term shall be carried out in accordance with the provisions of Article 23 of this Regulation."
3. The procedure for the Standing Committee of the National Assembly to examine and decide on the proposal to submit to the National Assembly to decide and announce the date of the supplementary election of National Assembly deputies shall be carried out in accordance with the provisions of Article 24 of this Regulation.
4. The procedure for the Standing Committee of the National Assembly to examine and submit to the National Assembly to decide on establishing the Supplementary Election Board for National Assembly deputies shall be carried out in accordance with the provisions of Article 59 of this Regulation.
- Prime Minister;66. Examine anddecide on the proposalto submit to the National Assembly to decide on shortening or extending the term of the National Assembly, the term of the People's Council
1. The Delegation Work Committee shall cooperate with relevant agencies to submit to the Standing Committee of the National Assembly for examination and decision on the proposal to submit to the National Assembly to decide on shortening or extending the term of the National Assembly, the term of the People's Council.
2. The dossier submitted to the Standing Committee of the National Assembly includes:
a) Documents submitted by the Deputies' Working Group;
b) Draft report of the Standing Committee of the National Assembly;
c) Draft resolution of the National Assembly;
d) Other documents (if any).
3. The procedure for the Standing Committee of the National Assembly to examine and decide on the proposal to submit to the National Assembly to decide on shortening or extending the term of the National Assembly, the term of the People's Council shall be carried out in accordance with the provisions of Article 24 of this Regulation.
Subsection 2
EXAMINE AND DECIDE ON PERSONNEL AND ORGANIZATIONAL STRUCTURE OF STATE AGENCIES WITHIN THE SCOPE OF AUTHORITY
IN ACCORDANCE WITH AUTHORITY
Article 67. Examination and decision on the number and approval of the list of Vice Chairpersons of the National Assembly's Ethnic Council, Deputy Heads of Committees, Standing Members, Specialized Members, and other members of the National Assembly's Ethnic Council, Committees;approval of the termination of membership in the National Assembly's Ethnic Council, Committees.1. At the first session of the National Assembly, after being elected by the National Assembly, the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committee shall cooperate with the Delegation Work Committee to propose to the National Assembly's Standing Committee for examination and decision on the number and approval of the list of members of the National Assembly's Ethnic Council, Committees; examination and decision on the number and approval of the list of Vice Chairpersons of the National Assembly's Ethnic Council, Deputy Heads of Committees, Standing Members, Specialized Members of the National Assembly's Ethnic Council, Committees.d.1. Amount of taxable income in Vietnam:During the term of the National Assembly, the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committee shall propose to the National Assembly's Standing Committee for approval of Vice Chairpersons of the National Assembly's Ethnic Council, Deputy Heads of Committees, Standing Members, Specialized Members, and other members of the National Assembly's Ethnic Council, Committees; examination and approval of the termination of Vice Chairpersons, Deputy Heads, Standing Members, Specialized Members, and other members of the National Assembly's Ethnic Council, Committees.C2. The Delegation Work Committee assists the National Assembly's Standing Committee in compiling proposals from the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committee; coordinating in preparing personnel files and draft resolutions of the National Assembly's Standing Committee. 3. The National Assembly's Standing Committee examines and decides on the number, approves the list, and approves the termination of Vice Chairpersons of the National Assembly's Ethnic Council, Deputy Heads of Committees, Standing Members, Specialized Members, and other members of the National Assembly's Ethnic Council, Committees according to the following procedures:
a) The Head of the Delegation Work Committee presents a report summarizing the proposals of the Chairman of the National Assembly's Ethnic Council and the Head of the National Assembly's Committee;
d) The Chairman of the National Assembly's Ethnic Council, the Head of the National Assembly's Committee, and the Head of the Delegation Work Committee report and explain (if required);
g) The National Assembly's Standing Committee votes to approve the draft resolution.
Examination, approval, and decision on personnel issues of the National Assembly's Delegation
1. The Delegation Work Committee proposes to the National Assembly's Standing Committee to designate the convener to chair the first session of the National Assembly's Delegation to elect the Head and Deputy Head of the Delegation.
b) The Chairman of the National Assembly's Ethnic Council and the Head of Committees may make statements (if applicable);
c) Delegates attending the meeting may make statements (if applicable);
đ) Agencies, organizations, or individuals submitting draft projects, proposals, programs, reports, requests, or suggestions may express their opinions (if applicable);
2. The National Assembly's Delegation sends the National Assembly's Standing Committee a proposal requesting approval, minutes of the election results of the Head and Deputy Head of the Delegation; a proposal regarding the assignment of National Assembly delegates to specialized activities within the Delegation (if applicable); a proposal requesting the termination of the Head and Deputy Head of the Delegation; a proposal requesting disciplinary action against the Head and Deputy Head of the Delegation, and disciplinary action against former holders of these positions who have retired.
e) The Chairman of the National Assembly or a Vice Chairman of the National Assembly shall chair the session, conclude, and raise issues for the National Assembly’s Standing Committee to vote;
The Delegation Work Committee compiles the proposals of the National Assembly's Delegation and prepares the file according to Clause 8 of Article 28 of this Regulation to submit to the National Assembly's Standing Committee.
- Prime Minister;68. 3. The procedure for transferring the organizational affiliation of National Assembly delegates is as follows:
a) In cases where a National Assembly delegate is decided by the competent authority to be transferred to hold a key leadership position in a province or centrally governed city not where they currently belong to a Delegation, the Delegation Work Committee will handle the procedures to submit to the National Assembly's Standing Committee for examination and decision on the transfer of the organizational affiliation of that National Assembly delegate;
b) In cases where a National Assembly delegate transfers to work in another province or centrally governed city and wishes to transfer their organizational affiliation to the Delegation where they will be working, they send a written request to the National Assembly's Standing Committee. The Delegation Work Committee exchanges opinions with the Vietnam Fatherland Front Provincial Committee, the Delegation where the National Assembly delegate currently belongs, and the Delegation where the National Assembly delegate plans to transfer to, to submit to the National Assembly's Standing Committee for examination and decision.
4. The procedure for the National Assembly's Standing Committee to examine, approve, and decide on personnel issues of the National Assembly's Delegation is implemented according to the provisions of Article 29 of this Regulation.
Examination, approval, and decision on personnel issues of the Chairman and Deputy Chairmen of the People's Council at the provincial level
1. The People's Council at the provincial level sends the National Assembly's Standing Committee the dossier proposing approval of the election results, removal, and dismissal of the Chairman and Deputy Chairmen of the People's Council at the provincial level; the dossier proposing designation of the acting Chairman of the People's Council at the provincial level; the dossier proposing disciplinary action against the Chairman and Deputy Chairmen of the People's Council at the provincial level, and disciplinary action against former holders of these positions who have retired or resigned.
2. The Delegation Work Committee compiles the proposals of the People's Council at the provincial level and prepares the dossier according to Clause 8 of Article 28 of this Regulation to submit to the National Assembly's Standing Committee.
3. The procedure for the National Assembly's Standing Committee to examine, approve, and decide on personnel issues of the Chairman and Deputy Chairmen of the People's Council at the provincial level is implemented according to the provisions of Article 29 of this Regulation.
- Prime Minister;69. Examine, approve, and decide on personnel issues concerning the Chairperson and Deputy Chairpersons of the Provincial People's Councils
1. The Provincial People's Council shall send the Standing Committee of the National Assembly the file proposing approval of the election results, removal, or dismissal of the Chairperson and Deputy Chairpersons of the Provincial People's Council; the file proposing designation of the acting Chairperson of the Provincial People's Council; the file proposing disciplinary action against the Chairperson and Deputy Chairpersons of the Provincial People's Council and disciplinary action against former Chairpersons and Deputy Chairpersons of the Provincial People's Council who have retired or resigned.
2. The Delegation Work Committee shall compile the proposals of the Provincial People's Council, prepare the file in accordance with Clause 8, Article 28 of this Regulation to submit to the Standing Committee of the National Assembly.
3. The procedure for the Standing Committee of the National Assembly to examine, approve, and decide on personnel issues concerning the Chairperson and Deputy Chairpersons of the Provincial People's Council shall be carried out in accordance with Article 29 of this Regulation.
Article 70. Examination and decision on issues related to National Assembly deputies and elected candidates for National Assembly during periods when the National Assembly is not in session1. In cases where a National Assembly deputy requests to terminate their duties as a deputy, they shall submit a written request to the Standing Committee of the National Assembly, simultaneously sending it to the Delegation Work Board.
2. In cases where a National Assembly deputy is arrested, detained, or indicted; or their residence or workplace is searched, the Procurator General of the Supreme People's Procuracy shall submit the case file requesting the Standing Committee of the National Assembly, simultaneously sending it to the Delegation Work Board, the Standing Committee of the Committee for Justice for study and reporting opinions to the Standing Committee of the National Assembly for examination and decision.
3. In cases where a National Assembly deputy is temporarily detained due to committing a crime on the spot, the detention authority shall report in writing to the Standing Committee of the National Assembly, simultaneously sending it to the Delegation Work Board, the Standing Committee of the Committee for Justice for study and reporting opinions to the Standing Committee of the National Assembly for examination and decision.
4. In cases where the competent authority decides to suspend investigation or terminate the case against a National Assembly deputy, or from the date the judgment or decision of the Court takes effect declaring that National Assembly deputy innocent or exempted from criminal responsibility, upon receiving the judgment or decision, the Delegation Work Board shall report to the Standing Committee of the National Assembly for examination and decision on resuming the performance of duties and powers of the National Assembly deputy.
5. At the most recent session of the National Assembly, the Standing Committee of the National Assembly shall report to the National Assembly on accepting the resignation requests of National Assembly deputies; agreeing with the arrest, detention, indictment of National Assembly deputies and elected candidates for National Assembly; searching the residence and workplace of National Assembly deputies; decisions to temporarily suspend and decisions on resuming the performance of duties and powers of National Assembly deputies in cases where they have been indicted; the loss of the status of a National Assembly deputy due to being convicted by a judgment or decision of the Court that has taken legal effect.
6. The Delegation Work Board assists the Standing Committee of the National Assembly in preparing the report to be submitted to the National Assembly.
Article 71. Examination and decision on personnel leadership of the National Assembly Office, Deputy Secretary-General of the National Assembly, leadership of agencies under the Standing Committee of the National Assembly, Deputy State Auditor; approval of members of the Secretariat Board
5. The procedure for the Standing Committee of the National Assembly to examine and decide on issues related to members of the National Assembly and successful candidates for members of the National Assembly shall be carried out according to the provisions of Article 24 of this Regulation.
1. The Delegation Work Board shall submit to the Standing Committee of the National Assembly proposals for appointing, dismissing, or removing from office the Director of the National Assembly Office, Heads of Departments under the Standing Committee of the National Assembly, and the Procurator of the Legislative Research Institute.
2. The Secretary-General of the National Assembly shall submit to the Standing Committee of the National Assembly proposals for appointing, dismissing, or removing from office the Deputy Secretary-General of the National Assembly; approving, dismissing, or removing from office members of the Secretariat Board.
3. The Director of the National Assembly Office, Heads of Departments under the Standing Committee of the National Assembly, the Procurator of the Legislative Research Institute, and the State Auditor shall submit to the Standing Committee of the National Assembly proposals for appointing, dismissing, or removing from office their respective deputy positions.
4. The Delegation Work Board shall assist the Standing Committee of the National Assembly in compiling proposals from the agencies specified in Clause 2 and Clause 3 of this Article, preparing files to be submitted to the Standing Committee of the National Assembly.
5. The procedure for the Standing Committee of the National Assembly to examine and decide on personnel leadership of the National Assembly Office, Deputy Secretary-General of the National Assembly, leadership of agencies under the Standing Committee of the National Assembly, Deputy State Auditor; approval of members of the Secretariat Board shall be carried out according to the provisions of Article 24 of this Regulation.
Approval of the Prime Minister's proposal for appointment
, dismissal
of the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam
Article 72.1. The Prime Minister shall submit to the Standing Committee of the National Assembly for approval the proposal for appointing or dismissing the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam.2. The file for submitting to the Standing Committee of the National Assembly for approval the proposal for appointing the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam includes:a) A report from the Prime Minister;
b) A conclusion document from the competent authority;
c) An action program of the proposed candidate;
d) Personnel file;
đ) Draft resolution of the Standing Committee of the National Assembly;
3. The file for submitting to the Standing Committee of the National Assembly for approval the proposal for dismissing the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam includes the documents specified in points a, b, d, đ, and e of Clause 2 of this Article.
4. The Foreign Affairs Committee shall review the Prime Minister's proposal for appointing or dismissing the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam.
5. The procedure for the Standing Committee of the National Assembly to approve the Prime Minister's proposal for appointing or dismissing the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam shall be carried out according to the provisions of Article 24 of this Regulation.
e) Other documents (if any).
3. The file submitted to the Standing Committee of the National Assembly for approval of the proposal to remove the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam shall include the documents specified in Points a, b, d, đ, and e of Clause 2 of this Article.
4. The Foreign Affairs Committee shall review the proposal of the Prime Minister regarding the appointment and removal of the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam.
5. The procedure for the Standing Committee of the National Assembly to approve the proposal of the Prime Minister regarding the appointment and removal of the Special Envoy and Ambassador Extraordinary and Plenipotentiary of the Socialist Republic of Vietnam shall be carried out in accordance with Article 24 of this Regulation.
Article 73. Examination and decision on the establishment, dissolution of High People's Courts, Provincial People's Courts, District People's Courts, Military Region Military Courts and equivalent courts, Military Area Military Courts, High People's Procuratorates, Provincial People's Procuratorates, District People's Procuratorates, Military Region Military Procuratorates and equivalent procuratorates, Military Area Military Procuratorates.
Clause 1. The President of the Supreme People's Court shall submit to the Standing Committee of the National Assembly for examination and decision on the establishment, dissolution of High People's Courts, Provincial People's Courts, District People's Courts, Military Region Military Courts and equivalent courts, Military Area Military Courts.
The Prosecutor General of the Supreme People's Procuracy shall submit to the Standing Committee of the National Assembly for examination and decision on the establishment, dissolution of High People's Procuratorates, Provincial People's Procuratorates, District People's Procuratorates, Military Region Military Procuratorates and equivalent procuratorates, Military Area Military Procuratorates.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) The proposal of the President of the Supreme People's Court regarding the establishment, dissolution of High People's Courts, Provincial People's Courts, District People's Courts, Military Region Military Courts and equivalent courts, Military Area Military Courts. The proposal of the Prosecutor General of the Supreme People's Procuracy regarding the establishment, dissolution of High People's Procuratorates, Provincial People's Procuratorates, District People's Procuratorates, Military Region Military Procuratorates and equivalent procuratorates, Military Area Military Procuratorates;
b) The opinion document of the Minister of National Defense concerning the establishment, dissolution of Military Region Military Courts and equivalent courts, Military Area Military Courts, Military Region Military Procuratorates and equivalent procuratorates, Military Area Military Procuratorates;
c) Draft resolution of the Standing Committee of the National Assembly;
d) Other documents (if any).
Clause 2. The Committee for Supervision of Law shall examine the proposals of the President of the Supreme People's Court and the Prosecutor General of the Supreme People's Procuracy regarding the establishment, dissolution of High People's Courts, Provincial People's Courts, Military Region Military Courts and equivalent courts, Military Area Military Courts, High People's Procuratorates, Provincial People's Procuratorates, District People's Procuratorates, Military Region Military Procuratorates and equivalent procuratorates, Military Area Military Procuratorates.
Clause 3. The procedure for the Standing Committee of the National Assembly to examine and decide on the establishment, dissolution of High People's Courts, Provincial People's Courts, Military Region Military Courts and equivalent courts, Military Area Military Courts, High People's Procuratorates, Provincial People's Procuratorates, District People's Procuratorates, Military Region Military Procuratorates and equivalent procuratorates, Military Area Military Procuratorates shall be carried out in accordance with the provisions of Article 24 of this Regulation.
- Prime Minister;74. Examination and decision on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries below the province level, centrally governed cities. Administrative units under provinces, centrally governed cities.
Clause 1. The Government shall submit to the Standing Committee of the National Assembly for examination and decision on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries below the province level, centrally governed cities.
Clause 2. The dossier for submission to the Standing Committee of the National Assembly for examination and decision on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries below the province level, centrally governed cities shall include the documents prescribed in Article 133 of the Law on Organization of Local Administration.
Clause 3. The Committee for Legal Affairs shall examine the proposals and projects of the Government on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries below the province level, centrally governed cities.
Clause 4. The procedure for the Standing Committee of the National Assembly to examine and decide on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries below the province level, centrally governed cities shall be carried out in accordance with the provisions of Article 24 of this Regulation.
The examination and decision on the establishment, dissolution, merger, division, adjustment of administrative unit boundaries at the district level shall be conducted concurrently with the examination and decision on the establishment, dissolution of District People's Courts, District People's Procuratorates.
- Prime Minister;75. Examine andDecision to dissolve the People's Council at the provincial level.; pApproval of the dissolution of the People's Council at the district level.
Clause 1. The Standing Committee of the National Assembly itself or upon the request of the Government shall examine and decide on the dissolution of the People's Council at the provincial level in accordance with the provisions of Article 139 of the Law on Organization of Local Administration.
In case the Standing Committee of the National Assembly decides on its own to dissolve the People's Council at the provincial level, the Delegation Work Committee shall coordinate with relevant agencies to prepare the dossier for reporting to the Standing Committee of the National Assembly.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) The proposal of the Government or the Delegation Work Committee;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Other relevant materials (if any).
Clause 2. The Standing Committee of the National Assembly shall examine and approve the dissolution of the People's Council at the district level upon the proposal of the People's Council at the provincial level.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) Proposal of the People's Council at the provincial level;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Other relevant materials (if any).
Clause 3. The Committee for Legal Affairs shall examine the proposals of the Government and the Delegation Work Committee on the dissolution of the People's Council at the provincial level; the proposal of the People's Council at the provincial level on the approval of the dissolution of the People's Council at the district level.
Clause 4. The procedure for the Standing Committee of the National Assembly to examine and decide on the dissolution of the People's Council at the provincial level, approval of the dissolution of the People's Council at the district level shall be carried out in accordance with the provisions of Article 24 of this Regulation.
- Prime Minister;76. Guidance on the operation of the People's Council.
Clause 1. The Standing Committee of the National Assembly itself or upon the request of the People's Council at the provincial level shall decide on the guidance on the operation of the People's Council.
Clause 2. The Delegation Work Committee shall take the lead and coordinate with the Standing Committee of the Ethnic Minority Committee, the Standing Committees of relevant Committees of the National Assembly to prepare the dossier in accordance with the provisions of Clause 6, Article 28 of this Regulation to submit to the Standing Committee of the National Assembly.
Clause 3. The procedure for the Standing Committee of the National Assembly to examine and decide on the guidance on the operation of the People's Council shall be carried out in accordance with the provisions of Article 29 of this Regulation.
In case the Standing Committee of the National Assembly issues normative legal documents to guide the operation of the People's Council, it shall be carried out in accordance with the Law on Issuance of Normative Legal Documents.
Article 77. Examination, Decision, and Announcement of Election Date for Members of People's Councils in Cases of Dissolution of Provincial People's Councils
1. The Government shall submit to the Standing Committee of the National Assembly for examination, decision, and announcement of the election date for members of provincial People's Councils in cases of dissolution of provincial People's Councils.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) The proposal of the Government;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Draft plan for organizing the election of members of provincial People's Councils;
d) Other documents (if any).
2. The Delegation Work Board shall report opinions on the Government's dossier.
3. The procedure for the Standing Committee of the National Assembly to examine, decide, and announce the election date for members of provincial People's Councils in cases of dissolution of provincial People's Councils shall be carried out in accordance with the provisions of Article 24 of this Regulation.
- Prime Minister;78Examination, Decision, and Announcement of Supplementary Election Date for Members of Provincial People's Councils
1. The Government shall submit to the Standing Committee of the National Assembly for examination, decision, and announcement of the supplementary election date for members of provincial People's Councils.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) The proposal of the Government;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Draft plan for organizing the supplementary election of members of provincial People's Councils;
d) Other documents (if any).
2. The Delegation Work Board shall report opinions on the Government's dossier.
3. The procedure for the Standing Committee of the National Assembly to examine, decide, and announce the supplementary election date for members of provincial People's Councils shall be carried out in accordance with the provisions of Article 24 of this Regulation.
- Prime Minister;79. Examine andDecision onissues related to organization and operation of People's Courts, Military Courts, People's Procuracy, Military Procuracy, State Audit Agency, National Assembly Office, agencies under the Standing Committee of the National Assembly, Secretariat
1. The President of the Supreme People's Court shall submit to the Standing Committee of the National Assembly for examination and decision on issues related to the organization and operation of People's Courts, Military Courts.
The Prosecutor General of the Supreme People's Procuracy shall submit to the Standing Committee of the National Assembly for examination and decision on issues related to the organization and operation of People's Procuracies, Military Procuracies.
The State Auditor General shall submit to the Standing Committee of the National Assembly for examination and decision on issues related to the organization and operation of the State Audit Agency.
The Secretary-General of the National Assembly, the Director of the National Assembly Office, and the heads of agencies under the Standing Committee of the National Assembly shall submit to the Standing Committee of the National Assembly for examination and decision on issues related to the organization and operation of the National Assembly Office, agencies under the Standing Committee of the National Assembly, and the Secretariat.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) Proposal of the submitting agency;
b) Draft resolution of the Standing Committee of the National Assembly;
c) Project on the relevant issue (if any);
d) Other documents (if any).
2. The Justice Committee shall review the reports of the President of the Supreme People's Court and the Prosecutor General of the Supreme People's Procuracy regarding the organization and operation of People's Courts, Military Courts, People's Procuracies, and Military Procuracies.
The Finance and Budget Committee shall review the reports of the State Auditor General concerning the activities of the State Audit Agency; the Legal Affairs Committee shall review the reports of the State Auditor General concerning the organization of the State Audit Agency.
The Delegation Work Board shall prepare opinions when assigned on the reports of the Secretary-General of the National Assembly, the Director of the National Assembly Office, and the heads of agencies under the Standing Committee of the National Assembly regarding the organization and operation of the National Assembly Office, agencies under the Standing Committee of the National Assembly, and the Secretariat.
3. The procedure for the Standing Committee of the National Assembly to examine and decide on issues related to the organization and operation of People's Courts, Military Courts, People's Procuracies, Military Procuracies, State Audit Agency, National Assembly Office, agencies under the Standing Committee of the National Assembly, and the Secretariat shall be carried out in accordance with the provisions of Article 24 of this Regulation.
Article 80. Examine andDecision on establishment,dissolution,organization and operation ofVietnam Parliamentary Friendship Organization,parliamentary friendship groups,N |||Young Parliamentarians Group, Women Parliamentarians Group, other parliamentary groups
1. The Foreign Relations Committee shall coordinate with the Delegation Work Board and relevant agencies to prepare dossiers on the establishment, dissolution, organization, and operation of the Vietnam Parliamentary Friendship Organization and parliamentary friendship groups in accordance with Clause 7, Article 28 of this Regulation to submit to the Standing Committee of the National Assembly.
2. The Delegation Work Board shall coordinate with relevant agencies to prepare dossiers on the establishment, dissolution, organization, and operation of the Young Parliamentarians Group, Women Parliamentarians Group, and other parliamentary groups in accordance with Clause 7, Article 28 of this Regulation to submit to the Standing Committee of the National Assembly.
3. The procedure for the Standing Committee of the National Assembly to examine and decide on the establishment, dissolution, organization, and operation of the Vietnam Parliamentary Friendship Organization, parliamentary friendship groups, the Young Parliamentarians Group, Women Parliamentarians Group, and other parliamentary groups shall be carried out in accordance with the provisions of Article 29 of this Regulation.
Section4
ECONOMIC-SOCIAL ISSUES, FINANCE, BUDGET,INVESTMENT POLICIES FOR NATIONAL TARGET PROGRAMMES, IMPORTANT NATIONAL PROJECTS AND OTHER IMPORTANT ISSUES
Article 81. Copinion concerning- Expanded seminars for comments, supplements, and perfection of reports implementation of the Resolution of the National Assembly onannual socio-economic development plans and five-year plans before submitting to the National Assembly
1. The Government shall submit to the Standing Committee of the National Assembly for opinions on the report on the implementation of the National Assembly's Resolution on annual socio-economic development plans and five-year plans.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) Report of the Government;
b) Draft resolution of the National Assembly (if any);
c) Other relevant materials (if any).
2. The Economic Committee shall review the report on the implementation of the National Assembly's Resolution on annual socio-economic development plans and five-year plans.
3. The procedure for the Standing Committee of the National Assembly to give opinions on the report on the implementation of the National Assembly's Resolution on annual socio-economic development plans and five-year plans shall be carried out in accordance with the provisions of Article 23 of this Regulation.
Article 82. Soliciting opinions or examining and deciding on financial and budgetary contents
1. The Government shall submit to the Standing Committee of the National Assembly for soliciting opinions or examining and deciding on financial and budgetary contents, and send the dossier to the Finance and Budget Committee for verification.
The dossier submitted to the Standing Committee of the National Assembly shall include:
a) The proposal of the Government;
b) Draft resolutions of the Standing Committee of the National Assembly in cases where the content falls within the decision-making authority of the Standing Committee of the National Assembly, or draft resolutions of the National Assembly in cases where they are submitted to the Standing Committee of the National Assembly for soliciting opinions before submitting to the National Assembly;
c) Other relevant materials (if any).
2. The Finance and Budget Committee shall verify the Government's proposal on financial and budgetary matters.
3. The Standing Committee of the National Assembly shall solicit opinions on financial and budgetary contents to be submitted to the National Assembly according to the procedures stipulated in Article 23 of this Regulation and conclude whether the submitted dossier meets the conditions or not for submission to the National Assembly.
The Standing Committee of the National Assembly shall examine and decide on financial and budgetary contents according to the procedures stipulated in Article 24 of this Regulation.
Article 83. Soliciting Opinions on Investment Policies for National Target Programs, Important National Projects, and Investment Projects within the Authority of the National Assembly to Approve Investment Policies
1. At least 60 days before the opening day of the National Assembly session, the Government shall submit the dossier to the Standing Committee of the National Assembly for soliciting opinions on investment policies for national target programs and important national projects as prescribed in Article 20 of the Public Investment Law, and on investment projects within the authority of the National Assembly to approve investment policies as prescribed in Article 34 of the Investment Law.
2. After receiving the dossier from the Government, the Standing Committee of the National Assembly shall assign the leading verification agency and participating verification agencies to conduct the verification.
3. The procedure for the Standing Committee of the National Assembly to solicit opinions on investment policies for national target programs, important national projects, and investment projects within the authority of the National Assembly to approve investment policies shall be carried out according to the provisions of Article 23 of this Regulation.
Article 84. Examining and Soliciting Opinions on Proposals for Referendum and Organizing Referendums
1. The Standing Committee of the National Assembly's examination and solicitation of opinions on proposals for referendum as prescribed in Article 14 of the Referendum Law shall be implemented as follows:
a) The proposing agency shall be responsible for preparing the dossier. In cases where the Standing Committee of the National Assembly proposes or at least one-third of the total number of National Assembly deputies propose that the National Assembly decides on the referendum, the Standing Committee of the National Assembly shall assign an agency to assist the Standing Committee of the National Assembly in preparing the dossier according to the provisions of Clause 3, Article 14 of the Referendum Law;
b) Based on the content of the proposal for referendum, taking into account the assigned areas of responsibility or actual circumstances, the Standing Committee of the National Assembly shall assign the National Ethnic Council and the Committees of the National Assembly to conduct the verification;
c) The procedure for the Standing Committee of the National Assembly to examine and solicit opinions on proposals for referendum shall be carried out according to the provisions of Article 23 of this Regulation and the Referendum Law.
2. After the National Assembly discusses the proposal for referendum, the leading verification agency shall assist the Standing Committee of the National Assembly in organizing the study, explanation, adoption, and revision of the draft resolution on the referendum to be submitted to the National Assembly for examination and approval.
3. Based on the decision of the National Assembly, the Standing Committee of the National Assembly shall organize the referendum according to the provisions of the Referendum Law.
Article 85. Examination and Provision of Opinions on Matters Related to Foreign Affairs Work
1. Contents related to foreign affairs work include:
a) Reports from the President and the Government on issues pertaining to the basic foreign policy of the State;
b) Reports from the Government on foreign affairs work;
c) Decisions to host international conferences of world and regional inter-parliamentary organizations in Vietnam; decisions to join or withdraw from world and regional inter-parliamentary organizations and other international organizations;
d) Examination of the annual results of foreign affairs and international cooperation activities of the National Assembly; examination of reports on the outcomes of visits and working trips by foreign delegations of the Standing Committee of the National Assembly, the Chairman, Vice Chairmen, and members of the Standing Committee of the National Assembly, and foreign national assemblies and international organizations visiting and working with the National Assembly of Vietnam; examination of reports on the outcomes of international conferences hosted by the National Assembly;
đ) Decisions on the program of foreign affairs activities of the National Assembly.
2. The President and the Government shall submit to the Standing Committee of the National Assembly the contents specified in points a and b of Clause 1 of this Article.
The Permanent Committee for Foreign Affairs of the National Assembly shall coordinate with relevant agencies and organizations to prepare and submit to the Standing Committee of the National Assembly the contents specified in points c, d, and đ of Clause 1 of this Article.
3. The dossier, procedures, and formalities for examining and providing opinions on matters related to foreign affairs work shall be implemented according to the provisions of the Regulation on Foreign Affairs Activities of the National Assembly issued by the Standing Committee of the National Assembly.
Article 86. Provision of Opinions on Matters Related to International Treaties
1. The President shall submit to the Standing Committee of the National Assembly for opinions on the submission to the National Assembly for approval, decision to join or terminate the effect, renounce, withdraw from, or temporarily suspend the implementation of international treaties.
The Government shall submit to the Standing Committee of the National Assembly for opinions on signing or joining international treaties that contain different provisions or have not been provided for in laws, resolutions of the National Assembly, provisions contrary to ordinances, resolutions of the Standing Committee of the National Assembly, or international treaties where implementation requires amendments, supplements, abolition, issuance of ordinances, or resolutions of the Standing Committee of the National Assembly.
2. The dossier submitted to the Standing Committee of the National Assembly shall be defined as follows:
a) Documents stipulated in Article 31 of the Law on International Treaties for dossiers submitted to the National Assembly for approval of international treaties;
b) Documents stipulated in Article 45 of the Law on International Treaties for dossiers submitted to the National Assembly for decision to join international treaties;
c) Documents stipulated in Article 55 of the Law on International Treaties for dossiers submitted to the National Assembly for termination of effect, renunciation, withdrawal from, or temporary suspension of implementation of international treaties;
d) Documents stipulated in Article 17 of the Law on International Treaties and draft resolutions of the Standing Committee of the National Assembly for dossiers submitted regarding signing or joining international treaties.
3. The Foreign Affairs Committee shall review the report from the President on submitting to the National Assembly for approval, decision to join or terminate the effect, renounce, withdraw from, or temporarily suspend the implementation of international treaties; the report from the Government on signing or joining international treaties that contain different provisions or have not been provided for in laws, resolutions of the National Assembly, provisions contrary to ordinances, resolutions of the Standing Committee of the National Assembly, or international treaties where implementation requires amendments, supplements, abolition, issuance of ordinances, or resolutions of the Standing Committee of the National Assembly.
4. In cases where necessary, based on the review opinions of the Foreign Affairs Committee, the agency submitting shall refine and complete the dossier to send to the Standing Committee of the National Assembly.
5. The procedure for the Standing Committee of the National Assembly to provide opinions on submitting to the National Assembly for approval, decision to join or terminate the effect, renounce, withdraw from, or temporarily suspend the implementation of international treaties shall be carried out according to the provisions of Article 23 of this Regulation. The conclusion of the Standing Committee of the National Assembly shall clearly affirm whether the dossier of the international treaty is sufficient or insufficient for submission to the National Assembly.
The procedure for the Standing Committee of the National Assembly to provide opinions on signing or joining international treaties shall be carried out according to the provisions of Article 24 of this Regulation.
Article 87. Expressing opinions or examining and deciding on other important issues
1. Documents and materials submitted to the Standing Committee of the National Assembly for expressing opinions or examining and deciding on other important issues include:
a) Petition or Report from the competent agency, organization, or person;
b) Draft resolution of the National Assembly or the Standing Committee of the National Assembly (if applicable);
c) Copy of the opinion document from relevant agencies (if applicable);
d) Other documents (if any).
2. The Standing Committee of the National Assembly assigns the competent agency to review or prepare opinions to report to the Standing Committee of the National Assembly.
3. The Standing Committee of the National Assembly expresses opinions to submit to the National Assembly according to the procedures stipulated in Article 23 of this Regulation and concludes whether the submitted dossier meets the conditions or not for submission to the National Assembly; examines and decides according to the procedures stipulated in Article 24 of this Regulation.
CChapter IV
PROGRAM OF WORK OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY, THE CHAIRMAN OF THE NATIONAL ASSEMBLY, THE DEPUTY CHAIRMAN OF THE NATIONAL ASSEMBLY AND THE MEMBERS THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

1. Annual and quarterly programs of work of the Standing Committee of the National Assembly.
2. Monthly and weekly programs of work of the Chairman of the National Assembly, Deputy Chairmen of the National Assembly.
3. Programs of work of Members of the Standing Committee of the National Assembly.
Article 89. Building the annual and quarterly programs of work of the Standing Committee of the National Assembly
1. The process of building the annual program of work is carried out as follows:
a) By the latest on November 15 each year, the Secretary-General of the National Assembly assists the Standing Committee of the National Assembly to send a document requesting the President of the State, the Government, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, the Standing Committee of the National Ethnic Council, the Standing Committee of the National Assembly's Committees, the State Audit Office, the National Assembly Office, and agencies under the Standing Committee of the National Assembly to propose contents to be included in the next year's program of work of the Standing Committee of the National Assembly;
b) Based on the tasks and powers of the Standing Committee of the National Assembly, laws, ordinances, resolutions, and proposals from relevant agencies, the Secretary-General of the National Assembly drafts the next year's program of work of the Standing Committee of the National Assembly, sends a document seeking opinions from the agencies mentioned in point a above, reports to the Chairman of the National Assembly, Deputy Chairmen of the National Assembly before submitting to the Standing Committee of the National Assembly;
c) The Standing Committee of the National Assembly examines and approves the next year's program of work at the December session of the previous year according to the procedures stipulated in Article 24 of this Regulation.
2. Based on the draft annual program of work for building the first quarter's program of work and based on the annual program of work for building the second, third, and fourth quarters' programs of work, taking into account the proposals from relevant agencies (if any) and actual circumstances, the Secretary-General of the National Assembly drafts the program of work for the Standing Committee of the National Assembly for each quarter and sends a document seeking opinions from relevant agencies by the latest on the 5th day of December, March, June, and September to report to the Chairman of the National Assembly, Deputy Chairmen of the National Assembly before submitting to the Standing Committee of the National Assembly.
The Standing Committee of the National Assembly decides the first quarter's program of work before December 25 of the previous year and the second, third, and fourth quarters' programs of work before the 25th day of the month immediately preceding the first month of each quarter according to the procedures stipulated in Article 29 of this Regulation.
3. Based on the annual and quarterly programs of work of the Standing Committee of the National Assembly, the Secretary-General of the National Assembly leads and coordinates with the Standing Committee of the National Ethnic Council, the Standing Committee of the National Assembly's Committees, and related agencies and organizations to draft the proposed regular session agenda, specialized session agenda, and other sessions (if any) of the Standing Committee of the National Assembly, seeks opinions from Deputy Chairmen of the National Assembly, Members of the Standing Committee of the National Assembly before submitting to the Chairman of the National Assembly for examination and decision.
Article 90. Building the Work Program of the National Assembly Chairman, Vice Chairmen of the National Assembly, and Members of the Standing Committee of the National Assembly
Clause 1. Based on the tasks and powers of the National Assembly Chairman, Vice Chairmen of the National Assembly, the quarterly work program of the Standing Committee of the National Assembly, proposals from the Secretary-General of the National Assembly, the Permanent Delegation of the National Ethnic Council, the Permanent Delegations of the National Assembly's Committees, agencies under the Standing Committee of the National Assembly, and actual circumstances, the National Assembly Office builds the proposed monthly and weekly work programs for the National Assembly Chairman and Vice Chairmen, reports to the National Assembly Chairman and Vice Chairmen for consideration and decision.
2. Chương trình công tác tháng của Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội được ban hành chậm nhất vào ngày làm việc đầu tiên của tháng; chương trình công tác tuần tiếp theo được ban hành chậm nhất vào thứ sáu của tuần trước đó.
3. Chương trình công tác của Ủy viên Ủy ban Thường vụ Quốc hội được lồng ghép vào chương trình, kế hoạch công tác của Hội đồng Dân tộc, Ủy ban của Quốc hội, Văn phòng Quốc hội, Ban thuộc Ủy ban Thường vụ Quốc hội gửi Văn phòng Quốc hội để báo cáo Chủ tịch Quốc hội.
Điều 91. Triển khai thực hiện và đánh giá việc thực hiện chương trình công tác
1. Thành viên Ủy ban Thường vụ Quốc hội chỉ đạo và chịu trách nhiệm triển khai thực hiện công việc thuộc lĩnh vực phụ trách trong chương trình công tác của Ủy ban Thường vụ Quốc hội; đề nghị cơ quan, tổ chức, cá nhân có liên quan thực hiện nghiêm túc chương trình công tác.
2. Tổng Thư ký Quốc hội chủ trì, phối hợp với Thường trực Hội đồng Dân tộc, Thường trực Ủy ban của Quốc hội, cơ quan thuộc Ủy ban Thường vụ Quốc hội giúp Ủy ban Thường vụ Quốc hội tổng kết, đánh giá kết quả thực hiện chương trình công tác hằng quý, hằng năm.
Chương V
CÔNG TÁC THÔNG TIN, TRUYỀN THÔNG PHỤC VỤ HOẠT ĐỘNG CỦA ỦY BAN THƯỜNG VỤ QUỐC HỘI VÀ CÁC VẤN ĐỀ KHÁC
Điều 92. Yêu cầu đối với công tác thông tin về hoạt động của Ủy ban Thường vụ Quốc hội
1. Hoạt động của Ủy ban Thường vụ Quốc hội, Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội, Ủy viên Ủy ban Thường vụ Quốc hội được thông tin đến cử tri và Nhân dân.
2. Thông tin về hoạt động của Ủy ban Thường vụ Quốc hội, Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội, Ủy viên Ủy ban Thường vụ Quốc hội phải chính xác, toàn diện, kịp thời, công khai theo quy định của pháp luật.
3. Cơ quan báo chí được mời tham dự, đưa tin về phiên họp và các hoạt động khác của Ủy ban Thường vụ Quốc hội, trừ phiên họp kín và các nội dung thuộc bí mật nhà nước.
4. Phiên họp chất vấn của Ủy ban Thường vụ Quốc hội được phát thanh, truyền hình trực tiếp, trừ trường hợp Ủy ban Thường vụ Quốc hội quyết định khác. Chủ tịch Quốc hội quyết định việc phát thanh, truyền hình trực tiếp các phiên họp hoặc hoạt động khác của Ủy ban Thường vụ Quốc hội theo đề nghị của Tổng Thư ký Quốc hội.
5. Thông tin về phiên họp Ủy ban Thường vụ Quốc hội được thực hiện theo Đề án về tổ chức công tác thông tin, báo chí, tuyên truyền về phiên họp.
Điều 93. Trách nhiệm thông tin về hoạt động của Ủy ban Thường vụ Quốc hội
1. Chủ tịch Quốc hội chỉ đạo toàn diện công tác thông tin về hoạt động của Ủy ban Thường vụ Quốc hội. Phó Chủ tịch Quốc hội giúp Chủ tịch Quốc hội trực tiếp chỉ đạo công tác thông tin về hoạt động của Ủy ban Thường vụ Quốc hội theo phân công.
2. Tổng Thư ký Quốc hội là người phát ngôn của Ủy ban Thường vụ Quốc hội; tổ chức cung cấp thông tin về hoạt động của Ủy ban Thường vụ Quốc hội, Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội, Ủy viên Ủy ban Thường vụ Quốc hội theo các hình thức do pháp luật quy định và có trách nhiệm sau đây:
a) Quyết định việc đăng tải chương trình, tài liệu phiên họp, hội nghị công khai của Ủy ban Thường vụ Quốc hội trên Cổng Thông tin điện tử của Quốc hội;
b) Xây dựng đề án về tổ chức công tác thông tin, báo chí, tuyên truyền về phiên họp Ủy ban Thường vụ Quốc hội chậm nhất là 03 ngày trước ngày bắt đầu phiên họp;
c) Quyết định mời cơ quan báo chí dự, đưa tin về phiên họp, hội nghị, cuộc họp công khai của Ủy ban Thường vụ Quốc hội, hoạt động của Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội, Ủy viên Ủy ban Thường vụ Quốc hội;
d) Tổ chức họp báo về phiên họp và các hoạt động khác của Ủy ban Thường vụ Quốc hội hoặc ban hành thông cáo báo chí để phục vụ công tác thông tin, tuyên truyền trong trường hợp cần thiết.
3. Thường trực Hội đồng Dân tộc, Thường trực Ủy ban của Quốc hội, cơ quan thuộc Ủy ban Thường vụ Quốc hội và cơ quan, tổ chức có liên quan có trách nhiệm phối hợp với Tổng Thư ký Quốc hội trong việc cung cấp thông tin về hoạt động của Ủy ban Thường vụ Quốc hội; cử người tham dự và trả lời những vấn đề thuộc nội dung phụ trách tại họp báo theo đề nghị của Tổng Thư ký Quốc hội.
4. Báo Đại biểu Nhân dân, Truyền hình Quốc hội Việt Nam có trách nhiệm cung cấp hình ảnh về phiên họp, hội nghị, cuộc họp của Ủy ban Thường vụ Quốc hội cho các cơ quan báo chí khai thác sử dụng sau khi được sự đồng ý của Tổng Thư ký Quốc hội.
Điều 94. Thông tin phục vụ hoạt động của đại biểu Quốc hội, Đoàn đại biểu Quốc hội
1. Các thông tin sau đây phải được kịp thời gửi đến đại biểu Quốc hội, Đoàn đại biểu Quốc hội:
a) Chủ trương lớn của Đảng và Nhà nước, những vấn đề quan trọng, những vấn đề lớn nổi lên qua phản ánh trên báo chí, dư luận xã hội, ý kiến của cử tri và Nhân dân quan tâm cần thiết để phục vụ hoạt động của đại biểu Quốc hội, Đoàn đại biểu Quốc hội;
b) Thông tin về hoạt động của Ủy ban Thường vụ Quốc hội, Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội, Ủy viên Ủy ban Thường vụ Quốc hội;
c) Các tài liệu được sử dụng tại phiên họp Ủy ban Thường vụ Quốc hội, tài liệu xin ý kiến Ủy ban Thường vụ Quốc hội, văn bản, nghị quyết đã được Ủy ban Thường vụ Quốc hội thông qua được công khai tại Ứng dụng cung cấp thông tin cho đại biểu Quốc hội, trang thông tin nội bộ của Văn phòng Quốc hội, trừ tài liệu thuộc bí mật nhà nước.
2. Văn phòng Quốc hội có trách nhiệm tổ chức cung cấp thông tin phục vụ hoạt động của đại biểu Quốc hội, Đoàn đại biểu Quốc hội quy định tại khoản 1 Điều này theo chỉ đạo của Ủy ban Thường vụ Quốc hội. Trường hợp cần thiết, Văn phòng Quốc hội đề nghị cơ quan, tổ chức, cá nhân cung cấp thông tin, tài liệu để gửi đến đại biểu Quốc hội, Đoàn đại biểu Quốc hội.
Điều 95. Biên bản, ghi hình, ghi âm, gỡ băng, kỷ yếu, lưu trữ
1. Phiên họp Ủy ban Thường vụ Quốc hội phải được ghi biên bản, ghi hình, ghi âm và gỡ băng; biên bản phải thể hiện đầy đủ thành phần, thời gian, địa điểm, diễn biến của phiên họp, ý kiến phát biểu, kết quả biểu quyết của Ủy ban Thường vụ Quốc hội (nếu có), có chữ ký của Chủ tọa và Tổng Thư ký Quốc hội.
Hội nghị, cuộc họp do Ủy ban Thường vụ Quốc hội tổ chức được ghi biên bản, ghi hình, ghi âm và gỡ băng theo yêu cầu của Chủ tọa.
2. Tổng Thư ký Quốc hội tổ chức việc ghi biên bản, ghi hình, ghi âm, gỡ băng phiên họp, hội nghị, cuộc họp của Ủy ban Thường vụ Quốc hội.
3. Tài liệu phiên họp của Ủy ban Thường vụ Quốc hội được đăng trong kỷ yếu của phiên họp do Văn phòng Quốc hội thực hiện.
4. Tài liệu về hoạt động của Ủy ban Thường vụ Quốc hội được lưu trữ theo quy định của pháp luật về lưu trữ.
Điều 96. Công bố nghị quyết của Ủy ban Thường vụ Quốc hội
Tổng Thư ký Quốc hội công bố nghị quyết của Ủy ban Thường vụ Quốc hội chậm nhất là 15 ngày kể từ ngày nghị quyết được thông qua; đối với nghị quyết được xây dựng, ban hành theo trình tự, thủ tục rút gọn thì Tổng Thư ký Quốc hội công bố nghị quyết chậm nhất là 05 ngày kể từ ngày nghị quyết được thông qua. Việc công bố được thực hiện bằng hình thức họp báo hoặc gửi văn bản đến các cơ quan báo chí để đăng tải.
Điều 97. Xử lý văn bản đi, đến của Ủy ban Thường vụ Quốc hội
1. Văn bản của Ủy ban Thường vụ Quốc hội, văn bản thông báo ý kiến của Ủy ban Thường vụ Quốc hội được phát hành chậm nhất là 01 ngày làm việc sau ngày ký văn bản. Văn phòng Quốc hội có trách nhiệm bảo đảm để văn bản được gửi đúng thành phần nơi nhận.
2. Ngay sau khi nhận được văn bản đến của Ủy ban Thường vụ Quốc hội, Văn phòng Quốc hội chuyển văn bản tới cơ quan đã được phân công; đồng thời, sao gửi văn bản, báo cáo Chủ tịch Quốc hội, Phó Chủ tịch Quốc hội.
Đối với nội dung chưa được phân công thì chậm nhất là 01 ngày làm việc sau khi nhận được văn bản, Văn phòng Quốc hội phối hợp với cơ quan có liên quan để xử lý như sau:
a) Đề xuất với Chủ tịch Quốc hội phân công cơ quan xử lý văn bản liên quan đến công tác tổ chức, cán bộ;
b) Đề xuất với Chủ tịch Quốc hội phân công cơ quan xử lý văn bản có nội dung liên quan đến nhiều cơ quan sau khi xin ý kiến Phó Chủ tịch Quốc hội phụ trách lĩnh vực;
c) Đề xuất với Phó Chủ tịch Quốc hội phụ trách lĩnh vực phân công cơ quan xử lý văn bản.
3. Văn phòng Quốc hội quy định cụ thể về quy trình xử lý văn bản đi, đến của Ủy ban Thường vụ Quốc hội. /.
