Regulations on the List of Products and Goods Capable of Causing Safety Hazards in the Field of Information Technology and Telecommunications under the Management Responsibility of the Ministry of Science and Technology

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Telecommunications dated November 24, 2023;

Pursuant to the Radio Frequency Law dated November 23, 2009; the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Product Quality Law, and Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP of the Government detailing the implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 154/2018/NĐ-CP dated November 9, 2018 of the Government amending, supplementing, and abolishing certain regulations on investment and business conditions in the field of state management of the Ministry of Science and Technology and certain inspection regulations;

Pursuant to Decree No. 13/2022/NĐ-CP dated January 21, 2022 amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008, and Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government detailing the implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 55/2025/NĐ-CP of the Government: Regulations on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of Science and Technology;

At the proposal of the Chairman of the National Standardization, Measurement, and Quality Control Committee;

The Minister of Science and Technology issues this Circular regulating the List of Products and Goods Capable of Causing Safety Hazards in the Field of Information Technology and Telecommunications under the Management Responsibility of the Ministry of Science and Technology (hereinafter referred to as the List of Products and Goods Group 2); principles for managing products and goods in Group 2; and provisions on some cases where the effectiveness is suspended or not compulsorily applied partially or entirely of certain technical standards.

Article 1. Scope of Regulation

Article 1. This Circular regulates the List of Products and Goods Group 2; principles for managing products and goods in Group 2; and provisions on some cases where the effectiveness is suspended or not compulsorily applied partially or entirely of certain technical standards.

Article 2. This Circular applies only to products and goods with HS codes and descriptions specified in the List of Products and Goods Group 2.

Article 2. Applicability

This Circular applies to:

1. Organizations and individuals engaged in production and business activities of products and goods listed in the List of Products and Goods Group 2 in Vietnam.

2. Organizations and individuals involved in quality management activities of products and goods listed in the List of Products and Goods Group 2 in Vietnam.

Article 3. List of Products and Goods Group 2

The List of Products and Goods Group 2 and management measures are stipulated as follows:

1. The List of products and goods in the field of information technology and telecommunications that must be certified and declared compliant is specified in Appendix I attached hereto.

2. The List of products and goods in the field of information technology and telecommunications that must be declared compliant is specified in Appendix II attached hereto.

Article 4. Principles for Managing Products and Goods Group 2

1. Quality management of products and goods listed in the List of Products and Goods Group 2 shall be carried out in accordance with the regulations of the Ministry of Science and Technology on certification, declaration of compliance, and quality inspection of products and goods in the field of information technology and telecommunications and corresponding technical standards.

2. Products and goods listed in the List of Products and Goods Group 2 that integrate other products and goods listed in the List of Products and Goods Group 2 must complete certification and declaration of compliance for all applicable technical standards for those products and goods and the integrated products and goods.

3. Products and goods listed in the List of Products and Goods Group 2 subject to two or more technical standards must comply with the certification and declaration of compliance requirements stipulated in those technical standards.

4. In case a technical standard issued before the effective date of this Circular contains different provisions from this Circular, the provisions of this Circular shall apply.

5. From the effective date of this Circular, if new technical standards replace the technical standards specified in the List of Products and Goods Group 2, or if new technical standards are issued to supplement the application to products and goods specified in the List of Products and Goods Group 2, the provisions of the Circular issuing the new technical standards shall apply.

Article 5. Effective Date

Article 5. This Circular takes effect from December 31, 2025.

Article 6. Circular No. 02/2024/TT-BTTTT dated March 29, 2024 of the Minister of Information and Communications regulating the List of Products and Goods Capable of Causing Safety Hazards under the Management Responsibility of the Ministry of Information and Communications ceases to be effective from the effective date of this Circular.

Article 6. Transitional Provisions

Certificates of Compliance and Notifications of Receipt of Declarations of Compliance issued for products and goods within the scope of this Circular prior to its effective date remain valid until their expiration dates as stated in the Certificates of Compliance and Notifications of Receipt of Declarations of Compliance.

This Circular shall apply until the List of Products and Goods according to risk classification is issued in accordance with the law on product quality.

Article 7. Implementation Organization

Article 7. The Director of the Office, the Chairman of the National Standardization, Measurement, and Quality Control Committee, heads of agencies and units under the Ministry of Science and Technology, and related organizations and individuals are responsible for implementing this Circular.

Article 8. During the implementation of this Circular, organizations and individuals are responsible for promptly reflecting any difficulties and following the guidance of the Ministry of Science and Technology./.
