JOINT CIRCULAR

Guidelines on sources of funds for managing construction capital for educational facilities

Regarding the construction of educational facilities, Decision No. 248-TTg dated November 22, 1973 of the Prime Minister clearly stated:

"In the years 1973-1975, it is necessary to mobilize all capabilities to ensure sufficient educational facilities for students to study, ending the situation where students have to attend three or four shifts. To achieve this, it is necessary to quickly restore schools damaged by war, actively improve existing schools, ensuring adequate lighting, ventilation, coolness in summer, warmth in winter, while also building half-permanent or permanent schools; in places where conditions are not met, build with bamboo and thatch, but must be done according to specifications..."

Implementing the above decision, the Ministry of Finance-Education issued guidelines on sources of funds and management of construction capital for educational facilities (including restoration, improvement, and new construction) as follows:

I. SOURCES OF FUNDS FOR CONSTRUCTION OF EDUCATIONAL FACILITIES

A. IN THE LOWLANDS:

1. Kindergartens, primary classes, and primary and secondary schools:

a) In rural areas, kindergartens are built by cooperatives with the contribution of members and the cooperative public welfare fund; if there is a lack of capital, the commune budget will provide additional support; primary classes and primary and secondary schools are constructed by the commune administrative committee. The main source of funding is the commune budget combined with the contributions of the people, the cooperative public welfare fund, the welfare fund of enterprises, forestry, and agricultural farms (central or local) located in the locality; if there is still a shortage, the provincial or municipal budget will provide additional support.

b) In towns, districts, and cities: construction is undertaken by the town, district, or city administrative committees. The main source of funding is the provincial or municipal budget combined with the contributions of the people.

2. Secondary schools are constructed by the county or district administrative committees. Funding comes from the provincial or municipal budget and can include contributions from the people through suitable forms.

3. Teacher training schools and centralized supplementary education schools are constructed by the provincial or municipal administrative committees; funding is provided by the provincial or municipal budget. If there is a shortage, the central government will consider providing additional support according to current regulations.

B. IN THE MOUNTAINOUS AREAS:

Sources of funds for constructing educational facilities are generally similar to those in the lowlands. Specifically, in rural areas, if the commune budget and contributions from the people are insufficient to construct kindergartens, primary classes, and primary and secondary schools, the provincial budget will provide additional support.

C. IN NEW ECONOMIC ZONES:

For new economic zones with approved planning, construction funds for educational facilities are provided by the central government budget (new economic zone construction fund).

D. IN ENTERPRISES, FORESTRY, AND AGRICULTURAL FARMS:

Enterprises, forestry, and agricultural farms (central or local), upon considering themselves capable and obtaining approval from the provincial or municipal administrative committees to construct their own educational facilities convenient for their children's studies, may allocate part of their welfare fund combined with contributions from parents to build such facilities. If there is a shortage, the provincial or municipal budget will provide additional support.

II. MANAGEMENT OF CONSTRUCTION CAPITAL FOR EDUCATIONAL FACILITIES

1. Commune administrative committees are responsible for managing the construction capital for primary classes and primary and secondary schools in rural areas and supervising the use of capital to ensure compliance with the construction plan for educational facilities approved by the provincial or municipal administrative committees. Management and supervision of capital must comply with the commune budget charter and Circular No. 14-TC/TDT dated October 6, 1972 of the Ministry of Finance. It is strictly prohibited to divert construction capital for other purposes.

2. Capital for constructing secondary schools, urban schools, and teacher training and centralized supplementary education schools is managed by the construction finance department of the province or municipality according to the state's regulations on basic construction capital management.

3. Tuition fees collected according to current regulations are only to be used for constructing educational facilities. The provincial or municipal administrative committees manage and distribute the tuition fee fund based on the needs of constructing educational facilities in the locality.

III. ORGANIZATION OF CONSTRUCTION OF EDUCATIONAL FACILITIES

1. Provincial and municipal administrative committees need to develop plans for constructing educational facilities in their respective regions; based on these plans, they should formulate annual construction plans and plans for mobilizing various sources of construction funds following the principle of promoting self-reliance, encouraging reasonable and voluntary contributions from the people, and combining them with appropriate state investment.

2. Departments of Education and Finance have the responsibility to assist provincial and municipal administrative committees in guiding counties, districts, towns, and cities in formulating construction plans for educational facilities. These plans must carefully calculate the sources of construction funds: commune budgets, contributions from the people, welfare funds, public welfare funds, tuition fee funds... Educational and financial departments at the provincial and municipal levels must compile these plans and submit them to the provincial or municipal administrative committees for review. After the plans are approved, the Departments of Education and Finance have the responsibility to provide specific guidance to units to implement according to the state's policies and regulations and to monitor and supervise implementation.

3. County Education and Finance Departments have the responsibility to assist county administrative committees in formulating construction plans for educational facilities in their respective regions and to guide the implementation of construction plans for schools and financial plans for school construction in communes.

4. Depending on necessity, administrative committees at various levels may establish Construction Committees to assist the administrative committees in organizing the construction of schools and managing construction capital for schools. The Construction Committee consists of representatives from the administrative committee: the head, representatives from the finance department, representatives from the education department, and representatives from parents of students.

The Ministry of Finance and the Ministry of Education request the Administrative Committees of the provinces and cities to guide the implementation of this Circular based on the specific conditions of their respective localities.
