Guidelines for Implementing Special Allowances

for Military Personnel, Civil Servants, and Professional Medical Staff

Implementing Decision No. 155/2003/QĐ-TTg dated July 30, 2003 of the Government Chairman amending and supplementing certain special allowances for civil servants and professional medical staff in the healthcare sector;

Pursuant to Circular Joint No. 09/2003/TTLT-BYT-BTC-BNV dated September 29, 2003 of the Ministry of Health, the Ministry of Finance, and the Ministry of Home Affairs guiding the implementation of Decision No. 155/2003/QĐ-TTg dated July 30, 2003 of the Government Chairman amending and supplementing certain special allowances for civil servants and professional medical staff in the healthcare sector;

The Ministry of National Defense guides the implementation within the military as follows:

A. APPLICABLE OBJECTS

1. Military personnel, civil servants, and professional medical staff specializing in military medicine performing 24/24 hours continuous duty in medical examination and treatment facilities under the military, including:

        Hospitals with beds (referred to collectively as hospitals);

Treatment teams;Outpatient clinics, Military Forensic Medicine Institute,

Emergency on-call duty at military health offices from division level upwards.

2. Military personnel, civil servants, and professional medical staff specializing in military medicine directly participating in epidemic control and on-call duty 24/24 hours at facilities managed by the military.

3. Military personnel, civil servants, and professional medical staff specializing in military medicine directly performing surgeries and procedures. B. SPECIAL ALLOWANCE REGIMES

I. ON-CALL DUTY ALLOWANCE FOR 24/24 HOURS

Military personnel, civil servants, and professional medical staff specializing in military medicine performing 24/24 hours continuous on-call duty at medical examination and treatment facilities according to point 1 of Section A of this Circular shall be entitled to the following allowance regimes:

1. On-call duty allowance levels:

The on-call duty allowance level based on the average number of people per shift on regular days includes the following levels:

a) On-call duty allowance level in ordinary areas:

1.1. Level VND 45,000/person/shift: applicable to on-call duty at Class A hospitals;

Level VND 35,000/person/shift: applicable to on-call duty at the Military Traditional Medicine Institute; other hospitals and the Center for Nuclear Medicine and Radiation Protection;

Level VND 25,000/person/shift: applicable to on-call duty at treatment teams; Outpatient Clinics of the General Staff Department - Ministry of National Defense Office; Outpatient Clinics of infantry divisions with full strength and the Military Forensic Medicine Institute;

Level VND 10,000/person/shift: applicable to on-call duty at remaining outpatient clinics and emergency on-call duty at military health offices from division level upwards.

b) On-call duty allowance level in intensive care and special care areas is 1.5 times the on-call duty allowance level in ordinary areas of the same hospital grade as specified in point a.

Intensive care areas include: Emergency Care Department (including emergency care units in other departments); Anesthesia and Intensive Care Department; Intensive Care Department; Emergency Department; Poison Control Department; Cardiac Care Unit.

Special care areas include: Ward A11 of the Central Military Hospital 108 and Hospital 175; acute mental patient care in hospitals.

1.2. On-call duty allowance level on standard weekly rest days (Saturday, Sunday) is 1.3 times the on-call duty allowance level on regular days.

1.4. Calculation of on-call duty allowance:

Doctor Nguyen Van A works at Department A2 (cardiology) of the Central Military Hospital 108 and is assigned 24/24 hours on-call duty. Doctor A's on-call duty allowance is as follows.

On regular days: VND 45,000.

Example 1: On Saturday or Sunday: VND 58,500 (VND 45,000 x 1.3).

On public holidays: VND 81,000 (VND 45,000 x 1.8).

Doctor Nguyen Van B works at Department B4 (Intensive Care) of the Central Military Hospital 108 and is assigned 24/24 hours on-call duty. Doctor B's on-call duty allowance is as follows.

- On regular days: VND 67,500 (VND 45,000 x 1.5).

Example 2: - On Saturday or Sunday: VND 87,750 (VND 67,500 x 1.3).

- On public holidays: VND 121,500 (VND 67,500 x 1.8).

2. Compensatory leave after on-call duty: Military personnel, civil servants, and professional medical staff specializing in military medicine performing 24/24 hours continuous on-call duty at medical examination and treatment facilities in the military on regular days or weekly rest days are entitled to one day off; on public holidays, they are entitled to two days off and receive full pay.

3. Manpower quota during 24/24 hours on-call duty at treatment facilities:

The manpower quota during 24/24 hours on-call duty at each medical examination and treatment facility is set out in the Appendix to this Circular.

This is the maximum average number of people on-call duty for each medical examination and treatment facility. When there are changes in functions, tasks, or increases/decreases in the number of beds, the number of people on-call duty will be adjusted accordingly.

The manpower quota during 24/24 hours on-call duty at each medical examination and treatment facility is set out in the Appendix to this Circular.

II. EPIDEMIC CONTROL ALLOWANCE

1. Direct epidemic control allowance

Military personnel, civil servants, and professional medical staff specializing in military medicine directly participating in epidemic control according to point 2 of Section A of this Circular shall be entitled to epidemic control allowance, calculated based on actual participation days as follows:

1.1. Level VND 60,000/day/person: applicable to those directly participating in controlling highly dangerous epidemics such as: Cholera, Plague, Yellow Fever; Severe Acute Respiratory Syndrome (SARS), Malaria, Ebola, Dengue Fever, and other infectious diseases causing epidemics of unknown origin as announced by the Ministry of Health.:

1.2. Level VND 30,000/day/person: applicable to other types of epidemics.

If the actual working time is less than four hours per day, only half of the above allowance will be granted.

2. On-call duty allowance for 24/24 hours epidemic control:

2.1. Level VND 40,000/person/shift: applicable to military personnel, civil servants, and professional medical staff specializing in military medicine participating in 24/24 hours on-call duty for epidemic control on regular days at facilities managed by the military and responsible for professional and technical matters in epidemic areas.

If on-call duty is performed on rest days (Saturday, Sunday), the allowance is 1.3 times the regular day on-call duty allowance; if on-call duty is performed on public holidays, the allowance is 1.3 times the regular day on-call duty allowance.

2.2. Compensatory leave:

If on duty on holidays (Saturday, Sunday), the allowance shall be 1.3 times the regular on-duty allowance; if on duty on public holidays or Tet, the allowance shall be 1.3 times the regular on-duty allowance;  on regular weekdays

2.2. Compensatory rest:

Military personnel, civil servants, and specialized military medical staff performing continuous anti-epidemic duty 24/24 hours on regular days or weekly holidays shall be granted compensatory leave of 01 day; on public holidays or Tet holidays, they shall be granted compensatory leave of 02 days and shall receive full salary.

III. SUBSIDY REGIME FOR SURGERIES AND PROCEDURES

Military personnel, civil servants, and specialized military medical staff directly performing surgeries and procedures as stipulated in Point 3, Section A of this Circular shall enjoy the following subsidy levels:

1. Surgery Subsidy Level:

The surgery classification list shall be implemented according to Decision No. 1904/1998/QĐ-BYT dated the date of issuance by the Minister of Health regarding the Surgery List (when this document is supplemented or amended, it shall be implemented according to the supplementary or amended document). 10/8/1998 For the surgery categories IA, IIB, and IIC, the surgery subsidy level I as prescribed above shall apply.

For the surgery categories IA, IIB, and IIC, the surgery subsidy level II as prescribed above shall apply.

2. Procedure Subsidy:

In cases where surgeries were previously required but have now been converted to procedures, a subsidy equal to 1/3 of the surgery subsidy of the same type shall be enjoyed.

2.1. 2.2. When the Ministry of Health prescribes a procedure list entitled to a subsidy equal to 1/3 of the surgery subsidy of the same type, such regulations shall be followed.

C. EXPENSES AND IMPLEMENTATION ORGANIZATION

1. Expense Payment:

Expenses for implementing special subsidy regimes for medical examination and treatment facilities shall be funded from the state defense budget.

For service and health insurance surgery cases, the subsidy payment for surgeries and procedures shall be sourced from service revenue or paid by the health insurance agency.

For medical examination and treatment facilities under enterprises that may apply the subsidy regime guided by this Circular, they must self-fund the expenses for implementation.

2. Payment Method:

Continuous duty, surgery, and procedure subsidies shall be paid monthly with each salary period.

Epidemic control subsidies shall be paid immediately after the epidemic is contained.

3. Effectiveness and Responsibility for Implementation:

This Circular shall take effect 15 days from the date of publication in the Official Gazette and replace Decision No. 166/2002/QĐ-BQP dated November 18, 2002, issued by the Minister of Defense regarding the subsidy regime for military medical officers and staff performing duty at treatment facilities within the military.

The special subsidy regime guided in this Circular shall be applied from July 1, 2003.

The Director of the Finance Department of the Ministry of Defense, the Director of the Military Medical Department of the General Logistics Department, and Commanders of units shall be responsible for implementing this Circular./.
