DECISION OF THE GOVERNOR OF THE STATE BANK OF VIETNAM
Regarding the issuance of the Working Regulations of the State Bank
GOVERNOR OF THE STATE BANK OF VIETNAM
Pursuant to the Law on the State Bank of Vietnam dated December 12, 1997; the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam dated June 17, 2003;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 23/2003/NĐ-CP dated March 12, 2003 of the Government on the Working Regulations of the Government;
At the proposal of the Director of the Office,
DECISION:
Article 1. The attached Decision promulgates the "Working Regulations of the State Bank."
Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and shall supersede the following documents:
- Decision No. 25/2000/QĐ-NHNN15 dated January 19, 2000 of the Governor of the State Bank on the issuance of the Working Regulations of the Governor of the State Bank;
- Decision No. 436/2000/QĐ-NHNN15 dated October 5, 2000 of the Governor of the State Bank on amending and supplementing certain provisions of the Working Regulations of the Governor of the State Bank issued pursuant to Decision No. 25/2000/QĐ-NHNN15 dated January 19, 2000 of the Governor of the State Bank.
Article 3. The Director of the Office shall be responsible for urging, inspecting, and reporting to the Governor on the implementation of the Working Regulations of the State Bank.
Article 4. The Governor, Deputy Governors; Heads of units under the State Bank; Chairmen of the Board of Directors, General Directors (Directors) of credit organizations shall be responsible for implementing this Decision./.
WORKING REGULATIONS OF THE STATE BANK

PART I
PRINCIPLES, SCOPE AND COOPERATION IN RESOLVING BUSINESS
Article 1. Principles for resolving business matters of the Governor
1. The Governor of the State Bank (hereinafter referred to as the Governor) is the head and leader who directs and manages the State Bank; is responsible before the Prime Minister and the National Assembly for monetary affairs and banking activities. The Governor is the legal representative of the State Bank.
2. The Governor directs and manages business matters according to the principle of centralized democracy and the chief executive system. The Governor assigns and delegates authority to Deputy Governors and may delegate authority to Heads of units under the State Bank to resolve some issues within the Governor's jurisdiction.
3. When the Governor is absent (on official duty, on leave, sick leave), a Deputy Governor appointed by the Governor shall manage the work of the State Bank.
Article 2. Scope of resolving business matters and working relations between the Governor and Deputy Governors
1. Scope of resolving business matters of the Governor
a) Organizing management, directing, and managing the operations of the State Bank in accordance with the provisions of the Law on Government Organization, the Law on the State Bank of Vietnam, and other regulatory legal documents;
b) Deciding important issues regarding policy direction, objectives in monetary policy and banking activities; issues related to many areas of work, issues that have been assigned to Deputy Governors but still have differing opinions;
c) Deciding to submit important issues in the field of money and banking activities beyond the Governor's jurisdiction to the Government and the Prime Minister;
d) Deciding issues to be discussed at meetings of the State Bank Leadership Board;
đ) Directly directing organizational and personnel work in the industry and internal audit and control work of the State Bank;
e) Resolving new issues arising and exceeding the jurisdiction of Deputy Governors.
2. Working relations between the Governor and Deputy Governors
a) The Governor regularly directs and inspects the implementation of work by Deputy Governors and coordinates work among Deputy Governors;
b) The Governor promptly informs Deputy Governors about policies, viewpoints of the Party and the State related to the fields of work of the State Bank and the banking industry.
Article 3. Principles for resolving business matters and duties and powers of Deputy Governors
1. Each Deputy Governor is assigned by the Governor to handle certain tasks and directly direct and oversee certain units under the State Bank (hereinafter referred to as Deputy Governors in charge of sectors).
2. Within the scope of assigned tasks, Deputy Governors have the following duties and powers:
a) Directing units under the State Bank to develop regulatory legal documents, projects, strategies, plans concerning monetary affairs and banking activities in accordance with the Governor's guidelines and directives;
b) Inspecting and urging units under the State Bank to implement decisions and directives of the Governor, policies, laws within their respective areas of responsibility. If violations of laws, policies, and guidelines of the Party and the State are discovered, Deputy Governors shall, on behalf of the Governor, decide to stop such violations, propose measures to address them, and report to the Governor;
c) Handling issues arising beyond the jurisdiction of the Head of the unit under their sectoral responsibility; seeking the Governor's opinion to address issues concerning mechanisms and policies not yet regulated by law or important issues beyond their jurisdiction;
d) Signing on behalf of the Governor documents of the State Bank within the scope of their assigned area and according to the Governor's delegation.
3. When handling matters within their own sector, but related to another sector under the responsibility of another Deputy Governor, Deputy Governors shall proactively coordinate with the relevant Deputy Governor to resolve the matter; if there are differing opinions, they shall report to the Governor for a decision;
4. Deputy Governors may exercise the Governor's powers and act on behalf of the Governor to direct and resolve matters within their assigned areas; they are legally accountable and accountable to the Governor for the results of such work;
5. When a Deputy Governor in charge of a sector is absent (on official duty, on leave, sick leave), the Governor shall resolve or assign another Deputy Governor to handle urgent matters within the absent Deputy Governor's sector. Upon the return of the Deputy Governor in charge of the sector, the Governor and the Deputy Governor assigned to handle the work shall exchange and hand over the work to the Deputy Governor in charge of the sector, including unfinished matters.
6. In case the Governor decides to reassign tasks among Deputy Governors, the Deputy Governors shall hand over the content of the work, files, and related documents to each other.
Article 4. Working relations between the Governor and Party organizations and trade unions in the banking industry
1. Relations between the Governor and the Party Executive Board of the State Bank
The Party Executive Board of the State Bank leads comprehensively the activities of the banking industry; collectively decides on issues related to policies, strategies for development, and personnel of the industry according to the Operational Regulations of the Party Executive Boards at ministries, ministerial-level agencies, and government agencies, and the Operational Regulations of the Party Executive Board of the State Bank. The Governor directs the implementation of policies and Resolutions of the Party Executive Board under the head-of-department system.
2. Relations between the Governor and the Central Bank Party Committee
a) The Governor meets with the Standing Committee of the Central Bank Party Committee once every quarter, and with the Central Bank Party Committee's Executive Board twice a year to report on policies, plans, the implementation of professional work and party work within the agency, discuss contents and measures to coordinate leadership in political education, organizational and cadre work, internal security, and leadership of political-social organizations within the agency to fulfill political tasks, consolidate internal unity, and care for the living conditions of cadres and civil servants in the agency.
b) The Governor seeks the opinion of the Central Bank Party Committee before deciding on the appointment, dismissal, evaluation, and classification of leaders at the Department level and equivalent positions in units under the State Bank, leaders of state-owned commercial banks, state-owned enterprises in the sector, and the Chair and General Director of the Central Credit Cooperative Fund.
c) The Governor closely coordinates with the Central Bank Party Committee to direct inspection, commendation, and disciplinary work for party members among cadres and civil servants under the Governor's management.
3. Relations between the Governor and the Trade Union Organization
a) The Governor informs the Vietnam Banking Trade Union about economic and social conditions, policies of the Party and State, and the sector directly related to the rights, obligations, and interests of workers.
b) The Governor consults the Vietnam Banking Trade Union before making decisions on issues directly related to the rights, obligations, and interests of workers.
c) Annually, the Governor meets with the Executive Board of the Vietnam Banking Trade Union to report on policies, plans, and the operation of the sector, and discuss contents to coordinate work related to the rights and obligations of workers.
d) The Executive Board of the Vietnam Banking Trade Union has the responsibility to reflect and report to the Governor on the operation of their organization and the thoughts and aspirations of workers.
Article 5. Responsibilities of Heads of Units under the State Bank
1. Heads of units within the organizational structure of the State Bank (hereinafter referred to as Unit Heads) are responsible for organizing the implementation of tasks according to the organizational and operational regulations of the unit and performing other tasks according to delegation or directives from the Governor or Deputy Governors. Unit Heads may not transfer matters within their authority to resolve to the Governor or Deputy Governor in charge of the sector.
2. Unit Heads are responsible under the law and to the Governor for all work within their duties and powers, including those delegated to deputy heads for handling. Those assigned or delegated must directly be accountable under the law, to the Governor, and to the Unit Head for the results of the work assigned.
3. If absent from the office for two days or more, Unit Heads must issue a written authorization for deputy heads to manage the unit's operations, report to the Governor, Deputy Governor in charge of the sector, and send to the Office. In cases where due to objective reasons, Unit Heads cannot report to the Governor, then beyond the specified period, deputy heads of the unit must immediately report to the Governor and Deputy Governor in charge of the sector.
4. Annually, the Governor and Deputy Governors work with the leadership collective and representatives of the party committee and trade union of units under their sectoral responsibility.
Article 6. Coordination of Work Between Units Under the State Bank
1. Coordination relations between units as stipulated in Clause a, Article 3, Decree 52/2003/ND-CP dated May 19, 2003 of the Government on the functions, tasks, powers, and organizational structure of the State Bank of Vietnam (hereinafter referred to as units at the headquarters of the State Bank):
1.1. In participating in opinions on draft documents and projects:
a) When drafting documents and projects that are primarily handled by their own unit but relate to the functions and tasks of another unit, Unit Heads at the State Bank headquarters must request that unit to provide comments. The document requesting opinions must clearly state the handling viewpoint of the drafting unit.
b) Units asked for opinions are responsible for responding in writing and sending it to the requesting unit within seven working days from the date of receipt of the request document. The opinion document must clearly state points of agreement, disagreement, and necessary modifications and supplements. If the content of the issue is unclear or requires additional time for research, the unit asked for opinions has the right to request the requesting unit to explain clearly or provide necessary materials or agree to extend the response deadline, but not exceeding ten working days from the date of receipt of the request document.
In cases where opinions need to be sought urgently due to work requirements, the requesting unit must clearly state the reasons.
c) If beyond the deadline set out in Point b of this Clause, the Unit Head asked for opinions does not respond, it shall be deemed as agreeing with the proposed handling content of the requesting unit;
d) If the unit asked for opinions has a different opinion from the content proposed by the requesting unit, the requesting unit must report to the Governor or Deputy Governor in charge of the sector on whether to adopt or not adopt the opinion of that unit.
1.2. In other work relations:
Within the scope of assigned functions and tasks, Unit Heads must be responsible for resolving, coordinating to resolve related matters upon request from other Unit Heads at the State Bank headquarters. The latest processing deadline is seven working days from the date of receipt of the request document.
In the case where the content of the work exceeds their authority to resolve, the head of the unit requested must respond in writing to the head of the requesting unit, stating the reasons clearly; if it cannot be resolved within the time limit set by the requesting unit, then a specific timeframe for handling must be provided.
2. The working relationship between the head of the unit at the headquarters and the head of another unit under the State Bank:
a) According to their assigned functions and tasks and the directives of the Governor, the head of the unit at the State Bank headquarters has the responsibility to study and respond to proposals and recommendations from the heads of other units under the State Bank. The response time shall not exceed seven working days from the date of receipt of the request document or the Governor's directive.
b) In cases where the request from another unit under the State Bank relates to the functions and tasks of multiple units at the headquarters, the head of the unit receiving the request must submit to the Governor or Deputy Governor for assignment of a lead unit to handle the matter. Related units must participate specifically and submit to the lead unit for consolidation. If there is no agreement among the units, the lead unit must report to the Governor or Deputy Governor responsible for the sector to make a decision.
Chapter II
WORK PROGRAM
Article 7. The work program of the State Bank includes:
1. Annual work program;
2. Quarterly work program;
3. Monthly work program;
4. Weekly work program of the Governor and Deputy Governors.
The Office is the lead unit for consolidating, registering, monitoring, and urging the implementation of the State Bank's work program.
Article 8. Proposals and projects in the State Bank's work program include:
1. Projects and draft normative legal documents submitted to the National Assembly, Standing Committee of the National Assembly, Government, Prime Minister.
2. Proposals and projects submitted to the Politburo, Secretariat, Government, Prime Minister.
3. Draft normative legal documents within the authority of the State Bank Governor to issue (Decisions, Directives, Circulars).
4. Proposals and projects within the authority of the State Bank Governor to decide.
Article 9. ANNUAL WORK PROGRAM
1. The annual work program of the State Bank includes:
- Orientation, goals, and key tasks and solutions regarding monetary policy and banking activities for the year;
- A list of proposals, projects, and drafts (hereinafter referred to as proposals) that the State Bank plans to approve, issue, or submit to competent authorities for approval and issuance during the year.
2. By the latest on October 25, units under the State Bank must submit their opinions on the next year's work program to the Governor or Deputy Governor responsible for the sector, including detailed contents of key tasks of the State Bank within their functions and tasks and the list of proposals primarily drafted by the unit as stipulated in Article 8 of this Regulation.
The proposal list in the annual work program must specify the name of each proposal, its main content, and the level of decision-making. The submission deadline for each proposal must be planned down to the month.
3. By the latest on November 5, units must send their annual work program to the Office.
4. The Office compiles the annual work program of the State Bank and submits it to the Governor by the latest on November 12.
5. Based on the announcement of the Government Office regarding the annual work program of the Government and Prime Minister, the Office officially announces the annual work program of the State Bank for units to implement.
Article 10. Chapter on Quarterly and Monthly Work Programs
1. The quarterly and monthly work programs reflect the key tasks and solutions regarding monetary matters and banking activities, and the list of projects of the State Bank for the quarter or month.
2. Based on the annual work program of the State Bank, units must evaluate the situation and progress of implementing the monthly or quarterly work program, forecast the next month's or quarter's work program, and submit it to the Office. In cases where adjustments to the tasks or projects listed in the annual work program are necessary, the unit head must seek the Governor’s or Deputy Governor’s approval and submit it to the Office.
3. The Office compiles and submits the next month's or quarter's work program for the Governor's approval and informs all units to implement it. For the monthly work program, based on the registration of units and the Governor's directives, the Office specifically forecasts the agenda items for the State Bank Leadership Board meeting (work content, project name, preparing unit, expected meeting time, etc.).
Article 11. Weekly Work Program of the Governor and Deputy Governors
The weekly work program of the Governor and Deputy Governors reflects the work content and activities of the Governor and Deputy Governors for the week.
Based on the monthly work program and the directives of the Governor and Deputy Governors, the Office builds the Governor and Deputy Governors' work program for the following week on the last working day of each month.
Article 12. Registration and Adjustment of Work Programs
1. The Office is the lead unit responsible for registering the State Bank's work program with the Government.
2. In cases where adjustments to projects that are not regulatory legal documents are required, the drafting unit must seek the Deputy Governor's approval and submit it to the Office. The Office compiles and submits the adjustment request to the Governor or proposes the Government to adjust the work program. After receiving the Governor's directive or the Government Office's notification, the Office informs the drafting unit to proceed.
3. If the State Bank's work program needs to be adjusted according to the Governor's directive, the Office notifies relevant units to implement it.
Article 13. Establishment, Registration, Monitoring, and Adjustment of Law Construction Programs on Banking
The establishment, registration, monitoring, and adjustment of law construction programs on banking shall be carried out in accordance with the Governor's regulations.
Chapter III
HANDLING OF OFFICIAL DOCUMENTS, MATERIALS, AND FILES SUBMITTED TO THE GOVERNOR
Article 14. Handling of Official Documents and Materials
1. All official documents and materials sent to the State Bank must be registered at the Office for processing according to the principle:
a) Documents addressed to individuals are transferred directly to those individuals. In cases where documents are addressed to individuals but relate to the functions and responsibilities of the State Bank, the recipient must immediately transfer them back to the Office for processing;
b) Documents from the Politburo, Secretariat, Government, Prime Minister, other Party bodies, National Assembly, and important documents related to the State Bank's functions and responsibilities: The Office will present them to the Governor or Deputy Governor authorized under Clause 3, Article 1 of this Regulation for handling;
c) Other documents not covered under point b, Clause 1, of this Article: The Office will forward them to the relevant unit heads for handling.
2. In cases where documents are directly submitted to the Governor or Deputy Governor, once they receive instructions from the Governor or Deputy Governor, the Office will record them in the tracking register and transfer them to the relevant units or individuals for resolution.
3. Management of Outgoing Official Documents and Materials: The management of outgoing documents from the State Bank follows the Government's regulations and related documents on clerical work.
Article 15. Handling of Files Submitted to the Governor
1. Files submitted to the Governor include:
a) A proposal signed by the unit head or deputy, stamped (if applicable), detailing the specific content requiring resolution, legal basis, viewpoints, and proposed solutions of the unit. If the proposal includes draft documents or projects for the Governor's signature or approval, the signatory must sign off at the end of the document or project and take responsibility before the Governor for its content.
b) Opinions from other units on unresolved issues (if any);
c) Directives from the Governor, Deputy Governor, or higher authorities (if any);
d) Any other necessary documents (if any).
The submission of files for issuing regulatory legal documents follows the Governor's regulations.
2. Proposals from units must indicate submission to the Governor. If the content being submitted is currently under review according to a Deputy Governor's directive, the proposal should be addressed directly to that Deputy Governor. If the unit also sends a copy to another Deputy Governor for reporting, it must clearly state "for reporting" in the recipient section of the proposal. If urgent guidance from the Governor or Deputy Governor is needed, the submitting unit must clearly mark or stamp "urgent submission" on the proposal.
3. The Office provides detailed templates for proposals for consistent application by units.
4. Within one working day of receiving a unit's submission, the Office is responsible for checking and processing:
a) Preparing a submission form and presenting it to the Governor or Deputy Governor for resolution if the submission is valid;
b) Returning the submission and materials to the submitting unit for supplementation or correction if the submission is invalid, while simultaneously reporting to the Governor or Deputy Governor if the issue requires urgent resolution.
c) In cases where the submission contains content inconsistent with Party policies or violates legal provisions,, The Office will present and report its views and positions to the Governor or Deputy Governor.
For urgent submissions, the Office will register them and immediately present them to the Governor or Deputy Governor responsible for the sector for resolution.
5. The Governor and Deputy Governors shall examine and process the files submitted by units within five working days from the date of receipt of the submission form and file sent by the Office. In cases where the Governor or Deputy Governor deems it necessary to bring the content of the unit's submission to the weekly meeting of the Bank of Vietnam Leadership Team for discussion and solicitation of opinions before making a decision, the processing time may be extended but not exceeding seven working days.
6. For projects included in the Bank of Vietnam's work program, the Governor or Deputy Governor responsible for the sector shall examine the submitted files and provide comments on their handling within seven working days from the date of receipt of the submission form and file sent by the Office:
a) Approve or sign documents for issuance;
b) Propose that the project be brought to the monthly meeting of the Bank of Vietnam Leadership Team;
c) Request a meeting with the main drafting unit and related units or individuals to hear additional explanations about the project;
d) Require the main drafting unit to prepare the project again if it does not meet the requirements.
7) The procedure for processing files submitted for projects arising outside the Bank of Vietnam's work program shall also be implemented according to the provisions of Clause 6 of this Article.
8. Within one working day from the date of receipt of the Governor's or Deputy Governor's comments, the Office shall send the submission form and file to the submitting unit and related units (if any) for implementation. In cases where the Governor or Deputy Governor requests a meeting to hear additional explanations about the project as stipulated at point c, Clause 6, this Article, the Office shall be responsible for sending out invitations, arranging venues, and providing reception services for the meeting.
In cases where the Deputy Governor responsible for the main drafting unit proposes bringing the project to the monthly meeting of the Bank of Vietnam Leadership Team, the Office shall submit to the Governor for a decision.
9. In cases where the Governor or Deputy Governor transfers the submission form to another unit for participation in opinion or review, the Office shall copy and send the form or notify the submitting unit to follow up.
10. After ten days from the date of receiving all the files submitted by the unit, if there is no comment from the Governor or Deputy Governor, the Office shall issue a notification to inform the submitting unit.
11. The archiving of files submitted to the Governor shall be carried out in accordance with the current state regulations on document storage protection and those of the Bank of Vietnam.
Chapter IV
ISSUANCE OF DOCUMENTS
Article 16. Drafting and issuing documents
1. The drafting and issuance of documents by the Bank of Vietnam must comply with the legal regulations on document management.
2. When submitting to the Governor for signing the regulatory documents of the Bank of Vietnam, documents submitted to the Government, Prime Minister, the person submitting must be the head of the main drafting unit; in cases of urgent time requirements and the absence of the head of the unit (on business trips, leave, illness), the head of the unit may delegate a deputy to sign and submit.
3. Authority to sign Bank of Vietnam documents
a) The Governor signs:
- Regulatory documents within the authority of the Bank of Vietnam to issue;
- Important documents sent to the Politburo, Secretariat, Government, Prime Minister, other Party and State agencies at central and provincial levels;
- Documents related to organizational structure and personnel of the industry; documents on internal control and audit activities of the Bank of Vietnam.
b) Within the scope assigned by the Governor, the Deputy Governor signs on behalf of the Governor:
- Documents to handle issues within the functions and responsibilities of the Bank of Vietnam that exceed the authority of the heads of Bank of Vietnam units;
- Other documents sent to the Government, Prime Minister, other Party and State agencies.
c) The Director of the Office signs documents on behalf of the Governor:
- Invitations for meetings and conferences of the Bank of Vietnam, except those signed by the Governor or Deputy Governor;
- Documents announcing conclusions and directives of the Governor or urging units in the industry to implement tasks according to the Bank of Vietnam's work program and other tasks as directed by the Governor;
- Copies and excerpts of issued documents;
- Certain administrative documents according to the authority defined in the Charter of the Office's organization and operation.
d) Heads (or deputies delegated) of other units at the headquarters of the Bank of Vietnam sign administrative documents within their unit's authority on behalf of the Governor. Documents signed on behalf of the Governor must be reported to the Governor and Deputy Governors.
đ) The Governor may delegate the heads of units at the headquarters of the Bank of Vietnam to sign certain documents within the Governor's authority. The delegation of signature authority is specified in the Charter of the unit's organization and operation or expressed in specific cases through written documents. The person delegated cannot redelegate the signing authority to another person.
Article 17. Issuing documents
Once signed, the Office of the Bank of Vietnam is responsible for copying and issuing the documents immediately on the same day, or at the latest, the next working day. For regulatory documents, the Office is responsible for updating them promptly onto the Government's wide-area network, the Bank of Vietnam's website (except for documents classified as state secrets), and simultaneously sending them to the Official Gazette and relevant agencies as prescribed by law.Chapter V
BUSINESS TRAVEL, GUESTS, MEETINGS
PART I. BUSINESS TRIPS AND GUEST RECEIPT
Article 18. Official travel
1. Domestic Business Trips
a) The Governor and Deputy Governors shall travel to localities according to their work programs and directives from the Governor. Upon completion of the trip, the Deputy Governor shall report the results to the Governor.
b) Heads of units at the headquarters of the State Bank (or deputy heads responsible) shall travel to localities according to programs approved by the Governor or Deputy Governor responsible for the sector. Upon completion of the trip, the head of the unit shall report the results to the Governor and Deputy Governor responsible for the sector.
c) Heads of units shall examine and decide on business trips of civil servants under their management (including deputy heads) according to plans approved by the Governor or Deputy Governor responsible for the sector. Upon completion of the trip, the civil servant shall report the results to the head of the unit.
2. Overseas Business Trips and Study Tours
a) The Governor shall travel abroad in accordance with the Working Regulations of the Government.
b) Deputy Governors shall travel abroad according to their work programs and approval from the Governor. Upon completion of the trip, the Deputy Governor shall report the results to the Governor.
c) Heads and deputy heads of units shall travel abroad or participate in study tours according to decisions made by the Governor. Upon completion of the trip, the head and deputy head of the unit shall report the results to the Governor and Deputy Governor responsible for the sector.
d) Civil servants and officials of the State Bank traveling abroad or participating in study tours shall do so according to decisions made by the Governor and in compliance with the State Bank's foreign activity regulations. Upon completion of the trip, staff members shall report the results to the head of the unit.
3. Directors and Deputy Directors of Provincial Branches, Chiefs and Deputy Chiefs of Representative Offices of the State Bank must report to the Governor for comments before traveling outside their province or city or traveling abroad according to decisions made by the People's Committee of the province or centrally governed city.
Article 19. Reception of Guests
1. Receiving Domestic Guests:
Upon request from domestic agencies, organizations, or individuals, the Chief of the Office shall consider and submit to the Governor or Deputy Governor for receiving and working with guests. The content and composition of the reception shall be decided by the Governor or Deputy Governor.
Heads of units at the headquarters of the State Bank shall directly work with domestic units or individuals who come to contact regarding matters within the authority of their unit.
2. Receiving Foreign Guests: The reception of foreign guests coming to work with the State Bank shall be carried out in accordance with the State Bank's Foreign Activity Management Regulations.
PART II. MEETINGS AND CONFERENCES
Article 20. Meetings and conferences of the State Bank include:
1. Mid-year banking operations review meetings and annual banking tasks deployment meetings;
2. Special topic meetings and training sessions;
3. Other important meetings decided by the Governor;
4. Other meeting formats such as seminars, roundtables, presentations...
The organization of signing ceremonies and international guest receptions of the State Bank shall be carried out in accordance with the State Bank's Foreign Activity Management Regulations and other relevant regulations of the Governor.
Article 21. Proposing the Organization of Meetings
When necessary to organize meetings as stipulated in Article 20 of this Regulation (hereinafter referred to as meetings), functional units must submit to the Governor or Deputy Governor for approval. The proposal must clearly state the purpose of organizing the meeting, its content, time, location, chairperson, cooperating units, participants and number of representatives, budget estimate (if applicable).
Article 22. Authority to Decide on Organizing Meetings
1. Depending on the requirements of leadership and management, the Governor shall decide to organize mid-year banking operations review meetings, annual banking tasks deployment meetings, and other important meetings.
2. The Governor shall convene special topic meetings based on proposals from Deputy Governors responsible for sectors.
3. The Governor or Deputy Governor responsible for sectors shall decide to organize training sessions and allow other meeting formats based on proposals from functional units.
Article 23. Responsibilities of Units Proposing the Organization of Meetings
1. Send documents to the Office at least 7 days before the scheduled opening of the meeting (5 days for other meeting formats), accompanied by the proposal approved by the Governor or Deputy Governor.
2. Prepare materials and send them to the Office 3 days before the start of the meeting for printing and binding; if the meeting is held in another province or city, materials must be sent to the Office 5 days in advance.
3. Prepare the opening remarks of the Governor or Deputy Governor;
4. Chair the program for meetings chaired by the Governor or Deputy Governor; chair the meeting when authorized by the Governor or Deputy Governor;
5. Distribute materials to delegates;
6. Report the results of training sessions, seminars, roundtables, presentations... to the Governor and Deputy Governor responsible for sectors and notify the Office in writing.
Article 24. Responsibilities of the Office
1. Serve as the coordinating body to assign tasks to units participating in organizing the meeting;
2. Issue invitations according to the approval of the Governor or Deputy Governor;
3. Arrange conference halls, meeting rooms, and reception services;
4. Print meeting materials;
5. Implement information dissemination, commendation and reward activities at the meeting (if applicable).
6. Organize secretaries and draft conclusions and directives of the Governor or Deputy Governor at mid-year banking operations review meetings, annual banking tasks deployment meetings, special topic meetings, and other important meetings chaired by the Governor.
Article 25. Responsibilities of the Administrative Bureau, Provincial Branches of the State Bank, Representative Offices
1. Responsibilities of the Administrative Bureau (for meetings held in Hanoi):
a) Provide accommodation and lodging facilities according to the requests of delegates;
b) Arrange transportation for delegates, lecturers, and staff involved in organizing the meeting;
c) Implement meeting expenses according to prescribed regulations and settle accounts for the meeting.
2. Responsibilities of Provincial Branches of the State Bank, Representative Offices (for meetings held in provinces or cities)::
a) Arrange conference halls and reception services;
b) Provide accommodation and lodging facilities according to the requests of delegates;
c) Arrange transportation for delegates, lecturers, and staff involved in organizing the meeting;
d) Implement conference expenses according to prescribed regulations and settle the conference accounts.
Article 26. Responsibilities of other units
1. Other units under the State Bank, when assigned to prepare conference materials, shall be responsible for sending such materials to the Office within the time limit stipulated in Article 23 of this Regulation.
2. Heads of related units shall be responsible for attending the conference and assigning staff to attend according to the list specified on the invitation letter. In cases where objective conditions permit, another person may be arranged to attend but must report to the Governor (through the Office). If it is deemed necessary to assign additional staff to attend the conference, then before the conference opening, the head of the unit must submit a document to the Office for the Governor's approval.
Article 27. Organizing international conferences and seminars
The organization of international conferences and seminars by the State Bank in Vietnam shall be carried out in accordance with the Prime Minister's Decision on organizing and managing international conferences and seminars in Vietnam, the Regulation on managing external activities of the State Bank, this Regulation, and other relevant provisions of the Governor.
Article 28. Meetings between units at headquarters
The provisions regarding the organization of conferences and meetings set forth in Section II of this Chapter shall not apply to internal meetings between units at the State Bank headquarters to discuss professional matters or other issues related to the implementation of their tasks.
Chapter VI
IMPLEMENTATION OF PUBLIC ACCESS AND DEMOCRATIC REGIME IN THE AGENCY
Article 29. Implementation of public access regime
1. The Governor authorizes the Chief Inspector of the State Bank to organize and implement public access procedures in accordance with the laws on handling complaints and denunciations. Weekly, the State Bank Inspectorate organizes a session to receive and handle complaints, denunciations, and petitions from citizens concerning issues related to the State Bank's management area.
2. Monthly, the Chief Inspector of the State Bank reports to the Governor on the results of receiving and handling complaints, denunciations, and petitions from citizens.
3. Based on specific circumstances, the Governor directly receives citizens to hear opinions on issues related to the banking industry's operations.
Article 30. Implementation of democratic regime in the agency
The implementation of democratic and transparent regimes within the State Bank system shall comply with the Government's regulations and the directives of the Governor.
Chapter VII
INFORMATION AND REPORTING
Article 31. Information and reporting regime
1. Heads of units under the State Bank and General Directors (Directors) of state-owned credit organizations must strictly adhere to the information and reporting regime as prescribed by the Governor of the State Bank.
2. The Chief of the Office has the responsibility:
a) To promptly inform the Governor and Deputy Governors about decisions made by each Deputy Governor to process work.
b) To organize the extraction of information on monetary and banking activities from reports submitted by units under the State Bank and state-owned credit organizations to serve the Governor's directive and operational control.
c) To conduct daily briefings, compile situations related to banking activities reported through mass media to promptly report to the Governor and Deputy Governors; coordinate with relevant units to implement information dissemination objectives for the industry and check, correct information on banking activities according to the Governor's instructions.
Article 32. Press conference regulations
1. The Governor organizes or assigns Deputy Governors to organize quarterly press conferences to provide information on the industry's activities; press conferences to announce important new documents or to implement major policies of the Party and State, or when there are significant events related to the monetary and banking sector.
2. The Office assists the Governor in organizing press conferences and serves as the main point of contact to coordinate with relevant units to provide information on monetary policy and banking activities to mass media outlets and other organizations and individuals.
Chapter VIII
INSPECTION, REWARD, AND DISCIPLINE
Article 33. Inspection work of the Governor and Deputy Governors
1. Annually, the Governor and Deputy Governors inspect the operations of units under the State Bank and credit organizations; survey and grasp practical issues arising and obstacles in monetary and banking activities.
2. The Chief of the Office coordinates with heads of relevant units under the State Bank to develop the inspection program of the Governor and Deputy Governors.
Article 34. Review of the implementation of the Regulation
Quarterly, the Governor convenes meetings with Deputy Governors and heads of units at the State Bank headquarters to review the implementation of the State Bank's working regulation.
Article 35. Awards and disciplinary actions
1. Units and individuals who achieve success in implementing the State Bank's working regulation will be considered for rewards in accordance with the law and the Governor's regulations.
2. State Bank officials violating the State Bank's working regulation will be subject to administrative disciplinary action according to the law, depending on the nature and severity of the violation. Chapter IX
FINAL PROVISIONS
Article 36. Amendment and supplementation of the Regulation
Amendments and supplements to these Rules shall be decided by the Governor./.
