Guidelines for Implementing Decision No. 203/2006/QĐ-TTg

dated August 31, 2006 of the Prime Minister

on specifying specialized professions needed for women citizens in the military.

Pursuant to the Law on Military Service dated December 30, 1981, the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated December 21, 1990, the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated June 22, 1994, the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated June 14, 2005, and Decree No. 83/2001/NĐ-CP dated November 9, 2001 of the Government on Military Service Registration;

Pursuant to the Ordinance on Reserve Forces dated August 27, 1996.

To implement Decision No. 203/2006/QĐ-TTg dated August 31, 2006 of the Prime Minister on specifying specialized professions needed for women citizens in the military (hereinafter referred to as Decision No. 203/2006/QĐ-TTg), the Ministry of National Defense provides the following guidelines:

I. GENERAL PROVISIONS:

1. Women citizens with specialized professions specified in Decision No. 203/2006/QĐ-TTg must register for military service according to the provisions of Decree No. 83/2001/NĐ-CP dated November 9, 2001 of the Government on Military Service Registration and be called for training; if they volunteer and the military has a need, they may serve in active duty.

In wartime, women citizens will be called up for military service and assigned appropriate tasks based on the decision of the Government.

2. Agencies, organizations, and localities where women citizens belonging to the target group specified in Clause 1 have the responsibility to urge and create conditions for women citizens to fulfill their obligations. The entity specified in Clause 1 shall be responsible for urging and creating conditions for female citizens to fulfill their obligations.

II. SPECIALIZED PROFESSIONS OF WOMEN CITIZENS NEEDED FOR THE MILITARY:

The specialized professions of women citizens needed for the military are specified in Decision No. 203/2006/QĐ-TTg as follows:

1. Bachelor's, Master's, and Doctoral degrees include nine professions:

a) Information Technology;

b) Electronics and Telecommunications;

c) Physician (general and specialist);

d) Pharmacist;

đ) Nursing;

e) Finance and Banking;

g) Accounting;

h) Cryptography Engineering;

i) Foreign Languages.

2. Associate degrees include sixteen professions:

a) Information Technology;

b) Electronics and Telecommunications;

c) Postal services;

d) Medical Assistant (general and specialty);

đ) Senior Medical Technician;

e) Associate Degree Nurse;

g) Pharmacist;

h) Traditional Medicine;

i) Nursing;

k) Nutrition and Cooking;

l) Finance and Credit;

m) Accounting;

n) Cryptography Engineering;

o) Surveying and Mapping;

p) Clerical Work and Archiving;

q) Petroleum.

3. Basic level includes four professions:

a) Radio Operator (15 watts or more);

b) Nursing;

c) Pharmacy Technician;

d) Surveying and Mapping.

When registering these professions, attention should be paid to the following points:

- For foreign languages, focus on registering and managing women citizens with bachelor's degree or higher in the following languages: English, French, Russian, German, Chinese, Japanese, Korean, and Southeast Asian languages.

- For other professions, clearly specify the specific field studied by the women citizen. For example, Physician: must specify General Physician, Internal Medicine Specialist, Surgery Specialist, Ophthalmology Specialist, Dental Specialist, etc.

III. REGISTRATION OF MILITARY OBLIGATIONS FOR FEMALE CITIZENS WITH SPECIALIZED PROFESSIONS REQUIRED BY THE ARMED FORCES

III. REGISTRATION FOR MILITARY SERVICE OF WOMEN CITIZENS WITH SPECIALIZED PROFESSIONS NEEDED FOR THE MILITARY:

1. For women citizens with specialized professions needed for the military:

- Women citizens from eighteen to forty years old with specialized professions as specified in Decision No. 203/2006/QĐ-TTg, when working at agencies, organizations, or residing in communes, wards, towns (collectively referred to as commune level) must declare their specialized professions to the agency, organization, or commune. Those who have been working or residing for a long time but have not declared must supplement the declaration if they are still within the age range.

- Upon receiving a call from the Military Command of the district, town, city, or provincial town (collectively referred to as district level), women citizens with specialized professions needed for the military must report to the Military Command of the district where they reside to register for military service. When registering, women citizens must present the call order and their graduation certificate or professional qualification certificate.

After being registered as a reserve citizen, women citizens must comply with regulations on supplementary registration, relocation registration, absence registration, individual registration, and discharge registration as stipulated in Decree No. 83/2001/NĐ-CP dated November 9, 2001 of the Government on Military Service Registration.

2. For commune level agencies and organizations:

- Within ten days of the first month of each year, the Chairman of the People's Committee at the commune level and the heads of agencies and organizations must report to the Military Command of the district where their offices are located about the list of women citizens from eighteen to forty years old with specialized professions needed for the military who have not registered for military service.

- When the Military Command of the district calls women citizens to register for military service, the commune level, agencies, and organizations have the responsibility to urge and create conditions for women citizens to register at the Military Command of the district within the prescribed time. Once women citizens have registered for military service and become reserve soldiers, the Military Command of the commune level, agencies, and organizations have the responsibility to monitor and manage these reserve soldiers according to current laws.

3. For the Military Command of the district:

- Based on reports from the People's Committee at the commune level and agencies and organizations, the Military Command of the district establishes a list of women citizens eligible for military service registration.

- In April of each year, based on the list of women citizens eligible for military service registration, the Military Command of the district issues orders calling those women citizens to the Military Command of the district to register for military service, except those specified in Article 8 and Article 9 of Decree No. 83/2001/NĐ-CP dated November 9, 2001 of the Government on Military Service Registration.

- Reservists who are women and are registered according to Decision No. 183/HĐBT dated November 2, 1982 of the Council of Ministers but not registered according to Decision No. 203/2006/QĐ-TTg shall be relieved of their registration.

IV. ORGANIZING WOMEN RESERVISTS INTO RESERVE MOBILIZATION UNITS

1. Based on the quota for building reserve mobilization units assigned and the list of women reservists who have registered, they shall be organized into reserve mobilization units according to the following principles:

- Assigning those with appropriate expertise to positions corresponding to their establishment posts; if there is a shortage, assigning those with related expertise;

- Assigning women reservists residing near each other or working at the same place to the same unit.

2. The organization of women reservists into reserve mobilization units is regulated as follows:

- Assigning some women reservists from Group A to suitable positions in combat support units directly subordinate to military branches, arms, local militia units;

- Assigning some women reservists from Groups A and B to suitable positions in logistics and technical units under the Ministry of National Defense, military regions, corps, military branches, arms, provincial military command offices under central cities, local military agencies, military region agencies, corps agencies, military branch agencies, institutions, specialized reserve units organized by ministries, sectors, provinces, and centrally governed cities.

3. Women reservists who have been organized into reserve mobilization units shall be notified by the People's Militia Command of the district to the People's Militia Command of the commune where the women reservist resides, and to the agency or organization where the women reservist works, to monitor and inform the women reservist that she has been organized into a reserve mobilization unit.

V. TRAINING, DRILLS, AND CHECKS ON READINESS FOR MOBILIZATION AND COMBAT

1. Women reservists organized into reserve mobilization units participate in training, drills, and checks on readiness for mobilization and combat according to the unit's quota and plan.

Women reservists not yet organized into reserve mobilization units may be called for concentrated training according to the decision of the Prime Minister.

2. When there is an order for concentrated training, drills, and checks on readiness for mobilization and combat, women reservists must strictly comply with the call-up orders of the competent authority. During the period of concentrated training, women reservists are subject to management by military units and must follow regulations according to the management rules of the Vietnam People's Army.

VI. RESPONSIBILITIES OF WOMEN RESERVISTS

1. In addition to the responsibilities stipulated in Clause 1 of Section III and Section V, women reservists also have the responsibility to comply with: health check regulations; living conditions in reserve mobilization units; orders for conscription and mobilization for tasks; other regulations of the law regarding the responsibilities of reservists.

2. Women reservists holding command positions in reserve mobilization units, in addition to implementing the above regulations, also have the responsibility to perform the duties of a commander of a reserve mobilization unit.

VII. POLICIES AND BENEFITS FOR WOMEN RESERVISTS

1. Female citizens during the time of registering for military service or undergoing health checks are entitled to the following benefits:

- If they are officials, civil servants, or workers receiving salaries from the state budget, their workplace shall pay them their full salary and other allowances (if applicable), travel expenses, and travel allowances according to current regulations.

- Other categories shall be provided with travel expenses for going and returning, food, and accommodation during the days waiting for registration or health checks according to current regulations by the People's Militia Command of the district.

2. Women reservists holding command positions in reserve mobilization units shall receive management responsibility allowances according to Article 25 of the Ordinance on Reserve Mobilization Forces and guiding documents for the implementation of the Ordinance.

3. Women reservists called for concentrated training, drills, and checks on readiness for mobilization and combat shall enjoy policies and benefits according to Article 23 of Decree No. 39/CP dated April 28, 1997 of the Government detailing and guiding certain provisions of the Ordinance on Reserve Mobilization Forces and other current documents according to the law.

4. Women reservists mobilized to reinforce the regular forces of the Military when there is a need for combat to protect the locality and territorial sovereignty without reaching the level requiring partial mobilization (Clause 2 of Article 18 of the Ordinance on Reserve Mobilization Forces) shall, during the performance of their duties, enjoy policies and benefits according to Section II of Circular No. 2221/2000/TT-BQP dated August 9, 2000 of the Minister of National Defense guiding the implementation of policies and benefits for reservists mobilized to perform tasks to protect the locality and territorial sovereignty without reaching the level requiring partial mobilization.

VIII. IMPLEMENTATION

This Circular takes effect 15 days after its publication in the Official Gazette.

Relevant agencies under ministries, ministerial-level agencies, government agencies, provincial people's committees under central cities, and military units are responsible for implementing it.

Any difficulties encountered during implementation should be reported to the Ministry of National Defense for research and resolution./.
