MINISTER OF INFORMATION AND COMMUNICATIONS

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating functions, tasks, authorities, and organizational structure of Ministries and ministerial-level agencies;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

Pursuant to Decision No. 901/QĐ-TTg dated July 19, 2007 of the Prime Minister on the establishment of the Vietnam National Institute of Software and Digital Content Industry under the Ministry of Posts and Telecommunications (now the Ministry of Information and Communications);

At the proposal of the Director of the Personnel Department and the Director of the Vietnam National Institute of Software and Digital Content Industry,

DECISION:

Article 1. Position and Function.

The Vietnam National Institute of Software and Digital Content Industry is a unit under the Ministry of Information and Communications, with the function of assisting the Minister of Information and Communications in researching, building, and participating in implementing strategies, policies, planning, programs, projects, and proposals for development in the software industry and digital content industry; training and developing high-level human resources for the information technology and telecommunications industries; researching, developing, and transferring technology in the production of software products and digital content services;

The Vietnam National Institute of Software and Digital Content Industry has the international trade name of Vietnam National Institute of Software and Digital Content Industry, abbreviated as NISCI.

The Vietnam National Institute of Software and Digital Content Industry is a self-financing public service unit with legal personality, its own seal and bank account for transactions according to the provisions of the law, operating funds provided from the state budget according to the provisions of the law, and its main office located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Vietnam National Institute of Software and Digital Content Industry shall have the following tasks and authorities:

1. Organizing research, construction, and participation in implementing strategies, medium-term and long-term plans, mechanisms, policies, programs, projects, models, and solutions for development in the software industry and digital content industry.

2. Training high-level personnel and issuing specialized certificates upon request from enterprises, agencies, and organizations in fields related to the information technology and telecommunications industries, particularly the software industry and digital content industry;

3. Researching, developing, and transferring technology related to software and digital content; participating in selecting and bidding for State scientific and technological tasks, scientific tasks within programs, projects, and urgent tasks; establishing and managing laboratories, testing, evaluation, and certification facilities for software, multimedia communication products, and digital information content; supporting research and development of new innovations, ideas, advanced technologies, and products in the software industry and digital content industry;

4. Researching, developing, and supporting transfer, cost assessment, economic-technical norms, production processes, quality assurance procedures, national and international standards in the software industry and digital content industry;

5. Conducting surveys, investigating current conditions, forecasting trends, and providing specialized information and materials; building databases, information repositories, and electronic information websites about markets, enterprises, software products, and digital information content; establishing specialized libraries, professional documents, white papers, guidelines on legal frameworks and intellectual property, investment environments, market opportunities, and business operations in the software industry and digital content industry;

6. Publishing scientific journals, electronic information websites; organizing and coordinating domestic and international conferences, seminars, and exhibitions in the field of software and digital information content;

7. Implementing measures, solutions, projects, and programs to promote the development and application of open-source software; collecting, researching, evaluating, certifying, and building databases on open-source software; compiling and publishing descriptive materials on solutions, products, installation, usage, development, and related documents;

8. Providing sample products and consulting services on software and digital information content, including product, technology, and training consulting services; project construction, evaluation, management, and effectiveness assessment consulting services; researching, developing, and providing software and digital information content solutions and services; other related consulting services;

9. Implementing international cooperation projects and programs; receiving financial support and assistance from international organizations in the field of software and digital content industry research and development;

10. Researching, developing, and supporting the development of key software and digital information content products according to government guidance; participating in national programs and projects related to information security and safety involving software and digital information content;

11. Implementing tasks to promote trade in the information technology industry; organizing trade promotion programs, market development, brand building for the industry; supporting businesses operating in the software and digital content industry to enhance their operational capacity and competitiveness; implementing tasks to nurture businesses in the software and digital content industry;

12. Organizing or participating in organizing contests and awarding prizes for information technology and communication products related to software and digital information content.

13. The Institute is authorized to proactively develop revenue-generating activities related to its functions and tasks, exchange products created from research and development processes, cooperation, and attract domestic and foreign investment to create additional funding sources and expand the scope and scale of the Institute's operations in accordance with its functions and tasks as prescribed by law.

14. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure and Staffing

The Vietnam Software and Information Technology Content Industry Institute shall have a Director, Deputy Directors, and an Advisory Council.

The Director of the Vietnam Software and Information Technology Content Industry Institute is responsible before the Minister and the law for organizing and implementing the Institute’s functions, tasks, and authorities as assigned.

Deputy Directors assist the Director in directing and managing all aspects of the Institute's work and are responsible to the Director for the tasks delegated to them.

The Advisory Council of the Institute, established by the Director, consists of leading experts, managers, entrepreneurs, and experienced investors in the field of software and information technology content industry development, assisting the Director in formulating strategies and directions for the Institute's development to fulfill its assigned functions, tasks, and authorities.

Functional Departments:

- Office.

- Planning and Project Department.

- New Product Research and Development Department.

- Digital Service and Information Content Research and Development Department.

Subordinate Units:

- Market Survey, Research and Development Center.

- Training and ICT and Telecommunications Services Center.

- Magazine "Software and Digital Content".

- Ho Chi Minh City Branch.

- Da Nang City Branch.

The functions, tasks, and authorities of subordinate units are established by the Director and submitted to the Minister for decision.

The staffing of the Vietnam Software and Information Technology Content Industry Institute is established by the Director and submitted to the Minister for decision. The Director is permitted to decide on entering into long-term labor contracts in accordance with the provisions of the law.

Article 4. Effective date

This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 792/QĐ-BBCVT dated August 1, 2007 of the Minister of Posts and Telecommunications on the functions, tasks, authorities, and organizational structure of the Vietnam Software and Information Technology Content Industry Institute is hereby repealed.

Article 5. Responsibilities for Implementation

The Head of the Office, the Director of the Cadre and Civil Servant Department, the Director of the Vietnam Software and Information Technology Content Industry Institute, and the Heads of agencies and units under the Ministry of Information and Communications are responsible for implementing this Decision./.
