PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations;
Considering the proposal of the Minister of Home Affairs and the Minister of Finance,
DECISION:
Article 1. Scope and Applicability
This Decision stipulates the remuneration system for individuals who have retired but continue to hold specialized leadership positions at the head of associations established and operating under Decree No. 45/2010/NĐ-CP dated April 21, 2010 of the Government on organization, operation, and management of associations.
Article 2. Remuneration System
1. The monthly remuneration for individuals who have retired but continue to hold specialized leadership positions at the head of associations shall be as follows:
a) For associations with nationwide or inter-provincial activities: Not exceeding 6.5 times the national minimum wage;
b) For associations with provincial-level activities:
- In Hanoi City and Ho Chi Minh City: Not exceeding 5.4 times the national minimum wage;
- In other provinces and centrally-administered cities: Not exceeding 5.0 times the national minimum wage.
c) For associations with district-level activities:
- Districts in Hanoi City and Ho Chi Minh City, and cities in provinces: Not exceeding 3.6 times the national minimum wage;
- Remaining districts, towns, and cities: Not exceeding 3.2 times the national minimum wage.
d) For associations with commune-level activities: Not exceeding 1.5 times the national minimum wage.
2. Based on the maximum remuneration levels set forth in Points a, b, c, and d of Clause 1 of this Article, associations shall specify the monthly remuneration for other retired individuals holding specialized leadership positions in accordance with internal equity, transparency, democracy, and consistency with the association's charter.
Article 3. Source of Funding
1. For associations with special characteristics: The funding for implementing the remuneration system shall be provided annually from the state budget according to the laws on state budget.
2. For other associations: The funding for implementing the remuneration system shall be ensured by the associations themselves.
Article 4. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from August 1, 2011.
2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees, and related agencies are responsible for enforcing this Decision./.
