Guidelines on the responsibility for organizing the implementation of Decision No. 1956/QD-TTg

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Implementing Decision No. 1956/QD-TTg dated November 21, 2009 of the Prime Minister approving the Project "Vocational Training for Rural Laborers until 2020";
After reaching consensus with the Ministry of Finance (document No. 14132/BTC-HCSN dated October 21, 2011) and the Ministry of Planning and Investment (document No. 6933/BKHĐT-KHDGTNMT dated October 12, 2011);
The Ministers of the Ministry of Labor - Invalids and Social Affairs, the Ministry of Home Affairs, the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, and the Ministry of Information and Communication jointly issue guidelines on the responsibility for organizing the implementation of Decision No. 1956/QD-TTg dated November 27, 2009 of the Prime Minister approving the Project "Vocational Training for Rural Laborers until 2020" as follows:
Article 1. Scope of Regulation and Applicability
1. These Circulars provide guidelines on the responsibility for organizing the implementation of Decision No. 1956/QD-TTg dated November 27, 2009 of the Prime Minister approving the Project "Vocational Training for Rural Laborers until 2020" (hereinafter referred to as the Project) at localities throughout the country.
2. This Circular applies to:
a) Departments of Labor - Invalids and Social Affairs, Departments of Home Affairs, Departments of Agriculture and Rural Development, Departments of Industry and Trade, Departments of Information and Communications, Departments of Finance, Departments of Planning and Investment under provincial People's Committees (hereinafter collectively referred to as provincial specialized agencies);
b) People's Committees of districts, towns, cities under provinces (hereinafter referred to as district-level People's Committees);
c) Labor - Invalids and Social Affairs Offices, Home Affairs Offices, Industry and Trade Offices, Agriculture and Rural Development Offices (or Economic Offices), Culture - Information Offices, Finance - Planning Offices under district-level People's Committees (hereinafter collectively referred to as district-level specialized agencies);
d) People's Committees of communes, wards, towns (hereinafter collectively referred to as commune-level People's Committees);
e) Academies, schools, training centers for cadre and civil servant training; provincial political schools, county-level political training centers,... participating in cadre and civil servant training at commune level; vocational colleges, intermediate vocational schools, vocational training centers; universities, colleges, intermediate professional schools, continuing education centers, comprehensive technical training centers, community learning centers; research institutes; industrial promotion centers; agricultural, forestry, fishery extension centers; enterprises, farms, cooperatives, ranches, production and service businesses; associations, occupational trade unions... participating in teaching basic vocational skills and short-term vocational training courses (hereinafter collectively referred to as training institutions);
f) Rural laborers participating in basic vocational skill training and short-term vocational training courses (hereinafter referred to as rural laborers); commune-level cadres and civil servants.
Article 2. Agricultural occupations, non-agricultural occupations
1. Agricultural occupations at the primary vocational level and training under three months include occupations belonging to the following groups: forest resource management (code number 223404); applied biology (code number 224202); salt production; processing and preserving agricultural, forestry, and aquatic products (code number 225403); agriculture (code number 226201); forestry (code number 226202); aquaculture (code number 226203); veterinary science (code number 2264) as specified in the Education and Training Catalogue of the National Education System issued together with Decision No. 38/2009/QĐ-TTg dated March 9, 2009 of the Government Prime Minister.
2. Non-agricultural occupations at the primary vocational level and training under three months include occupations belonging to the groups specified in the Education and Training Catalogue of the National Education System issued together with Decision No. 38/2009/QĐ-TTg dated March 9, 2009 of the Government Prime Minister, except for agricultural occupations at the primary vocational level and training under three months as defined in Clause 1 of this Article.
Article 3. Responsibilities of provincial specialized agencies
1. Department of Labor, Invalids and Social Affairs
a) Is the standing body of the provincial project; takes the lead and coordinates with relevant departments, agencies, and district People's Committees to develop annual and five-year plans and budgets for implementing the project, to be submitted to the provincial People's Committee;
b) Guides relevant provincial departments and agencies, and specialized agencies at the district level to annually develop vocational training plans for rural workers according to current regulations, to be compiled and submitted to the provincial People's Committee;
c) Takes the lead and coordinates with the Department of Home Affairs, Department of Agriculture and Rural Development, Department of Finance, and Department of Planning and Investment to develop budget allocation plans for implementing the project, to be submitted to the provincial People's Committee;
d) Takes the lead and coordinates with the Department of Home Affairs, Department of Agriculture and Rural Development, and related agencies to coordinate and guide the implementation of policies, solutions, and activities of the project at the local level;
e) Takes the lead and coordinates with related agencies to determine the list of non-agricultural occupations; compiles the list of training occupations (agricultural and non-agricultural occupations), to be submitted to the provincial People's Committee for approval; provides information to district and commune levels about training occupations and guides the promotion and counseling for rural workers to choose suitable occupations; compiles the demand for training from rural workers in the province;
f) Guides institutions to establish and approve curricula and teaching materials for non-agricultural occupations at the primary vocational level and training under three months according to regulations. Organizes inspections on the capacity of institutions regarding conditions for training rural workers according to regulations;
g) Takes the lead and coordinates with related agencies to develop training costs for each non-agricultural occupation in the list of training occupations for rural workers;
h) Takes the lead and coordinates with the Department of Finance and Department of Agriculture and Rural Development to compile training costs for each occupation (agricultural and non-agricultural) in the list of training occupations for rural workers, to be submitted to the provincial People's Committee for approval;
i) Takes the lead and coordinates with the Department of Finance and Department of Planning and Investment to guide institutions receiving investment under the project's policy to develop investment projects and plans for purchasing equipment for vocational training, to be submitted to the provincial People's Committee for approval;
j) Publicly announces the vocational training project for rural workers until 2020 and the five-year and annual training plans for rural workers in the locality to institutions within the province;
k) Takes the lead and coordinates with related agencies to review and select institutions meeting the conditions for training rural workers in the province according to Clauses 1 and 2 of Article 7 of this Circular, to be submitted to the provincial People's Committee for approval in the annual training plan for rural workers. For occupations where institutions in the province do not meet the conditions for organizing training, the Department of Labor, Invalids and Social Affairs will compile and report to the Ministry of Labor, Invalids and Social Affairs;
l) Determines the annual demand for vocational training according to the guidelines of the Ministry of Labor, Invalids and Social Affairs, to be submitted to the provincial People's Committee for approval and组织实施;
m) Compiles the annual demand for training and upgrading teachers, instructors, and managers of vocational training for rural workers, to be submitted to the provincial People's Committee for approval and组织实施;
n) Cooperates with the Department of Home Affairs to propose to the provincial People's Committee to allocate sufficient staffing for the Vocational Training Office under the Department of Labor, Invalids and Social Affairs, and dedicated staff for vocational training supervision in the county-level Labor, Invalids and Social Affairs Office; assigns sufficient management and instructor quotas to vocational training centers and public secondary vocational schools in the locality;
o) Develops and submits to the provincial People's Committee for approval and组织实施the inspection, supervision, evaluation plan for the implementation of the project in the province;
p) Regularly compiles and reports on the implementation status of the project in the locality every six months, annually, and every five years, and annually proposes commendations for collectives and individuals with outstanding achievements in implementing the project, to be submitted to the provincial People's Committee.
2. Department of Home Affairs
a) Takes the lead and coordinates with related agencies to develop annual and five-year plans and budgets for training and upgrading village cadres and civil servants in the locality according to the guidelines of the Ministry of Home Affairs, to be sent to the Department of Labor, Invalids and Social Affairs for compilation and submission to the provincial People's Committee;
b) Guides the County Home Affairs Office to develop annual and five-year plans and budgets for implementing the project for training and upgrading village cadres and civil servants in the county;
c) Takes the lead in developing budget allocation plans for training and upgrading village cadres and civil servants in the province, to be sent to the Department of Labor, Invalids and Social Affairs for compilation and submission to the provincial People's Committee;
d) Coordinates with the Department of Labor, Invalids and Social Affairs and related agencies to coordinate and guide the implementation of policies, solutions, and activities of the project at the local level;
d) Chair and coordinate with the Department of Labor - Invalids and Social Affairs to propose to the Provincial People's Committee to allocate sufficient staffing for the Vocational Training Room under the Department of Labor - Invalids and Social Affairs, dedicated staff to oversee vocational training work for the Department of Labor - Invalids and Social Affairs at the district level; assign sufficient management cadre and vocational teachers to vocational training centers and public intermediate vocational schools within the locality;
e) Determine the demand for training and upgrading cadres and civil servants at the commune level; develop plans for training and upgrading cadres and civil servants at the commune level until 2015 and until 2020 for the locality;
g) Chair and coordinate with relevant agencies to organize the implementation of the training and upgrading plan for cadres and civil servants at the commune level; select educational and training institutions that meet the prescribed conditions to participate in upgrading cadres and civil servants at the commune level within the province according to regulations;
h) Chair the organization of inspections, supervision, and evaluation of the implementation of training and upgrading cadres and civil servants at the commune level in the province; coordinate with the Department of Labor - Invalids and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project at the local level;
i) Regularly build reports on the implementation of training and upgrading cadres and civil servants at the commune level every six months, annually, and every five years; annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
3. Provincial Departments of Agriculture and Rural Development
a) Develop plans and budgets for the annual and five-year needs of funds to implement agricultural vocational training at the local level according to assigned management levels, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
b) Directly lead and take responsibility for agricultural vocational training for rural laborers;
c) Provide information on agricultural production orientation and planning to the Department of Labor - Invalids and Social Affairs when developing annual plans;
d) Guide the Agricultural Extension Office (or Economic Office) at the district level to determine the list of vocational training programs and the need for agricultural vocational training for rural laborers in the area;
d) Chair and coordinate with relevant agencies to determine the list of vocational training programs, the need for vocational training, and the funding for agricultural vocational training for rural laborers in the province, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
e) Chair and coordinate with relevant agencies to establish training costs for each agricultural vocational training program in the list of vocational training programs for rural laborers, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
g) Propose qualified institutions to participate in agricultural vocational training for rural laborers in the province according to regulations, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and approval by the Provincial People's Committee in the annual vocational training plan for rural laborers;
h) Coordinate with the Department of Labor - Invalids and Social Affairs to guide institutions in building and approving training programs and curricula for agricultural vocational training for rural laborers at the primary vocational level and short-term training under three months according to regulations;
i) Coordinate with the Department of Labor - Invalids and Social Affairs to develop a budget allocation plan to support vocational training for rural laborers, to be submitted to the Provincial People's Committee;
k) Coordinate with the Department of Labor - Invalids and Social Affairs and related departments to inspect, supervise, and monitor the implementation of the Project at the local level;
l) Regularly build reports on the implementation of the Department's responsibilities as outlined above every six months, annually, and every five years; annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
4. Department of Industry and Trade
a) Chair and coordinate with relevant departments and the District People's Committee to survey and determine the demand for labor in the industrial, small-scale industry, and service sectors of enterprises, production, business, and service establishments in the locality, to be consolidated and sent to the Department of Labor - Invalids and Social Affairs to develop the annual vocational training plan;
b) Propose qualified institutions to participate in non-agricultural vocational training for rural laborers in the province according to regulations, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and approval by the Provincial People's Committee in the annual vocational training plan for rural laborers;
c) Chair and coordinate with information and communication agencies to provide market commodity information; support the marketing of agricultural and small-scale industrial products;
d) Coordinate with the Department of Labor - Invalids and Social Affairs and related agencies to inspect, supervise, and evaluate the implementation of the Project at the local level;
d) Regularly build reports on the implementation of the Department's responsibilities as outlined above every six months, annually, and every five years; annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
5. Department of Information and Communications
a) Chair and coordinate with the Department of Labor - Invalids and Social Affairs, the Department of Agriculture and Rural Development, the Department of Civil Service Management and Supervision, the Department of Industry and Trade, the Local Radio and Television Station, and other relevant agencies to organize the implementation of promotional programs on vocational training for rural laborers; provide information on qualified institutions participating in vocational training for rural laborers, vocational training programs, and effective vocational training models linked to employment opportunities in the locality for rural laborers to know and choose from;
b) Direct information and communication agencies, county radio stations, and grassroots broadcasting stations to regularly and extensively disseminate information and promote policies and the implementation status of activities under the Project;
c) Organize training sessions on vocational training promotion and counseling for rural laborers for volunteers and information and communication officers at the provincial, district, and commune levels;
d) Coordinate with the Department of Labor - Invalids and Social Affairs and related agencies to inspect, supervise, and evaluate the implementation of the Project at the local level;
d) Regularly build reports on the implementation of the Department's responsibilities as outlined above every six months, annually, and every five years; annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
6. Department of Finance
a) Coordinate with the Department of Labor - Invalids and Social Affairs to develop plans and budgets for the annual and five-year needs of funds to implement the Project, to be submitted to the Provincial People's Committee;
b) Chair and coordinate with the Department of Labor - Invalids and Social Affairs and relevant agencies to appraise the budget allocation plan for vocational expenses to implement the Project annually, submit to the Provincial People's Committee;
c) Coordinate with the Department of Labor - Invalids and Social Affairs, the Department of Planning and Investment and relevant agencies to appraise investment projects and procurement plans for vocational training equipment according to the Project's policy, submit to the Provincial People's Committee;
d) Coordinate with the Department of Labor - Invalids and Social Affairs and relevant agencies to appraise the training costs for each trade, submit to the Provincial People's Committee for approval;
đ) Coordinate with the Department of Labor - Invalids and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project at the local level;
e) Regularly build reports on the implementation of the Department's responsibilities every six months, annually, and every five years according to the above contents, and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project, send to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
7. The Department of Planning and Investment
a) Coordinate with the Department of Labor - Invalids and Social Affairs and relevant agencies to develop plans and budgets for vocational expenses to implement the Project annually and every five years, submit to the Provincial People's Committee;
b) Chair and coordinate with the Department of Labor - Invalids and Social Affairs to advise the Provincial People's Committee on allocating development capital from the provincial budget to implement the Project annually;
c) Chair and coordinate with the Department of Labor - Invalids and Social Affairs and relevant agencies to appraise the budget allocation plan for development funds to implement the Project annually, submit to the Provincial People's Committee;
d) Coordinate with the Department of Labor - Invalids and Social Affairs and related agencies to inspect, supervise, and evaluate the implementation of the Project at the local level;
d) Regularly build reports on the implementation of the Department's responsibilities as outlined above every six months, annually, and every five years; annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project, to be sent to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
Article 4. Responsibilities of the District People's Committee
1. Direct specialized agencies of the district and the People's Committee of communes to implement the Project within their jurisdiction;
2. Propose a list of agricultural trades and non-agricultural trades: demand for learning agricultural trades and non-agricultural trades and facilities meeting the conditions to provide vocational training for rural laborers within the district, send to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee;
3. Annually and every five years, compile plans and budgets for vocational training expenses for rural laborers to implement the Project at the district level (including training and capacity building for commune officials), send to the Department of Labor - Invalids and Social Affairs and the Department of Home Affairs for consolidation and submission to the Provincial People's Committee;
4. Direct and organize vocational training for rural laborers as prescribed, conduct inspections, supervision, and evaluation of the Project's implementation within the district;
5. Allocate one full-time position to oversee vocational training work for the Labor - Invalids and Social Affairs Office; ensure financial and staffing conditions for management staff, vocational instructors, and infrastructure for public vocational training facilities to carry out vocational training according to the plan;
6. Create favorable conditions for facilities meeting the conditions to participate in providing vocational training for rural laborers within the district;
7. Regularly build reports on the implementation of the District People's Committee's responsibilities every six months, annually, and every five years according to the above contents, and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the district, send to the Department of Labor - Invalids and Social Affairs for consolidation and submission to the Provincial People's Committee.
Article 5. Responsibilities of specialized agencies at the district level
1. Department of Labor, Invalids and Social Affairs
a) Take the lead and coordinate with relevant specialized agencies at the district level to develop plans and budget estimates for the implementation of the Project annually and over five years, to be submitted to the District People's Committee;
b) Guide cadres working on labor, invalids, and social affairs at the commune level to develop annual and five-year implementation plans for the Project, to be submitted to the Commune People's Committee;
c) Take the lead and coordinate with relevant agencies to determine the list of vocational training occupations and the demand for non-agricultural vocational training among rural workers within the district;
d) Compile the list of agricultural and non-agricultural occupations; the demand for agricultural and non-agricultural vocational training and plans for teaching agricultural and non-agricultural occupations to rural workers within the district, to be submitted to the District People's Committee;
đ) Publicly notify entities within the district about their participation in vocational training for rural workers;
e) Take the lead and coordinate with the Industry and Trade Department, Agriculture and Rural Development Department (or Economic Department) to select entities that meet the conditions for vocational training of rural workers within the district according to regulations, to be submitted to the District People's Committee. For occupations where entities within the district do not meet the conditions to organize training, the Department of Labor, Invalids and Social Affairs will compile and report to the Provincial Department of Labor, Invalids and Social Affairs;
g) Develop, submit to the District People's Committee for approval and implement plans for inspecting, supervising, and evaluating the implementation of the Project within the district;
h) Regularly build reports every six months, annually, and over five years on the implementation of the Project and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the district, to be submitted to the District People's Committee;
2. Civil Service Department
a) Take the lead and coordinate with relevant agencies to develop plans and budget estimates for the annual and five-year training and capacity building of commune-level civil servants, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
b) Determine the demand for training and capacity building of commune-level civil servants; develop planning for training and capacity building of commune-level civil servants until 2015 and until 2020 for the locality;
c) Coordinate with the Department of Labor, Invalids and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project within the district;
d) Regularly build reports every six months, annually, and over five years on the situation of training and capacity building of commune-level civil servants and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the district, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
3. Agriculture and Rural Development Department (or Economic Department)
a) Develop plans and budget estimates for the annual and five-year implementation of agricultural vocational training within the district according to assigned management levels, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
b) Directly oversee and be responsible for agricultural vocational training for rural workers within the district;
c) Provide information on production orientation, new rural area development plans, and guide communes to determine the list of vocational training occupations and the demand for agricultural vocational training among rural workers within the commune;
d) Take the lead in determining the list of vocational training occupations and the demand for agricultural vocational training among rural workers within the district, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
đ) Propose entities that meet the conditions to participate in agricultural vocational training for rural workers within the district according to regulations, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
e) Coordinate with the Department of Labor, Invalids and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project within the district;
g) Regularly build reports every six months, annually, and over five years on the implementation of the responsibilities of the Department as mentioned above and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the district, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
4. Industry and Trade Department (or Economic Department)
a) Take the lead and coordinate with relevant agencies to survey and determine the demand for labor in the industrial, small-scale industry, and service sectors of enterprises, production and business establishments, and services within the district, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
b) Guide communes to exploit market information for rural workers through channels related to product sales; support the sale of agricultural products and small-scale industry products;
c) Propose entities that meet the conditions to provide non-agricultural vocational training for rural workers within the district according to regulations, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
d) Coordinate with the Department of Labor, Invalids and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project within the district;
đ) Regularly build reports every six months, annually, and over five years on the implementation of the responsibilities of the Department as mentioned above and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the district, to be sent to the Department of Labor, Invalids and Social Affairs for consolidation and submission to the District People's Committee;
5. Culture and Information Department
a) Take the lead and coordinate with the Department of Labor, Invalids and Social Affairs, Industry and Trade Department, Agriculture and Rural Development Department (or Economic Department) to organize the implementation of publicity programs about vocational training for rural workers through local media; provide information on qualified training institutions, vocational training occupations, and effective models of vocational training linked to employment for rural workers to know and choose from;
b) Direct the county radio station and grassroots broadcasting stations to regularly and extensively disseminate information and promote policies and the implementation status of activities under the Project;
c) Coordinate with the Department of Labor, Invalids and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project within the district;
d) Periodically, every six months, annually, and every five years, prepare reports on the implementation of the Department's responsibilities as outlined above, and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the county, to be submitted to the Department of Labor, Invalids, and Social Affairs for consolidation and submission to the County People's Committee;
6. The Finance and Planning Department
a) Take the lead and coordinate with the Department of Labor, Invalids, and Social Affairs, the Civil Service Department, the Agriculture and Rural Development Department (or the Economic Department) to review the annual and five-year plans and budgets for funding the vocational training activities for rural workers and the training and development of village cadres and civil servants within the area, to be submitted to the County People's Committee;
b) Coordinate with the Department of Labor, Invalids, and Social Affairs and relevant agencies to inspect, supervise, and evaluate the implementation of the Project within the county;
c) Periodically, every six months, annually, and every five years, prepare reports on the implementation of the Department's responsibilities as outlined above, and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the county, to be submitted to the Department of Labor, Invalids, and Social Affairs for consolidation and submission to the County People's Committee;
Article 6. Responsibilities of the Commune People's Committee
1. Establish a steering committee or working group to implement the Project; develop economic and social planning, production planning, and new rural construction planning as a basis for conducting vocational training for rural workers;
2. Promulgate policies and regulations regarding vocational training for rural workers; provide information about local economic and social development planning, information about available trades, conditions for learning trades, post-training employment opportunities, and eligible institutions for rural workers to participate in vocational training;
3. Statistically record the actual number of rural workers requiring vocational training within the commune; the recruitment needs of enterprises, production units, businesses, and service providers for trained workers; advise rural workers to choose suitable trades; propose a list of training trades and rural worker training needs to the Department of Labor, Invalids, and Social Affairs and the Agriculture and Rural Development Department (or the Economic Department); propose the need for cadre and civil servant training to the Civil Service Department;
4. Annually, develop a vocational training plan for rural workers within the commune to be submitted to the Department of Labor, Invalids, and Social Affairs and the Agriculture and Rural Development Department (or the Economic Department); develop a training and development plan for commune cadres and civil servants to be submitted to the Civil Service Department;
5. Certify the vocational training application forms of rural workers within the commune regarding the specified target groups and conditions for working in the registered trade;
6. Coordinate with institutions assigned the task of vocational training for rural workers to recruit qualified rural workers for training;
7. Facilitate access to local credit funds for trainees according to regulations; assist rural workers in organizing production, selling products, or finding employment after training;
8. Organize inspections and supervision of vocational training for rural workers within the commune;
9. Compile lists to track and statistically record the number of people who have completed training, the number of people employed in various forms, the number of households escaping poverty, the number of households becoming relatively well-off, and the number of people transitioning to industrial or service work after training within the commune;
10. Guide and direct communal organizations and village associations to participate in promoting and advising rural workers on vocational training and supervising vocational training classes within the commune;
11. Periodically, every six months, annually, and every five years, prepare reports on the implementation of the Commune People's Committee's responsibilities as outlined above, and annually propose commendations for collectives and individuals with outstanding achievements in implementing the Project within the commune, to be submitted to the Department of Labor, Invalids, and Social Affairs for consolidation and submission to the County People's Committee.
Article 7. Responsibilities of institutions participating in vocational training for rural workers and institutions participating in training and upgrading cadres and civil servants at the commune level.
Clause 1. Institutions participating in vocational training at the primary level must prepare all necessary conditions to operate vocational training activities in accordance with Circular No. 29/2011/TT-BLDTBXH dated November 24, 2011 of the Ministry of Labor, Invalids and Social Affairs on registration for vocational training activities and obtain a certificate of registration for vocational training activities for the trades being trained.
Clause 2. Institutions participating in vocational training for less than three months must prepare all necessary conditions for training and be inspected and notified in writing by the Department of Labor, Invalids and Social Affairs regarding the trade being trained and the scale of training for each trade. The conditions for training include:
Point a) Having a team of teachers or trainers who have expertise, skills, practical experience in the trade to be organized for training; having been trained in teaching skills for rural laborers and must have at least two teachers or direct trainers in one vocational training class.
Point b) Having sufficient material, equipment, and means of training suitable for the trade to be organized for training and the number of trainees.
Point c) Having a training program and materials for the trade to be organized for training that are built and approved in accordance with specific characteristics and conditions according to production, business requirements or crop and livestock growth processes and the conditions of learners in each region; the training program must clearly define the duration of training and the time spent in practical learning for each trade.
Clause 3. Institutions assigned the task of vocational training for rural workers are responsible for:
Point a) Cooperating with the People's Committee at the commune level to organize the recruitment of rural workers to learn trades correctly according to the trade being trained, target group, number of trainees, and recruitment area specified in the vocational training service contract signed with the agency assigned the task of vocational training for rural workers by the provincial People's Committee and the recruitment regulations for vocational training learners as stipulated in Decision No. 08/2007/QD-BLDTBXH dated March 26, 2007 of the Ministry of Labor, Invalids and Social Affairs on the recruitment regulations for vocational training learners.
Point b) Organizing vocational training for rural workers strictly according to the approved training program and training plan. Organizing examinations, graduation certification for primary-level vocational training learners in accordance with examination, inspection, and graduation certification regulations in formal vocational training as stipulated in Decision No. 14/2007/QD-BLDTBXH dated May 24, 2007 of the Ministry of Labor, Invalids and Social Affairs; issuing primary-level vocational training certificates in accordance with regulations. Organizing examinations, graduation certification for learners in training for less than three months in accordance with the training program regulations; issuing certificates in accordance with regulations.
Point c) Establishing management forms and registers for vocational training and learning for rural worker training classes in accordance with the management forms and registers for vocational training and learning for vocational training and primary-level vocational training as stipulated in Decision No. 62/2008/QD-BLDTBXH dated November 4, 2008 of the Ministry of Labor, Invalids and Social Affairs on the issuance of management forms and registers for vocational training and learning.
Point d) Fully implementing all commitments in the vocational training service contract signed with the agency assigned the task of vocational training for rural workers by the provincial People's Committee and managing, using, and settling accounts for funds in accordance with current regulations; reporting on the situation and results of organizing vocational training for rural workers as stipulated.
Point đ) Cooperating with the People's Committee at the commune level to monitor and statistically track employment status and income of rural workers trained by the institution after training.
Clause 4. Institutions participating in training and upgrading cadres and civil servants at the commune level shall implement their functions and tasks as prescribed by law or assigned by competent authorities. During the organization of training and upgrading of commune-level cadres and civil servants, they must fully comply with state regulations and guidance from competent authorities.
Article 8. Responsibilities of rural workers participating in vocational training at the basic level and short-term vocational instruction under three months
1. To familiarize themselves with policies and regulations on vocational training for rural workers; the names of trades being trained, conditions of the trade being studied, workplace addresses after completion of training; facilities meeting the conditions to participate in vocational training for rural workers within their jurisdiction, in order to independently choose suitable trades and training facilities that match their personal conditions, specifically:
a) For rural workers studying trades to create self-employment must have necessary conditions to organize production and business independently (land, production and business tools, human resources) to increase income or have enterprises or units providing raw materials for production and purchasing products;
b) For rural workers studying trades to work for enterprises, employers, or to work abroad for a limited period must meet requirements regarding age, educational qualifications, health, and working conditions of enterprises, employers, or recruitment units sending workers to work abroad.
2. To accurately and fully declare information about themselves, target groups, and selected vocational training needs when submitting the application form for vocational training (Form No. 1 attached) to the People's Committee of the commune for confirmation according to the guidance provided in Clause 5 of Article 6 of this Circular;
3. To attend all training sessions and comply with class rules and regulations of the training facility;
4. To truthfully provide information about employment status and income after completing vocational training to the People's Committee of the commune.
Article 9. Implementation Provisions
1. This Circular takes effect from January 27, 2013.
2. During implementation, if there are difficulties, please report to the Ministry of Labor, Invalids and Social Affairs, the Ministry of Home Affairs, the Ministry of Agriculture and Rural Development, the Ministry of Industry and Trade, and the Ministry of Information and Communications for research and appropriate amendments.
