Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 108/2012/ND-CP dated December 25, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Vietnam Academy of Science and Technology;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decision No. 81/2010/QD-TTg dated December 13, 2010 of the Prime Minister on the receipt, storage, processing, exploitation, and use of national remote sensing data;

At the proposal of the Chairman of the Vietnam Academy of Science and Technology,

The Prime Minister promulgates this Decision on the management, operation, and exploitation of the first Earth observation satellite of Vietnam VNREDSat-1.

Article 1. Scope of Regulation

This Decision stipulates the control, transmission, and reception of satellite image signals, processing, storage, provision, and use of VNREDSat-1 image data.

Article 2. Applicability

This Decision applies to agencies, organizations, and individuals involved in the management, operation, exploitation, and use of the VNREDSat-1 satellite and related ground facilities such as: Satellite Control Center, satellite command signal transmission and reception station, backup data storage station, image signal reception and processing station.

Article 3. General Principles

1. Management, operation, and exploitation of the VNREDSat-1 satellite must comply with current regulations on the receipt, storage, exploitation, and use of national remote sensing data and be consistent with international standards as required by the provider.

2. Maximize the exploitation of VNREDSat-1 satellite image data for monitoring natural resources, environment, disaster reduction; scientific research and training to serve state management work, meet economic and social development needs, and ensure defense and security.

3. Exploitation of VNREDSat-1 satellite images must involve close cooperation between the Vietnam Academy of Science and Technology, the Ministry of Natural Resources and Environment, and other relevant state agencies.

Article 4. Management and Operation of the VNREDSat-1 Satellite

1. The Vietnam Academy of Science and Technology shall be responsible for managing and operating the VNREDSat-1 satellite including the following contents:

a) Operating the VNREDSat-1 satellite and related ground facilities including: Satellite Control Center, satellite command signal transmission and reception station, and backup data storage station;

b) Taking the lead and coordinating with the Ministry of Natural Resources and Environment and relevant ministries and sectors to develop plans for capturing and receiving VNREDSat-1 images; scheduling and issuing commands for image capture from the satellite; providing information on mission, status, and orbit of the satellite to the Ministry of Natural Resources and Environment.

2. The Vietnam Academy of Science and Technology shall be responsible for building, organizing, managing, storing, supplementing, and updating VNREDSat-1 satellite image data into the Academy's remote sensing image database.

3. The Vietnam Academy of Science and Technology shall cooperate with international organizations and satellite providers to operate the VNREDSat-1 satellite safely and effectively; implement services for providing VNREDSat-1 image signals to international partners; build and implement annual science and technology tasks from the science and technology fund to master the technology and serve satellite programs and projects.

4. The Vietnam Academy of Science and Technology and the Ministry of Natural Resources and Environment shall coordinate in developing and promulgating regulations on cooperation in the management, operation, and exploitation of the VNREDSat-1 satellite to ensure budget savings, proper use, and effective exploitation of the VNREDSat-1 satellite.

Article 5. Exploitation of VNREDSat-1 Satellite

1. The Vietnam Academy of Science and Technology shall be responsible for:

a) Providing VNREDSat-1 satellite image signals to the Ministry of Natural Resources and Environment according to the agreed plan for photographing and receiving images;

b) Cooperating with the Ministry of Natural Resources and Environment to effectively exploit VNREDSat-1 satellite image data;

c) Promptly providing VNREDSat-1 satellite images upon request from Party and State leaders or in emergency situations as decided by competent state authorities.

2. The Ministry of Natural Resources and Environment shall be responsible for receiving VNREDSat-1 image signals, storing, processing signals, and using image data in accordance with Decision No. 81/2010/QD-TTg dated December 13, 2010 of the Government Chairman on the reception, storage, processing, exploitation, and use of national remote sensing data.

3. The Vietnam Academy of Science and Technology shall determine the imaging capacity of the VNREDSat-1 satellite as a basis for the Ministry of Natural Resources and Environment to report to the Prime Minister for consideration and decision on purchasing foreign remote sensing signal or image data.

Article 6. Management and Operation Costs of VNREDSat-1 Satellite

Costs serving the management and operation of the VNREDSat-1 satellite include:

1. Guaranteed by the state budget, allocated in the annual budget estimate of the Vietnam Academy of Science and Technology.

2. Revenue from image signal service provision after payment to the state budget as prescribed.

Article 7. Financial Mechanism for the Exploitation and Use of VNREDSat-1 Satellite Image Data

1. Exploitation and use of VNREDSat-1 satellite image data at the request of Party and State leaders or in emergency situations shall not require financial obligations.

2. Agencies, organizations, and individuals exploiting and using VNREDSat-1 satellite image data not falling under the provisions of Clause 1 of this Article must fulfill financial obligations.

The Ministry of Finance shall take the lead and coordinate with the Ministry of Natural Resources and Environment to stipulate fee levels and guide the collection, payment, management, and use of fees for the exploitation and use of VNREDSat-1 satellite image data.

3. Provision of VNREDSat-1 satellite image signals to international partners shall be carried out based on agreements between the parties on market prices and international practices.

The Ministry of Finance shall guide the management and use of funds received from the provision of VNREDSat-1 satellite image signals to international partners.

Article 8. Implementation clause

1. This Decision takes effect from June 15, 2014.

2. Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairmen of provincial and municipal People's Committees directly under the Central Government, and Heads of related agencies are responsible for implementing this Decision./.
